PLANNING AND ZONING COMMISSION
MARCH 8, 1988
MEETING
The Regular Meeting of the Planning and Zoning Commission of the City of Palm Beach
Gardens, Florida, was called to order by Chairman Don Vogel at 7:30 P.M. in the
Conference Room at the Municipal Complex, 10500 North Military Trail, Palm Beach
Gardens, Florida, and opened with the Pledge of Allegiance to the Flag.
ROLL CALL
The roll was called by the secretary, and present were: Don Vogel, Chairman;
Robert Hamner, Jeffrey Ornstein, Members
John Toshner, Mike Rosen, Nancy Jean Laurie and Robert Norris were not in attendance.

Mr. Hamner requested Mr. Ken Stapleton advise as to information received
from Attorney Brant regarding clarification of the subject amendment, as requested at
the Workshop Meeting of February 23, 1988.
Mr. Stapleton stated he was advised by Attorney Brant the proposed Ordinance would
permit off - premise consumption of alcoholic beverages in establishments such as
Walgreen's.
The Commission agreed they would have no objection to the sale of alcoholic bevera-
ges in conjunction with a restaurant, as a permitted use, however, a petition for
off - premise consumption of alcoholic beverages should go through the approval process.
Mr. Ornstein moved to recommend denial to the City Council to amend the City's Zoning
,,Codes, providing for the sale of alcoholic beverages, for off - premise consumption,

and for on- premise consumption when in conjunction with a restaurant, as a permitted
use. Mr. Ornstein stated his motion was for denial as the wording included
"off- premise" consumption. Mr. Hamner seconded and the motion was unanimously
carried.
P. Hring - Recommendation to City Council re: Petition of The Architects Group,
Inc., to permit as a "conditional use" in the CG -1 General Commercial District, the
retail sale of alcoholic beverages, including liquor, beer and wine, for on- premise
consumption at "Ruby Tuesday's Restaurant" within the "Gardens Mall ", 3101 PGA
Mr. Eric Paul, authorized agent for the petitioner, addressed the Commission stating
alcoholic beverages will be sold in conjunction with the restaurant, which will
receive approximately 85% of its revenue from the sale of food, and approximately 15%
from the sale of liquor. "Ruby Tuesday's Restaurant" is located within the "Gardens
• all" and anticipates opening October 5, 1988. The restaurant will not provide
plastic "go- cups ", thereby eliminating the possibility of restaurant customers
carrying beverages into the Mall area. Mr. Paul stated the owners have restaurants
throughout the country, including Morrison's Cafeterias.
Mr. Ornstein recommended approval to the City Council to permit as a "conditional
use" in the CG -1 General Commercial District, the retail sale of alcoholic beverages,
including liquor, beer and wine, for on- premise consumption at "Ruby Tuesday's
Restaurant" within the "Gardens Mall ", 3101 PGA Boulevard, Space G -129.
