PLANNING AND ZONING COMMISSION
• DECEMBER 27, 1988
REGULAR MEETING
The Regular Meeting of the Planning and Zoning Commission of the
City of Palm Beach Gardens, Florida, was called to order by
Chairman Don Vogel, at 7:30 P.M. in the Assembly Room at the
Municipal Complex, 10500 North Military Trail, Palm Beach
Gardens, Florida, and opened with the Pledge of Allegiance to the
Flag.
The roll was called by the secretary, and present were: Don
Vogel, Chairman, Mike Rosen, Jeffrey Ornstein, Members; Domenick
• Lioce, Alternate Member. Robert Hamner and John Toshner were
not in attendance.
The minutes of November 22, 1988 were approved as submitted.
Public Hearing - Recommendation to City Council re: Creation of
"Golf Estates Villas" High Density Residential PUD, proposed to
consist of 16 townhouse units and to be located on 1.5 acres
contiguous to north of tri -plex existing on northwest corner of
Holly Drive and N. Military Trail, per application of Mr. Len
Kirschke (adv. 12/12/88)
Mr. Kirschke addressed the Commission stating the townhouses he
• proposes to build will be similar to townhouses which were

• proposed to be built on the two adjacent lots north of his to
keep continuity through the projects. The proposed project

consists of two eight - plexes, two stories, but built to appear as
one story because of the roof structure.
Mr. Ornstein asked Mr. Kirschke if he had unity of title and
stated that the staff report indicated the present owner of the
property has not given permission for this application. Mr.
Kirschke submitted a letter of authorization from the co -owner to
the Commission.
Mr. Ornstein stated because the plan does not reflect the ulti-
mate right -of -way on Military Trail, it does not allow for the
required setbacks including landscape strips, backup space and
parking space. If the wall in back is a garden wing wall and
will not be screened in, it is too high because the wall cannot
exceed six feet. Mr. Ornstein suggested Mr. Kirsccke have the
plans reviewed by the architect.
Mr. Ornstein asked Mr. Kirschke if he had a traffic study done
indicating traffic conditions due to the entrance proximity to
Holly Drive and suggested the entrance be located to the.north
end of the property, away from .Holly Drive to alleviate stacking
problems. Mr. Kirschke agreed to change the entrance as suggest-
ed by Mr. Ornstein.

Mr.
Ornstein stated
his opinion
that
there were
too many units
and
the density was
out -of -line.
Mr.
Kirschke
stated there are
four lots each consisting of 1.5 acres. Mr Ornstein replied,
that would be 12 units /acre. Mr. Ornstein also stated, for the
record, the Planning and Zoning Commission did not approve the
development proposed for similar townhouses on the two lots
adjacent to this property to the north. This project was ap-
proved by the Council with some changes. The developer again
changed the plans to include garages and significantly more
landscaping. The landscaping far exceeds the landscaping shown
on Mr. Kirshcke's plan. The project is due to go through the
Council again for this change.
• Mr. Ornstein expressed concern with the appearance of the roof
from the standpoint of the residents in back. Mr. Kirshcke
explained the extended roof was for the privacy of the residents
to the back so there would be no windows overlooking the back
from the second floor.
Mr. Rosen also expressed the same concerns as Mr. Ornstein with
regard to the density being too high. Mr. Rosen also explained
the easement along the southwest property line, established for
the utility companies and maintenance of the waterways, is not
accessible due to the shrubbery and bushes proposed to be planted
there. The service to the houses on Holly Drive to the west of
• this property are all serviced from the rear utilizing the

• easement. Mr. Rosen suggested the shrubbery and bushes be moved
to the edge of the easement inside the property line.
Mr. Rosen stated the setback of the tri -plex to the south is
sufficient because it is more than 40 feet, however, the setback
to the pool enclosure southwest of the property is too close. If
the density was lowered, it may be within limits. Mr. Rosen also
stated with an intense development such as this, there is usually
berming along the rear to give privacy to the neighboring homes.
Mr. Rosen said Mr. Kirschke needs to show on his site plan how he
anticipates garbage and waste collection. Mr. Kirschke pointed
out the location of the dumpster on the site plan. Mr. Rosen
• asked Mr. Kirschke if there were any drainage plans done. Mr.
Kirschke explained the engineer, who works through Mr. Bob
Somberg, is currently working on it. Mr. Rosen expressed concern
for the area established in the rear for drainage.

Chairman Vogel stated it will be necessary to properly screen the
dumpster with solid screening or plantings and Mr. Kirschke
acknowledged the statement.
Mr. Walton gave Mr. Kirschke a copy of the staff report he wrote
addressing the concerns he had regarding the project and stated
they were all still valid concerns.

• Mr. RArschke explained the reason he purchased the property was
because he was told by the previous planner that he could put 16
units on the property if it was classified PUD. He further
explained he believed the development would not be worth the
expense if there was less than 16 units. Chairman Vogel stated,
in the past if there were some uniqueness to the property that
allowed a higher density, the project has been approved. How-
ever, in this case, it was Chairman Vogel's opinion that this was
basic housing and too dense for this type of approval. Chairman
Vogel made a recommendation to Mr. Kirschke to open the public
hearing and then continue the public hearing at the next
scheduled meeting on January 10, 1989 because as the project
• stands now, it would not receive a favorable recommendation to
the City Council.
Chairman Vogel declared the Public Hearing open.
Mr. John Gun, owner of property bordering Mr. Kirschke's proper-
ty, is opposed to a multiple -story development on this property
because it would dominate his own property. Mr. Gun's opinion is
that there should be a transition from the existing two -story
dwellings to the north progressing south to the single - family
homes on Holly drive. Mr. Gun is also concerned that the drain-
age from Mr. Kirschke's property will drain into his backyard.
Chairman Vogel replied the drainage plan, which the engineer is
working on, will provide the location for drainage.

Mrs. Jacqueline Sims, owner of property adjacent to the rear of
Mr. Kirshcke's property, expressed concern regarding windows on
the second story of the townhouse, that would overlook her pool
and patio area and also the fact that the proposed building is so
close to her property. Mrs. Sims also expressed concern about
the schedule for garbage pickup for the proposed project in
regard to noise.
Mr. Bill Schmidt, property owner adjacent to Mr. Gun, expressed
concern regarding access to the canal via the easement, to keep
it clean. Mr. Schmidt was also concerned about the density of
the development and how the additional activity in that area
• would affect the existing residences and canal area. Mr. Schmidt
also expressed the opinion, as Mr. Gun, that the property should
be a transition from the two -story dwellings north of the proper-
ty, to the single -story homes along Holly Drive.
Mr. Ornstein stated there were more items lacking in the applica-
tion such as colors, materials and light fixtures. Also, Mr.
Ornstein stated there are major aesthetic problems with this
project as well as technical problems. Mr. Ornstein cited areas
such as the general appearance of the building and lack of land-
scaping in the front of the building.
Chairman Vogel recessed the Public Hearing to the next Regular
Planning & Zoning Meeting on January 10, 1989 at 7:30 P.M.

Adjournment
There being no further business to discuss the meeting was ad-
journed at 8:20 P.M. The next meeting of the Planning and Zoning
Commission will be held Tuesday, January 10, 1989.
