ROLL CALL: The G'icy Clerk called the roll and present were: Mayor Feeney, Vier- Mayor Martino, Co incilman Rldred, ana Councilwoman Monroe. Councilman Kiselewski was not in attendance as he was out of town. ANNOUNCEMENTS Mayor Feeney announced there would be a Special Referendum Election on Tuesday, March 8, 1988, from 7:00 a.m. - 7r00 p.m.; a meeting of the Planning and Zoning Commission on Tuesday, March 8, 1988, at 7:30 p.m.; and a meeting of the Palm Beach Gardens Fire Department, Ir,c., on Tuesday. March 8, 1988, at 7:30 p.m. PROCLAMATION'S -1aycr Feeney read a proclamation proclaiming March 30, 1988, as "Doctor's Day 11. ITEMS BY THE CITY MANACE.R GYMNASIUM FLOOR The City Manager recommended awarding the bid received 2118188 for resur- facing of poured urethane flooring of gymnasium at City's Community Activities Building to Martin Resurfacing, IRe. The City Manager stated Martin Resurfacing's bid was for $19,999, however, tney did not deduct the 5% service tax, which would make their bid $19,524. Per a unanimous vote of the ;ity Co,tncii the bid was awarded to Martin Resurfacing, Inc. in the amount of .x19,524 to be taxen from Account 4 14- 46.50. CITY COLNCIL- REGULAR A£ETING, 313188 PAGE 2 LAWSUITS The City Manager stated the City has received a 5th lawsuit, and Attorney Kan Spillias' firm has a conflict of interest in being an auxilliary coup - suel. The City N '»gr °` scat Tended and the City Council �.-'Lenimously approved appointing the law firm of Scott, Royce, Harris & Bryan as auxilliary counsel. REPORTS VICE MAYOR MAR71NO Vice mayor M: =rtrno reported attending a meeting last night of the Loxahatchee Council of uovernments. The Loxahatchee Council of Governments was to accept a report from a Growth Management Committee set up by the CQG group, dealing with the intracoastal bridge crossings. Vice Mayor Martino stated there were residents in attendance who voiced their concerns re: needed crossings to move traffic east and west. The public hearing on this item is schedi,Ied for April 4, 1988, with a CA UNCILMAN workshop on March 2I, 1988. ALDRED Councilman Aldred stated the Cour;ty has purchased the 20 acres by the Courthouse, and questioned whether they had to comply with the Traffic Performance Standards. It was felt that government was exempt from the Standards. MAYOR FEENEY Mayor Feeney met with County Administrator Jan Winters this morning to discuss the possibility of a lawsuit re: Traffic Performance Standards. It was the concensus of the City Council that Councilman Aldred will rewrite the Traffic Performance Standards. Mayor Feeney suoAPsted that Mr. Winters contact the City Manager to discuss the Tnterlocal Agreement. COUNCILWOMAN MONROE Per the request of Councilwoman Monroe, Attorney Brant explained the accu- sations of the County in their lawsuits against the Ciiy of Palm Beach Aft CITY COLNCIL REGULAR WETING, 313188 PAGE 3 Gardens. Attorney Brant felt the City had a 65 -70% chance of winning against the County and a 76% chance of winning against the lawsuit with Riviera Beach. ITEMS BY THE MAYOR AND CITY COUs CIL VICE MAYOR MARTINO _ Vice Mayor Marti ^e st?reo Lhe CIcy needs to move into the preparation stage of putting together a Traffic Performance Standard Ordinance for the City and suggested the Mayor appoint a committee to accomplish this. Vice Mayor Martino suggested the committee consist of the City Engineer, reore- sentative from Kimley Horne, David Plummer, Mr. Basehart of Urban Design Studio, a representative from Palm Beach County, a representative from the Forum Group and a member of the City Council. It was the concensus of the City Council that this be placed on the March 10, 1988 agenda under "Items for Discussion ". Cr1M+tENTS FROM THE PUBLIC FOR ITEMS NOT ON AGENDA SAM CARSILLO Mr. Sam Carsillo, resident of Palm Beach Gardens, addressed the City Cauncia voicing his concerns re: PGA Bridge, trains whistles and rest areas on I -95. Per a unanimous vote of the City Council. the City Manager wa-- instructed to write a Tetter to the County stating the City chooses to be under the County's rrain Whistle Ordinance, banning train whistles from 10:00p.m. to 6:OOa.m. Mr, Carsillo also questioned whether the Landscape Committee of Adjustments had been abolished. The City Manager stated the Coae Enforcement Board has taken this jurisdiction. Resolution 9, 1988, was unanimously approved by the City Council. RESOLUTION 17,1988 mr. vincent Pappalorde stated he has incorporated the thoughts of the City Council from the workshop meeting and incorporated them into his plans, as well as delivered a copy of the plans to the City Attorney. Per the concensus of the City Council the City Clerk read, by title only, Resolution 17, 1988, approving a temporary project sign for "Admiralty II" commercial PUD created 12117187 by Ordinance 15, 1987, on the souto site of PGA Boulevard, between Interstate -95 and the existing "Admiralty" pro- fessional office building. Resolution 17, 1988, was unanimously approved by the City Council. RESOLUTION 19,1988 The City Council requested the City Clerk amend Subparagraph I of Chapter ),vIr of the Merit System Rules and Reopllations to read "individual poli- cies" instead of "single policies". Per the concensus of the City Council the City Clerk read, by title only, Resolution 19, 1988, modifying the City's Merit '�Ilstem Rules & Regulations, per recommendations of the City's Merit System Board at their urPetings of 6116187 and 12115187. Resolution 19, 1988, was unanimously approved by the City Council. Per a unanimous vote of the City Council the City Clerk read, by title only, on second and final reading, Ordinance, G, 1988. Per a unanimous vote of the City Council the City Clerk read, by title only, on second and final reading, Ordinance 7, 1988. Ordinance 7, 1988, was unanimously adopted by the City Council.
