HomeMy WebLinkAboutMinutes Council 022389CITY COUNCIL WORKSHOP MEETING CITY OF PALM BEACH GARDENS FFBRUARY 23, 1989 The Workshop Meeting of the City Council of Palm Beach Gardens, Florida, was called to order by Mayor Feeney at 8:00 P.M. in the Assembly Room of the Municipal Complex, 10500 North Military frail, Palm Beach Gardens, Florida; and opened with the Pledge of Allegiance to the Flag. ROLL CALL The Deputy City Clerk called the roll and present were: Mayor Feeney, Vice Mayor Martino, Councilman Aldred, Councilwoman Monroe and Councilman Kiselewski. ANNOUNCEMENTS Mayor Feeney announced there would be a meeting of the City Council, sitting as the Local Planning Agency, We,-kshop Meeting, on Monday, February 27, 1989, at 7:30 P.M. Mayor Feeney further announced there would be a meeting of the Planning and Zoning Commission on Tuesday, February 28, 1989, at 7:30 P.M. PRESENTATION - FLORIDA RENEGAGES Mr. Ron Bushore of Bushore Shoemaker & Associates, Professional Sports Marketing, made a brief presentation to the City Council re: their support of a minor league football system, local team, Florida Renegades. The City Council had no objections to supporting a local team, and requested Mr. Bushore address the Recreation Advisory Board. ITEMS BY THE CITY MANAGER COUNTY TRAFFIC PERFORMANCE STANDARDS The City Manager reported on a meeting he had with Mr. George Webb, Assistant County Engineer, to coordinate the City's Traffic Performance Standards with the County's. Mr. Webb informed the City Manager that they have formed a committee to work on the Traffic Performance Standards and the northern county representative will be Gilbert Moore. The �nunty CITY COUNCIL WORKSHOP MEETING, 2/23/89 PAGE 2 COUNCILWOMAN MONROE Councilwoman Monroe reported attending a "Meet the Candidates Night" at the Meadows Mobile Home Park. At this meeting there were questions about the frequency of the PGA Bridge being open. Vice Mayor Martino stated the Chamber of Commerce was looking into this problem. MILITARY TRAIL The City Manager stated he has found out that Military Trail, which was once a stale road, is now under the jurisdiction of Palm Beach County. PALM BEACH COUNTY The City Manager stated he and the City Attorney will be meeting with the FIRE RESCUE Palm Beach County Fire Chief to settle any remaining problems re: annexa- tions so that the City can proceed without the threat of lawsuits. REPORTS COUNCILMAN KiSELEWSKI Councilman Kiselewski reported attending the Municipal League meeting yesterday in Boca Raton and stated he discussed the problem the City was having with banning train whistles. The Municipal League has agreed to discuss this with their members in attempt to have the problem solved. Councilman Kiselewksi stated that while at this meeting he found there are more municipalities that support the Solid Waste Authority's selection of Site I. Councilman Kislewski stated the new Director of the Planning Council was in attendance at the meeting and stated there is a division on the Council, and stated they are upset with the County not respecting their position on various programs. COUNCILWOMAN MONROE Councilwoman Monroe reported attending a "Meet the Candidates Night" at the Meadows Mobile Home Park. CITY COUNCIL WORKSHOP MEETING, 2/23/89 PAGE 3 ITEMS BY THE MAYOR & COUNCIL VICE MAYOR MARTINO Vice Mayor Martino reminded everyone of the Chamber of Commerce Festival of the Arts this Saturday and Sunday. In response to Vice Mayor Martino, it was the concensus of the City Council to meet with the Town of Jupiter City Council in an effort to coordinate sections of the Comprehensive Plan. The City Manager was directed to arrange this meeting. COUNCILMAN KISELEWSKI Councilman Kiselewski expressed his concern with the Countywide Planning Council overstepping their boundaries and passing policy decisions. The City Attorney was requested to research how the Countywide Planning Council issue was worded on the ballot and to determine exactly what authority they do have. COMMENTS FROM THE PUBLIC CHUCK CAMPBELL Mr. Chuck Campbell, member of the Recreation Advisory Board, informed the City Council that they had met with Resource Engineering and Planning and have scheduled an additional meeting this Tuesday. After that meeting they will report back to the City Council. ORDINANCES ORDINANCE 30,1988 Councilman Kiselewski explained the recommendations from the Planning arc Zoning Commission and what amendments should be made to the Sign Code because of those recommendations. Jack White, member of the Site Plan and Appearance Review Committee addressed the City Council with several con - is terns he had with the rewrite of the Sign Code. The City Council requested several amendments and additional paragraphs be written re: spe- CITY COUNCIL WORKSHOP MEETING, 2/23/89 PAGE 4 ciai events and PUDs. The City Attorney was requested to make these revi- sions to the proposed Sign Code. The City Council will ccnsider second reading and adoption of Ordinance 30, 1968, at their Regular Meeting of March 2, 1989. ITEMS FOR DISCUSSION MOONLIGHT CAFE Mr. Alan Andrzejewski addressed the City Council re: (1) amending the 32.25 -acre "Gardens East Plaza" (now commonly known as "The Promenade ") PUD created 6/18/87 via Resolution 44, 1987, providing for the sale /service of beer and wine, for on- premise consumption at "Moonlight Cafe ", located at 9920 Alternate A -i-A, Suite H -1; and (2) a variance to the distance requirement of 750' between alcoholic beverage vendors, pro- viding for the sale /service of beer and wine, for on- premise consumption, at the same location. The City Council had no objections to this request and will consider approval at their Regular Meeting of (larch 2, 1989. NORTHRIDGE Mr. Robert A. Bentz addressed the City Council re: application made pur- suant to Section 7 of Ordinance 18, 1987, (which created 12/3/87 the "Northridge" single family PUD (now -known as "Gardens Hunt Club ") on 44.247 acres located 1/4 mile north of Northiake Boulevard, immediately east of Gibson Road. It was the concensus of the City Council that once the Sign Code has been adopted by the City Council, with the revisions requested, this project come back before the Council for their con- sideration. GOLF ESTATES VILLAS Mr. Len Kirschke addressed the City Council re: creation of "Golf Estates Villas" Medium Density Residential PUD, proposed to consist of 14 townhouse units and be located on Lots 13 -16, Block 53, PGA National Golf CITY COUNCIL WORKSHOP MEETING, 2/23/89 PAGE 5 Club Estates Plat #2, fronting on west side of Military Trail, immediately north of Tri -plex located on the northwest corner of Holly Drive and Military Trail. It was the concensus of the City Council that the swimming pool be removed from the plan and that Mr. Kirschke see what could be done about the angle of the one building on the site. The City Attorney was directed to prepare an Ordinance for the City Council's con- sideration of first reading. REZONING- J.D.M. COUNTRY CLUB Mr. Hank Skokowski of Urban Des.gn Studio addressed the City Council re: rezoning 1311.51 acres, including site commonly known as "J.D.M. Country Club" located, in general between PGA & Northlake Boulevards and N. Military Trail & the Turnpike, from present City zoning classifications of RS -2 (Residential Single Family District) and PDA (Planned Development Area) and Palm Beach County's zoning classifications of AR (Agricultural District) (Comparable to the City's zoning designation of AG) and RM (Residential Multiple Family, Medium Density District) (Comparable to City's zoning designation of P.M) to City's zoning classification of PCD (Planned Community District). Mr. Skokowskl stated there were 48 conditions of approval by the Planning and Zoning Commission, and wanted to discuss 4 of those conditions. Condition 2 states that parcels designated as low density shall be limited to single - family detached housing. Mr. Skokowski requested this condition be modified slightly to specifically designate parcels 8, 9, 10, 25A, and 25B, stating that these low- density parcels shall be single - family ® detached housing. Other low density parcels, such as # 13 may be brought before the City Council as an attached product such as a cluster arrange- CITY COUNCIL WORKSHOP MEETING, 2/23/89 ment. PAGE 6 Condition 3 states residential development shall be limited to a maximum of 2 stories, other development to a maximum of 3 stories. Mr. Skokowski requested this condition be amended, so that parcels 8, 9, 10 and 25A would have that limitation and all other parcels would have the oppor- tunity to be presented as a 3 -story possibility. Mr. Skokowski requested Condition 29 stop in the middle, stating that the applicant needs to verify the adequacy of the Merrill ditch to serve as one of the two positive outfalls for the PCD. Mr. Howard Searcy discussed how the rest of condition 29 relates to an improvement which really did not relate to the development proposal. The City Manager stated he has listened to the applicants concerns, however, he would like to leave con- dition 29 in place until all information is available. Condition 40 states that five years after approval of the PCD, the City of Palm Beach Gardens, at the developer's expense, shall review the transpor- tation system outlined in the original traffic study. If intersections and links affected by the project are not operating at least as well as stated, the developer may pay its recalculated share of needed improve- ments to continue construction or delay furthr construction until needed improvements are in place to handle the projected trips. Mr. Skokowski requested that this ccndition be deleted, pointing out that the Planning and Zoning Commission recommended it be deleted. Mr. Skokowski stated that it is not necessary in this case because of the threshold formulas that exist as part of this approval. Other conditions here specifically ® limit the development of the project relative to roadway improvements that must take place on PGA Boulevard, Military Trail and Northlake °lulevard. CITY COUNCIL WORKSHOP MEETING, 2/23/89 PACE 7 There are specific dwelling unit phasing limitations that limit the deve- lopment to a certain point and would not allowed continued development until certain roadway improvements take place. Mr. Skokowski further stated condition 40 should be deleted because this is not a large scale commercial enterprise. Mr. Skokowski stated he would feel more comfor- table Leith wording that allowed for revisita--ion of this si.e in five years to determine what impacts this particular development has on road- ways so that the developer is not responsible for traffic problems caused by other developments that may be approved by the City and /or County in the next five years. The City Council stated they would take this request under consideration. While not ready to move to first reading, the City Council requested the City Attorney prepare a draft ordinance for their review.
