REGULAR MEETING
CITY OF PALM BEACH GARDENS

The Reoular Meeting of the City Council of Palm Beach Gardens, Florida,
was called to order by Mayor Feeney at 8:60 P.M. in the Assembly Room of
the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens,
Florida; and opened with the Pledge of Allegiance to the Flag.
ROLL CALL The Cite Clerk called the roll and present were: Mayor Feeney,
Councilwoman Monroe, Councilman Aldred and Councilman Kiselewski. Vice
Mayor Martino was not in attendance as he was out of town.
APPROVAL OF
MINUTES The minutes of the Special Regular S Workshop Meetings of 2116/89 and the
Regular Meeting of 2 12/89 were unanimously approved as written.
ANNOUNCEMENTS Mayor Feeney announced the City's Administrative offices would be closed
on Monday, February 20, 1989, in observance of Presidents' Day.
CALL FOR BIDS

FIRE DEPARTMENT The City Clerk opened and read the following two bids received for thirty -
five (35) Scott Air Pac 2.2 Complete, and thirty -five (35) spare cylin-
ders, with trade -in of present breathing apparatus, "or the Fire
Department as advertised 2/1/89:
Safety Equipment Company, North Miami Beach - $42,700.00
(Includes Trade -In)
Scott Company, Douglasville, Georgia - $53,725.00
Spares 12,845.00
No Trade -In Allowance
Per a unanimous vote of the City Council the bids were remanded to the
City Manager and Fire Chief for their review and recommendation,.

COUNTY ROAD
IMPACT FEES The City Manager referenced a letter received from Palm Beach County
stating as of March 1, 1989, they will start collecting the Road Impact
Fees. The City Attorney is researching whether the City should give fees
to the County when they do not have an ordinance in place, and will report
back to the City Council.

COUNCILMAN
KISELEWSKI Councilman Kiselewski reported attending a meeting of the Planning and
Zoning Commission on Tuesday night where discussions took place on the
City's Sign Ordinance. The Sign Ordinance was approved by a vote of 5
ayes to 0 nays, with 3 minor recommendations.
Councilman Kiselewski reported attending a meeting of the Solid Waste
Authority on Wednesday. It was reported the County Commission has
approved either a $50,000 or $100,000 expenditure to the same engineering
group for an adaitional study For a west site and have given them 30 days
for this information.
Councilman Kiselewski reported Lttending a meeting of the Metropolitan
Planning Organization this morning where he was again appointed Chairman.
A discussion ensued re: County Commission attempt to force the Solid Waste
Authority in obtaining an alternate location to Site 1, and the problems
with that proposal.
Councilman Aldred stated that the most beautiful section of a golf course
that he has seen in this County is the south end of JDM which is built on
a landfill, and one of the finer golf courses that he has played, Ro'ling

Hills in Ft. Lauderdale, is also built on a landfill. Councilman Aldred
stated if the Solid Waste Authority would plan far enough ahead to show
that, instead of the typical Indian burial ground, we would receive
something as beautiful as these golf courses from a publicity standpoint,
they would be better off. Councilman Kiselewski stated this has already
been done, and referenced awards won by the Dyer Boulevard landfill.
Councilman Kiselewski stated that part of the landfill process is that
when it is done it will fit right back into the community in some form,
whether it be a golf course or similar to the old environment.
GOUNCILMAN
DRED Councilman Aldred suggested and the Council agreed that a resolution be
prepared and presented to the Seacoast Utility Authority and Palm Beach
County suggesting that they work out an agreement for the 100 acres they
have to be used for a daily fee public golf course since there is a lack
of County parks in this area.
Councilman Aldred expressed his concern with the leash taw and "pooper
%cgQPe r" law not being enforced and )-Uque5tad the City Council review
these ordinances in the near future.
COUNCILWOMAN
MONROE Councilwoman Monroe expressed her concern that each resident of the County
is putting out equal dollars, millage -rate wise, paid to Palm Beach
County, but County recreatianal parks are scarce in northern Palm Beach
County.
UNCILMAN
JW SELEWSKI Councilman Kiselewski stated he has received complaints about the traffic
situation at PGA National, specifically at Rabbit's Run, specifically

speeding, around 5:30 -7:30 P.M. during the week and between 8:00 P.M. and
Midnight on the weekends. The City Manager was directed to have police
officers patrol this area.
Councilman Kiselewski requested the Police Department ticket cars parking
on the sidewalk on Holly Drive, west of Military Trail at St. Ignatius
Cathedral.
Councilman,Kiselewski stated the Law Enforcement Officer of the Year is
going to be selected on February 24, 1989, at the Palm Hotel, and each
Council member is invited to attend, for $35 a ticket.
MAYOR FEENEY Mayor Feeney stated he signed 3 checks to replace transmissions in Police
cars, and after questioning the Director of Public Works, was informed the
cause was abuse. Mayor Feeney requested the City Manager instruct the

Acting Police Chief to take corrective action to try to alleviate the
destruction of transmissions,
Mayor Fczney questioned whether the policy set by the City Council re:
what City employees qualified to have City vehicles, and if it is not in
effect at the present time that it be put into effect. Mayor Feeney
further stated that City vehicles, regardless of who has them, with the
exception of the City Manager, should not be used for personal use. Mayor
Feeney stated he has seen husbands and wives driving around in City cars,
specifically on weekends. The City Manager was requested to make a recom-
mendation to the City Council about City vehicles used by City employees.
Mayor Feeney stated he has received calls re: train whistles and requested
information on the status of this problem. The City Council directed
the City Manager request the Municipal League to apply some pressure to
municipalities to install signs banning train whistles so that this

Mr. Vito DeFrancisco, 15 Alwick, PGA National, addressed the City Council
expressing his concern with a letter he received from PGA National stating
they would be putting the guard arms down on a 24 -hour basis for a one -
month exoerimental program. The City Manager explained that this was part
of the traffic study that was required to be done by the DRI. Mr. De
Francisco stated the guard house were directed to be built 295 feet from
his property line and they have been huilt 195 feet from his property line
instead. The City Council directed the City Manager to investigate these
figures. Mr. DeFrancisco stated he has contacted the American Civil
Liberties Union and stated they are in total agreement with him and he
will be forwarding all documents to them. Councilman Aldred requested
information re: who owns guard houses, and if it is the property owners
then would like to know what Mr. DeFrancisco has done to get the property
owners to vote unanimously or in majority of removing the guard houses.
The concensus of the City Council was to have the guard barriers being
down 24 -hours and the flashing light stopped immediately. The City
Manager will review the necessary documentation and will report back to
the City Council at their Regular Meeting of March 2, 1989.
Mr. Hank Skokowski of Urban Design Studio addressed the City Council re:
Ordinance 50, 1988, creation of a PUD, with land uses permitted being
those as set forth in the CG -1 (General Commercial) Zoning District of the
Palm Beach Gardens Code, proposed to consist of a two- story, 53,2.00 sq.

and be located on 4.5 acres, more or less, fronting on the south side of
PGA Boule�,.u, east of Fairchild Gardens Avenue, directly across from "The
Gardens" regional shoppin; mall.
Mayor Feeney declared the Public Hearing open, which was duly advertised
2 11/89. Per a unanimous vote of the City Council the Public Hearing was
postponed to the City Council Regular Meeting of March 16, 1989, at 8:00
P.M.
ORDINANCE 53,1988 Attorney Fred Cohen addressed the City Council, stating modifications have
been made to the plans pursuant to workshoo discussions.
Mayor Feeney declared the Public Hearing open, which was duly advertised
2/1189, and held on the intent of Ordinance 53, 1988, creation of a PUD,
with land uses permitted being those as setforth in the CG -1 (General
Commercial) District of the Palm Beach Gardens Code, proposed to consist
of existing 1600 sq. ft. bank (City Federal) and 91 -room limited - service
"The Gardens Suites Hotel ", and be 1 cated on 1.85 -acre parce' on the east
side of U.S. Highway One. There being no comments from the public, Mayor
Feeney declared the Public Hearing closed.
Councilwoman Monroe read a letter received from Mr. Shapiro, secretary of
the Twelve Oaks Condominium Association, stating his concern that con-
ditions recommended by the Planning and Zoning Commission were not
including in this Ordinance. Councilwoman Monroe felt there was a valid
concern in terms of a wall being installed first and how they treat the
landscaping and fence that is there now. Mr. Don Hearing of GBS 8 H
Architects stated the petitioner did agree to this and still agrees to
41 these stipulations. The City Attorney was directed to incorporate these

the stipulations as outlined by the Planning and Zoning Comnissicn in the
Ordinance as an "Exhibit ".
The City Council requested Ordinance 53, 1988, Section 5, second
paragraph, describing uses for existing bank facility, be amended to read:
"Permitted uses are those that are established under the City's current
Code, Section 159.088, Paragraph A (2) and (3), including banks, excluding
drive - through facilities. The first paragraph of Section 5, 3rd line,
will read "facility use until 511/91."
The petitioner agreed to locate the dumpster at the northwest corner of
the site. It was further agreed that the 4th paragraph of Section 5, be
amended to read: "The elevations of the bank building shall be modified
in accordance with the plan and drive -in facility removed no later than
three (3) years from effective date, or as setforth above, depending which
event shall first occur."
Per a unanimous vote of the City Council, the City Attorney read, by title
only, on second and final reading, Ordinance 53, 1988. Ordinance 53,
1988, was unanimous adopted by the City Council.
ORDINANCE 1,1989 Mayor Feeney declared the Public Hearing open, which was duly advertised
on 2/1/89, and held on the intent of Ordinance 1, 1989, amending "Gardens
Medical Park" PUD, 3355 Burns Road, created 11/17/83 by Ordinance 17,
1983, and amended 12/19/85 by Ordinance 23, 1985, providing for: exten-
sion, by three years, of the permissible time for completion of the pro-
ject. There being no comments from the public, Mayor Feeney declared the
Public Hearing closed,
Per a unanimous vote of the City Council the City Attorney read Ordinance
1, 1989, by title only, on second and final reading. Ordinance 1, 1989,

was unanimously adopted by the City Council.
ORDINANCE 2,1989 Mayur Feeney declared the Public Hearing open, which was duly advertised
2/1/89, and held on the intent of Ordinance 2, 1989, amending plans for
architectural elevations, landscaping, site lighting & parking lot of
"Marriott Hotel ", approved 11117187 by Ordinance 20, 1987, on RCA
Boulevard. There being no comments from the public, Mayor Feeney declared
the Public Hearing closed.
Per a unanimous vote of the City Council the City Attorney read Ordinance
2, 1989, by title only, on second and final reading.
Ordinance 2, 1989, was unanimously adoptea by the City Council.
ORDINANCE 3,1989 Mayor Feeney declared the Public Hearing open, which was duly advertised
of 2/1/89, and held on the intent of Ordinance 3, 1989, amending Section
153.20 Landscape Strips, of Chapter 153: Landscaping of City's Code of
Ordinances, providing for a 15' wide landscape strip along all street
frontages of all non - single family residential projects within the City.
There b -ing no comments from the public, Mayor Feeney declared the Public
Hearing closed.
Per a unanimous vote of the City C -uncil the Mayor read Ordinance
3, 1989, on second and final reading. Ordinance 3, 1989, was unanimously
adopted by the City Council.
ORDINANCE 4,1969 Per a unanimous vote of the City Council the City Attorney read, by title
only, on first reading, Ordinance 4, 1989, amending 103.4 -acre "Garden
Lakes" Commercial /Multi - ;amity Residential PUD created 2/16/78 via
Ordinance 18, 1977, providing for the construction of a buffer landscape
and wall along their easterly and northerly property lines fronting on
North Military Trail and the Interstate -95 off -ramp.
