Florida; ana opened with the Pledge of Allegiance to the Flag. ROLL CALL: The Deputy City Clerk called the r(,11 and present were: Mayor Feeney, Vice Mayor Martino, Councilman Aldred, Councilwoman Wnroe and Councilman Kiselewskl. ANNOUNCEMENTS Mayor Feeney announced there wou'j be a meeting of the Planning and Zoning Commission on Tuesday, January 12, 1988, at 7:30 P.M.; and a meeting of the Palm Beach Gardens Fire Department, Inc. on Tuesday, January 12, 1988, at 7:30 P.M. i EMS 8Y THE C17Y MANAGER COMPREHENSIVE 1-AND USA PLAN1WF' UPDATE_ The City Co ,rrr1 i directed the City Manager to set up c meeting at the Sheraton in PGA National to discuss the Comprehensive Land UsP Plan Undate wfth Public Participation. BOUL EVAR0 AND RYDER CUP BOULEVARD The City Council authorized the City Manager to approve the opening of to'? entrance /exit of Ryder Cup Boulevard at PGA Boulevard once he has received the approval from the City Engineer. PL44B AND ASSC)CIATES The City Council unanimously authorized the Mayor to execute an agreement with Palm Beach County, with a limit of $5,000.00, for the study of an aiternative to Park Avenue extension, The money woulo be taken from the Council Continqency Account. CITY COLNCIL REGULAR WETING, 117188 PAGE 2 ENGINEERING �RVICES RE: COAST UTILITIES The City Council unanimously authorized the Mayor to sign an agreement and the City Manager to expend up to $15,000 from the Council Contingency Account for the purpose of engineering services for preparation of a study re: possible acquisition of Seacoast Utilities. The total cost will be shared by the Northern Palm Beach County water Control District, the Village of North Palm Beach and the City of Lake °ark ATTORNEY FEES The City Council unanimously authorized the City Manager to expend monies, at the rate of $90 1hour, to employ the services of an attorney to cover the defense of police personnel in a pending law suit against the City. MEETING WITH PALM BEACH COLNVTY COMMISSIONERS The City Manager referenced a letter received from Bill Bowden of Palm Beach County re: joint meeting with the P,-in 3each County Commissioners. The City Council will workshop this item to determine a date and a list of priorities to be discussed. REPORTS COL#VCILWOMAN MONROE Councilwoman Monroe reported attending a meeting of the Site Plan and Appearance Review Committee meeting, stating the minutes are on file with the City Clerk's office for review. VICE MAYOR MARTINO Councilman Martino reminded the Council and residents that the Board of County Commissioners through the Department of Airports, in conjunction with the cicizen's committee that was formed to peruse the North County General Aviation Airport information, will hold a general information /public hearing on January 12 and 13, 1988. The January 12, 1988 meeting will be held at the City's Community Center and on the 13th ® it will be held aL the Palm Beach Gardens High School Auditorium. Councilman Kiselewski requested at least one member of the City Council attend the Annual Congress. Councilman Kiselewski stated this is a coun- terpart meeting of the the one he attended in Las Vegas. Mr. Sam Carsillo, resident of Palm Beach Gardens, addressed the City Council expressing his concerns, including the heliport at the hospital, quality of water. annexations, and a City library. Mr. P. J. Clare, Edgemere Terrace, Palm Beach Gardens, addressed the City Council, stating he felt the City was in need of a canine unit for the Police Department. The City Manager was directed by the City Council to have the Police Chief look into the City's need for a canine unit. Thf, City Manager stated this Resolution would better describe the City's boundaries, per the study done by Resource Engineering and Planning, Inc. The City Council directed the City Clerk to add a paragraph after the third "WHEREAS" to read the same as the third paragraph, however, would include the general description for the "Woodberry" annexation. The City Council requested the City Clerk amend the third paragraph on Page 2 to change "A -1 -A Highway" to State Road 811; and as "in such study" after the word contemplated. CITY CLERK REGULAR MEETING, 117188 PAGE 4 The City Council also requested the City Clerk to amend the title of Resolution 1, 1988. Pui a concensus of the City Council, Mayor Feeney read, in full, Resolution 1, 1988. Resolution 1, 1988, as amended, was unanimously adopted by the City Council. ORDINANCES ORDINANCE 1� 1288 Mayor Feeney stated Ordinance 1, 1988, provided for "Involuntary" anneya- tion ,f (1) 19.5866- acre "Cinnamon Plat No 111, (21k1a "Woodberry Lakes" and "The Gardens of Woodberry "), as recorded 12115178 in Plat Book 36, °ages 56 -59, and (2) 17.7004 -acre "Cinnamon Plat No. 2" (alkla "Woodberry Lakes" and "the Gardens of Woodberry "), as recorded 817180 in Plat Book 40, Pages 66 -70, together consisting of 240 lots fof which 218 have been developed with attached residential units); and simultaneously zoning same PM- Medium Density Residential District, per the petition of Mr. Woodie Van Voorhees, President of "Woodberry Lakes Homeowners Association, Inc." and authorized agent of 50 +% or the property owners; and providing for a Referendum Election in the City and within said areas pr0005ed to be annexed. Mayor Feeney declared the Courtesy Public Hearing open. Mr. Van Voorhees, President of the Homeowners Association of Woodberry Lakes, addressed the City Council outlining why the residents of Woodberry want to become a part of the City. Mr. Van Voorhees, stated at their public hearing they 240 families, with only one person objecting to the annexation- 40 CITY COUVCIL REGULAR METING, 117168 PAGE 5 There being no further comments from the public, Mayor Feeney declared the r'a!rtesy Public 'nk closed. The Council requested the wording on the referendum ballot be adjusted in such a way as to identify tt-e area involved. Per a unanimous vote of the City Council the Deputy City Clerk read, on first reading, Ordinance 1, 1988. Mayor Feeney announced this was a Courtesy Public Hearing and consideration of 1st ,Reading. Mayor Feeney announced notices were sent to perperty owners on December 16, and 17, 1987. Mayor Feeney declared the Courtesy Public Hearing open. E CITY COUNCIL REGULAR hC'ETING, 117188 PAGE 6 Mr. Sam Shannon of Palm Beach County, addressed the City CouriciI, pro- 40 viding them with a letter from Mr. Jan Winters, County Administrator. Mr. S,,aanon stuffed at this time he will be addressing Ordinance 2 and 3, 1988. Mr. Shannon stated the County promotes annexation that promotes efficiency and clarity of service delivery. The County desired mutual consideration of on- existing programs ,or services and facilities. After meeting with t a Pity r,fanagar and Mayor Feeney, Mr. Winters recommended to the Board of County Commissioners that the County continue efforts with the City to reach mutual agreement on some of the concerns that vere raised. Mr. Shannon suggested several alternatives for fire protection in the "north annexation" area, particularly the County fire station located near Cabana Colony. Mr. Herman Brice, Palm w °Bch County Fire Administrator, stated the station located near Cabana Colony, Station # 16, would loose 80% of their calls with the proposed annexation. Mr. Brice suggested either a contract with the City for expansion of services or a gradual phase out of Station # 16 so that the economic impact would not be so immediate. Mr. Shannon stated the county was concerned with the impact on County roads with future development in these annexation areas. Mr. Shannon suggested the City adopt a Traffic Performance Standard much like the one existing in the County and to also collect and provide the Coun r. road impact fees so they can include it in their Five Year Road Program and build the roads that are necessary in the area. Mr. Shannon further requested the City agree not to increase intensity or density beyond wnicn is currently provided for in the County Comprehensive Plan without receiving concurrence from the County. Mr. Shannon requested the City aqree to assist the County in implementing its Thoroughfare Protection CITY COUVCIL RFGULAR WETING, 117188 PACs 7 Ms. Janice Jennings, Assistant City Attorney for Riviera Beach, addressed the City Council stating the City of Palm Beach G.:rdens seeks to encroach on the City of Riviera Beach's "heretofore agreed upon reserve annexation 1,11 to rnpinrilmAn K,isplewski, Ms. Jennings stated there was no prZor written agreement with the City of nlviera Beach. Several residents of Horseshoe Acres addressed the City Council stating they support the City's annexation efforts and would like to be annexed into the City of Palm Beach Gardens in the future. Pastor William Leach, Grace Alliance Church, stated he supports the annexation procedure and would like to be considered for annexation into the City. E Right -of -Way Map. Mr. Brandenberg, Pa]m Beach County Attorney's Office, addressed the City Council pointing out the legal concerns of the County. Mr. Brandenberg pointed out various "enclaves" and "pockets" that the County felt existed in the proposed annexations. Mr. Brandenberg stated one of the County's concerns is that if the election goes forward with all these difficulties, and is not passed, under Florida Statutes the City would be prohibited from annexing these areas under another referendum for another two year period of time. The City Council directed the City Manager have staff respond to items presented by Palm Beach Countv, then schedule a Special Workshop Meeting of the City Council Palm Beach County and surrounding municipalities. Councilman Aldred requested the City Manager request the City of Riviera Beach to indicate what part of this annexation they perceive as a problem. Per a unanimous vote of the City Council the Deputy City Clerk read, by title only, on first and second reading, Ordinance 2, 1988. The Council will consider second reading and adoption of Ordinance 2, 1988, at their Regular Meeting of February 4, 1988. Mayor Feeney stated the City Council has received a letter and a companion resolution from the 7own of Jupiter stating their concerns with the annexation of "Frenchmen's Creek" north. Mr. Griff Roberts, Town Manager of Jupiter, addressed the City Council stating they were concerned with areas north of Donald Ross Road being into the City of Palm Beach Gardens. City Manager John Orr explained there was no way to separate t-)e "Frenchmen's Creek" annexation since :t was a DRI and the residents of that area did not wish to divide their subdivision,, nor did they wish to be - nnexed into the Town of Jupiter. The City Council assured Mr. Roberts that the City was not Interested in any additional lands north of Donald Ross Road, however, could not leave the north part of the "Frenchmen's Creek" subdivision out of the annexation since the developer does not wish to divide the lands. ® The City Council stated they were willing to meet with the Town Council of Jupiter to discuss future annexation, however, felt it was crucial to the City of Palm Beach Gardens to annex all of the Frenchmen's _'reek sub- division. Ms. Gail Nelson, City Clerk of Junn Beach, addressed the City Council with acnexatl.on plans for property east of the Intracoastal Waterway. The City Council agreed that properties east of the intracoastil Watp,s,, -hot -ld not be annexed by the City of Palm Beach Gardens, and instructed the City Manager to delete this area from the legal description of the properties i:o be annexed. Mayor Feeney declared the Public Nearing closed. the Council requested the wording on the referendum ballot be adjusted in such -a way as to identify the area involved. ITEMS FOR DISCUSSION CHAP rER 151 OF TITLE 15 The City Manager stated he has been updating Chapter 151 of Title 15 of the City's Code of Ordinances, providing for Fair Share Contributions for ADJOURNMENT APPROVAL 0 Road Improvements. The City Manager stated some of the fees will be Increased one and a half times what they are presently. The City Council requested the City Manager Place this item on the next Regular Meeting agenda. There being no further business to discuss, the meeting adjourned at 11:34 P.M.
