HomeMy WebLinkAboutMinutes P&Z 080189• fJ � Y CITY OF PALM BEACH GARDENS PLANNING AND ZONING COMMISSION AUGUST 1, 1989 SPECIAL MEETING The Special Meeting of the City of Palm Beach Gardens, Florida was called to order by Chairman Don Vogel, at 7:30 P.M. in the Auditorium at the Community Center, 4404 Burns Road, Palm Beach Gardens, Florida, and opened with the Pledge of Allegiance to the Flag. The roll was called by the secretary, and present were: Don Vogel, Chairman; Robert Hamner, Mike Rosen, Jeffrey Ornstein, Members; Domenick Lioce, Alternate Member. VI. PUBLIC HEARING: Z -89 -05 - Recommendation to City Council re: (Lake Catherine) Rezoning of 75.13 -acre parcel north of Northlake Blvd. on the east and west sides of MacArthur Blvd. from PDA and RH to PUD with uses designated in RM • and RS -2 for construction of 298 residential units. (18- 42S -43E) (Adv. 7- 10 -89) (Recessed from 7 -25 -89 Meet- ing) a Mr. Rich Walton, Planning and Zoning Director, addressed the Commission stating this meeting is being held to discuss a rezon- ing application by a petitioner who represents a land owner for a development. The Planning Staff has reviewed the application in accordance with the City's Codes and Ordinances, and the City's Comprehensive Plan. The discussion should be limited to discus- sions about the plan and application only, and any other issues should be saved for another forum. Mr. Walton continued, giving history of the site, and a discussion of the staff report, dated July 28, 1989, presented to the Planning and Zoning Commission prior to the meeting. 1 • W, - Mr. Ray Royce, attorney for the applicant, addressed the Commis- sion with a presentation of the site plans and the development proposal. The Commission presented several questions and concerns to the applicant regarding the following issues: - Traffic concerns on both MacArthur Blvd. and Silverthorne Road resulting from this proposed develop- ment. Mr. Steve Godfrey, Traffic Consultant for the applicant, addressed traffic concerns. - Size of lots and setback amounts - How will residents of the zero lot line homes be able to install pools on their property in the future? The applicant responded it will be possible, and it has been done before. - Elevations - single - family units are identical (refer- encing the uniformity of the Bluffs) - Has there or will there be an ecological study done? The applicant was not aware of a study done or if there will be one done. Concern over the impact the construction will have on the Lake (construction debris, etc.) - Will the proposed ballfields include all improvements, and will there be more details available? The appli- cant responded all improvements were included and they will provide more details. - The median strip on MacArthur Blvd. will be improved with landscaping. - The density of the existing homes surrounding the site compared to the density of the proposed development - Repositioning of the proposed recreation center to provide more open space - Spacing of interior street lights. Mr. Don Hearing, architect for the applicant, stated the street lights will be spaced approx. 200 ft. on center within the parking tracts, for the multi - family area, and equally spaced on an alternating repetition along the local streets. 2 • - Clean -up of waterway on northwest corner of property Impact on schools - Effect of run -off from storm water on the lake. Mr. Philip Vogelsang, engineer for the applicant, stated the run -off will be directed to a different lake than Lake Catherine. This lake will be isolated from Lake Catherine by a control structure. Mr. Len Lindahl, Engineering Consultant for the City of Palm Beach Gardens, stated he is in agreement with Mr. Vogelsang's statement. Buffer on west side of property Mr. Kahart Pinder, Traffic Consultant for the City, stated the traffic impacts for this project are well within the standards of the City's Traffic Performance Standards Ordinance. This project does not have a significant impact on MacArthur Blvd., Northlake Blvd. or Silverthorne Rd. Mr. Pinder is in the process of doing a comprehensive study on the traffic impact of the proposed projects currently before the Planning and zoning Commission and the City Council. Mr. Doug Hood, Director of Parks and Recreation, stated the Recreation Advisory Board is in favor of the acquisition of parks and ballfields resulting from this proposed project. Mr. August Hernandez, Government Liaison for the School Board of Palm Beach County, addressed the Commission stating the School Board is unable to support the Lake Catherine PUD at this time because information relative to vehicular traffic movements, pedestrian sidewalks and crossings has not been made available to the School Board for review and comment. Walter Cudricker, 370 Lighthouse Dr. - Impact on schools (Grove Park Elementary and Palm Beach Gardens High School are already overcrowded) - Safety of students walking and biking to school due to lack of adequate sidewalk - Traffic congestion at intersections of Lighthouse Dr. and MacArthur Blvd., A -1 -A and Lighthouse Dr., and Holly Drive and Lighthouse, compounded by the safety of children and the train crossing at Lighthouse Dr. - Traffic from Promenade Shopping Plaza on Lighthouse Dr., and traffic from Costco on MacArthur Blvd. - Road Impact Fees - The Traffic Standards now in affect may change when the City's Comprehensive Plan comes back from DCA. 4 • • - The projected needs and estimated increase of Fire and Police protection as a result of this proposed devel- opment. - The impact on the sewer and water management program and already threatening water shortages - Sidewalks 8 - 12 ft. wide for bikes and pedestrians - Safety of bicyclists and pedestrians on bottleneck bridge on MacArthur Blvd. - Threat to the Lake Catherine ecosystem - Incidental and accidental pollution from pesticides and fertilizer run -off into the lake - Limited access to the lake - Limited open space for non - organized recreation - Overcrowded organized recreation program - Lack of sidewalk on Riverside Drive - Problems on 91st St. resulting from construction - Drainage from retail stores on 91st St. going into Lake Catherine - Lake Catherine is the only lake in the area, this property is the only open space in the area - Sufficient time for residents to vote through a referendum to buy the land with a bond issue - Traditional and cultural value of Lake Catherine - Flooding in Suncourt - Where traffic will go traveling to the north (e.g., Riverside Dr., Garden Blvd.) Chairman Vogel directed the secretary to read and enter into the public record a letter from Mr. Burt Reynolds objecting to the proposed development. Mr. Royce addressed the Commission, answering some of the ques- tions posed by the public. He stated Palm Beach County will,be improving the area over by Silverthorne Road and Sunrise Road. 5 C • 0 In response to the concern over lake pollution, Mr. Royce stated the lake will not be filled or polluted, and there are severe penalties from state agencies for those who pollute the lake. The Commission expressed concern over the possible existence of gopher tortoises on site, and referencing a paragraph in the City's Code, required a study be done. The Commission also requested the plans be revised to reflect varying colors and elevations. Mr. Jeff Ornstein made a motion to recommend approval to City Council for Lake Catherine with the following conditions: 1. The applicant will provide a fully- constructed 10.79 acre park site to the City in a turn -key operation, as designated by the City Administration. 2. The park site described above, will have one main entrance with a south -bound left turn lane on MacArthur Boulevard in the location shown as the middle entrance on the master plan dated July 26, 1989. The existing median opening at the southernmost entrance shall be closed to move conflicts further from Northlake Boulevard. 3. A left -turn lane shall be provided at the project entrance on MacArthur Boulevard. 4. Two (2) outbound lanes shall be provided at the project exit on MacArthur Boulevard. 5. At the Silverthorn Road entrance, one ingress and one egress lane shall be provided. 6. Additional right -of -way shall be provided where needed along the entire length of Silverthorn Road where it abuts this project. 7. The 5 -acre site along the lake will remain in its natural state. No change from current use. 8. The extension of the two -lane configuration northbound on MacArthur Boulevard (north of Northlake Boulevard) and discussed on page 13 of the traffic analysis of June 1989 by Kimley -Horn, shall be provided by the applicant prior to issuance of any building permits for the project. N • 9. A 6 -foot minimum pedestrian way shall be provided around the entire lake within the multi - family (four - plex) development. 10. A berm shall be installed without a fence along both sides of MacArthur Boulevard on the lands described as part of this application. 11. The applicant will be required to dedicate an additional 20' to the existing right -of -way of Silverthorn Road unless the City is supplied a written waiver from the County as to any additional need for this right -of -way. 12. The applicant be required to dedicate to Palm Beach County sufficient land for a drainage ditch so as to continue to serve as an_outfall for the existing development west of this project. 13. The applicant be required to honor the intent of an existing drainage easement that conveys storm water from Northlake Boulevard to the Earman River by pro- viding conveyance of this stormwater by way of the project's storm drainage /water management system. • 14. The developer shall relocate twelve (12) Sabel Palms and four (4) Live Oaks from on -site, not shown to be protected, to one or the other dedicated.City lands (location to be determined by Doug Hood, Director of Parks and Recreation). 15. All Oak Trees not saved and the protected Oaks (ones to be preserved) that are killed due to the construc- tion or relocation efforts, be replaced on -site using the following contingency: a. Three (3) inches of new tree caliper will be replaced for every one inch caliper lost. b. Each new tree shall have a minimum of three -inch caliper at D.B.H. (i.e. four feet above ground) 16. The City of Palm Beach Gardens will help the developer clean up the canal located near the most western boundary of the site, if it is requested within three (3) years of this final approval. 17. There shall be a tree preservation and tree protection clause in the property owner's association documents.' • 18. The sidewalk along the one side of the road in the single- family area shall be 5' as it is in the multi- family area. 7 • 0 19. The sidewalk along the one side of the main roadway into the project shall be 61. 20. A 6' sidewalk shall be included on the east side of MacArthur Boulevard through the 10.79 -acre tract. 21. Between the time of this recommendation of approval of this meeting and the Cityy Council Workshop, the developer is required tb provide to the City an ecological study of the flora and fauna of this property. 22. The City Council take no action on this project until sufficient time to allow the citizens to have a bond issued or make their feelings known to the City Coun- cil. 23. The exterior rear elevations of the single- family units will not be the same from one unit to the next nor will the colors be the same. Mr. Mike Rosen seconded the motion. Mr. Domenick Lioce made an amendment to the motion stating all 3 recreational areas in this project will be dedicated to the Public and the median strip along MacArthur Boulevard be landscaped. Mr. Ornstein seconded the amendment to the motion. The amended motion was unanimously approved (5 -0). ADJOURNMENT There being no further business to discuss, the meeting was adjourned at 11:15 P.M.
