PLANNING AND ZONING COMMISSION
DECEMBER 10, 1991
MINUTES
The Regular Meeting of the Planning and Zoning Commission of the
City of Palm Beach Gardens, Florida, was called to order by
Chairman Jeffrey Ornstein at 7:30 P.M., in the Assembly Room at
the Municipal Complex, 10500 North Military Trail, Palm Beach
Gardens, Florida and opened with the Pledge of Allegiance to the
Flag.
The roll was called by the secretary and present were: Jeffrey
Ornstein, Chairman; Mike Rosen, Vice Chairman; Alan Strassler,
James Leatherman, Domenick Lioce and Joseph Hamzy Members. Mr.
Carl Sabatello and James Kuretski were not in attendance.
APPROVAL OF MINUTES OF NOVEMBER 26, 1991
Domenick Lioce made a motion to approve the minutes of the meet-
ing of November 26, 1991. James Leatherman seconded the motion.
The minutes were approved by ,a 6 to 0 vote.
ITEMS BY PLANNING AND ZONING DIRECTOR
Mr. Bristol Ellington, City Planner, stated at the last City
Council meeting, the agent for the Palm Beach Community College
Theater explained there are time constraints in getting the
approval in time for their budget. Staff requests advertising
this petition for the January 28, 1992 meeting and having a work-
shop at the January 14, 1992 meeting. Mr. Leatherman made a
motion to advertise the petition for the Palm Beach Community
College Theater for a Public Hearing at the January 28, 1992
meeting. Alan Strassler seconded the motion. The motion carried
with a 6 - 0 vote.

WORKSHOP: PUD -91 -10 - Recommendation to City Council re:
(Gardens Medical Park) Five -year time extension to the Planned
Unit Development, created by Ordinance 17, 1983 and amended by
Ordinance 28, 1985 and Ordinance 1, 1989, for the development of
three medical and dental office buildings totaling 75,000 net
square feet. Located north of Burns Road and approximately 1,000
feet east of Gardens East Drive. (7- 42S -43E)
Mr. Ellington gave a presentation of the December 7, 1991 staff
report. He stated there is a hedge that is required along Burns
Road and the majority of the hedge is within Phase I. The Peti-
tioner for this application is responsible for the installation
of a portion of the hedge along Burns Road. The property owner
of the phase with the majority of the hedge indicated that after
Burns Road is widened the hedge would be installed. A discussion
ensued. The Commission expressed concern with the legality of
the subdivision of the property. The Commission questioned if
the PUD expired, what would happen to the phases that have been
• built (i.e., are they in violation of the zoning code, does their
PUD expire, should the PUD be severed because the extension was
not granted). A discussion ensued. The Commission requested
clarification on the letter provided by City Attorney Bill Brant
dated December 2, 1991. The Commission directed staff to adver-
tise this petition for a Public Hearing at the January 14, 1991
Planning and Zoning Commission meeting. The Commission directed
staff to look into the legality of the subdivision of the proper-
ty and to find out if the phasing extends beyond the building
footprint (i.e., roads, parking).
ADJOURNMENT
There being no further business to come before the Commission,
the meeting was adjourned at 8:00 P.M. The next meeting of the
