Councilwoman Monroe was not in attendance as she was out -of -town. ANNOUNCEMENTS Mayor Martino announced there would be a meeting of the Planning and Zoning Commission on Tuesday 11/14/89 at 7:30 P.M. Mayor Martino announced the City's Administrative Offices would be closed 11/10/89 in observance of Veterans Day. ITEMS BY THE CITY MANAGER ROSS SIMMONS OF FLORIDA EVENTS Mr. Ross Simmons of Florida Events, Inc., addressed the City Council re: grand opening ceremonies for the Promenade Plaza, particularly Santa Claus skydiving onto the plaza property. The City Council expressed concerns re: this request, howeeer, determined that the authority to skydive in the City has never been approved or disapproved by the City Council and they would not like to set a prece- dent. The City Attorney stated skydiving was not addressed in the City's Codes. Per the advice of the City Attorney, the City Council decided not to approve or disapprove this action. The liability acid responsibility will lie with Florida Events, Inc. for hooking this event, and with the Federal Aviation Administration which gives them the right to skydive. CITY COUNCIL WORKSHOP MEETING, 11/9/39 • REPORTS BY MAYOR AND CITY COUNCIL PAGE 2 MAYOR MARTINO Mayor Martino reported the Beautification and Environmental Comn;'tee m.t last evening. Mayor Martino reported attending a meeting of the Art Advisory Board where discussions took place it:: .ardens Suites Hotel, minutes of which are on file in the City Clerk's Office. Mayor Martino announced he was appointed by the League of Cities to serve as the City's representative on the Traffic Performance Standards Advisor�- Committee. OUNCILMAN RU-U Counclim ^,an Russo reported the teen street party was a very successful com- munity event and was attended by approximately 500 - F00 youth. Councilman Russo reported attending the Recreation Advisory Board meeting where plans were reviewed re: Lake Catherine Park. This Board is also atteinpting to make some policy decisions and meeting with the YAA to control what is happening with their programs. COUNCILMAN KISELEWSKI Councilman Kiselewski reported attending the Metropolitan Planning Organization meeting where discussions tack place re: aspects of the ITLMS BY THE CITY transportation elements in Palm Beach County. COUNCIL COUNCILMAN RUSSO Councilman Russo requested the City Manager check into the possibility of installing a street light at Gardenia and Honeysuckle, stating he has received complaints from residents in that area who felt it was needed. 40 CITY COUNCIL WORKSHOP MEETING, 11/9/89 0 PAGE 3 COUNCILMAN KISELEWSKI Councilman Kiselewski stated he received some information from the State League of Cities, including a resolution regarding various state mandates that are unfunded. Councilman Kiselewski felt the City should adopt it's n th °; ;eselu[Eon. COMMENTS FROM THE PUBLIC DR. GRAY Dr. Gray, resident of Palm Beach Gardens, addressed the City Council expressing his concern with the absEnce of a school crossing guard at Holly Drive and Military Trail. The City Council directed the City Manager to make a written report as to the placement of school crossing guards it the C.ty and if there was a need for one to be placed at the internettion of Holly Drive and Military Trail. uRDINANCES ORDINANCE 31,1989 Richard Walton, Plannino and Zoning Director, addressed the City Council re: Ordinance 31, 1989, "The Oaks ". Mr. Walton felt there should be a paragraph added to the Ordinance re: right -of -way along Burns Road and RCA Boulevard. The petitioner agreed to dedicate the right -of -way at the time of platting, and the City Attorney was directed to note this in the tdinance. Kahart Pindar, Traffic Consultant for the City, reviewed the Interlocal Agreement for the widening of Burns Road that will involve three develop- ments , "The Oaks ", "Siena Oaks ", and "Gardens East Rental Apartments ". Mr. Pindar stated his study was based on traffic studies provided by the applicants, and detailed the formula for monies to be paid by each deve- loper. CITY COUNCIL WORKSHOP MEETING, 1119/89 PAGE 4 Mr. Walton, Planning and Zoning Director, requested condition p 13 be added to read "The temporary sales center shall be removed at the time Campus Drive is open to RCA Boulevard or the first certificate of occu- pancy is issued for a model, whichever occurs first. The City Council requested the petitioner insure the homeowners documents inc'._'e what lots in the out - parcel could have swimming pools without disturbing the trees located on certain lots. Thi petitioner also agreed that the Ordinance be revised to include a section approval of the Landscape Plan be approved by a subsequent resolution of the City Council. The City Council will consider Ordinance 31, 1989, for second reading and approval at the Regular Meeting of 11/16/89. ep DiNANCE 34,1989 Richard Walton, Director of Planning and Zoning, addressed the City Council re: annexation of 4.648 acres located on the south side of Northlake Boulevard and on the east and west sides of Dania Drive. The City Council had no concerns re: Ordinance 34, 1989, and will consider second reading and approval at the Regular Meeting cf 11/16/89. ORDINANCE 35,1989 Richard Walton, Director of Planning and Zoning, addressed the City Council re: rezoning of 4.648 acres from Palm Beach County designation of RM (Multiple- Family Residential District - Medium District) to PLD (Northlake Centre) with underlying zoning of PO (Professional Office), located on the south side of Northlake Boulevard and on the east and west sides of Dania Drive. Mr. Walton stated all requested amendments to the Site Plan have been incorporated into the revised plans. The Mayor requested the Ordinance include as statement that the petitioner ® will attempt to acquire a cross - access agreement on both sides of this project, should the opportunity become available. The ,'eveloper was informed that there has been an ordinance on the books for serera', year, that passes the cost for City consultants onto the petitioner. ORDINANCE 36,1989 Richard Walton, Director -f 'tanning and Zoning, addressed the City Council re: rezoning from RM, Residential Multiple- Family to PUD, with uses designated in RM, Multiple - Family (Me :`-, i District and site plan approval (Siena Uaks) for the constructi c' single - family dwelling units on 73.44 acres located approximately 500 feel south of Burns Road and approximately 300 feet west of Prosperity Farms Road, adjacent to Allamanda Elementary School. Mr. Walton stated the petite :7er has agreed to all conditions and has revise.i plans to in.corporat,, the thoughts of the City Council. Attorney Royce, authorized agent for the pet Lioner, briefly reviewed revisions to the plans. The City Council will consider second reading and approval of Ordinance 36, 1989, at the Regular Meeting of 11/16189. ORDINANCE 38,1989 Mayor Martino explained that the City Attorney has taken the existing sign code and amended certain sections as directed by the City Council. The Building Official has suggested several additional minor amendments which the City Attorney will include these amendments. The City Attorney was directed to determine if this ordinance would need ® to be sent to the Planning and Zoning Commission for their review and CITY COUNCIL WORKSHOP MEETING, 11/9/89 PAGE 6 recommendation. ORDINANCE 39,1989 The City Council directed the City Attorney remove any reference to PO - Professional Office from Ordinance 39, 1989, amending Zoning District designations contained in Chapter 155, The Sign Code. (Workshop - Clerical update of existing code to bring the zoning classifications in line with the current ,Istricts.) The City Council expressed no further concerns with Ordinance 39, 1989, and will consider first and second reading, on an emergency basis, at the 11/16/89 Regular Meeting. ITEMS FOR DISCUSSION "ROSPERITY CENTRE Richard Walton, Director of Planning and Zoning, addressed the City Council re: Prosperity Centre PUD, stating there has been revisio ^s to the landscape p,Ar: Tor this project. Attorney Larry Smith, authorized agent for F. F. Adams, Jr., stated the revisions to the landscape plan incorporate the thoughts of the City Council from previous workshop meetings. Attorney Smith further stated he will submit material samples to the Planning and Zoning Department. Kathleen Smith of Teach Road, Sally Beatty of Kidd Lane and Mrs. Wood of Kidd Lane all addressed the City Council expressing their preference for a wall instead of a hedge and chain link fence. It was the concensus of the City Council that the neighbors should have the wall if that is what they preferred. The City Council requested the petitioner present material samples pro- posed for the restaurant on the out - parcel, stating they must match the rest of the center. The petitioner was further requested to research whether the roof equipment would be properly screened. GARDENS EAST PCD AND RENTAL APART- MENTS Richard Walton, Director rf Planning and Zoning, addressed the City Council re: amendment to the Gardens East PCD and the creation of the Gardens East Rental Apartment PUD. Attorney Royce, authorized agent for Linpro Florida, Inc., discussd access points and deceleration lanes, and the City Council expressed no problems with the proposals presented by the petitioner. Attorney Royce presented photographs of areas in Palm Beach that used street parking comparable to what is being'requested for this project. It was the concensus of the City Council that the petitioner keep the width of the roadways at 39 feet, and requested Kahart Pindar, Traffic Consultant, contact the City Engineer to get hic feelings on the subject of road width and parking. The City Council expressed no further concerns with this project and will consider first reading of the Ordinance for the amendment to the Gardens East PCD at the 11 /16189 Regular Meeting. APPOINTMENTS TO PLANNING & ZONING COMMISSION Mayor Martino requested City Council members submit their choices for appointments to the Planning and Toning Cornmission to the City Clerks office to be tabulated. The City Council will consider appointment by Resolution of these members at the Regular Meeting of 11/15/89. INTERLOCAL AGREEMENT WIDENING OF BURNS ROAD It was the concensus of iiie City Council that the Interlocal Agreement for 0 the widening of Burns Road was acceptable as submitted.
