PLANNING AND ZONING COMMISSION
JUNE 11, 1991
` MINUTES
The Regular Meeting of the Planning and Zoning Commission of the
City of Palm Beach Gardens, Florida, was called to order by
Chairman Jeffrey Ornstein, at 7:30 P.M., in the Assembly Room at
the Municipal Complex, 10500 North Military Trail, Palm Beach
Gardens, Florida and opened with the Pledge of Allegiance to the
Flag.
The roll was called by the secretary, and present were: Jeffrey
Ornstein, Chairman; Mike Rosen, Vice Chairman; Alan Strassler,
Domenick Lioce, Joseph Hamzy, Members; and James Kuretski, Alter-
nate Member. Carl Sabatello and James Leatherman, Members; and
Rebecca Serra, Alternate Member, were not in attendance.
ITEMS BY CITY COUNCIL LIAISON
• Mayor Mike Martino, City Council Liaison, gave a presentation of
the second Comprehensive Plan amendment for 1991 to assign land
uses to 10,218 acres of land north of PGA Boulevard, south of the
Donald Ross Road extension, and west of the former city boundary,
owned by the MacArthur Foundation.
Recommendation to City Council: SP -91 -04 (BP Oil Station) Site
Plan approval to demolish the existing 1,412 square -foot service
station and construct a new 1,225 square -foot service
station /convenience market and a 850 square -foot car wash, locat-
ed south of Northlake Boulevard, approximately 700 feet east of
Interstate 95. (19- 42S -43E)
Mr. Bristol Ellington, City Planner, gave a presentation of the
June 6, 1991 staff report.
Mr. Alan Ciklin, agent for the Petitioner, stated, in response to
the Commission's request for a cross - access agreement with the
Shopping Center, a representative from BP Oil got in touch with

the Shopping Center representative. The Shopping Center repre-
sentative was in favor of the cross - access agreement, however, he
said that when the shopping center was approved he thought there
was a restriction placed on that shopping center prohibiting
cross - access into the gas station. Mr. Ciklin stated if this is
the case, they would need assistance from the City in getting
that restriction removed.
Mr. Ciklin stated the Petitioner has reviewed the possibility of
moving the car wash to the rear of the site and has found the
site works best as it is. The attendant should be able to see
into the car wash in case of emergencies.
Mr. Ciklin stated the Petitioner will put a lens over the neon
light around the building if the Commission prefers, however, the
neon light is a narrow band of 5/811 and the lens may make it look
• wider.

Mr. Ciklin stated the Petitioner agrees to all the staff's condi-
tions of approval. Mr. Ciklin asked that the condition requiring
the Petitioner to record a cross - access easement with the
Crossroads at Northlake Shopping Center prior to City Council
approval be changed to prior to the issue of the building permit.
The Commission expressed concern with the elimination of the
service bays of the station; the vegetation picked to screen the
site, particularly the Slash Pine; location of the car wash;
necessity of the food store; and the location of the flag pole.
Mr. Domenick Lioce made a motion to recommend denial of this
petition to City Council. Further, if the City Council does not
accept the Planning & Zoning Commission's recommendation, they

should consider the following:
1. The hedge to be established in the northeast corner and
• northern perimeter island shall be planted on two foot
centers per City code. However, the hedge shall be
three (3) feet tall at planting and allow to grow to a
minimum of five (5) feet tall and maintained at five
(5) feet to screen the car wash.
2. The hedge material shall be a cold tolerant species and
not of the Ficus family.
3. A convex mirror shall be installed in the southwest
corner section of the rear store area of the store.
The installation, location, angle and other standards
of the convex mirror shall be approved by the Police
Department prior to the issuance of the Certificate of
Occupancy.
4. Any condition(s) recommended by the City's Traffic
Engineer consultant.
5. The car wash be conditioned to recycle water;
6. The car wash shall be relocated to the rear of the
building;
7. The flag pole be moved into a position that if it
• were to fall it would not fall outside of the property
line. That is if is 35' tall, it should be set back
35'.
8. The City is satisfactorily confirmed that there are no
more pumps at the new location than would be existing
at the old location.
Mr. Mike Rosen seconded the motion. The motion carried unani-
mously.
PUBLIC HEARING: CU -91 -01 - Recommendation to City Council re:
(BP Oil Station) request for a Conditional Use to allow a service
station /convenience food market and car wash in the CG -1 General
Commercial district, located south of Northlake Boulevard, ap-
proximately 700 feet east of Interstate 95. (19- 42S -43E)
Mr. Domenick Lioce made a motion to recommend denial of the
Conditional Use to City Council as set forth for the same condi-
tions the Planning and zoning Commission set forth in the Site
Plan Review but also objecting to the use of food market and sale
• of beverages at this site. Mr. Joseph Hamzy seconded the motion.

The motion carried unanimously.
• PUBLIC HEARING: PUD -91 -05 - Recommendation to City Council re:
(Bridge Center PUD) Amendment to Bridge Center PUD for a two -year
time extension and elimination of two parking spaces, located at
the northwest corner of Ellison Wilson Road and PGA Boulevard.

Mr. Bristol Ellington gave a presentation of the June 4, 1991
staff report. The Commission requested the Petitioner explain
good faith shown to warrant an extension.
Mr. Larry Smith, agent for the Petitioner stated they were re-
quired to give some right -of -way at Ellison Wilson Road. Mr.
Smith indicated that he provided City Attorney Bill Brant with
the deed as well as the engineers and everybody concerned. Mr.
Smith indicated that they spent about 18 months getting the plans
ready and the engineers were not in agreement with the plans.
About that time Mr. Adams had dropped out temporarily and FPL had
• to go ahead with their improvements because they had some time
constraints on their DRI. Mr. Smith stated a condition precedent
to the Petitioner getting the Building Permit was the dedication
of the right -of -way. The Petitioner tried to deed the right -of-
way and are prepared to deed it now, but the right -of -way which
was initially required by the City was not enough to meet the
actual needs of the intersection improvement.
Mr. Domenick Lioce made a motion to continue the Public Hearing
to the next Planning and Zoning Commission meeting of June 25
1991. Mr. Alan Strassler seconded the motion. The motion car-
ried unanimously. Mr. James Kuretski requested the Petitioner
provide a chronology of development plans showing intent that the
Petitioner was proceeding to move with this development. The

Commission directed staff to research the chronology of the
right -of -way situation and get a report from City Attorney Bill
• Brant on factual issues on good cause shown and provide the
Commission with the this information.
PUBLIC HEARING: Z -90 -08 - Recommendation to City Council re:
(Palm Beach Gardens Medical Center) Rezoning the 22.122 -acre
hospital site from P.O., Professional Office and P.O., Profes-
sional Office with a Conditional Use to allow for a hospital
facility to a zoning designation of Planned Unit Development to
expand the existing 211,000 square -foot hospital to 296,300
square feet. Located on the south side of Burns Road and east of
Gardens East Drive. (7- 42S -43E)
Mr. Bristol Ellington gave a presentation of the June 3, 1991
staff report.
Mr. Ray Royce, agent for the Petitioner, stated the helicopter
landing pad site has been moved at the request of the Commission.
The Petitioner is still working on relocating the Women's Center.
The Commission is concerned with the location of the Women's
• Center being too close to the road. A discussion ensued regard-
ing some of the changes the Petitioner has made to the site plan
since the last Commission meeting.
The Commission stated the configuration of the south parking area
is satisfactory as shown on the plans at the meeting, however,
the curb cut entrance should be "cleaned up" in order to flow
smoothly. A discussion ensued.

The Commission had no objections to another curb cut at Burns
Road providing it be a two way drive along the eastern property
line.
The Commission suggested staggering the trees on the berm along
Burns Road. A discussion ensued.
Chairman Ornstein opened the Public Hearing. Mr. Bob Hendrick-

son, resident on Gardens East Drive, stated he is against the
Women's Center being across the street from his house, particu-
larly because it is three stories high. Mr. Hendrickson ex-
pressed concern regarding the location for the entrance of deliv-
eries. Currently the delivery trucks enter from Gardens East
Drive and Mr. Hendrickson stated they should enter from Burns
Road. Chairman Ornstein stated the plans show the deliveries to
enter from Burns Road.
Chairman Ornstein stated the Public Hearing will be continued at
the Planning and Zoning Commission Meeting on June 25, 1991.
There being no further business to discuss, the meeting was
adjourned at 11:30 P.M. The next meeting of the Planning and
Zoning Commission is scheduled for June 25, 1991.
