HomeMy WebLinkAboutMinutes Council 091886CITY COUNCIL REGULAR MEETING CITY OF PALM FXACH GARDENS SEP7z:MBF_R 13, 198K The Regular Meeting of the City Council of Palm Beach Gardens, Florida, was called to order by Mayor AIdred at 8:0u P.M., in the Assembly Room at the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida; and opened with the Pledge of Allegiance to the Flag. ROLL CALL The roll was called by the City Clerk and present were: Mayor Aldred, Vice Mayor Feeney, Councilman Martino, Councilman Kiselewski, and Councilwoman Monroe APPROVAL OF MINUTES AND The minutes of the Regular Meeting of 914186, the Special Regular Meeting ANNO- LI SCE"!, NT5 of 9111186 and the Workshop Meeting of 9111166 were unanimously approved as written. Mayor Aldred announced there would be a meeting of the Planning and Zoning Commission Meeting as well as a meeting of the Merit System Board feting at 7:30 P.M. on Tuesday, September 23, 1986. ITEMS BY THE CITY MANAGER COWUTER SYSTEM The City Manager stated the new computer system for the Finance Department has been installed. The City Manager stated he may have to change she payday for City employee's from Thursday to Friday since we are presently turning in time sheets before the week is complete. The City Manaqer said he would make a recommendation to the City Council at the next meeting as to what changes will be needed in the payday schedule. REPORTS COUNClb'4AN AIRTINO Councilman Martino reported attending the Loxahatchee Council of Governments Morlting on Monday. One of the subjects discussed at this meeting was the drug issue in the north end of the County and what mun- City Council Regular Meeting, 9118186 Page 2 cipalities could do to help with this problem. It was suggested a meeting . with all law enforcement agencies in the north end of the County, Inc- Ji, ^y the Sherlfi's Cepartment, to coordinate and discuss what each is doing and can do re: drug problems. Councilman Martino requested the City Manager make the Police Chief aware that this request will be coming. Councilman Martino further reported there seems to be a misconception about the resolution passed by the Council re: Hood Road. Councilman Martino made it clear that all the Council was asking that a corridor be open somewhere between Donald Ross Road and PGA Boulevard In the 2000 Year Thoroughfare Plan, or some other acceptable solution. Councilman Martino requested the City Manager follow this up with a letter to the County Commission and other municipalities in the north County to explain our position. Councilman. Martino stated he attended the Playscape Grand opening last night, recognizing the monetary donations and efforts by the City Council, City staff, developers and residents. MAYOR ALDRED Mayor Aldred reported he was a speaker at a debate on the issue of the Planning Council. ITEMS BY ''HE PAYOR AND COUNCIL CUNCIU44N W RTINO _ Councilman Martino requested a letter be written to the County Commission requesting information on: (I) what was done with the revenues from the Beach Bond and Recreation Referendum passed in the middle 701s; how was it spent, how much money was derived, and what areas of the County did the money go to; (2) information as to what County is doing with impact monies Vthe County has collection for road impacts in our area; (3) what have they City Council Regular Meeting, 9118186 Pagp 3 done with the gasoline tax rr*nies collected and where has it been spent • and has any been spent in the area of Pali Beach Gardens; f ^! where /if /how does the County plan to take care of the recreational needs for the middle -north end of Palm Beach County. It was the concensus of the Council that the Mayor write this Ietter requesting the above information. COM41ENTS FROM THE PUBLIC FOR ITEMS NO T ON THE AGENDA W . DON KALE Mr. Gon Kalb, addressed the Council re: Resolution 36, 1986, referencing Hood Road was specifically mentioned in this resolution. Mayor Aldred stated the City would find anything accaptable, however, at present Hood Road is what land the Year 2000 Thoroughfare Plan mention, and the City would like the County to c=c uN 4iL,`, c,r accentable corridor. Vice Mayor Feeney stated the County changed the alignment in the Year 7000 Thoroughfare Plan without the benefit of public input. RESOLUTIONS: RESOLUTION 6, 1986 RESOLUTION 40, 1986 RESOLUTION 41, 1986 the City Manager stated that Fairway Drive is the road that lines up with the interchange of the Florida Turnpike and goes through the commercial property being built in PGA National, and would be a pity street. Per the concurrence of the City Council the City CIerk read, by title only, Resolution 5, 1986, approving the Plat of "Fairway Drive" collector road. Resolution 6, 1986, was unanimously adopted by the City Council. Mayor Aldred declared the Puhlic Hearing open for both Resolution 40, 1986, modification to conditional usages in the CG -1, General Commercial City Council Regular Meeting, 9118186 Page 4 Mayor Aldred explained to the audience that now before the Council were Ordinance 12, 15,,o, Ordinance 13, 1986, Ordinance 17, 1986 and Ordinance 14, 1986, all pertaining to annexations and amending the Comprehensive Land Use Plan. These are required to be advertised in a certain manner in the newspapers, which ad has to be a certain size. All of the deadlines were met for the advertisements, hoic ?ver, in the last ad run in the Palm Beach Post, the Post ran the ad in a size 2 inches below the standards. Therefore, although the advertising meets the charter of the City of Palm Beach Gardens, it does not meet state law, and there is now a need to re- advertise for a Special Requ:ar Meeting next Thursday. The Public Hearings will be opened tonight In order to receive public input. Zoning District, providing for the retail sale of beer and wine, for off - Opremise consumption, 8t "Shoppers Drug Mart ", located at 11586 U.S. Hlohway 61, wffhir Squarc ", a PUD; and Resoluticr, 41, 1986, granting a variance to the distance requirement of 750' between alcoholic beverage vendors to '-Shoppers Drug Mart ". There being no comments from the public, the Mayor declared the Pubic Hearing closed. Mr. Oxenhaler, representing Shoppers Drug Mart and Manager of Shoppers Drug Mart in Oakbrook Square, stated they are requesting permission to sell beer and wine. Mr. Oxenhaler stated there are 9 Shoppers Drug Marts in Palm Beach County now selling beer and wine. Several Council members expressed con- cerns with the need for a drug store selling alcoholic beverages. Mr. Oxenhaler requested the Council postpone the vote on these resolutions until the October 2, 1986, meeting, at which time Shoppers Drug Mart could give a presentation. HP suggested recessing a -1 Public Hearings. PUBLIC HEARINGS Mayor AIdred declared the Public Hearings open on Ordinance 12, 1986, Ordinance 13, 1986, Ordinance 17, 1986, and Ordinance 14, 1986. ORDINANCE 12, 1986 The Mayor asked the audience for any comments re: Ordinance 12, 1986, stating any comments would also pertain to Ordinance 14, I986. ORDINANCE 14, 1986 Mr. Don Kahlman, 2035 S. Waterway Drive, addressed the Council stating he was opposed to the Ordinance 12 and 14, 1986, stating the permit from the Corps of Engineers were approved for residential and this project is com- mercial. Mr. Sam Shannon, Assistant County Administrator of Palm Beach County, addressed the Council stating there would be a need for two right turn lanes at Ellison Wilson Road and PGA, and the City %vuld need to secure the appropriate right -of -way. The City Manager stated that has already been taken care of, and thr right -of -way ha3 been ;,cured. Mr, and Mrs. Harold Evans, 2058 S. Waterway Drive, addressed the Council stating they were adjacent to the project and were concerned that the wall and vegetation buffering their oroperty would not be built. They were ^,-�)�)sed to Cho restaurant. Councilwoman Monroe requested at the next meeting the City Attorney out in the ordinance what type of entertainment is covered under night -club entertainment. Councilman Kiselewski requested the City Manager investi- gate under what conditions the docks were built. 11 City Council Regular Meeting, 9118186 Page 6 ORDINANCE 13, 1986 Mr. Manuel Green, 536 Greenway Drive, North Palm Beach, addressed the • Coune,tl re: Ordinance 13, 1986, pointing out there is correspondence in the file stating the Villar:e of North Palm Beach is against commercial property in this area. ORDINANCE I7, 1986 Mr. Sam Shannon of Palm Beach County, stated the County appreciated the City Council working with them in obtaining the proper right -of -way needed for this project. Mr. Shannon briefly discussed changes that will occur some day to roads in the area according to the County's year 2000 Thoroughfare Man. Mr. Gilbert Moore, resident of Frenchmen's Landing, addressed the Council stating his concerns re: exits and entrances to "The Financial Center" and the ?ntensity o" t;,Is project. Councilman Kiselewski made a motion to recrssed the second and final reading and consideration of adoption of Ordinance 12, 1986, Ordinance 13, 1986, Ordfnanr_e 17, I986, and Ordinance 14, 1986, until the Lrtunei.s l' Special Regular Meeting of 5rotembpr 25, 1986: seconded by Vice Mayor Feeney. ORDINANCE 23, 1986_ By a unanimous vote of the City Council, the City Clerk read, by title . only, on first reading, Ordinance 23, 1986. Ordinance 23, 1986, will be considered for final approval at the City Council's Regular Meeting of October 2, 1986.
