HomeMy WebLinkAboutMinutes Council 060685CITY COUNCIL REGULAR METING s CITY OF PALM BEACH GARDENS JUNE 6, 1985 The Regular Meeting of the City Council of Palm Beach Gardens, Florida, was called to order by Mayor Linda Monroe, at 8:00 P.M., in the Assembly Room at the Municipal Complex, 10500 North Military Trail, Palm Beach Gardens, Florida; and opened with the Pledge of Allegiance to the Flag. ROLL CALL: The roll was called by the City Clerk and present were: Mayor Monroe, Vice Mayor Kiselewski, Councilman Martino, Councilman Aldred, and Councilman Feeney. City Manager John Orr and Attorney William Brant were also in attendance. MINUTES: The minutes of the Regular Meeting of May 16, 1985, were unanimously approved by the Council, as amended; and the minutes of the Workshop Meeting of May 23, 1985, were unanimously aproved by the Council, as written. ANNOUNCEMENTS: Mayor Monroe announced that the City's Planning & Zoning Commission and Fire Department would be meeting at 7 :30 P.M., on Tuesday, June 11, 1985; and that a meeting of the City's Beautification & Environmental Committee will convene at 7 :30 P.M., on Tuesday, June I2, 1985. PROCLAMATION: Mayor Monroe read a proclamation proclaiming June 14, 1985, "Flag Day ". PRESENTATION OF PLAQUES OF APPRECIATION TO MESSRS. PETER BERGEL & SCOTT MOORES FOR TEN YEARS' SERVICE TO PALM BEACH GARDENS FIRE DEPARTMENT Mayor Monroe presented a plaque to Mr. Peter Bergel in appreciation of his ten years of dedicated and conscientious service, as a volunteer, to our Fire Department. Mr. Scott Moores was not in attendance to receive a plaque of the like. Mayor Monroe noted that Mrs. Kathy Arrants and Mrs. Marilyn Brent, members of our Fire Department's Auxiliary, recently became President and Second Vice President, respectively, of the State Firemen's Auxiliary. CITY COUNCIL REGULAR MEETING, 616185 PAGE 2 RESOLUTIONS: By the concurrence of the Council, the Mayor read, in full, Resolution 20, 1985, P.E "UTION 20, recognizing the Palm Beach Gardens High School "Lady Gators" for becoming 1985 Class 4A State Softball Champions in Tampa, Florida, on May 10th. Mayor Monroe presented a framed original of Resolution 20, 1985, to each member of the softball team, and Mr. John Logan, Assistant Coach, as they were intro- duced by the Head Coach, Mr. Carlos Garcia. ITEMS BY THE CITY MANAGER: RESIGNATION OF The City Manager reported that he had received and accepted a Letter of Resig- POLICE CHIEF EDWARD nation, dated June 4, 1985, from Police Chief Edward F. Himmelsbach. The members HIS RCH of the Council were not objectionable to the City Manager's recommendation he take immediate steps to find a replacement. TEMPORARY Per the recommendation of the City Manager, a motion was unanimously adopted by EMPLOYMENT OF rn ,N STUDENT the Council he be authorized to employ an intern student graduating from Boston College, under a Work Study Program, from mid -June to mid - August, for a cost to the City of no greater than $1,000 - the monies to be taken from Account 02 -59.10 (Council Contingency) ENCOURAGING The City Manager reported that he is planning to, on Friday, June 14, 1985, be E-XPAN= OF TURNPIKE in Tallahassee before the State Department of Transportation to discuss their INTERCHANGE increasing the capacity of the Turnpike Interchange on PGA Boulevard. ITEMS BY THE MAYOR AND COUNCIL: COUNCILMAN Councilman Martino acknowledged receipt of form communications from residents MARTINO of P.B.G. Estates Plat #4, suggesting certain roadway improvements be made with the realization of "The Gardens" Mall. Vl— MAYOR A Resolution expressing concern to the Palm Beach County Commission re: billboards KISELEWSKI located within unincorporated lands in northern Palm Beach County will be con- sidered for adoption by the Council at their Regular Meeting of June 20, 1965. CITY COUNCIL REGULAR MEETING, 616185 PAGE 3 MAYOR MONROE Mayor Monroe referenced her letter to the residents on the front page of the City's latest "Newsletter "; and suggested that the local commercial newspapers consider clarifying that the regularly- scheduled Council Meetings for the months of June, July, and August, will take place the 1st and 3rd Thursdays only. Mayor Monroe noted that certain addresses within the City will have a new zip code (i.e., 33418 for all those west of N. Military Trail), effective July 1, 1985. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA: MR. STEWART Mr. Stewart Barr of 4271 Althea Way, Mr. Larry Baronoff of 3569 Cosmos Street, RRARRY . Mr. Mary Root of 3638 Cosmos Street, and Mrs. Marcie Castro of 413 Riverside MRS. U/1,M0 Drive, PBG, addressed the Council referencing the City Manager's May 31, 1985, termination of Police Chief Edward F. Himmelsbach, which was rescinded upon his acceptance of the Chief's letter of resignation received and dated June 4, 1985. These individuals made various statements ranging from defending the ex -Chief to alleging corruption and inefficiency within the Police Department as a whole. An investigation of the lower ranking officers of the department was strongly suggested. Vice Mayor Kiselewski challenged Mrs. Castro's statement that he, as a Council member was aware of the existence, in the Police Department, of the list of items she alleged. (Ref: Exhibit "A") The City Manager suggested that citizens who believe they have evidence of wrong- doing within the Police Department report them to the State Attorney's office for their consideration of an investigation. MRS. JEANNE Mrs. Jeanne Yeend of the "Rainwood East" Planned Unit Department (alkla "Town YE' -- Oaks ") addressed the Council presenting a petition from residents of the duplex/ townhouse project, requesting that the drainage canal that runs immediately north of the Alamanda Elementary School be preserved as a natural conservation easement. CITY COUNCIL REGULAR MEETING, 616185 PAGE 4 ORDINANCES: During the Council's discussions on their consideration of the March 28, 1985, OP-- 'ANCE 5, draft of Ordinance 5, 1985, providing for "Fair Share Contribution for Road ISe.. Improvements" by developers of new projects within the City, clerical errors were corrected and amendments were made, as follows: 1. The word "and" inserted in the stead of the first "or" in the second line of Sub - paragraph (6) (b) of Section 3. 2. The word "not" inserted between the words "shall" and "limit" in the first line of Sub - paragraph (7) of Section 3. J. The last line of Sub - paragraph B. of Section 5. was made into a new paragraph, followed by an additional paragraph "The two zones are hereby designated for the purpose of this Ordinance. Said zones being from the right -of -way center line east of Military Trail and from the right -of -way center line west of Military Trail; provided, however, upon accumulation of monies from developers within either zone, those funds may be allocated for improvements of Military Trail right -of- way." 4. The first line of the formulas for "Residential " and "Non - Residential" in Sub- paragraph C. 2. b. of Section 5. were revised to read: "External Trips ; 2* X Cost to construct 1 lane for 1 mile = 6,000 =" and "External Trips = 2* X Cost to construct 1 lane for 112 mile = 6,000 =", respectively. 5. The chart outlined in Sub - paragraph C. 3. b. Non Residential: of Section 5. was amended to include "General Industrial ", as per the last line of the chart for Shopping Centers on the following page. 6. The chart for Shopping Centers in Sub- paragraph C. 3. b. was amended by the deletion of the line for "General Industrial ". 7. The area ",Palm Beach County," was inserted between the words "City" and "and" in the fifth line of Sub - paragraph D. of Section 5. CITY COUNCIL REGULAR MEETING, 616185 PAGE 5 8. The word "due" was changed to read "payable" in the first line of Sub- paragraph A. of Section 6. 9. The word "returned" was replaced with "refunded, less accumulated interest," in the first line of Sub - paragraph C. of Section 8. 10. The second /last line of Sub - paragraph C. of Section 8. was amended to read "The present owner must petition the City Council for the refund within 90 days from the date the building permit was issued. ". 11. The fourth line of Sub - paragraph B. 2. of Section 9. was amended to read: "cost estimate and recommenation of the City Engineer, and approval of the City Manager, to construct more than two ". 12. The parentheses around Sub - paragraph B. of Section 10. were deleted. 13. Sub- paragraph A. of Section 12. was deleted; and Sub paragraph B. became Sub- paragraph A. Mayor Monroe declared the Public Hearing open on the Council's consideration of Ordinance 5, 1985, which was duly advertised May 22, 1985. Mr. Lew Lauder addressed the Council on behalf of the Palm Beach County Home Builders and Contractors Association, voicing objection to the "retroactive" clause considered for inclusion in Section 13. at the Regular Meeting of May 16, 1985 and Workshop Meeting of May 23, 1985. He was advised that this provision was no longer under consideration, as it, if included, would only apply to one project. Mr. Vincent J. Pappalardo of Pappalardo Construction Company, and Mr. Carl Sabatello of Sabatello Development Company addressed the Council not, necessarily, objecting to the intent of Ordinance 5, 1985; but rather, recom- mending a concerted effort be made toward easing off impact fees. CITY COUNCIL REGULAR MEETING, 616185 PAGE 6 During the Public Hearing, and after a five - minute recess, a new Section 10. was inserted, which read: "Section 10. Applicability to future DRIs & PUDs Not Under DRIB A. All Developments of Regional Impact shall comply with the requirements hereof. B. All Planned Unit Developments not part of a Development of Regional Impact, as a minimum, shall comply with the requirements hereof." The numbering of the previous Sections 10, 11, 12, and 13 were revised accordingly. Mayor Monroe declared the Public Hearing closed. By a unanimous vote of the Council, the City Clerk, with the assistance of the City Attorney, read Ordinance 5, 1985, on second and final reading, by title, and the new Sections 8 and 10. Ordinance 5, 1985, was unanimously adopted by the Council. ORDINANCE 11, Mayor Monroe declared the Public Hearing open, which was duly advertised May 20, I985- 1985, and held on the intent of Ordinance 11, 1985, providing for the zoning of lands contained in phases of the multi - family section of the "Sandtree" PUD that remain uncompleted. Mr. Douglas Algeri of 801 Sandtree Drive, PBG, addressed the Council expessing concern re: the appearance and safety of the area used for storage of vehicles and construction materials to the rear of his townhouse unit in "Sandtree ". He was advised that the passage of Ordinance 11, 1985, will enable Code Enforcement at this site. Mr. Philip Clare of 414 Sandtree Drive, PBG, addressed the Council endorsing their passage of Ordinance 11, 1985. CITY COUNCIL REGULAR MEETING, 616185 PAGL i Mayor Monroe declared the Public Hearing closed. By a unanimous vote of the Council, the City Clerk read, by title only, on second and final reading, Ordinance 11, 19815. Ordinance 11, 1985, was unani- mously adopted by the Council. ORDINANCE 14, Attorney Larry Smith, authorized agent, addressed the Council pursuant to their ?98- consideration of first reading of Ordinance 14, 1985, In response to his inquiry, Councilman Kiselewski advised he was not in favor of the shed currently located close to the rear property line of the project remaining as is. By a unanimous vote of the Council, the City Clerk read, by title only, on first reading, Ordinance 14, 1985. Ordinance 14, 1985, will be further workshopped by the Council at their meeting of June 20, 1985. A Public Hearing and the Council's consideration of adoption of Ordinance 14, 1985, will take place at the Regular Meeting of July 18, 1985. ORDINANCE 16, By a unanimous vote of the Council, 278. the City Clerk read, by title only, on _ first reading, Ordinance 16, 1985. A duly advertised Public Hearing and the Council's consideration of adoption of Ordinance 16, 1985, will take place at the Regular Meeting of June 20, 1985. RESOLUTIONS: By the concurrence of the Council, the City Clerk read, by title only, Resolution RESOLUTION 22, 22, 1985, requesting permission of the Palm Beach County Commission to rezone .138 lands under consideration for annexation via Ordinance 14, 1985. By a vote of four ayes and one nay, with Mayor Monroe voting in the negative, Resolution 22, 1985, was adopted. My address is 213 Riverside Drive, Palm Beach Gardens. What I have to say , but I feel that it's time that the City Council members heard what the City, the people and your men in blue who cannot — speak for themselves for fear of losing their jobs. Therefore, a couple of them have asked me to speak for them and I said I would. Mr. Orr, I came here tonight as a citizen of Palm Beach Gardens for the past 12 years and for your men in blue fear of losing their jobs. I feel it my duty to them to say what has to be said Your police department has been in shambles for some time. It is now that the whole thing is coming out. I don't a secret to this Council that you have known about the internal problems of the police department to one of your Council mem- bers on a few occasions, and his reply was that he would check into this. We the residents of Palm Beach Gardens are tired of promises that something will be done. Your police officers are being harrassed, being followed and watching everything that they say. in the City to checking potholes in the streets, checking street signs and numerous other jobs. This is not what they were paid for. We want to know what happened to the man that was hired to do this job. has to watch everything that he said because that his office may be being bugged. wires in his ceiling that have been ripped out and replaced and I know no one knows . We are not here tonight not only to justify whether the chief has done something wrong, but we are here to make as not for the citizens interest in this town be fired. We are about to open up many years ago. The people in Palm Beach Gardens are tired of reading in the paper about cars and maybe once in a while a car stolen, for there are many other things that have happened in this town have and will know. it is time the citizens know the truth and and your men in blue can back . We are tired of a certain number of people running this town that are not doing their job. the golf capital of the world. You have built swimming pools, you have the finest recreation that money can buy and why do we not have the finest police force that money can buy. What good is all this if your 100,000 miles on them with bald tires. Cars that won't start if they had to upkeep of these vehicles. We are here to stick up for those officers that are here to protect matter is brought into the open, and yet they sit back keeping their mouth shut " I feel that we owe it to them to clean house if need be to make sure that we have the finest all this beauty surrounding us with corruption going on in your police department. be able to defend what is right. I implore you, the City Council, to investigate these facts and to act . Fact #1: Recent law suits brought on by police officers that were in the City all lost or settled out of court because of poor investigation being done. police officers working up to last year with an illegal pension plan. A the Holiday Inn of Palm Beach Gardens called a detective bureau and informed them of a room the detective bureau sealed the room and did not follow up on any leads for three days. By then the leads were dried was received from a murder victim's mother living in Tampa. She asked the D- Bureau and refused to let the detective go and follow up on the leads which may have resulted in solving something in this town in the past couple of years where the money was recovered but was never turned in. One of your police captains was in this matter and was finally able to turn the whole amount in. One of your captains in the police department in a short period of time. It was after complaint from other officers that their lockers were broken into. After this same captain was observed carrying out by the handfull folders and records from the police department for a one week period. We want to know what was in them that had to be taken out of the file cabinets in the department. One that people can see and another one that they can't It is also a known fact that drugs run rampant in this City. Last year observed 17 -21 high school children entering a house within a one hour period. She hired to look into this matter and notified the high school. The high school called up the detective bureau who is still employed with the Palm Beach Gardens Police Department. His reply was that if It is also a known fact that some of your police officers at the top of your department prostitution ring at the Holiday Inn and Sheraton Inn. I myself have been approached on a few occasions to — join the ring. It is also a known fact that there was a heavy betting operation going on in one of the local clubs and is there and one of your captains that now held the rank of lieutenant many years ago was busted from lieutenant to police officer. The charges were from his defacing the badge by engaging in sex was asked to resign and did so. When the City was working without a contract he was hired back and reinstated as captain. The high ranking officers had had numerous complaints of the same captain. Within the past few years it is a known fact that failed to make probation or asked to resign. A recent case was who held the rank of detective there and did not make probation here. We want to know why. One of your lieutenants has worked his way up from patrolman to lieutenant in a short period of time * He has stated to the men that it would give him great pleasure to be a top officers have not qualified on the police range which is Fact, one of your lieutenants has had a hard time recently appre- hending a suspect because another officer was called to apprehend the suspect and was asked by the lieutenant to lie officer on the force now who is being investigated has not been suspended people with the head of this being a top City official, how can these people The City Council and Mr. Orr have known about these problems going on in this City for sometime and have failed to correct them. Your police force is 20 years behind the times. The problem existing . One of your top City officials has stated that he is headhunting and is looking for an inspector on the force. Look no further, you know who we are now . If you feel that the ex -chief should have been fired then I would think that you would if need be. We are here to fight for what we feel is right. You owe an investigation to the citizens and this town just cause to fire the chief or pressure him to resign. We feel that there was headhunting the He PETITION FOR GOOD ACCESS TO THE SHOPPING MALL "THE GARDENS" Dear Mayor Vie: This is a petition concerning the shopping mall "The Gardens ". We think it is very important to have good access to the Mall and that the roads should be able to handle a fast flow of traffic, especially in cases of emergency. If the railroad crossing at PGA and AIA stays the way it is, there may be problems for emergency vehicles (police, fire engines) to get to the Mall fast enough, specially when the railroad crossing is closed. We think it would be most important to have a PGA overpass at the railroad crossing. Not only would it be good for emergencies mentioned above, but it would be a realistic approach to the growing traffic in the years ahead. It would also cut the whistle blowing each time a train passes and would help -in keeping the noise level down for the Mall and nearby habitations. We think it must be the responsibility of Bankers Land Company and the Railroad Company to share in the expenses of an overpass at PGA and AIA. Bankers Land Company is the primary beneficiary of the Gardens Mall and the Railroad crossing is an interference to the good flow of traffic on PGA Blvd. (specially in case of emergency). APPROXIMATELY 45 SINGLE FAMILY HOMES �UBMI TE�Dy� Maw 23 - 1985 JACK Hr�NSON 0 BUILDING OFFICIAL My name is Jeanne Yeend and I reside in Town Oaks, Palm Beach Gardens, corner of Burns and Prosperity Farms Road. I am spokesperson for the 23 families who own property on the drainage canal that runs immediately North of the Allamanda school. It runs from behind Sandalwood Estates accross Allamanda Road to Prosperity Farms Roaaand drains into what is known as Prosperity Harbor. Along the South bank of this canal there is a lush, dense area of natural Florida vegetation. We have observed anhinga, little blue herons, iimpkin, great white egrets, sand cranes, ibis, terns, gallinules, little green herons, etc., some of whom are nesting. Of the garden birds�ve have seen black birds, red winged black birds, boattail grackles, blue jays, oreoles, cardinals, painted buntings, woodpeckers and more. Also a red fox and an otter have been spotted. In the canal there are numerous fish and turtles. This small area that adjoins the Allamanda school property is a veritable oasis in what is otherwise rapidly becoming closely populated. We request the council to preserve this parcel of land as a natural conservation easement. We would in the meantime appreciate the posting of signs on both Allamanda and Prosperity Farms Roads prohibiting motorized vehicles from disturbing the peace and eliminate the dumping of trash. We invite the members of this council to view for themselves the simple beauty of what is in reality only a drainage dithh and perhaps send a clean up crew to rid it of the flotsam and jetsam accumulated at the Allamanda road bridge. Now that there is such an alarming increase in population in Florida, especially in Palm Beach county, it is imperative to preserve every unspoiled stretch of nature that is not crucial to development.
