WORKSHOP h£ETING
CITY OF PALM BEACH GARDENS
40 MAY 23, 1985
The Workshop Meeting of the City Council of Palm Beach Gardens, Florida,
was called to order by Mayor Linda Monroe, at 8:00 P.M., in the Assembly
Room, 10500 North Military Trail, Palm Beach Gardens, Florida, and was
opened with the Pledge of Allegiance to the Flag.
ROLL CALL: The roll was called by the Deputy City Clerk and present were: Mayor
Monroe, Councilman Martino, Councilman Aldred, and Councilman Feeney.
vice Mayor Kiselewski was absent.
City Manager John Orr and Attorney William Brant were in attendance.

POLICE The City Manager advised that Folice Chief Edward Himmelsbach has

been suspended without pay, pending further investigation.
REPORTS:
COUNCILMAN Councilman Feeney reported that he attended the meeting of the City's

Site Plan and Appearar. a Review Committee, May 21, 1985. The minutes of
this meeting are on file in the office of the City Clerk.
ITEMS BY THE MAYOR AND COUNCIL:
COUNCILMAN Councilman Feeney advised that the parking situation for the ballfields
at Gardens Park should be looked into. He feels there is inadequate
parking facilities.

ORDINANCES:
ORDINANCE The City Council workshopped Ordinance 5, 1985, providing for
5, 1985
"Fair Sl.are Contribution for Hoad Improvements" by developers of new
projects within the City.
There was concern about that section of this Ordinance pertaining
to retroactive provisions, especially as it relates to previously
approved Planned Unit Developments. The City Manager advised that
this will not effect those PUD's as they have made a contribution
through that process.
The fees listed in the Ordinance are lower than those given in the
County's Ordinance. The City Manager advised that the fee schedule
Palm Beach County has adopted is rather high at this time.
The Council requested the City Manager request the back -up information
used in justification of the fees adopted by Palm Beach County.
Ordinance 5, 1985 will be placed on Second Reading and Council's
consideration of passage at the Regular Meeting of June S, 1985.
ITEMS FOR DISCUSSION:
AMENDING "WINCHESTER COURTS" MULTI - FAMILY PUD CREATED 813178 BY ORD.

Mr, Samuel Holden and Mr. Ken Reed were present representing the
Winchester Courts Homeowner's Association.

They addressed the Council explaining that the tot lot now in
® place at Winchester Courts is so rarely used, and they feel
it invites trouble with the younger generation, that a passive
park is requested in it's place.
There was a vote taken of the owner.- who reside on this property
and it was a majority vote in favor of the replacement.
The Council requested a plan or pictures showing how the tot lot
appears presently and what they plan for the passive park.
It is the intention of the Association to donate the equipment
now in place to the City.
The City Attorney was requested to draft an Ordinance which will be
placed on First Reading at the Regular Meeting of June 20, 1985.
ANNEXATION OF 5.056 -ACRE SITE OF IJOW- "POSSUM FGLLOW PLANT NURSERY"

The Mayor addressed two Letters of correspondence relating to this
project. The first from Mr. Richard hbrley, a principal planner with
Palm Beach County, and comments from the County Engineer. The second
from Kimley Horn Traffic Consultants with a traffic analysis.
Mr. John Trusler, Windward Development, addressed the Council, explain-
ing he is proposing 40 townhouse units, two and three bedrooms with
single car garages. The existing zoning in Palm Beach County is AC -
Agricultural.

Mr. Trusler presented the side and rear elevations, explaining
the units will be condominiums consisting of 1000 to 1300 square
feet. A deceleration lane is being incorporated into the plans.
Mr. Bruce Friedman, Klmely Horn Traffic Consultants, addressed the
Council and explained that after their research a recommendation
was made to construct a right turn lane for traffic heading west
turning into the project.
Mr. Trusler was requested to determine the distance from the
intersection of Northlake Boulevard and Military Trail to the
entrance of this project and report to the Council on his findings.
He also agreed to the construction of a concrete sidewalk the
length of his property along Nbrthlake Boulevard.
• There was concern about insufficient parking spaces and Mr. Trusler
advised that he added an additional six reserved parking spaces if
needed.
Residents of the Horseshoe Acres project addressed the Council with
their concerns and voiced their objection to the density of this
proposed project.
The City Attorney was requested to prepare an Ordinance which will be
placed on First Reading at the Council's Regular Meeting of June 6, 1985.

ANNEXATION OF .31 -ACRE PARCEL ON EAST SIDE OF ELLISON WILSON ROAD,
FOR THE GREAT-1 N

Mr. Larry Smith, Attorney, addressed the Council informing that a
cross parking agreement is being proposed between this parcel and
that parcel directly south, which wis recently annexed into the City.
He advised of the comments made by the City's Planning and Zoning
Commission. It has been agreed upon to pave Smith Drive from property
line to property line. The building proposed will consist of
approximately 1200 gross square feet. The proposed commercial usage
for this parcel was agreed upon by the Council.
The parking spaces provided total 13, the City Code requires 5 - 7
spaces. The Council requested the spaces on the east side of the site
be shortened to add to the buffer along that property line. There
was question as to whether to keep the existing shed located in the
southeast corner of the property.
It was suggested that at such time as this parcel is joined together
with that parcel directly to the south, the iumpster be placed on the
adjacent site. It was requested that a concrete sidewalk be
constructed along Ellison Wilson Road from Bomar Drive to Smith Drive.
Mr. Smith advised that there will be a cross - maintenance agreement
between these two parcels.
The City Attorney was requested to prepare the ordinance .which will
be read on Second Reading at the Council's Regular Meeting of
June 6, I985.

The City's Fire Marshal, Peter 8ergel, spoke to the Council explaining
his recommendations on amending the City's Fire Protection and
Prevention Code.
Section 11 -5. Codes and Standards Adopted: it is suggested the
Volume numbers be changed to conform with the latest edition of
the National Fire Code.
Section I1 -26. Water Service for Fire Protection: single family
attached /zero lot line homes is added to the requirement of placement
of fire hydrants every 300 feet versus 500 feet.
Section 11 -35. Fire Department Communications: this is a new code
added requiring all building having floors for human occupancy
located more than five stories or sixty feet above the finished grade
elevation of fire department vehicle access and /or building having a
gross floor area exceeding 75,000 square feet on any given floor
from the finished grade, provide fire department communications.
The Fire Marshal advis.;u that the only commercial building in the
City conforming with this requirement presently is The Towers.
The Council requested a letter from the developer of this project,
informing as to the reason they went with this particular system.
The City Attorney was requested to draft an Ordinance for these
amendments. The Ordinance will be placed on First Reading at the
Regular Meeting of the Council on June 20, 1985.

PETITIONS AND COMMUNICATIONS:
Mayor Munroe acknowledged receipt of the following communications:
MUNICIPAL 1. Agenda from the Municipal League advising of their meeting May 31,

Councilman Aldred advised that a project by Satter Companies south
of the City, is being advertised on WRMF radio as being located in
Palm Beach Gardens. A letter will be sent to the Satter Companies
informing of the City's opposition to their advertisement.
ADJOURNkENT: There being no further business to discuss, the meeting was adjourned
at 1I:25 P.M.
