PLANNING AND ZONING COMMISSION
OCTOBER 8, 1991
MINUTES
The Regular Meeting of the Planning and Zoning Commission of the City of Palm
Beach Gardens, Florida, was called to order by Chairman Jeffrey Ornstein, at 7:30 P.M.,
in the Assembly Room at the Municipal Complex, 10500 North Military Trail, Palm
Beach Gardens, Florida and opened with the Pledge of Allegiance to the Flag.
The roll was called by the secretary and present were: Jeffrey Ornstein, Chairman; Mike
Rosen, Vice Chairman; Joseph Hamzy, Domenick Lioce, James Leatherman and Alan
Strassler, Members; and James Kuretski, Alternate Member. Carl Sabatello, Member,
was not in attendance.
APPROVAL OF MINUTES OF SEPTEMBER 24, 1991
Mr. Joseph Hamzy made a motion for approval of the minutes of the September 24,
1991 Planning and Zoning Commission meeting.
Mr. James Leatherman seconded the motion.
The minutes of the September 24, 1991 meeting were approved by a 6 -0 vote. Mr. Mike
Rosen abstained from the vote.
ITEMS BY THE PLANNING AND ZONING DIRECTOR
Mr. Rich Walton, Planning and Zoning Director, informed the Commission that the
Frenchman's Creek Marina wishes a reinstatement of is approval from the Site Plan and
Appearance and Review Committee on June 6, 1989. He added that due to problems
at the development construction of the facility had not taken place within the one year
time frame and that the approval had expired. He added that Building Official Jack

Hanson coordinated the approval process during the time of the Site Plan approval. He
said Mr. Hanson is present at the meeting and would be available to answer any
questions.
Mr. Domenick Lioce asked what the hurry was with this request. Mr. Walton responded
that the petitioner is wishing to move forward with their plans. He added that the
decision could be delayed two weeks if the Commission is uncomfortable about making
a decision at that night's meeting.
Chairman Jeffrey Ornstein asked if anything has happened on the site since the approval.
Chairman Ornstein suggested that the discussion on the Frenchman's Creek Marina be
delayed until the end of the meeting.
PLANNING AND ZONING
WORKSHOP: Z -91 -06 - Recommendation to City Council re: (Trinity Methodist
• Church) Rezoning 10 ± acres currently under purchase contract and 4.5 ± acres
currently owned by Trinity United Methodist Church from PDA, Planned Development
Area, to RS -3, Residential Single - Family District. Located at 9625 North Military Trail.

WORKSHOP: CU -91 -06 - Recommendation to City Council re: (Trinity Methodist
Church) Conditional Use on 19 ± acres to allow a church use, including preschool and
elementary school at Trinity United Methodist Church. Located at 9625 Military Trail.

Mr. Bristol Ellington, City Planner, reviewed the October 3, 1991 staff report on the
above - referenced project.
Chairman Ornstein asked if the project will be phased and, if so, what is the phasing
plan.
Mr. Ellington, received a copy of the project phasing schedule from Mr. Ed Oliver,
architect for the project, and handed the phasing schedule to Chairman Ornstein.
Chairman Ornstein read the phasing schedule out loud for the record.

0 Mr. Ellington reviewed staffs concerns for this project and the petitioner's responses to
those concerns. He added that the petitioner is seeking an exemption from the City's
Environmental Ordinance as they plan to relocate all gopher tortoises off the site. He
said City Council, at its October 4, 1991 meeting, decided that small tortoise habitat sites
may be exempted from preservation if the relocation of tortoises is planned. Mr.
Ellington added that City Forester Mark Hendrickson is recommending a 15' buffer and
6' wall along the site's northern boundary. The petitioner is proposing a 3' to 4' berm
with trees and a 3' hedge.
Mr. Mike Rosen asked what is the landscape buffer for the adjacent BallenIsles Country
Club PCD. Mr. Walton responded that it is a 25' of landscaping with a chained fence.
Mr. Rosen asked staff to check to see if BallenIsles was proposing to build a berm in
the landscape buffer.
Mr. Ellington said that staff is requesting a 100' typical landscaping buffer plan from the
petitioner.
Chairman Ornstein questioned whether grass parking is permitted within the City.
Mr. Walton stated that City Attorney William Brant has determined that grass parking
is allowable for churches because the large majority of parking spaces are not used
except for Sunday mornings. A general discussion concerning grass parking ensued.
Mr. James Kuretski asked if a drainage plan is required for this project,
Mr. Kurt Cooper of Kimley -Horne and Associates responded that drainage will be
allowed to be retained off the subject site and into the BallenIsles lake system.
Mr. Cooper then made an introduction to the petition by describing the growing church.
He added that Trinity United Methodist Church is one of the largest United Methodist
churches in the country.

Chairman Ornstein asked what is the membership of the church. Mr. Cooper responded
by saying 2,400 members with approximately 1,400 in attendance each Sunday during the
season.
Mr. Ed Oliver, architect for the project, then reviewed the master plan for the site.
Chairman Ornstein asked if there will be a columbarium within the church's memorial
garden. Mr. Oliver said there will not be any inurnment of ashes on the site.
Mr. Kuretski stated that the church lacks sufficient parking on the south parcel because
of the use of classrooms on that parcel. He added that the overflow parking along the
Earman River canal will probably be used because of the location of the classrooms.
Chairman Ornstein questioned the width of the curb cut onto Gardenia Drive extension
from the north and south parcels of the church site. Mr. Oliver said he will reexamine
the curb cut at Commission's direction. Chairman Ornstein stated that Mr. Oliver should
. take another look at it.
Responding to Commission concerns over the amount of paved parking spaces on site,
Mr. Oliver stated that there will be approximately 100 paved parking spaces.
Chairman Ornstein stated that he is concerned that there is not enough paved parking
for teachers and staff who will use the site on a daily basis. Mr. Oliver stated that he
will come back with figures for the number of cars that will daily use parking at the site.
Mr. Oliver and the Commission then discussed the proposed landscaping on the
BallenIsles PCD, which is adjacent to the north, west and south of the subject site.
Chairman Ornstein asked what was the anticipated height of the proposed sanctuary. Mr.
Oliver -responded that it will be approximately 60 feet, but it will be sloped.
Mr. Ellington stated that RS -3 zoning district only allows buildings 36' in height or less.
. Mr. Oliver added that the church realizes that it will have to request a height variance

• when it comes back for site plan approval.
During the discussion of the legality of grass parking in the City, Building Official Jack
Hanson said that City Attorney Bill Brant has provided a letter allowing grass parking
for churches in the case of St. Ignacious.
Chairman Ornstein requested that the petitioner present a phasing plan at the next
meeting before the Commission.
In responding to a question about the petitioner's environmental plan, Mr. Cooper said
there is currently three active gopher tortoise burrows on the south site. They have
receivership sites for those tortoises. The relocation of the tortoises on the north parcel
will be addressed when site plan approval is granted, Mr. Oliver said.
Mr. Alan Strassler asked how dense was the BallenIsles PCD buffer adjacent to the west
subject site. Mr. Walton responded by saying it is 25' of natural vegetation from the
• BallenIsles property line to the closest lot.
Mr. Domenick Lioce expressed his concern that there may not be enough parking on the
site for all the uses proposed. He suggested using the parking calculations for a church
and a school instead of using just the calculations for a church.
Mr. Joseph Hamzy stated that it is important that the required landscape buffer be put
in place. He added that the landscaping should be installed with the phasing. Mr.
Hamzy also said that he would like to see landscaping along the southern boundary of
the site.
Mr. Lioce reiterated his concerns over the amount of proposed parking for the site. He
added that the landscaping buffers should be the required width on the north and west
boundaries.
• Mr. Strassler would like to see the buffering on the south and the west be more dense.

He suggested that there not be parking within the medians. Mr. Strassler added that the
project's architects should be careful in designing the massing of the church.
Responding to a question from Mr. Ellington, Chairman Ornstein said that wheel stops
and curbing should be used along the perimeter, but not with interior grass parking
spaces.
The Commission directed staff to advertise this petition for a Public Hearing at the
November 12, 1991 meeting.
PREAPPLICATION REVIEW: PUD -91 -07 - Recommendation to City Council re: (PGA
National Parcel M -29A) Creation of a 161 zero lot line and attached villa residential
Planned Unit Development (7.02 d.u. /ac.) on Parcel M -29A within the PGA National
planned Community District. (15- 42S -42E)
Mr. Bristol Ellington, City Planner, reviewed the staff report dated October 3, 1991 for
the above - referenced petition.
• Mr. Ellington listed the following current concerns of staff:
1. The sidewalk proposed along General Drive should continue east to Avenue

of the Master.
2. The sidewalk along General Drive should be consistent with the sidewalk
proposed to be constructed with Parcel M -30.
3. City Engineer David Getz has recommended that the sidewalks in the
interior of the project should be 5 feet wide instead of the proposed 4 feet.
4. City Engineer David Getz has concerns about the building -to- building
separation between one and two -story units.
5. The Fire Department has expressed concerns over the lengths and widths
of the access tracts and access drives would not allow easy maneuverability
of emergency vehicles.

• 6. The Fire Department has also expressed concern over the possibility of the
entranceway landscaping becoming overgrown and interfering with
emergency vehicle trying to gain access.
7. Mr. Dick Beck of Waste Management has expressed concern over the
lengths of the access tracts. The petitioner has indicated that the people
living in the units served by the access tracts will carry their garbage cans
to the end of the access tracts. Staff would like to see a specific location
and details for these trash cans so a row of cans do not end up in
someone's front yard.
8. Building Official Jack Hanson has expressed a concern over the 0' rear
and side setbacks for screens and pools. He would like to see a minimum
of 3' setbacks for pools and spas and a 2' setback for screens. Mr. Hanson
• has asked the petitioner for a pool /screen scenario for all the combination
possible on the site.
9. Staff has a concern with the proposed minimum setbacks for units A2 and
B2. Staff has asked the petitioner to provide every building situation where
these units would be used on the master plan.
10. Some of the units are only proposed for the street side. Staff would like
the master plan to contain more information on which units will be used
in order to help the Building Department ensure the compliance with the
approved master plan.
Mr. Ellington said there is a lot of issues unresolved concerning this petition and that
staff would like to see another Commission workshop on this petition before it goes to
0 City Council.

Mr. Hank Skokowski of Urban Design Studio, agent for the petitioner, reviewed the
project, which will be called "Monterey Point."
Mr. Skokowski said that the features in this project are also included in other
communities within PGA National. For example, the Villas of Glengary feature two
different types of units.
He added that this project will be marketed to the empty nester /second home buyer.
There will be 100 percent maintenance for all properties, Mr. Skokowski said. He added
that the originally approved density for this site is for 14 units per acre. The petitioner
is proposing 7 units per acre, but it looks dense because, for market reasons, single
family homes and duplexes are proposed.
In addressing staffs concerns, Mr. Skokowski stated that there are several projects within
PGA National with 4' sidewalks. He said there will be setbacks for pools, however,
• screens would be allowed to be constructed on the property line under the proposed
plan. He said Mr. Hanson will have a table to help him administer the processing of
building permits.
Chairman Ornstein commented that this plan is deceiving. He said the project is very
dense.
Mr. Kuretski asked the petitioner that he would like to see a matrix of setbacks and
building footprints for each model and the sizes of the lots associated with each model.
Mr. Skokowski said that the sidewalk connecting M -30 to M -29 will be on the north side
of General Drive. He added that placing a sidewalk to the east to the Avenue of the
Masters would be costly as General Drive was not designed for a sidewalk. Mr.
Skokowski said the landscaping and irrigation system would have to be relocated if a
sidewalk was put in place.

Chairman Ornstein asked about the garbage pick -up procedures proposed for the project.
Mr. Skokowski said the Waste Management official had no problem with the placement
of the trash cans at the end of the access tracts. Chairman Ornstein said Mr. Skokowski
should readdress the issue and come back with additional information at the next
meeting.
Mr. Mike Rosen stated that he likes the variety of the plan and that it breaks up the
cookie cutter type development.
Mr. Hamzy said he believes it is an excellent product, but he added that he has
problems with the site plan. He said the density and the small lot sizes will create some
livability problems.
Mr. Lioce said he liked the project, but has some concern over the coverage area of the
site.
-• Mr. Strassler said the petitioner was proposing clever building elevation plans. He added
that he is not comfortable with the density, but he said he will keep an open mind.
Mr. James Leatherman said he liked the product, but also has concerns over the density.
Mr. Kuretski requested that the petitioner present four lots back -to -back with the worst
and best case scenarios.
Chairman Ornstein believes the project is interesting, but it is too dense.
Landscape architect Dave Johnson presented the landscape plan to the Commission.
The Commission agreed to schedule this petition for another workshop in two weeks if
the petitioner provides the requested information by staffs timeframe.
ITEMS BY THE PLANNING AND ZONING DIRECTOR
Planning and Zoning Director Rich Walton presented a request from Haft - Gaines
Associates for a reinstatement of their site plan approval for the Frenchman's Creek

Marina Dry Boat Storage. The Commission decided that the petitioner should come
back with a formal request and be placed on the agenda of the next available meeting.
ADJOURNMENT
There being no further business to come before the Commission, the meeting was
adjourned at 10:28 P.M. The next meeting of the Planning and Zoning Commission is
scheduled for October 22, 1991.
