PLANNING AND ZONING COMMISSION
JANUARY 12, 1988
MEETING
The Regular Meeting of the Planning and Zoning Commission of the City of Palm Beach
Gardens, Florida, was called to order by Chairman Don Vogel at 7:30 P.M. in the
Assembly Room at the Municipal Complex, 10500 North Military Trail, Palm Beach
Gardens, Florida, and opened with the Pledge of Allegiance to the Flag.
ROLL CALL
The roll was called by the secretary, and present were: Don Vogel, Chairman;
Jeffrey Ornstein, Mike Rosen, Members; Nancy Jean Laurie, Primary Alternate Member.
John Toshner, Robert Hamner and Robert Norris were not in attendance.

APPROVAL OF MINUTES
Mr. Mike Rosen moved to approve the minutes of of December 22, 1988. Mr. Jeff Ornstein
seconded the motion and the minutes were unanimously approved as submitted.

Mr. Larry Schneider, authorized agent for Dr. Ray A. Maiwurm, addressed the Commission,
requesting the Public Hearing for the subject Comprehensive Land Use PlanlMap modifica-
tion be recessed to January 26, 1988. Chairman Vogel declared the Public Hearing open
and recessed the hearing to January 26, 1988 at approximately 7:30 P.M.

W-P. Hring - Recommendation to the City Council re: annexation of 18.9 -acre
"Cypress Hollow" subdivision (approved February 10, 1987, by the Palm
Beach County Commission as a Special Exception to allow a Planned
Residential Development and recorded 5128187 in Plat Book 56, Pages 147
& 148, Palm Beach County Official Records), located on the northwest
corner of the intersection of Lake Park West Road (alkla S.R. 809A or
Northlake Boulevard) and consisting of 56 single - family home sites

Attorney Ray Royce, authorized agent for the petitioner, addressed the Commission
presenting an aerial photograph of the proposed annexation area. Attorney Royce stated
the site is now contiguous to the City by virtue of the recently annexed "Northridge"
project. Attorney Royce presented a site plan and stated "Cypress Hollow" consists of
56 single family lots, 3 units per acre, and was rezoned in the County for residential
development as RS. This parcel will be brought into conformity with zoning codes and
land use plan designations; RS -3 zoning is anticipated. Chairman Vogel requested
*Attorney Royce review and address concerns raised in a letter dated January 11, 1988,
from Mr. Stan Redick, Planning Director with the County, regarding contiguousness of
the subject parcel and conditions placed on the development.
Attorney Royce stated all conditions of approval, placed on the petitioner by the
County, have been met, with the exception of the Fair Share contribution for road
improvements, which would be paid to the City if the proposed annexation is approved.
Attorney Royce stated this petition has been reviewed by the City Attorney and has been
determined to be contiguous.
Mr. Don Hearing, Vice President of GBS Architects, addressed the Commission, stating he
has contacted Chief Arrants and Chief Neubauer regarding the length of the cul -de -sac,
and neither had objections.
Chairman Vogel declared the Public Hearing open. There being no comments from the
,public, the hearing was closed. Mr. Ornstein moved to recommend approval to the City
Council for the annexation of 18.9 -acre "Cypress Hollow" subdivision (approved February

Beach County Official Records), located on the northwest corner of the intersection of
Lake Park West Road (alkla S.R. 809A or Northlake Boulevard) and consisting of 56
single - family home sites, with the proviso that the City Attorney agrees the parcel is
contiguous and that the list of conditions previously placed on the petitioner by the
County remain in effect, with the exception that the fair share contribution be paid
to the City of Palm Beach Gardens. Ms. Laurie seconded the motion which was unani-
moualy carried.
Workshop - Recommendation to the City Council re: annexation of 1.72
acres located on the south side of Northlake Boulevard on the east and
.west side of Dania Drive; and simultaneously providing for the creation

Mr. Larry Schneider addressed the Commission, presenting a preliminary site plan and
alternate parking plan. The new concept proposes maintaining the Dania Road access
as it is, going through the project. The building would be located on one side of
Dania Dr. and the parking on the other. The Commission suggested the petitioner
consider creating an actual road, for use by residents living behind the project,
by closing some ingress /egress points in proposed parking area, providing a 20' road-
way and 5' landscape strip. Mr. Ornstein questioned the legal ramifications, should
an accident occur, of forcing residents to go through a commercial development.
Chairman Vogel invited input from the public. Mr. Rick McGuire, Dania Drive resi-
ent, addressed the Commission, objecting to the proposed project.
Ralph Paulson, owner of residential property on Dania Drive, addressed the
-- Commission, stating the new plans are an improvement over the original submittal.

NEW BUSINESS
Chairman Vogel reported that he and Ms. Laurie attended an informative lecture on
Government in the Sunshine at a recent Florida Planning and Zoning seminar, held in
Miami. Chairman Vogel relayed information received and cautioned members re:
discussing projects with petitioners or reviewing plans outside of a public meeting.
ADJOURNMENT
There being no further business to discuss, the meeting was adjourned at 8:15 P.M.
The next meeting of the Planning and Zoning Commission will be held on Tuesday,
January 26, 1988.
