HomeMy WebLinkAboutMinutes Council 030890CITY COUNCIL_ WORKSHOP MEETING CITY OF PALM BEACH GARDENS MARCH 8, 1990 The workshop Meeting of the City Council of Palm Beach Gardens, Florida, was called to order by Mayor Martino in the Assembly Room of the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida at 8:05 P.M.; and opened with the Pledge of Allegiance to the Flag. ROLL CALL The Sr-retary called the roll, and present were Mayor Martino, Councilwoman Monroe, and Councilman Kiselewski. Vice Mayor Aldred was absent. Councilman Russo arrived at 8:30 P.M. ANNOUNCEMENTS Mayor Martino announced there would be a General Election on Tuesday, March 13, 1990. The polls would be open from 7:00 A.M. until 7:00 P.M. and encouraged everyone registered in the City to vote. Mayor Martino announced there would be a Planning & Zoning Commission Meeting in the Council Room on Tuesday, 3/13190 at 7:30 P.M. and on Wednesday, 3/14/90 at 7:30 P.M., there would be a Beautification & Environmental Meeting in the Community Center. ITEMS BY THE CITY MANAGER HOOD ROAD The City Manager reported on th^ memo given to the Council re: a Public Hearing the County will hold in the near fQture regarding the Hood Road extension and the ultimate route from Alternate A -1 -A to Prosperity Farms Road. The City Manager felt we should keep informed as it will affect the City. TEAM PLAN, INC. Scott Brown of Team Plan, Inc. addressed the City Council and outlined his letter of October 24, 1989, wherein he had enclosed the selection of streets and median trees for the new annexed area of Palm Beach Gardens, (Hood Road, Central Boulevard, and Donald Ross Road), feasible CITY COUNCIL WORKSHOP MEETING, 3/8190 0 REPORTS BY MAYOR AND COUNCIL PAGE TWO planting trees in the median of Military Trail' and Alternate A -1 -A, cost estimate for PGA Boulevard median at buildout, major intersection Level I 3 II redesigned with costs estimates and sign concepts for entrances to Palm Beach Gardens. Councilwoman Monroe was concerned with the sign concept as to cost and maintenance. Mr. Brown stated there would be low maintenance on the one - half arc and the cost would be approximately $20,000, including seal and landscaping. Councilman Kiselewski stated he was not in favor of the flags above the 112 arcs, but did suggest ground lighting for such arcs. Mayor Martino stated the Council would have to take these ideas and for- mulate a land development regulation around it. Councilwoman Monroe suggested Mr. Brown give the Council one or two more alternative tree suggestions. COUNCILMAN KISELEWSKI Councilman Kiselewski stated the Council had received a copy of the Solid Waste Authority's Annual Report and referred the Council to page 12 which had a picture of Mr. Sam Carsillo and notation of his good works. Councilman Kiselewski reported he met today with people from Boca Raton and explained the Solid Waste Authority's side re: abolition of authority of the Solid Waste Authority. Councilman Kiselewski reported on Monday the County Legislative Delegation will be meeting to hopefully decide one way or another what is to happen CITY COUNCIL WORKSHOP MEETING, 3/8/90 PAGE THREE to the Solid Waste Authority. Councilman Kiselewski reported he has heard that in 30 - 60 days, the removal of the billboards on PGA Boulevard will begin. COUNCILWOMAN MONROE Councilwoman Munroe reported to Mr. Carsillo re: heliport at Palm Beach Gardens Hospital. COUNCILMAN RUSSO Councilman Russo reported that on Tuesday the Recreation Advisory Board held a joint meeting with the Youth Athletic Association to iron out dif- Perences and to improve the programs. The Recreation Advisory Board will to coming to the Council with a recommendation on the non - resident issue. Mayor Martino stated he would like to receive a report from the Advisory Board before they appear before the Council. MS BY THE MAYOR AND COUNCIL COUNCILMAN RUSSO In response to Councilman Russo, the City Manager reported the City does not have a streetsweeper but will look at including one in the budget for next year. COUNCILWOMAN MONROE _ Councilwoman Monroe reported there will be a fashion show on Sunday at the PGA Sheraton for the Boys and Girls Club and she will be one of the models. COUNCILMAN KISELEWSKI In response to Councilman Kiselewski, Mayor Martino explained that Jan Winters wanted some of the constraint facilities to be passed through the Planning Council and Mr. ftnuniz:to asked that it become an official request. Councilman Kiselewski reported he iiad done some research and the costs are more than regular paper and the appearance is not as good. Councilman Kiselewski felt befc e the City used recycled paper, they should look into the costs and the products. In response to Councilman Kiselewski, Linda Erbacher reported the City had publisl, ~d an Information Booklet and it was made from recycled paper and the cost was less. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA SAM CARSILLO Mr. Carsillo reported on the entrances onto 1 -95, the grass is dead and full of weeds. SOLUTIONS RESOLUTION 20, 1990 Rich Walton, Director of Planning & Zoning, addressed the City Council re. Reso'iution 20, 1990, site plan review for 8,463 sguare foot research deve- lopment anu manufacturing company proposed to be located on a 1.1+ acre parcel of land known as Tract 2 of the PGA National Commerce park PUD located on Hiatt Drive, and briefly recapped the previous discussions con- cerninq the site plan review. Jim Sterges, gbs &n architects, addresed the Council and stated they received POA approval today and distributed a letter from the PGA Property Owners Association, Inc., stating same. Mr. Sterges stated that per the last discussion, they have repositioned the building so that it was 10' to the south of the second future building of the Montessori School, which is now 50' from the property line, from the original 331. Mr. Stergcs reported that by moving the building north, they lost 3 pine trees. Mr. Sterges reported he has a memorandum from David Getz of Lindahl, Browning, et al, stating they do not have a problem with the planting in the easement along the side property line. Councilwoman Monroe requested the spread of the trees be included on the site plan. Councilwoman Monroe wanted to know from Staff what the proce- dure is to ensure that Condition #1 is being taken care of. Councilman Russo stated he felt they have done a great job in making the changes the Council had suggested. Resolution 20, 1990 will be considered for approval at the Regular Meeting of 3115/90. ORDINANCES Alk INANCE 3, 1990 The City Manager briefly reviewed previous discussions re: amending Ordinance 27, 1989, which approved a gargage and solid waste collection franchsie agreement. Councilman Kiselewski questioned whether it would have been better to have a resolution simitulaneously so that annually the rates could be changed. The City Manager stated we have a CPI change only. Councilman Kiselewski was concerned that the City would to force businesses to use Waste Management after their contracts expire with their current haulers, even though they may have a better deal with their current haulers. Councilman Kiselewski was concerned that the language does not apply in Paragraph III. Upon Councilman Kiselewski's suggestion, the words "of other carriers" shall be added after "contracts ". In response to Councilman Russo, the City Manager stated they had surveyed Delray Beach and West Palm Beach, and the rates in both cities was around CITY COUNCIL WORKSHOP MEETING, 3/8/90 is PAGE SIX $9b.00. Councilman Russo stated he had a hard time forcing someone in our City to use one company and making them pay more money. Councilman Russo stated he believed there are companies out there doing business for less than $95. In response to Councilman Russo, Attorney Brant stated that the main contract is the exclusiveness of each and every item except for spe- cial equipment and special containers. This was put to public bid, to create an exclusive contract. If this is put out to bid, you destroy the foundation of the original ordinance. Attorney Brant stated that looking at the City's Charter and based upon the facts submitted to him, the City did not have to go for public bids. Councilman Kiselewskl suggested this Ordinance be sent to other companies who work in the City to let them know Ordinance 3, 1990, is coming up for second reading and public hearing on April 5, 1993, and that would be the time for their comments. Larry March Banks, attorney for County Sanitation, addressed the Council briefly regarding Ordinance 3, 1990. Attorney Banks stated that in Paragraph Ia. 5th line: "Charges for equipment purch ?ses or rentals shall not be regulated by the City." Attorney Banks did not understand how the City could regulate rates that were fair if the City oid not regulate thn rates. Also in IIa.: Contrary to what the C°ty Manager stated, this sec- tion states that "Containers shall be leased from the franchised hauler at the rate of $50.00 each per month." Attorney Banks pointed out that it does not say the business can buy it but it shall be leased. Attorney Banks stated that $50.00 per month was a significant amount of money which the business people in this community are not paying today. He stated 49 that 95% of their customers pay no rental rate at all for rolloff con- tainers. Attorney Banks stated that County Sanitation would be happy to open their books to the City Manager and the survey team to verify the figures he outlined tonight. Attorney Banks stated he felt the City was giving Waste Management a chance to make more money at the expense of the businessmen. Counci, woman Monroe suggested Attorney Banks put his comments in writing. The City Manager stated that there are some charges that County Sanitation has for equipment, such as $400 monthly equipment charge for various places. Attorney Banks stated that open -top construction rolloff con- tainers do not have a rental fee. Attorney Banks stated that some busi- ness such as Burdines do have a $400 monthly charge and some other businesses have as little at $150. monthly charge. The City Manager requested that Attorney Banks supply the information as to what they charge prior to the meeting of April 5th. Rich Walton, Director of Planning S Zoning, addressed the City Council re; Ordinance 4, 1990 wh�ch is an ordinance enacted to protect the natural resources and environmentally significant habitats on lands within the City to be known the Palm Beach Gardens Natural Resources and Environmentally Significant Lands Ordinance. CITY COUNCIL WORKSHOP MEETING, 3/8/90 0 PAGZ EIGHT Attorney Brant stated that the County has an ordinance on the books, but the City can "opt out" of that ordinance provided we show a compelling reason and have a substitute ordinance. Councilwoman Monroe was concerned with the fact that this Ordinance be approved before the Comprehensive Plan was redrafted. Staff E :s directed to clairfy some of the vaguness of the language and to add additional definitions and to have comprehensive plan language tie - ins. Ordinance 4, 1990 will be scheduled for Planning & Zoning Commission before it comes back to the Council. Hank Skokowski, Urban Design, addressed the City Council regarding Ordinance 4, 1990. Mr. Skokowski stated his understanding that the County IF clearing regulates uplands habitats and allows for a muni:ipality to adopt a local ordinance and no such understanding exists as far as wetlands are concerned. The County and State regulate wetlands. The provisions in Ordinance 4, 1990, duplicate the County and State because the City cannot exempt itself from the County crdinace. Mr. Skokowski stated his staff has comments re: Ordinance 4, 1990 and will forward those to the Planninq & Zoning Commission. Mayor Martino asked Mr. Skokowski to put in writing his comments on the ordinance and the uplands /wetlands issue and forward to Council. ITEMS FOR DISCUSSION PRESTON COURTS Rich Walton, Director of Planning & Zoning addressed the City Council and briefly detailed the petition from Robert J. Frein, Jr., agent for Hansen - Preston Courts, Inc, to amend the Preston Courts PUD, by reducing CITY COUNCIL WORKSHOP MEETING, 3/8190 16 PAGE NINE the 30 duplex units to 25 duplex units. Mr. Walton stated that in September 1989, there was an amendment from the original application of 34 duplex units to 30 duplex units. Robert (rein, agent for Hansen- Preston Courts, Inc., addressed the City Council stating that the public prefers the single - family home rather than the d;�lex units, therefore the reason for the amendment. Mr. Frein agreed to the conditions suggested by the Planning and Zoning Commission in their February, 1990 meeting. Per a consensus of the City Council, the resolution will be drafted and scheduled for consideration of approval at the Regular Meeting of 3/15/90. SIENA OAKS Rich Walton, Director of Planning & Zoning, addressed the City Council re: Am request of The Engle Group, to amend the Siena Oaks PUD, to allow for a IV zero foot side and rear yard setback for screen enclosures on the estate and patio homes. Mr. Walton referred to a memo from Jack Hanson, Building Official, stating he preferred a minimum of 3' as a setback on the rear and non -zero lot line side for the screen enclosures. Bob Bentz, agent for the Engle Group, Inc., addressed the Ci--y Council any, stated he had no objections to the 3' recommendation. Per a consensus of the City Council, the resolution will be drafted and scheduled for consideration of approval at the Regular Meeting of 3/15/90. ADJOURNMENT There being no further business to discuss, the meeting was aajourned at 11:15 P.M.
