CITY OF PALM BEACH GARDENS
MAY 18, 1989
The Regular Meeting of the City Council of Palm Beach Gardens, Florida,
was called to order by Mayor Martino at 8:00 P.M. in the Assembly Room of
the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens,
Florida; and opened with the Pledge of Allegiance to the Flag.
ROLL CALL
The City Clerk called the roll and present were: Mayor Martino, Vice
Mayor Aldred, Councilman Kiselewski, and Councilman Russo. Councilwoman
Monroe arrived at approximately 8:15 P.M.
APPROVAL OF
MINUTES
The minutes of the Regular Meeting of 5/4/89 and the Workshop Meeting of
5111/89 were unanimously approved as written.
ANNOUNCEMENTS
Mayor Martino announced there would be a Planning and Zoning Commission

meeting on Tuesday, May 23, 1989, at 7:30 P.M.
PRESENTATION
Mayor Martino made a presentation to Lieutenant Robert Marts of the Police
Department for being an employee with the City for ten years May 12, 1989.
PROJECT GRADUATION
Ms. Kim Martino, representing the Class of 1989 at Palm Beach Gardens
Community High School addressed the City Council re: Project Graduation.
By a unanimous vote of the City Council $3300 will be donated by the City
toward the cost of Project Graduation. The money is to be taken from the
Council Ccr;tingency Account. Ms. Martino invited each Council m mblcr and
the City Manager to join the Class of 1989 at Project Graduation.

EQUIPMENT
Per the recommendation of the City Manager and Fire Chief, the City
Council unanirously approved the bid received for the Hurst Rescue

KISELEWSKI Councilman Kiselewski reported attending a meeting of the Solid Waste
Authority where discussions took place re: odor from the Dyer Dump. It
0 was decided that they would come up with a odor masking until the burning
facility comes on line.
Equipment for the Fire Department in the amount of $19,158, to be taken
from Account q 12- 64.20.
CITY COUNCIL MEET-
INGS - SUMMER
SCHEDULE
Per a unanimous vote of the City Council the Workshop Meetings on the 2nd
and 4th Thursdays of each month were cancelled for the summer months of
June, July and August.
SCULPTURE
DEDICATION
The City Manager reminded the City Council of the dedication of the
"Double Rainbow" sculpture on Monday at 8:00 A.M. The City Manager stated
he will be out -of -town and unable to a.tand.

OUNCILMAN RUSSO
Councilman Russo stated he attended a meeting with Mr. Skrimsher, Doug
Hood and Susan Ruskay re: use of school facilities by the Recreation
Department for summer programs. It was decided that the City will submit
requests for needs for the summer by November 15 of each year and the
School Board would reply by January 1st, giving the City advance notice on
the availability of the facilities.
Councilman Russo reported attending the Merin System Board meeting on
Tuesday where discussions took place re: ren,ganization of the BuilJing
Department. Councilman Russo stated the Board reauested parameters of
benefit package from the City Council,
COUNCILMAN
KISELEWSKI Councilman Kiselewski reported attending a meeting of the Solid Waste

Councilman Kiselewsk' reported attending a Metropolitan Planning
Organization meeting today where it was decided to hire consultants to
study the bus passenger transfer facility in the West Palm Beach area.
The study should be completed by the end of August.

AND CITY COUNCIL
MAYOR MARTINO Mayor ':artino stated the Horseshoe Acres annexation becomes effective May
20, 1989, and welcomed those new residents into the City.
Per a consensus of the City Council, the Comprehensive Land Use Plan
Update Committee will meet on Tuesday, May 30, 1989„ at 7:30 PM. to
discuss the housing and conservation elements.
RESOLUTIONS
&SOLUTION 27, 1989 Per a concensus of the City Council the Deputy City Clerk read, in full,
Resolution 27, 1989, expressing opposition to School Board Preemption
(SB25 8 HB478); and Group House Zoning (CSIHB 1269 & SB 1061).
Resolution 27, 1989, was unanimously approved by the City Council.
RESOLUTION 28, 1989 Per a concensus of the City Council, Resolution 28, 1989, entering into an
[nterlocal Agreement between the City and School Board, re: High School
referred to in proposed Ordinance 10, 1989, was pulled from the agenda and
will be considered by the City Council at their Regular Meeting of June
15, 1989, at 8:00 P.M, This will give the School Board, which has a
scheduled meeting for June 7, 1989, an opportunity to review and sign the
[nterlocal Agreement prior to City Council consideration.
RESOLUTION 29, 1989 Per a concensus of the City Council the Deputy City Clerk read, by title
only, Resolution 29, 1989, execution of a cortract, providing for the

ORDINANCES
ORDINANCE 5, 1989 Mayor Martino declared the Public Hearing open, which was duly advertised
513/89, and held on the intent of Ordinance 5, 1989, creation of "Golf
Estates Villas" Medium Density Residential PUD, proposed to consist of 14
townhouse units and be located on Lots 13 -16, Block 53, PGA National Golf
Club Estates Plat # 2, fronting on the west side of Military Trail, imme-
diately north of tri -plex located on the northwest corner of Holly Drive
and Military Trail.
At the request of the Petitioner, enabling him to continue negotiations
with Palm Beach County re: dedication of right -of -way on Military Trail,

the City Council unanimously approved postponing Ordinance 5, 1989, until
the City Council Regular Meeting of June 1, 1989, at approximately 8:00
P.M.
ORDINANCE 8, 1989 Mayor Martino declared the Public Hearing open, which was duly advertised
514/89, and held on the irtent of Ordinance 8, 1989, rezoning 1312.85
acres, including the site commonly known as "J.D.M. Country Club" located,
in general, between PGA 8 Northlake Boulevards and N. Military Trail 8 the
Turnpike, to Planned Community District (PCD).
There being no comments from the public, Mayor Martino declared the Public
Hearing closed.
Per a unanimous vote of the City Council the Deputy City Clerk read, by
title only, Ordinance 8, 1989. Ordinance 8, 1989, was adopted by the City
Council by a vote of 4 ayes and 1 nay. Councilman Kiselewski cast the nay
vote, stating he felt the project restricted and directed traffic to other
areas of the City which was not in the best interests of the residents.

ORDINANCE 10, 1989 Mr. "•_Suet n Hsrna.kd,:z, representing the School Board of Palm Beach
County, addressed the City Council outlining amendments to the site plan,
per requests of the City Council from previous meetings.
Mayor Martino declared the Public Hearing open, which was held on the
in•^nt of Ordinance 10, 1989, creation of a PUD, with those uses permitted
in the City's GU - Governmental Use zoning district. enabling development
of a High School (referred to as "Site GGG ") on a 60 -acre parcel located
on the south side of Donald Ross Road, between Military Trail and Central
Boulevard.
Mrs. Ester Zuretski of West Palm Beach, Mrs. Rosa Durando of Lake Worth.
Mrs. Jane Sheer of Palm Beach Gardens, and Mr. Carl Turwilliger of Lake
Worth, addressed the City Council expressing their opposition to Ordinance
10, 1989, based on environmental issues. Mr. Ted Mintell of Palm Beach
Gardens addressed the City Council, stating he supported this site and the
construction of a high school facility.
The City Council stated that the last sentence of Section 4. of Ordinance
10, 1989, should be inserted into the Interlocal Agreement instead of the
Ordinance.
At the request of the petitioner, the Council was polled re: Ordinance 10,
1989. Mayor Martino, Vice Mayor Aldred, Councilman Kiselewski and
Councilman Russo were in favor of rezoning the property to allow the
construction and operation of a high school facility. Councilwoman Monroe
stated she was not in favor of the rezoning, stating she felt the total
acreage for the wetlands should be left in place.
Per a unanimous vote of the City Council, the Public Hearing on Ordinance
10, 1989, was postponed to the City Council Regular Meeting of June 15,

1989, at 8:00 P.M., in order to give the petitioner time to have the
School Board review and sign the Interlocal Agreement before the City
Council considered approval of Ordinance 10, 1989.
ORDINANCE 13, 1989 Per a unanimous vote of the City Council the Deputy City Clerk read, by
title only, on first reading, Ordinance 13, 1989, modifying the Pension
Program for the City's General Employees.
The City Council will consider second reading and adoption of Ordinance
13, 1989, at their Regular Meeting of June 1, 1989.
ORDINANCE 14, 1989 Per a unanimous vote of the City Council the Deputy City Clerk read, by
title only, on first reading, Ordinance 111, 1989, amending Sub - paragraph
159.139 (E) (2) of Sub - Section 159.135 Planned Community Districts of
Section 159: Zoning Code of the City's Code of Ordinances, increasing the
amount of land developers are required to provide for public parks or
recreation.
The City Council will consider second reading and adoption of Ordinance
14, 1989, at their Regular Meeting of June 15, 1989.
ORDINANCE 15, 1989 Per a unanimous vote of the City Council the Deputy City Clerk read, by
title only, on first reading, Ordinance 15, 1989, amending Sub- paragraph
159.044 (A) Special Front Setback Requirements of chapter 159: Zoning Code
of the City's Code of Ordinances, providing for a 55' -wide green belt
along Donald Ross Road, Hood Road and Central Boulevard.
The City Council will consider second reading and adoption of Ordinance
I5, 1989, at their Regular Meeting of June 15, 1989.

cation to the City's Comprehensive Land Use Plan /Map for a 2.57 -acre

expansion on the west side of Prosperity Farms Road, south of RCA
Boulevard.
Mayor Martino declared the Public Hearing open, which was duly advertised
5/11/89, and held for the Local Planning Agency to consider a formal
recommendation to the City Council re: modification to the City's
Comprehensive Land Use Plan /Map adopted 11/21/85 by Ordinance 22, 1985,
providing for a change in the delineation of the City's boundaries by a
2.57 -acre expansion within Section 8- 42 -43, on the west side of Prosperity
Farms Road, approximately 700' south of RCA Boulevard. There being no
comments from the public, Mayor Martino declared the Public Hearing
Closed.

ORDINANCE 12, 1989 Per a unanimous vote of the City Council the Deputy City Clerk read, by
title only, on first reading, Ordinance 12, 1989, modification to the
City's Comprehensive Land Use Plan /Map adopted 11/21/85 by Ordinance 22,
1985, providing for a change in the delineation of the City's boundaries
by a 2.57 -acre expansion within Section 8- 42 -43, on the west side of
Prosperity Farms Road, approximately 700' south of RCA Boulevard.
The City Council will consider second reading and adoption of Ordinance
12, 1989, at their Regular Meeting of June 1; 1989.
ITEMS FOR DISCUSSION
ORDINANCE 30, 1989 The City Council briefly reviewed remaining Sections of Ordinance 30,
® 1988, rewrite of the City's Sign Code. Councilman Kiselewski has a
meeting scheduled for May 25, 1989, with the Chamber of Commerce and will

report to the City Council results of that meeting.
The City Council will consider second reading and adoption of Ordinance
30, 1988 at their Regular Meeting of June 1, 1989.
SAFE NEIGHBORHOOD
IMPROVEMENT
DISTRICT Attorney Steve Mathison addressed the City Council re: creation of Chapter
100A of City's Code of Ordinances, providing for "Safe Neighborhood
Improvement" District.
The City Council stated they will review the package, including the State
Statute, and discuss this proposal at their Workshop Meeting of May 25,
1989.
ADJOURNMENT There being no further business to discuss, the meeting was adjourned at
11:40 P.M.
