HomeMy WebLinkAboutMinutes Council 102287CITY COLNCTL ® WORKSHOP h£ETING CITY OF PALM BEACH GAHOENS OCTOBER 22, 1987 The Workshop Meeting of the City Council of Palm Beach Gardens, Florida, was called to order by Mayor Feeney, at 8 :05 P.M., subsequent to the aa'journment of the Special Regular Meeting, in the Assembly Room at the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida; and opened with the Pledge of Allegiance to the Flag. RCU CALL The Deputy City Clerk called the roll and present ware: Mayor Feeney, Vice Mayor Martino, Councilwoman Monroe and Councilman Kiselewski. Councilman Aldred was not in attendance due to another committment. rTEMS BY THE 1 Y i`r'i;�fuLR AUTIFICATION AND ENHA,,CEMENT PRO- GRAM, The City Manager stated due to the length of this evenings agenda the pre- sentation by Team Plan, Inc. was postponed. Per the City Manager's reCOMMandation the Council requestcd the City Manaoer schedule this pre- sentation for a Wednesday evening in November. The Council further requested the City Manager invite members of the Planning and Zoning Commission, Site Plan and Appearance Review Cowittee and the Beauti`'ication and Enviro.rmentaI Committee to attend tnis meeting. ROAD IMPACT FEES The City Manager stated he was in the process of revising the fee stucture for road .impact fees in an effort to increase them relative to today's cost of construction. The City Manager stated he would have more ;nfor- mation to the City Council in approximately 3 weeks. Ll F CITY COLWCIL WORKSHOP MEETING, 1002187 PAGE 2 The City Manager recce msnded that once the correct dollars are in the structure, we can eitnut ^ullert the fees beginning at that f{me, or the developers can hold off paying the new impact fees until the Ordinance is completed. Councilman Kiselewski stated, and the Council agreed, since some fees are triggered by the number of units, future ordinances should be written in such a manner that the fees that are collected Rill be as they are reflected at that point in time. REPORTS COUNCILMAN KISELEWSKI Councilman Kiselewski reported the Solid Waste Authority has authorized its attornies to, if nacessary, take action to go into condemnation pro- ceedings for the approximately 1700 acres in the southwest corner of the County for a landfill and possible resource recovery facility. I rEMS FOR ,iISCUSSIG.N per the consensus of the City Council the Mayor stated Items 1 through 8 under "Items for Discussion" will be heard first on the agenda, s;n cc they are requests for conditional uses and variances for the sale of alcoholic beverages and should not take much time. „GUISEPPE'S RIS FO-94N 7F ITALIANO" Mr. Joe Casale, owner of "Guiseppe's Ristoraunte Italiano ", located at 4225 Northlake Boulevard, Palm Beach Gardens, addressed the Council stating he is requesting a conditional use to permit the r9tcil s611e /service o(' alcoholic beverages, for on- premise consumption. Mr. Casale stated he is also requesting a variance to Chapter 112, Section 112.21 of the Palm Beach Gardens Code, to the distance requirement of 750 L] CITY COLNCIL WORKSHOP M=ETING, 10/22187 PAGE 3 feet between alcoholic beverage vendors. The City Cou,,Gll had no concerns regarding these requests, and directed the City Attorney to pre- pare the necessary resolutions. "JESSIEIS SEAFOOD RESTAURANT" Messrs. Marvin & Ronald Wardell, owners of "Jessie's Seafood" restaurant and lounge were not in attendance re: request for a conditional use to permit the retail sale /service of alcoholic beverages, for on- premise con - surption, at 7100 Fairway Dirve, Suite 63, Palm Beach Gardens; and a variance to Chapter 112, Section 112.21 of the Palm Beach Gardens Cade, to the distance requirement of 750 feet between alcoholic beverage vendors. Tne City Council directed the City Attorney to prepare the necessary reso- lutions, and the .items will be discussed with Messrs. Marvin & Ronald 40 Wardell at their next meeting. "FANTASY BASKFTS & GIFTS, INC." Mr. David Pernelli, authorized agent for Karen K. Ha -,ris, President of Fantasy Baskets & Gifts, Inc., addressed the Council re: their request for a condtionaI use to permit the retail sale of beer and wine, for off - premise consumption, at 7100 Fairway Drive, Suite 33, Palm Beach Gardens; and their request to a variance to Chapter 112, Section 112.21 of the Palm Beach Gardens Code, to the distance requirement of 750 feet between alco- holic beverage vendors. The City Council had no concerns repardincl these requests, and directed the City Attorney to prepare the necessary resolu- tions. The Council r, ,quested the City Attorney research changing the ordinanres so the approvals of special exceptions can go to the business and not the property. The Council further requested the City Manager place this Item on a future agenda, as soon as possible. "DINO'S PIZZA PARLOR" Mr. Nick Cuccie of "Dino's Pizza Parlor ", addressed the City Council re: request for a conditional use to permit the retail sale /service of beer and wine for on- premise consumption, at his establishment located within "'Crossroads at Northlake" Shopping Center, 3880 Northlake Boulevard, Palm Beach Gardens; and a variance to Chapter 112, Section 112.21 of the Palm Beach Gardens Code, to the distance requirement of 750 feet between alco- holic beverage vendors. It was determiner) there would be a bar in this establishment that would seat 6 people. The hours of "Dino's Pizza" are: 12:00 a.m. during the week and 1:00 a.m. on weekents. The Council had no concerns re: these requests and directed the City Attorney prepare the necessary resolutions. ORDINANCES ORDINANCE 14, 1987 Mr. Bob Whitley, authorized agent for "Golden Bear Plaza ", addressed the Council re: request for approval of a drive -in bank facility and monument sign. The City Council directed the City Attorney to prepare the necessary ordi- nance for their consideration. 1987 Attorney Raymond Royce, authorized agent for Vincent 7. Pappalardo, adressed the Council re: creation of 12.497 -acre "Admiralty 11" PUD, with the land usages being those as set forth in the City's CG -1, General Commercial District, including providing for the sale of alcoholic bevera- ges for on- .premise consmption as a "conditional use ", proposed to be located on the south side of PGA Boulevard, west of I -95 and consist of two ten -story office buildings, a ten -story 160 -Suite Hotel with four meeting rooms and retail space, a one -story restaurant, a four -story atrium, a 3.5 -story parking structure and a 3 -story parking structure, a public park, and a .244 -acre site of existing lift station. Attorney Royce reviewed traffic concerns expressed by the Council at pre- vious workshop meetings. Mr. Charlie Walker of Palm Beach County Traffic Department, addressed the Council expressinq concern re: intensity of this project and traffic problems. The Council requested Ordinance 15, 1987, be scheduled for first reading, and further requested the Ord_ina +ce reflect no medical uses will be per- mitted in this project. Cowie, Trustee, addressed the City Council re: request for annexation, of 44.247 -acre parcel located 114 mile north of Lake Park West Read (a /k /a Ll a Northlake Boulevard), immediately east of Gibson Road; and simultaneous adoption of "Northridge" PUD, consisting of 125 single family lots, two lakes, and a neighborhood park with a tot lot; with the land usages being those as set forth in the City's RS-4, Residential Single Family District. Mr. Houston stated there were two existing homes that have been incor- porated into the plan, with the owners being in agreement with the plan. The City Council directed the City Attorney to prepare an ordinance to be considered for first reading. nttcrney ,Raymond Royce, authorized agent for idjacdlio Ueve:op'pent Corporation, addressed the City Council re: modification to the City's Ccenprehensive Land Use Plan /Mao adopted 11121185 by Ordinance 22, 1985, providing for a change in the delineation of the City's boundaries by a 8.05 -acre expansion within Section 23 -42-42 on the south side of Northla,,° Boulevard, at Howell Lane, and simultaneously providing for ResioenGiai 0 -5 units /acre land use designation. Attorney Royce also addressed the Council re: annexation of a 8.05 -acre parcel of land located within Section 23 -42 -42 on the scuth side of Northlake Boulevard. at howell Lane, and simultaneously created a 6.25 u /p /a Planned Chit Development, with usages as set forth in the City's RS-4 - Single Family Residential CITY COUVCIL WORKSHOP WETING, 10122187 PAGE 7 District. MARIOTT HOTEL SITE Attorney Larry Smith, authorized agent for Robert N. Hatfield, Jr., addressed the Council re: (1) amendment to the City's Comprehensive Land Use Plan /Map adopted 11121185 by Ordinance 22, 1985, providing for changing the land use designation on a 2.127 -acre parcel of land located between RCA Boulevard and 1 -95, at the extreme northwest corner of the former site of "RCA ", within Section 12- 42 -42, from industrial to commer- cial (i.e., a 2.127 -acre southerly extension of the 6.28 -acre Comprehensive Land Use Plan /Map amendment granted 10116186 by Ordinance 2'), 1986; and (2) creation of a PUD with the land usages being those as set forth in the City's CG -1, General Commercial District, including pro- viding for the sale of alcoholic beverages fok' on- premise consumption as a "conditional use ", proposed to be located on 6.586 acres located on the property described above. Mr. Louis Pounders, architects for the hotel, descrtbau t;-tC clevdiions, parking, and design of the hotel. Mr. Joe Pollack, of Kimley Horn, addressed the Council re: traffic. Mr. Michael Redd of Team Plan, yrnc. discussed the landscaping plans. The City Council requested the peti- tiorrr hav,, a tr -%ric prepared, including a "worst —,sell scenerio for the remainder of the former "RCA" site. The City Council will workshop this petition at their meeting of November 12, 1987. PETITIONS AND C"UVICA TIONS FATHER FLYNN The Council acknowledged a letter from Father Flynn of St. Ionatius Loyola Cathedral requesting a temporary sign be allowed for the church's "Annual Holiday Boutique ".
