HomeMy WebLinkAboutMinutes Council 052490CITY COUNCIL WORKSHOP MEETING CITY OF PALM BEACH GARDENS MAY 24, 1990 The Workshop Meeting of the City Council of the City of Palm Beach Gardens, Florida, was called to order by Mayor Martino at 8:00 F.M. in the Assembly Room of the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens. Florida; and opened with the Pledge of Allegiance to the Flag. ROLL CALL The Secretary called tha roll, and present were Mayor Martino, Vice Mayor Aldred, Councilwoman Monroe, Councilman Kiselewski and Councilman Russo. ANNOUNCEMENTS Mayor Martino announced the City's Administrative Offices will be closed Monday, 5/28/90 in observance of Memorial Day. ITEMS BY THE CITY MANAGER 6n�ABATCHEE COUNCIL 'GOVERNMENTS The City Manager reported on correspondence received from the Loxahatchee Council of Governments which stated the City's pro rata share for the 1989/90 fiscal year would be $3,000. The City Manager stated is is up to the City Council if thev would like to continue the me�sbership. Mayor Martino recommended continuing the membership for one more year. The Mayor suggested and the Council agreed to discuss goals and objectives for presentation to the Loxahatchee Council of Governments. If these goals and objectives cannot be realized within the next year, further membership would be declined. This item will be scheduled for consideration of approval at the Regular Meeting of 617 1901. El CITY COUNCIL WORKSHOP MEETING, 5/24/90 PAGE TWO 41EMS AND REPORTS BY MAYOR AND COUNCIL RICHARD SIMPKINS Richard Simpkins, Scoutmaster of Troop 187, addressed the City Council stating the boys are attending this evenirg's meeting to observe local government to aia them in obtaining their Citizenship Badge. MAYOR MARINO Mayor Martino stated he attended the Planning and Zoning Commission Tuesday night. Mayor Martino stated there was a workshop meeting between the Traffic Performance Standards Committee and the County Commissioners wherein direction was given to the Committee and the County staff to try to resolve some of the lingering problems with thirty days. Mayor Martino stated the League of Municipalities met Wednesday and by a vote of 26 to 0, voted to support the alternative document for discussion purposes. AM tJNCILMAN RUSSO Councilman Russo stated he attended the North Palm Beach County Boys and Girls Te?n Club meeting Monday and in the near future they will be approaching the cities to see who would like to participate in the rrogram. COUNCILWOMAN MONROE Councilwoman Monroe stated she attended the Landscape and Tree Preservation Ordinance Committee on Wednesday and plans are proceeding. COUNCILMAN KISELEWSKI Councilman Kiselewski stated the last workshop meeting on the Solid Waste Authority budget will be held on 5131190 and invited the City Council to attend. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA SAM CARSILLO Sam Carsilio addressed the City Council re: proposed public golf course and possiblity of increase in taxes. CITY COUNCIL WORKSHOP MEETING, 5/24190 1 Rn I NANC E=S PAGE THREE ORDINANCE 13, 1990 The City Manager Lriefly reviewed Ordinance 13, 1990, proposed amendment to Part IV of Chapter 151 or the Palm Beach Gardens Code pertaining to Art in Public Places by changing the method or procedures of art work selected. the proposed amendment would allow the developer of the proliect to receive all submittals for art and then present three works of art to the Art Advisory Committee for their selection with final approval by the City Council. If the Committee did not select one of the three works of art presented, then the Developer, at their option, could either present three other works of art to the Committee or appeal to the City Council. If the City Council affirmed the Committee', decision, then the Developer would resubmit three different works of art to the Committee. JOIN Howard Ostrout, Chairman of the Art Advisory Committee, addressed the City Council stating the Committee would prefer to continue to view all works of art submitted. Mr. Ostrout suggested having all artist submittals sent directly tc the Art Advisory Committee, thereby, relieving the City Manager's Office of the administrative responsibilities. In response to ^ ouncilman Kiselewski, Attorney Brant stated he was con- cerned with the issue of liability, i.e. storage and returning of items submitted. Attorney Brant recommended strengthening the advertisements for art work. Mayor Martino suggested the Art Advisory Committee discuss the Ordinance pertaining to Art in Public Places with Councilman Kiselewski, Council Liaison, and Attorney Brant, and return to the City Council fcr dnotherr, workshop. r CITY COUNCIL WORKSHOP MEETING, 5/24/90 PACF FOUR qDTNANCE 14, 1990 ORDINANCE 15, 1990 The -i_t• Ma6,-ger of iei is reviewed the amendments containea in Ordinance 14, 1990 and Ordinance 15, 1990 to the Policemen's and Firemen's Retirement Trust Funds, respectively. Attorney Brant stated the City must meet the minimum requirements as set forth in the Florida Statutes. After discussion by the City Council, there was a consensus to amend Ordinance 14, 1990 and Ordinance 15, 1990, as follows: Ordinance 14, 1990: Sec. 19 -22. Local Law Plan - "The City shall meet the minimum requirements of Section 185.351 of Chapter 185 Florida Statutes." Ordinance 15, 1990: Sec. 19 -22. Local Law Plan - "The City shall meet the minimum requirements of Section 175.351 of Chapter 175 Florida Statutes." Ordinance 14, 1990 and Ordinance 15, 1990 will be scheduled for first Ak reading at the Regular Meeting of 60/90. ITEMS FOR DISCUSSION PUBLIC SAFETY ELEMENT Rich Walton, Director of Planning and Zoning, add- -essed the City Council re: Public Safety Element of the Comprehensive Land Use Plan. Mr. Walton stated that although the Public Safety Element is an optional element of the Comprehensive Plan, Dr. Nicholas strongly suggests adopting the Public Safety Element along with the Comprehensive Plan, if the City is pursuing impact fees. The Plan would state the existing situation and the City's preferred method of paying for services in the future. Attorney Brant stated he preferred the Public Safety Element be included as part of the Comprehensive Plan, however the City Council could consider ® adopting an Ordinance which would incorporate the contents of the Public `� Safety Element. FAIRWAY OFFICE CENTER Rich Walton, Director of Planning and Zoning, addressed the City Council regarding the request to place a carport /canopy over parking spaces at the Fairway Office Center PUD at PGA National PUD. Mr. Walton stated the Petitioner has deleted three canopies over 36 parking space and is now proposing two canopies over 20 spaces. Mr. Walton stated the Petitioner amended plans so that canopies will be located near the lake and away from Fairway Drive. Mr. Walton stated the Pol,cc Department has expressed con- cerns re: lighting underneath the canopies. Mr. Walton stated David Getz requested documentation re: how the canopies would stand up under hurri- cane conditions. Mr. Hank Skokowski, Urban Design Studio, addressed the City Council and presented t.:o samples of canopies with a decorative scalloped edge and the proposed color. Mr. Skokowski stated the material is translucent and covers only the top of the canopy and felt there was sufficient lighting. Mr. Skokowski stated he had received a statement from a pro- fessional engineer stating the frames are designed in accordance with the South Florida Building Code and the Southern Standard Building Code to withstand winds of 140 miles per hour. The canvas awnings shall be removed when winds reach maximum whole gale force or installed in such a manner that it will release from the frame with a wind load of 15 pounas per square foot. Mr. Skokowski stated he will provide Mr. Getz with this 0 documentation. CITY COUNCIL WORKSHOP MEETING, 5/24/90 PAGE SIX There was a Consensus of the City Council to not require additional lighting underneath the canopies and to schedule this item for con- sideration of approval at the Regular Meeting of 6/7/90. GOODWILL INDUSTRIES Bob Dugas, Goodwill Industries, addressed the City Council regarding the OONOMY INNS improvements at the donation center located on Military Trail. Mr. Dugas stated a fence has been installed to hide the tongue of the trailer and a planter to accommodate the plants selected by the City Forester. After discussion by the City Council, Mr. Dugas was directed to extend the fence around the back of the trailer and provide a drawing showing the new extension. The petitioner was further directed to bring the signage into compliance with the Sign Code. This item will be scheduled for con- sideration of approval at the Regular Meeting of 5/7/90. Attorney Brant stated the City Council may workshop this item as long as the Council makes no commitments. Robert Lemoine, Herrick Development /Economy Inns of America, addressed the City Council regarding the difficulty the Economy Inn, located off of Horthlake Boulevard, is having in attacting customers. Mr. Lemoine stated this piece of property is approximately 301. be'lnd other properties in the area and contributes that loss of business to the lack of signage off Interstate I -95 and Northlake Boulevard. After discussion by the City Council, Mr. Lemoine was directed to prepdre his petition for a variance to the Sign Code and file same with the City Clerk. C'Ty COUNCIL WORKSHOP MEETING, 5124190 PAGE SEVEN fGLETON COVE Walton, Directoi of Planning and Zoning, addressed tha City Council re: request to amend Eagleton Cove PUD by switching the footprint of the home and guesthouse on Lot 18 and to extend the guesthouse to the lakeside lot line. Mr. Walton stated staff has received a letter from Northern Palm Beach County Water Control District stating they have no problem with this modification. Mr. Har% Skokowski, Urban Design Studio, addressed the City Council and explained the 'owner of the property would like this amendment to allow for better views of the lake and golf course from the home and guesthouse. After discussion by the City Council, Mr. Skokowski was directed to pro- vide signoffs regarding the overhang of the guesthouse from the PGA National Property Owners Association and Northern Palm Beach County Water Control District. Mr. Skokowski was also directed to provide Attorney Brant with the fee simple title holder of the property wherein no notice would be required by the City Council. This item will be scheduled for consideration of approval at the Regular Meeting of 617190. PUBLIC GOLF COURSE Attorney David Norris, Public Golf Corporation, addressed the City Council to provide an update on the status of the contract. A.tUrney Norris stated Public Golf Corporation is close to meeting all requirements of the contract and all permits should be received by June 5, 1990, with the exception of the Sout�, Florida Water Management District permit which should be received by June 13, 1990. Staff was directed by the City Council to work with Public Golf Corporation to ensure all requirements are met. Richard Orman, Public Golf Corporation, detailed the changes in the site plan of the golf course due to the access road off of Northlake Boulevard.
