DECEMBER 17, 1987
The Regular Meeting of the City Council of Palm Beach Gardens, Florida,
was called to order by Mayor Feeney at 6:00 P.M. in the Assembly Roan at
the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens,
Florida: and opened with the Pledge of Allegiance to the Flag.
ROLL CALL:
The C -cy Clerk called the roll and present were: Mayor Feeney, Vice Mayor
Martino, Councilman Aldred, Councilwoman Monroe and Councilman Xiselewski.

Mayor Feeney announced there would be a meeting of the Planning and Zoning
Canmission on Tuesday, December 22, 1087, at 7:30 P.M.
Mayor Feeney announced there would not be a meeting of the City Council on
Thursday, December 24, 1987, and Thursday, December 31, 1987, due to
is
Christmas and New Years holidays.

Vacuum Design
Sweeper
The City Manager recommended the City Council award the bid for a all
Vacuum Design Sweeper for Turf h Pavement, Pull- Behind Unit, to DeBra
Turf, for a used unit in the amount of $6995.
The City Council unanimously approved awarding the bid to DeBra Turf in
the amount of $6995, to be taken from account # 15 -6420.
32 N.P. Diesel

The City Manager recommended the City Council award the bid for the 32 H.P
Diesel Tractor for Public Works Department to DeBra Turf in the amount of
$9759.
The City Council unanimously appoved awarding the bid to DeBra Turf in the

amount of $9759, to be taken from account # 15- 64.20.

overnments Per the recommendation of the City Manager, the City Council unanimously

Irrigation System -
Plant Drive Park Per the recommendation of the City Manager, the City Council authorized
the City Manager to expend $5,600 for the cost of equipment to replace the
irrigation system at Plant Drive Park. The money will be taken from the
Council Contingency Account.
Advertisements for
Annexation Process Per the recommendation of the City Manager, the City Council approved by a
4 to I vote, with Councilwoman Linda Monroe voting nay, $4000 be taken
from Council Contingency to cover the costs of advertisements for the
annexation process.
Genarai Aviation
Study Per the recommendation of the City Manager, the City Council unanimously
approved the payment of .$21646.46 for,the City's portion of the North
County General Aviation Study, to be taken from the Council Contingency
Account,
Acquisition of
Seacoast Utilities T;:e City Manager reported meeting with Lake Park, North Palm Beach and
Northern Palm Beach County Water Control District re: the possible
acquisition of Seacoast Utilities. There was a joint effort proposed for
a feasibility, study, with North Palm Beach stcting they would share the
cost with Palm Beach Gardens, and hopefully Lake Park and the Water
Control District wi2l also share in the cost.

Metropolitan Planning organization, stating the Tri- County Rail System is
moving along on schedule. Councilman Kiselewski stated he attended a
meeting of the Solid Waste Authority yesterday, stating the Dyer Dump has
won an award for the refurbishinq of hiding all the hills with all the
native vegetation and landscaping. Councilman Kiselewski reported
;ttend�ng the National League of Cities meeting in Las Vegas Friday
through Tuesday. Councilman Kiselewski gave a condensed review of the
meeting.
MAXaq -W ENEY Mayor Feeney reported attending a Governing Board Meeting of Palm Beach
Gardens Medical Center, where concern was expressed re: the closing of St.
Mary'o Emergcncy Room and the effect it will have on other hospitals.

ALDRED Councilman Aldred stated some of the medians are being improved and the
City is having a problem maintaining them. Councilman Aldred felt this
was an issue the Council may wish tc address further in connection with
the City's overall master plan for beautification throughout the entire
City to see if there is any way we ran overcome the legal liability

Sam CarsilIo, resident of Palm Beach Gardens, expressed his thanks to
Councilman Kiselewski for his report on the National League of Cities
meeting.
ELEANOR BIRDSALL
Eleanor Birdsall, a member of the Board of Directors of Trails End Villas,
stated she is concerned with gas engine used on the canal. Ms. Birdsall
also stated she is concerned with the growth in the City.
ORDINANCES
ORDINANCE 15, 1987
Attorney Raymond Royce addressed the City Council, briefly reviewing plans
for "Admiralty II" POD, to be located on the south side of PGA Boulevard,
west of Interstate -95.
Mayor Feeney declared the Public Hearing open, which was duly advertised
December 2, 1987, and held on the intent of Ordinance 15, 1987. A number
of residents addressed the Citv Council stating their concerns and objec-
tions to the project. The major concern of the residents was the traffic
problems they felt this project would cause. Mr. George Webb, Palm Beach
County Engineer, addressed the C!ty Council thanking them for what reGuc-
tions were made on this project. W. Webb stated the County staff would
like to work with the City staff on future projects, Mayor Feeney stated
he /l,-et with the City Manager today and requested he obtain a traffic count
for the I -95 traffic as well as the Turnpike traffic and find the dif-
ference once I -95 is opened on Saturday. Mayor Feeney further requested
the City Manager to review traffic figures that were given to Palm Beach

The petitioner requested, and the Council agreed, to amend the next to the
® last ,. ragraph of Section 6. to read "This shall be cocaleted prior to the
cez jucate of" occupancy of Phase I." The following conditions of aopro-
vat were agreed to by the petitioner, and are to be included in Ordinance
15, 1987:
Item 1. Eliminate present driveway Cut onto PGA Boulevard by present
office building; utilize one driveway for both existing
office buildings Admiralty II PUD.
Item 2. Agreed to now proposed traffic impact fees in lieu of pre-
sent ones now in force.
Item 3. Casement over present Admiralty property so as to afford
ingress and egress to Military Trail.
Item 4. Land donation elsewhere in the City, 6 parcels, and park
improvements by the developer at Lighthouse Drive per plan
all in lieu of Recreation Land Donation as required by
PUD ordinance. (Lots 1 and 30) The improvements shall be
funded within one year from the effective date nf the
0rdinanca.
Item 5. No medical or dental tenants shall be allowed in Admiralty
11.
Item 6. Construct new roadway between existing p.'king garage and
new one proposed, exiting onto Tanglewoou street in rear of
Tanglewood Plaza.

Item 8. Construct second right hand turn lane on Military Trail in
conjunction with scheduled improvements to Intersection of

Item 10. Construct third lane over present Admiralty property to
Military Trail, if later requested by Palm Beach Gardens
City Council. The City shall make such request within 15
months from date of issuance of last certificate of
occupancy.
Item 11. Construct exits out of both parking garages, but the chain
rlosed until the City Council feels the need for later use.

Item 12. Introduce ''lex -time policy in leasing Admiralty 11 so as
to stagger hours of traffic arriving and leaving project
during peak hours.

Item 14. A traffic signal shall be provided by the developer at the
intersection c` arch Street ano Military rra:i, provided
the Department of Transportation aporoves such installation.
The sum of money to be provided by the developer shall be
the sum of $35,000 and the City shall have 5 years from date
of this Ordinance to obtain the DOT approval. In the event
same shall not be obtained then this requirements shall
terminate.
Item 15. The bank and drive -in teller facilities located in the
eastern most office building, Phase II, shall be deleted.
Item 16. Drive -in teller lanes to the west of west office building
shall be omitted during construction of Phase I. Six months
after the last certificate of occupancy shall he issued
the City Council will, after evaluation of traffic flows
after complete occupancy, shall reconsider the use of a
® maximum of 3 drive -in teller lane at west office building
In accordance with the site plan entitled PUD -1 B, as revised
September 14, 1987. At time of such reconsideration the
traffic engineer's office of Palm Beach County shall be
notified and their input at the appropriate meeting_ shall
be provided.
By a unanimous vote of the City Council the City CIerk read on second and
final reading, by title only, Ordinance 15, 1987, as amended, approving
the creation of 12.497 -acre "Admiralty II" PUD, with the land usages being
those as set forth in the City's CG -1, General Cprr^ercia? Cistrict.
including providing for the sale of alcoholic baveraoes for on- oremise
consurmption as a conditional use, to be located on the south side of P (,A
Boulevard, west of Interstate -95,
Ordinance 15, 1987, was adopted by the City Council by a vote of 4 ayes
and I nay, with Councilwoman Monroe casting the vay vote. Councilwoman
Monroe cast the nay vote because she felt the City should work towards

making PGA Boulevard a road which is reasonable to traverse.

Mr. iom Foster, 8645 Square Lake Drlve, addressed the City Council re:
117.94 -acre expansion south of Lake Park west Road (a/k /& Northlake
Boulevard) between I -95 and N. Military Trail, stating his objection to
the density of this project.
The City Manager read a letter from Mr. Stan Redick, Planning Director,
Palm Beach County, dated December 16, 1987, requesting the City deferr
submitting the 117.94 -acre expansion to the State Department of Community
Affairs. Attorney Raymond Royce offerred his rebuttal to the letter
from Palm Beach County.
The City Council agreed that the land use designation of the 117.94 -acre
expansion south of Lake Park West Road, between I -95 and North Military
Trail, should be changed to "Residential 0 -5 units /acre land use ".
Mayor Feeney declared the Public Nearing closed.
Per a unanimous vote of the City Council, the City Clerk was instructed to
transmit to the State Department of Community Affairs for determination of
compliance /consistency with Statutory requirements, modifying the City's
Comprehensive Land Use Plan /Map adopted 11121185 by Ordinance 22, 1985,
providing for a change in the delineation of the City's boundaries by a
44.247 -acre expansion within Section 14 -4242 north of Lake Park West
Road, immediately east of Gibson Road, and simultaneously providing for
"Residential 0 -5 units /acre land use designation.
Per a vote of 4 ayes and 1 nay of the City Council, the City Clerk was
instructed to transmit to the State Department of Community Affairs for
determination of compliance /consistency with Statutory requirements,
modifying the City's Comprehensive Land Use Plan /Map adopted 11121185 by
Ordinance 22, 1985, oraviding for a change in the delineation *'

City's boundaries by a 117,94 -acre expansior. within Section 24 -42-42 south
of Lake Park West Roan, between I -95 and North Ki:ltery Trail, south of
the shopping center known as "Gardens Park Plaza ", and simultaneously pro-
viding for "Residential 0 -5 units /acre land use designation ". The nay
vote was cast by Councilwoman Monroe as she was opposed to annexation of
this property.
Per a unanimous vote of the City Council, the City Clerk was instructed to
transmit to the State Department of Community Affairs for determination of
compliance /consistency with Statutory requirements, modifying the City's
Comprehensive Land Use Plan /Map adopted 11/21/85 by Ordinance 22, 1995,
providing for change in the delineation of the City's boundaries by a
4.5I3 -acre expansion within Section I3- -42 -42 immediately south of St.
Ignatius Loyola Catholic Cathedral on the southwest corner of Holly Drive
and N. Military Trail, and simultaneously providing for "Residential 6 -8
® units /acre land use designation.

only, Resolution 107, 1987, permitting as a "conditional use" within
the tract designated for commercial usage on the "PGA National,- Master

premise consumption, at "Incredibly Gourmet" located within "PGA National
Shcppes" at Store #27, 7100 Fairway Drive, Palm Beach Gardens, Florida.
Resolution 107, 1987, was unanimously adopted by the City Council.

Per a concensus of the City Council the City Clerk read, by title
only, Resolution 109, I987, amending the PGA National PIanned Community
Development Master Development Plan (Map) by re- designating the 2.5 -acre
Lot i of the "P.G.A. National Commerce Park" PUD (as created in the
southeast corner of the PGA National PCO on 817186 by Resolution 34, 1986,
and recoreded, per the Plat approved 11120186 by Resolution 58, 1986, in
P.B. Co. Public Records 1127187, in Plat Book 55, Pages 160 & 161), as
"commercial" enablino the location of a community -bed or ancillary
sheltered -bed ousring home, as regulated by Chapter 400, Part 1, and
Chapter 651, Section 651.118, Florida Statutes, and an Adult Congregate
Living Facility as regulated by Chapter 400, Part 11, Florida Statutes.
Resolution 109, 1987, was unanimously adopted by the City Council.
RESOLUTION 110,
1987 Per a concensus of the City Council the City Clerk read, by title
only, Resolution 110, 1987, amending "Devonshire" multi - family PUD created
6117182 by Resolution 23, 1982, on 22.49 -acre M -22 Tract of the PGA Resort
Conmunity PCD, providing For the creation of "Devonshire Estates" muiti-
fdmlly PUD, proposed to consist of 337 life care facility units, fneluding
existing three -story 77 -unit building.

In response to questions re: exhaust syste:7 for the restaurant facility,
Mr. Hank 5kokowski read the following "the developer herewill, as In other

Resolution 110, 1987, was unanimously adopted by tha City Council.
Mayor Feeney instructed the City Clerk to furnish the Building Official an
excerpt of these minutes and a copy of the Resolution.
RESOLUTION 111,
1987 Per a concensus of the City Cc4,ncil the City Clerk read, by title Only,
Resolution 11I, 1987, amending the 33.454 -acre "P.G.A. National Commerce
Park" PUD created 817186 by Resolution 34, 1986, providing for (1) M-1A
Light industrlai L'saga a+ 36.9:�4 acres (I.e., Lots 2 -8) and commercial
• usage (i.e., a community-bed or ancillary sheltered -bed nursing home, as
regulated by Chapter 400, Part I, and Chapter 651, Section 651.118,
Florida Statutes, and an Adult Congregate Living Facility as regulated by

1987 Attorney Steve Mathison, au�horized agent for the Diocese of Pa,m eeacn,
addressed the City Council briefly outlining their request. Attorney
Mathison stated that clean -up procedures requested by Councilman

In .esponse to Councilman Kiselewski, Attorney Mathison stated the "mess
which currently exists will be completely clean and the weeds which are
growing will be completely removed, sodded and maintained" by January 31,
I988.
Mayor Feeney declared the Public Hearing open, which was duly advertised
November 25, 1987, December 2, 9 and 16, 1987 and held on the intent of
Ordinance 13, 1987. There being no comments from the public, Mayor Feeney
declared the Public Hearing closed.
Per a unanimous vote of the City Council the City Clerk read, by title
only, on second and final reading Ordinance 13, 1987, annexing parcels
abutting "St. Ignatius Loyola Catholic Cathedral" on the southwest corner
of Holly Drive and North Military Trail, totalling 4.513 acres, and
® simultaneous zoning of RM- Medium Density Residential District, with the
conditional use of "churches or places of worship, rectory, convent, and
accessory buildings, and structures" as a permitted use.
Ordinance 13, 1987, was unanimously adopted by the City Council.

1987 Mr. Phil Rodgrrs, representing Glendale Federal, addressed the City
Council briefly reviewing their request.
Mayor Feeney declared the Public Nearing open which was duly advertised
December 1, I987, and held on the intent of Ordinance 19, 1987. There
being no further comments from the public, Mayor Feeney declared the
Public Hearing closed.
Per a unanimous vote of the City Council the City Clerk read, by title
only, on second and final wading, Ordinance 19, 1987, amending "Gardens

Code, permitting size of 45 sq. ft.) at "Glendale Federal", located at
3300 PGA eoulevazd. Ordinance 19, 1987, was unanimously adopted by the
City Council.
ORDINANCE 20,
1987 Attorney Lawrence Smith, authorized agent for Durbin - Hatfield Company,
addressed the City Council re: Ordinance 20, 1987. The petitioner agreed
to install a sidewalk along the project property and to dim the "Marriott"
Sign or the building by 50% at 11 :00 P.M.
Mayor Feeney declared the Public Hearing open, which was duly advertised
December 2, 1987, and held on the intent of Ordinance 20, 1987. There
being no comments from the public, Mayor Feeney declared the Public
Hearing closed. The City Manager stated the Recreation Impact Fee would
be .$40,000 and the Road Impact Fee would be $90,000.
Per a unanimous vote of the City Council the City Clerk read, by title
only, on second and final reading, Ordinance 20, 1987, creating a PUD with
the land usages being those as set forth in the City's CG -1 General
Commercial District, including providing for the sale of alcoholic bevera-
ges for on- premise consumption as a "conditional use ", proposed to be
located on 6.586 acres Iocated between RCA 8ouievard and Interstate -95, at
the extreme northwest corner of the former site of "RCA ", within Section
1-4)-42 and 12- 42 -42, and consist of a 267 -room, 182,000 sq. ft.
"Marriott" Hotel. The City Attorney read the following amendment to
Ordinance 20, 1987: Section 4., adding the paragraph "The identification
sign of Marriott aoproved in this Ordinance shall contain the standard

Ordinance 20, 1987, as amended, was adopted by the City Council by a vote
of 4 ayes and I nay. Councilwoman Monroe cast the nay vote since she felt

providing for changing the land use designation on a 2.127 -acre parcel of

land located between RCA Boulevard and Interstate -95, at the extreme
northwest corner of the former site of "RCA", within Section 12- 42 -42,
from industrial to commercial (i.e., a 2.127 -acre southerly extension of
the 6.28 -acre Comprehensive Land Use PIao /yap amendment granted 10116,86
by Ordinance 20, 1986).
Ordinance 21, 1987, was adopted by the City Council by a vote of 4 ayes

Per a unanimous vote of the City Council the City Clerk read, by title
only, on first reading, Ordinance 23, 1987, annexing parcels, totalling
.266 acres within Section 4 -42-43 on the north side of Bomar Drive, bet-
ween U.S. Highway X61 and Ellison Wilson Road, and simultaneously providing
for the creation of a PUD with the permitted uses being those as set forth

Meeting of January 21. 1987.
