Located north of Burns Road and approximately 1,000 feet east of Gardens East Drive. (7- 42S -43E) Mr. Ellington gave a presentation of the December 7, 1991 staff report. He stated there is a hedge that is required along Burns Road and the majority of the hedge is within Phase I. The Peti- tioner for this application is responsible for the installation of a portion of the hedge along Burns Road. The property owner of the phase with the majority of the hedge indicated that after Burns Road is widened the hedge would be installed. A discussion ensued. The Commission expressed concern with the legality of the subdivision of the property. The Commission questioned if the PUD expired, what would happen to the phases that have been • built (i.e., are they in violation of the zoning code, does their PUD expire, should the PUD be severed because the extension was not granted). A discussion ensued. The Commission requested clarification on the letter provided by City Attorney Bill Brant dated December 2, 1991. The Commission directed staff to adver- tise this petition for a Public Hearing at the January 14, 1991 Planning and Zoning Commission meeting. The Commission directed staff to look into the legality of the subdivision of the proper- ty and to find out if the phasing extends beyond the building footprint (i.e., roads, parking).
