PLANNING AND ZONING COMMISSION
February 23, 1988
MEETING
The Regular Meeting of the Planning and Zoning Commission of the City of Palm Beach
Gardens, Florida, was called to order by Chairman Don Vogel at 7:30 P.M. in the
Assembly Room at the Municipal Complex, 10500 North Military Trail, Palm Beach
Gardens, Florida, and opened with the Pledge of Allegiance to the Flag.
ROLL CALL
The roll was called by the secretary, and present were: Robert Hamner, Mike Rosen,
Members; Robert Norris, Secondary Alternate Member.
Don Vogel, John Toshner, Jeffrey Ornstein and Nancy Jean Laurie were not in atten-
ance.
J ke Rosen served as Acting Chairman in Don Vogel's absence.
APPROVAL OF MINUTES
Mr. Hamner moved to approve the minutes of February 9, 1988. Mr. Norris
seconded the motion and the minutes were unanimously approved as submitted.
PUBLIC HEARING - RECOMMENDATION TO THE CITY COUNCIL RE: AMENDING THE CITY'S ZONING
CODES, PROVIDING FOR THE SALE OF ALCOHOLIC BEVERAGES, FOR OFF- PREMISE CONSUMPTION,
AND FOR ON- PREMISE CONSUMPTION WHEN IN CONJUNCTION WITH A RESTAURANT, AS A PERMITTED
USE ADV. 1/25/88) (RECESSED FROM MEETING OF FEBRUARY 9, 1988
Acting Chairman Rosen declared the Public Hearing open.
Mr. Norris requested clarification of the proposed zoning amendment. Mr. Ken
Stapleton addressed the Commission stating the first clause, under subsection 13, of
the Ordinance, refers to any establishment selling alcoholic beverages for off -
premise consumption, such as Walgreens, Big Daddy's, etc. The second clause under
9- ubsection 13 would allow restaurants to serve liquor in conjunction with food. The
Commission expressed - concern re: pemitting restaurants to sell alcoholic beverages

premise consumption. Mr. Stapleton stated he would review the intent of the
Ordinance with Attorney Brant. The Commission recessed the Public Hearing to March
8, 1988 at 7:30 P.M.
WORKSHOP - RECOMMENDATION TO CITY COUNCIL RE: ANNEX. OF 39.287 ACRES MORE OR LESS,
LOCATED WITHIN SW% OF SECTION 14, TOWNSHIP 42 SOUTH, RANGE 42 EAST, LESS EASEMENT
OVER WEST 40 FEET THEREOF, UNDER THE CITY'S AG - AGRICULTURAL DISTRICT ZONING
CLASSIFICATION. PER PETITION OF MR. DON HEARING OF GBS ARCHITESCTS, AUTHO. AGENT FOR

Mr. Don Hearing of GBS Architects, authorized agent for the petitioner, addressed the
Commission stating the proposed petition is for voluntary annexation of property
located north of Northlake Blvd., just east of Gibson Road. The subject area is
located south of the recently annexed "Northridge" PUD. Mr. Hearing stated annexa-
tion of this parcel will help to square off City boundaries. Mr. Hearing reported
_here are no plans for the property at this time.
There were no concerns expressed by the Commission or staff.
PREAPPLICATION REVIEW - CREATION OF .71 -ACRE "GARDEN TRAIL" PUD, WITH LAND USES
PERMITTED BEING THOSE AS SET FORTH IN THE CITY'S RH -HIGH DENSITY RESIDENTIAL
DISTRICT, PROPOSED TO CONSIST OF 8 CONDOMINIUM UNITS AND BE LOCATED ON .71 ACRES
FRONTING ON THE WEST SIDE OF N. MILITARY TRAIL, BETWEEN LILAC STREET AND HOLLY DRIVE
IMMEDIATELY SOUTH OF "PALM GARDENS APTS ", PER THE PETITION OF MESSRS. FRANK S.
DEFILIPPO AND NICHOLAS CORCOKIOS OF J.D.M. GARDENS, INC.
Mr. Frank Defilippo addressed the Commission, pointing out the location of the pro-
posed project. Mr. Defilippo stated the property is currently zoned RM- Medium
Density Residential, which would allow 7 units. The requested change would allow one
additional unit. Proposed are single story condominiums, CBS construction, with
cement tile roof. Mr. Defilippo stated 10 -12' Live Oaks will serve as buffering to
the rear of the property and there will be no garbage or trash services to the rear.
• Acting Chairman Rosen stated staff comments noted minor deficiencies in the landscape
plan and insufficient lighting in the parking areas and requested these concerns be
addressed at the Public Hearing.

UNITS ACRE LAND USE DESIGNATION" ON .71 ACRES FRONTING ON THE WEST SIDE OF N.
MILITARY TRAIL, BETWEEN LILAC STREET AND HOLLY DRIVE, IMMEDIATELY SOUTH OF "PALM
GARDENS APTS", PER THE PETITION OF MESSRS. FRANK S. DEFILIPPO AND NICHOLAS CORCOKIOS
OF J.D.M. GARDENS, INC.
Mr. Stapleton advised the change in density from 7 to 8 units requires a change in
the Comprehensive Plan, to maintain consistency between the zoning designation and
the Comprehensive Plan.
WORKSHOP - RECOMMENDATION TO CITY COUNCIL RE: MODIFYING THE "CLOCKTOWER"
PROFESSIONAL OFFICE PUD CREATED 12/19 85 BY ORDINANCE 19, 1985, PROVIDING FOR
IDENTIFICATION WALL SIGNAGE FOR THE INDIVIDUAL TENANTS, PER PETITION OF MR. EARL
SWARTZ, PRES. OF CLOCKTOWER ASSOCIATION
Mr. Earl Swartz, President of Clocktower Association, addressed the Commission
&tating five tenants currently have been issued sign permits, however, another tenant
,ecently applied for a sign permit and was denied. Mr. Swartz stated signage was not
addressed in the original PUD. Mr. Swartz stated the proposed and existing signage
consists of cast aluminimum letters with baked enamel finish, permanently attached to
the building, offset to prevent rain streaks.
Mr. Stapleton reported there has been some confusion as to signage approval within
PUD's. In the past, if signage was not addressed in the PUD Ordinance, the Sign Code
was applied by the Building Official in issuing sign permits. Mr. Stapleton stated
the interpretation has changed inasmuch as the City Council has expressed a desire
to review signage as a part of the entire PUD. Mr. Swartz is now requesting an
amendment to the PUD, at the City's direction.
The Commission complimented Mr. Swartz on the quality and attractiveness of the pro-
posed signage and requested that performance specifications be submitted, which will

DENSITY RESIDENTIAL DISTRICT, CREATED 11/29/87 BY ORDINANCE 12, 1987, SOUTH OF
NORTHLAKE BOULEVARD (A K A LAKE PART WEST ROAD), BETWEEN INTERSTATE -95 AND NORTH
MILITARY TRAIL, SOUTH OF THE SHOPPING CENTER KNOWN AS "GARDENS PARK PLAZA ", PROVIDING
FOR THE CREATION OF 3.51 U P A "GARDEN OAKS" SINGLE FAMILY (ZERO -LOT -LINE ) PUD, WITH
DISTRICT, PER THE PETITION OF BURG & DIVOSTA CORPORATION
Attorney Ray Royce, authorized agent for Burg & Divosta Corporation, addressed the
Commission stating the "Garden Oaks" annexation is currently being challenged by the
County and a hearing date has been set for next week. Attorney Royce stated he feels
confident regarding the outcome, however, the litigation may continue through the
appellate process, which could possibly delay a final decision for up to 2 years.
Until final disposition, the project is within the City of Palm Beach Gardens and no
•njunction has been filed to prevent proceeding with the amendment.
Attorney Royce stated other than minor modifications, the major change includes
deleting the 4 -plex units and replacing with single- family residences, thereby
reducing the number of units by 129, and trip generation by almost 500, or 12 %.
Attorney Royce stated that since the number of units has been reduced, the petitioner
would like to reduce the size of the recreation area and requested input from the
Commission. Attorney Royce pointed out the number of tennis courts has been reduced
from 4 to 2; handball courts from 4 to 2; size of recreation area has decreased by
approximately 4 %.
Attorney Royce stated the proposed changes will decrease the density from 4i u /p /a to
3i u /p /a.
Mr. Rosen stated City tennis facilities are overcrowded on weekends now and it is his
feeling recreation facilities provided by the developer could help to alleviate the
9 roblem. Attorney Royce responded he believes the developer agreed to make a dona-
tion to the City recreation fund, but will check the Ordinance to verify.

WORKSHOP - RECOMMENDATION TO CITY COUNCIL RE: ANNEXING 5.05 -ACRE "PROSPERITY OAKS"
DISTRICT, PER PETITION OF MS. PAULA J. BRADFIELD, AUTHO. AGENT FOR 10 OF PROPERTY
OWNER
Ms. Paula J. Bradfield addressed the Commission stating she is representing 17 lot
owners in Prosperity Oaks. Ms. Bradfield stated the subject area is surrounded by
the City and feels annexation would be beneficial to the City and residents. It was
the concensus of the Commission that the proposed annexation would be consistent with
the City's annexation plans.
WORKSHOP - RECOMMENDATION TO CITY COUNCIL RE: ANNEXING 9.1 -ACRE "MONET OAKS" SINGLE
FAMILY DISTRICT, PER PETITION OF MR. JEFFREY D. RENAULT, AUTHO. AGENT FOR 100 OF
PROPERTY OWNERS
Mr. Jeffrey D. Renault, authorized agent for "Monet Oaks" property owners, addressed
the Commission pointing out the location of the proposed annexation area and stated
the property owners are looking forward to being a part of Palm Beach Gardens. It
was the concensus of the Commission that the subject area is consistent with the
City's annexation plans.
PREAPPLICATION REVIEW /WORKSHOP - RECOMMENDATION TO CITY COUNCIL RE: ANNEXATION OF
29.38 ACRES LOCATED APPROXIMATELY 800 FEET SOUTH OF NORTHLAKE BOULEVARD BETWEEN THE
EAST SIDE OF BURMA ROAD AND THE C -17 CANAL; AND SIMULTANEOUS APPROVAL OF A PUD TO
CONSIST OF 282 CONDOMINIUM UNITS, WITH THE LAND USES BEING THOSE AS SET FORTH IN THE
RM- RESIDENTIAL MEDIUM DENSITY DISTRICT PER PETITION OF MICHAEL HOUSTON, URBAN DESIGN
STUDIO. AUTHO. AGENT FOR K. HOVNANIAN.
Mr. Hank Skokowski, authorized agent for the petitioner, addressed the Commission
• resenting an aerial and pointing out the location of the proposed annexation area,
surrounding zoning districts and Park Avenue alignment.

Mr. Skokowski stated the density will be 9.6 u /p /a overall. The net land

area is 28.14 acres, however, the current owners of the property, Foundation Land
Company, has dedicated a 30' addition to the public right -of -way, at no cost to Palm
Beach County. The developer is requesting the City give the same consideration the
County would, in allowing the developer to count the land area as part of the total
for density calculation purposes, since there was no compensation for the land. Mr.
Skokowski stated if the land is not counted, the density would be 1 dwelling unit
over 10 u /p /a.
Mr. Skokowski presented a site plan, pointing out access points and describing
building types.
46 r. Skokowski discussed recreational facilities, which include: swimming pool, 2000
q. ft. clubhouse, heated spa, 2 lighted tennis courts, 2 racquetball courts, tot lot
facility, internal bicycle path system and landscaped mini - parks.
Mr. Skokowski discussed traffic impact, stating the developer will be responsible for
Burns Rd. and its ability to accommodate additional traffic and will, if necessary,
provide for signalization at the intersection of Burma Rd. & Northlake Blvd. Mr.
Skokowski stated the developer will address the traffic impact on Northlake Blvd. and
the petitioner will be participating in the City's traffic impact fee standards,
totalling approximately $126,000, to be used for roadway improvements.
The Commission expressed concern re: excessive building length; need for expanded
tennis facilities and need for additional guest parking. Mr. Skokowski stated
recreational facilities will be reviewed, however, specific budgetary constraints may
prevent the developer from providing additional recreational facilities.

been paved within the last 10 years. Mr. Rogers does not recommend further widening
of Burma Rd. since the total trips would be approximately 1600 and the capacity of
the two -lane road is approximately 13,000 trips per day.
Parking was discussed and Mr. Skokowski stated he will see if there is a way to
research the parking demands with comparable Hovnanian projects.
ADJOURNMENT
There being no further business to discuss, the meeting Was adjourned at 9:00 P.M.
The next meeting of the Planning and Zoning Commission will be held on Tuesday, March
8, 1988.
