SPECIAL REGULAR WETING
CITY OF PALM EEACH GARDENS
FEBRUARY 25, 1988
The Special Regular Meeting of the City Council of Palm Beach Gardens,
Florida, was called cc order by Mayor Feeney at 8:00 P,M. in tha Assemblv
Room at the Municipal Complex, 10500 North Military Trail, Ralm °each
Gardens, Florioa; and open, -d with the Pledge of Allegiance to the Flag.
ROLL CALL: The City Clerk called the roll and oresent were: Mayor Feeney.
Vice Mayor Martino, Councilman Aldred, and Councilwoman Monroe. Councilman
Kiselewski was not in attendance as he was out of town.
ORDINANCES:
ORDINANCE 12, 1988 Mayor Feeney stated Ordinance 12, 1988, was to be read and voted on by the
City Council tonight on an rxnergency basis. Ordinance 12, 1983, repeals
Ordina ^ca 3. 1988, adopted February 4, 1988, which provided for (1)
"Involuntary" annexation into the City of approximately 6,195 acres of
land located north of PGA Boulevard; and (2) Special Referendum Elections
in the City and within said areas pro,nnsad to be annexed. The City
Manager stated this was necessary since Foundation Land Company, the major
Property owner in the north annexation area, withdrew its consent for
annexation. The City Monaner apolooized to the residents of Frenchman's
Creek for not being able to vote on wl;et,tie they would like ti- be n the
Ctty or in the County. The City Manager further stated that the City nas
received a "voluntary" annexation application from Fo+,uria Land for the
same orcparty, excluding Frenchman's Creek.
Mayor Feeney announced the City Council was in receiot of a letter from
(,rif'f Roberts, City Managor of Jupiter, and an attached Nesolution sfalino

on the northern annexation and, hopefully, come to an agreement on an
aIntetlocal Agreement wnich expressed the Donald Ross Road as the boundary
between the two communities, that Jupiter wfll pease and desist in their
current suit against Palm Beach Gardens.
Mayor Feeney declared the Public Hearing open. There being no a;mments
from the public, Mayor Feeney declared the Public Hearir, clusec'.
It was the concensus of the City Council to write a letter to Foundation
Land Company requesting they repay the City for costs involved with adver-
tising Ordinance 3, 1988.
Per a unanimous vote of the City Council the Deputv City Clerk read, by
title only, on first reading on an emergency basis, Ordinance 12, 1988,
repealing Ordinance 3, 1988.
Per a unanimous vote of the Criy Council the Deputy City Clerk read, by
title only, on second ano final reading on an emergency basis, Ordinance
12, 1988.
Ordinance 12, 1988, was unanimously adopted by the City Council.
ORDINANCE 11, 1988 Mayor Feeney stated Ordinance 11, 1988, creating "Chapter 1, ;0. Mcdel
7raffic Performance Standard Code" of the City's Code of Ordinances, was
the County's Traffic Performance Standard, to be passed on an emergency
basis until such time as the City could write one of it's own.
Mayor Feeney declared the Public Nearing open.
Mr. Eugene Bie addressed the City Council stating he was concerned with
this Ordinance, feeling it could provide the means for a moratorium on
development.
There being no further comments from the public, Mayoi Feeney oeclared b-_-
Public Hearing closed.

emergency to read and adopt Ordinance 11, 1988. It was the cuncensus of
the City Council that circumstances re: proposed annexations have vastly

time to consider a Traffic Perfcrman,a Standard for the City.
Councilwoman Monroe cast the nay vote, feeling that the City needed to
adopt Ordinance 11, 1988, as agreed at an earlier meeting with Palm Beach
The City Council stated they received tonight a copy of an Interlocal
Agreement from the County, however, they have not had an ooportuolty to
review this document. It was determined th -t the representative from Palm
Beach County would be meeting with the City Manager tomorrow and the City
Council agreed to a Special Meeting on Monday, February 28, 1988, at 8:00
P.M. to discuss the Interlocal Agreement with Palm Beach County.
There being no further business to discuss, the meeting was adjourned at
8:53 p.m.
