ROLL CALL: The roll was called by the City Clerk and present were: Mayor Aldred, Vice Mayor Kiedis, Councilman Martino, Councilwoman Monroe, and Councilman Kiselewsi,i. City Manager John Orr and Attorney William Brant were also in attendance. MINUTES: The minutes of the Workshop Meeting of December 8, 1983, and Regular Meeting of December 15, 1983, were unanimously approved by the Council, as written. ANNOU =-MENTS: M.3vor Aldred announced that meetings of o „r Planning and Zoning Commission, Recreation Advisory Board, Merit System Board, and Fire Department will convene at 7:30 P.M. on Tuesday, January 10, 1984; and meetings of our ® Zoning Board of Appeals and Beautification and Environmental Committee will convene at 7:30 P.M. on Wednesdav, January 11, 1984. Mayor Aldred recognized Councilman Martino's appointment to the Board of Directors of the Northern Palm Beach County Chamber of Commerce. PROCLAMATIONS: :Mayor Aldred read proclanations proclaiming January, 1984, "National Volunteer Blood Dono Month” and "Arbor Month ". ITEMS BY THE CITY MANAGER: STATE DOT'S The City Manager reported that pursuant to Resolution 68, 1983, the State RCI Department of Transportation acquired the City's 2.9 -acre parcel located CITY'S 2.9- ACRE PARCEL within the right -of -way of the proposed Interstate -95 northw,,rd extension. DONATED The $175,000 received December 28, 1983 for this parcel donated to the City by DiVosta Construction Company, developer of the Garden Lakes /Square PUB, were deposited into the City's Recreational Land /Facilities Fee Account. PURCHASE OF Per the recommendation of the City Manager, the Council unanimously ,adopted PATROL a motion authorizing he purchase, under State Contract, of five 1984 Chevro- 1 FOR CITY MNGR. 8 p let Impalas @ $8,857.65 each - the cost of the four to be assigned to the 0 Police Department for patrol cars to be taken from the Federal Revenue Sharin, Account; and the cor.t of the one to be a5siprned to the City Manager and used by police personnel when needed/available, to be taken from the Council Contingency Account. City Council Regular Meeting, 1/5/84 Page 2 LIGHTING CITY'S At the Workshop Meeting of January 12, 1984, the Council will discuss JOGGING TRAIL soliciting sealed hids for lighting, the City's jogging trail on the south side of Burns Road, cast of Military Trail. The recommendations of the Recreation Advisory Board re: performance specifications for this proposed project will be rnquetited o£ them of thetr meeting of January 10, 1984. Also, the Recreation Director will contact Mr. Bill Hebden, an electrician emploved by Pratt 6 Whitney Aircraft that addressed the Council offering input. COUNTY IMPROV- The City Manager reported that per the County, construction shouiLl commence ING MILITARY within 30 -60 days on the center stacking lanes for left -hand turns along the TIt iR 7=CTIONS segment of Military Trail between Holly Drive and Northlake Boulevard. REPORTS: Councilman Kiselewski reported on the meeting he, Member, attended of the COUNCILKAN Palm Beach County Metropolitan Planning Organization this date. At this KISEJ�EWSKI meeting, they finalized establishing a system by which they will be able to evaluate and prioritize roadways within the County; and received a report on the Palm Beach Expressway Authority established by a Special Act of the Florida Legislature effective ,July 1, 1983. STAN REDICK RE: Stan Redick, Palm Beach County Planning Director, addressing Mr. Howard BANKERS LAND Muse, DRT Coordinator of the Treasure Coast Regional Planning Council, CO.DRI outlining concerns rc; the traffic impact of the Bankers Land Company Regional Center proposed to be located within our City; and suggested referral to our contracted land planner, Marvin Hill, and independent traffic engineer, David Plummer. The City Manager noted the tardiness of the department's participation /input, as the TCRPC's hearing on recom- mendations to the City was held December 16th and the communication was received by all on December 21st; and advised it has been referred. ECONOMIC COUN- The City Manager noted the event to be held February 2nd - 4th, 1984, by CIL EVENT the Economic Council at Port St. Lucie. PSC'S HEARINGS The City Manager advised that the Public Service Commission has reserved ON SEACOAST the auditorium at the City's Community Center for Public Hearings on UTILITIES RATE INCREASE Seacoast Utilities' request for rate increases on February 2nd and 3rd from 10:00 A.M. to 5:00 P.M.. Mayor Aldred acknowledged receipt of communications from: ROBERT & CO. 1. Robert and Company Associates, dated January 3, 1984, advising of the ASSOCIATES meeting to be held January 13, 1984, by the Technical Advisory Committee of the Palm Beach Countv Central Region on treatment plant sludge and its disposal. The Board of County Commissioners has directed that a meeting be held with all the municipalities to request their comments in this regard. F, Kahlert County Engineer Subject: Palm Beach County Erosion Prevention District Proposed Act Commissioners: The attached is an executive summary of a proposed act which establishes a Special Taxing District for Palm Beach County which would be known as the Palm Beach County Erosion Prevention District. This executive summary is intended only as an outline of the proposed act which would be drafted and presented to the State Legislature for approval if the Board -of County Commissioners wishes to pursue specific legislation. Upon conceptual approval by this Board, it should be presented to the Inlet Districts and the Municipal League for comments. The proposed act would provide for erosion control, maintenance of three of the four inlets, and provides for varying taxing rates according to benefit tones. The proposed act would also provide for a governing board comprised of three members of the Board of County Commissioners and four municipal officials. County Engineer HFK:d BOX 2429 • WEST PALR1 BEACH, FLORIDA 23402 • (305) 634 -4000 �J 11 EXECUTIVE SUMMARY PALM BEACH COUNTY EROSION PREVENTION DISTRICT ACT This act will create a special tax district for Palm Beach County which will be known as The Palm Beach County Erosion Prevention District. The district would be governed by a board which would be made up of three Palm Beach County Commissioners and four elected officials from municipalities within the district. The purpose of the district will be to construct and maintain beach nourishment projects, erosion control structures, sand transfer plants, and maintenance of the inlets for navigation and erosion control purposes. It is proposed that the Act redesignate the Jupiter Inlet District, the South Lake Worth Inlet District, and the Boca Raton Inlet under the Prevention District. This will provide for uniform control of these inlets and beaches since they are closely related and affect each other. Under the assumption that all County residents benefit, it is proposed that zones be established which would classify the type of benefit received; i.e., purely recreational recreational plus shore protection, utilization to navigable inlets., etc. Those with property on the ocean will derive a stbrlm protection benefit from the maintenance of the beach. Those residents living in the vicinity of the Jupiter, Boynton and Boca Inlets would have the benefit of a navigable inlet nearby. Thus the County could be divided Into several zones for the purposes of taxing. For example: Zone A -- Could be Ocean Front Propoerty. Zone B -- Could be the remaining property within the County outside of the Inlet Districts. Zone C -- Could be that property which now lies in the Jupiter Inlet District and is located on the ocean. ZoneD -- Could be that property which now lies in the South Lake Worth Inlet District and is located on the ocean. Zone E -- Could be that property which nov lies in the Jupiter Inlet District and is not on the ocean. Zone F -- Could be that property which now lies in the South Lake Worth District and is not on the ocean. A map showing the proposed zones is attached. El It would be proposed that the taxing rate vary for each zone based on the benefit received. A more detailed basis for establishing a millage cap is necessary; however, based on this example the miliae rates to generate approximately $1 Million in budget based on the 1983 tax roll would be: Zone A 0.40 Mills Zone B 0.06 Mills Zone C 0.63 Mills Zone D 0.45 Mills Zone E 0.29 Mills Zone F 0.11 Mills Conceptually, the erosion prevention board would prepare an annual budget and have the power to levy ad valorem taxes on all property within the county at the varying rates similar to those described above to finance the work of the district. In addition the district should have the power to issue bonds for the purpose of raising money to construct large projects and borrow money for periods as allowed under general 1%V. The district would be authorized to apply for and accept money from State and Federal grants for construction and engineering on erosion control projects. The daily operations of the erosion prevention district would be controlled by the district supervisor. The supervisor would coordinate all activities of the District. The supervisor would be appointed by the board. The board would have the power to hire engineers and other professionals to assist them in evaluations and project designs as required. Broxard County has an Erosion Control Prevention District which appears to be working. The Board of County Commissioners may wish to hear from its Executive Director at some workshop. If the Board is inclined to move in the direction summarized above, it is respectfully requested that it be presented in concept to the Legislative Delegation at the January meeting.
