PLANNING AND ZONING COMMISSION
APRIL 23, 1991
• MINUTES
The Regular Meeting of the Planning and Zoning Commission of the
City of Palm Beach Gardens, Florida, was called to order by
Chairman Jeffrey Ornstein, at 7:30 P.M., in the Assembly Room at
the Municipal Complex, 10500 North Military Trail, Palm Beach
Gardens, Florida and opened with the Pledge of Allegiance to the
Flag.
The roll was called by the secretary, and present were: Jeffrey
Ornstein, Chairman; Mike Rosen, Vice Chairman; James Leatherman,
Alan Strassler and Carl Sabatello, Members; and James Kuretski,
Alternate Member. Domenick Lioce and Joseph Hamzy, Members; and
Rebecca Serra, Alternate Member, were not in attendance.
APPROVAL OF MINUTES OF APRIL 9, 1991
• Mr. Mike Rosen made a motion to approve the minutes of April 23,
1991. Mr. James_Kuretski seconded the motion. The motion car-
ried unanimously.
MISC -91 -10 - Amendment to Miami Subs restaurant site plan to
install a new building lighting scheme. Located east of U.S.
Highway One, approximately 600, south of PGA Boulevard. (4 -42S-
43E)
Mr. Bristol Ellington, City Planner, gave a presentation of the
April 17, 1991 staff report.
Chairman Jeff Ornstein asked Mr. Ellington if this project is
going before the City Council. Mr. Ellington stated only if the
Site Plan and Appearance Review Committee denies this request,
the Petitioner would have to appeal to City Council as their only
recourse for review of their project.

Mr. Martin Perry, agent for the Petitioner, addressed the Commis-
sion stating that the result,of the last meeting was the Commis-
41 sion making a subjective decision to place the lighting within
the awnings. The awnings are designed to be water -tight because
there are electrical fixtures underneath the awnings. In addi-
tion, there was discussion about creating a trough for the light-
ing. The problem with this is that water and debris will collect
in the trough and run out the sides of the awnings. Mr. Perry
stated their lighting plan shows the rear lighting at both 15
feet high and 10 feet high. The Petitioner prefers the lighting
at 10 feet high.
The majority of the Commission expressed no concern with the
lighting plan. Chairman Ornstein was not in agreement with the
lighting plan and expressed concern with the appearance of the
stucco boxes on the walls. Chairman Ornstein suggested the
• lighting be placed under the awning and a portion of the awning
be transparent for the light to show through. Mr. Rosen ex-
pressed concern with the maintenance of lighting under an awning.
A discussion ensued.
Mr. Carl Sabatello made a motion to approve petition MISC -91 -10
as shown on the detail attached to the plan with rear lighting as
shown mounted 10 feet above the finish floor. Mr. James
Leatherman seconded the motion.
The motion carried with a vote of 4 to 2, Mr. Alan Strassler and
Chairman Jeff Ornstein voting against.
Recommendation to City Council re: SP -91 -01 - (First Union Bank)
site plan,approval to construct two additional drive -thru teller
lanes and new bypass lane to the existing three -lane bank facili-
ty. Located at the southeast corner of Northlake Boulevard and
• Military Trail. (24- 42S -42E)

Mr. Bristol Ellington gave a presentation of the April 17, 1991

• Chairman Ornstein asked the Petitioner why they are requesting to
add more drive -thru lanes.
Mr. Cory Cross, agent for the Petitioner, stated the Petitioner
is requesting to add additional drive -thru lanes to better serve
their customers.
Chairman Ornstein asked if Mr. Cross was in a position to address
the landscaping on the site because it is rather sparse.
Mr. Cory Cross stated it was the perimeter landscaping that the
Planning and Zoning Commission wanted to be brought up to code.
Mr. Carl Sabatello expressed concern with the closeness of the
trees to the bypass lane. Mr. Sabatello suggested moving,the
trees to the east of the property line.
Chairman Ornstein expressed concern with the necessity of adding
• more drive -thru tellers.
Mr. Alan Strassler stated the trees in the buffer along Military
Trail and along Northlake Boulevard should be staggered to give
depth.
Mr. Mike Rosen made a motion to recommend denial of petition SP-
91-01 to the City Council. Mr. Carl Sabatello seconded the
motion. Mr. Rosen stated the reasons for a recommendation for
denial as follows:
1. The additional drive -thru lanes and bypass lane give the
appearance of trying to put too much on a condensed site
which will not allow for adequate landscaping on the east.
2. The addition will not be aesthetically compatible with
the site.
3. The trees around the perimeter of the site should be
• staggered to give depth to the buffer area.

4. The traffic reports provided by Ken Rogers are not clear.
The motion for recommendation of denial passed unanimously.
ADJOURNMENT
There being no further business to discuss, the meeting was
adjourned at 8:30 P.M. The next meeting of the Planning and
Zoning emission is scheduled,, for May 14, 1991.
