HomeMy WebLinkAboutMinutes Council 041984CITY COUNCIL REGULAR MEETING CITY OF PALM BEACH GARDENS APRIL 19, 1984 The Regular Meeting of the City Council of Palm Beach Gardens, Florida, was called to order by Mayor Martino at 8:00 P.M., in the Assembly Room, located within the Municipal Complex at 10500 North Military Trail, Palm Beach Gardens, Florida; and opened with the Pledge of Allegiance to the Flag. ROLL CALL: The roll was called by the City Clerk and present were: Mayor Martino, Vice Mayor Monroe, Councilman Kiedis, and Councilman Kiselewski. Councilman Aldred was not in attendance, as he had a pressing commitment to tend to. City Manager John Orr and Attorney George Baldwin were also in attendance. MINUTES: The minutes of the Regular Meeting of April 5, 1984, were approved, as amended, by a motion adopted by Mayor Martino, Councilman Kiedis, and Councilman Kiselewski. Councilwoman Monroe abstained from voting, as she was not in attendance at that meeting. ® The minutes of the Workshop Meeting of April 12, 1984, were approved, as amended, by a motion unanimously adopted by the Council. ANNOUNCEMENTS: Mayor Martino announced that the bi- monthly meeting of the City Planning and Zoning Commission will convene at 7:30 P.M., on Tuesday, April 24, 1984. ITEMS BY THE CITY MANAGER: REQUEST FOR The City Manager referenced the copv of a communication he sent this date to MATCHING FUNDS FROM COUNTY Palm Beach County Commissioner Peggy Evart, requesting that the County FOR RECREA- provide matching funds (i.e., 50% of the $12,990 low bid awarded March 15,-1,1 TONAL IMPROVEMENTS 1984) for lighting the City's jogging trail that is not monitored aL to usage by residents /non - residents of the City. In response to Councilman Kiselewski, the City Manager advised that the City's recreational facilities that are improved with Federal, State, or County funding are open to non- residents for the same fee, if any, as residents. ANTICIPATED The City Manager reported that he spoke with representatives of Connecticut INCREASE IN General this week re: the anticipated increase in the City's PREMIUMS FOR p y premiums for 40 CITY EMPLOYEES' our employees' hospitalization coverage. He hopes to have an accurate HOSPITALIZATION COVERAGE figure for discussion at next week's Workshop Meeting. City Council Regular Meeting, 4/19/84 Page 2 IMPROVEMENTS TO The City Manager noted that the County's installation of the center - stacking MILITARY TRAIL lanes at the intersections along the Holly Drive/Northlake Boulevard segment BETWEEN HOLLY DRIVE & of Military Trail are coring along; and advised he is inquiring as to NORTHLAKE BLVD. whether they intend to replace the concrete radii and mark the street pavement as part of the program. Councilwoman Monroe expressed concern re: the manner in which traffic is being directed during the cunstruction of the above - referenced improvements. She requested that the Police Department monitor whether motorists are being stopped for undue periods of time, while waiting for others travelling in other directions. Councilman Kiselewski expressed concern re:the safety of citizens until such time the bicycle/pedestrian paths are replaced as a part of the roadway improvement program. He felt some temporary steps should be taken to alleviate this potential hazard. REPORTS: Councilman Kiselewski reported that the C+ty's Comprehensive Land Use COUNCILMAN Planning Committee's regularly- scheduled meeting of April 18, 1984, was KISELEWSKI cancelled due to the lack of a quorum. • Councilman Kiselewski, member of the P.ilm Beach County Solid Waste Authority, reported on their meeting he attended April 18, 1984. VICE MAYOR Vice Mayor Monroe reported that she received something in the mail this last MONROE week on the relatively -new solid waste treatment facility in Pinellas County; and noted that it was working out well. ITEMS BY THE MAYOR LND COUNCIL: 2% INCENTIVE Per the recommendation of the City Manager in a memo dated April 17, 1984, PAY RAISE FOR a motion was unanimously adopted by the Council that all full -time employees, CITY EMPLOYEES except certified police officers, with more than six (6) months service with the City of Palm Beach Gardens as of October 1, 1983, shall receive a wage adjustment of two percent (2%) effective May 1, 1984 - the funds to be taken from Account 02 -59.10 (Council Contingency) to be replenished with this fiscal year's budget revision. With the exception of the Chief, all certifed police officers with more than one (1) year's service with the Ciry as of October 1, 1983, received the same wage adjustment effective, January 1, 1984. Six months is the probationery period for all City employees, except certifed ® police officers who have a probationery period of one year. City Council Regular Meeting, 4/19/84 Page 3 COUNCILMAN Councilman Kiselewski suggested that, whenever possible, the pending items KISELEWSKI for Council discussion be scheduled in their order of introduction. ® COUNCILMAN In response to Cuuucilswu faedis, the City Manager confirued that Bankers KIEDIS Land Company has seeded and mulched the previous location of the Hetzel Brothers Christmas & Easter Pageants on the northwest corner of Northlake and MacArthur Boulevards; and they are working on the east side. The City will work with them as much as we can to get the water fountain in operation again, etcetera; and we will maintain these lands they now own. The City Attorney was requested to draft an ordinance for the Council's consideration, providing for developers' payment of costs for independent planning, engineering, and traffic studies for their projects. VICE MAYOR Vice Mayor Monroe reported that some time ago she had discussed with the City's Forester and member, of the City's Building and Public Works Depart- ments the City's Tree Preservation Ordinance; and they came up with some minor revisions. She discussed them with the City's Site Ylan and Appearance Review Committee at their meeting of April 3rd; and asked for their comments. She suggested that she submit the suggested revisions to the Council for . their workshop at a future meeting. Vice Mayor Monroe noted the article in the April 19, 1984 "Town Crier" local newspaper in which Mayor Martino responded favorably to his interpretation of the quote in last Sunday's newspaper of Jupiter Mayor Mary Hinton re: the need for a committee to central growth at a regional level before development of large tracts of now - vacant land begins. Vice Mayor Monroe was concerned that in contrary to the County's Comprehensive Land Use Plan, Okeechobee Boulevard in West Palm Beach is reportedly going to, in the very near future, be eight - laced in one area; and, without proper p1.inn1ng /-Tuning the Same could happen to PCA Boulevard. Per the County Comprehensive Land Use Plan, the majority of the land between our City and Jupiter is zoned multiple family, which is 8 u/p /a, with an allowable bonus of 4 u /p /a under a PUD, and a possible additional bonus of 4 u /p /a with "transfer of development rights ". She, too, suggested that our City, Jupiter, and the County have ,ome dialogue re: this. When Vice Mayor Monroe contacted her, Mayor Hinton was very pleased to see that there was an interest; and as soon as the Council of Governments meets on May 2, 1984, she will be in contact with us. City Council Regular Meeting, 4/19/84 Page 4 MAYOR MARTINO Mayor Martino reported that the YMCA on Monet Road in the City contacted ® him regarding signs for locating their facility. Mayor Martino advised the ger`leman that a:, ions 1s Ghay conformed with the format /traffic -type signs that we use in the City, he didn't feel it would be objectionable; and referred him to the City Manager. COUNCILMAN Councilman Kiselewski offered that he is objectionable to any sign in the KISELEWSKI City that is not in conformity with our Code, including off- premise advertising. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA: MR. SAMUEL In response to Mr. Samuel Carsillo, 10063 Dahila Ave., PBG, members of the CARSILLO Council expressed that while Che Citv is not divided Lnto districts for the five Council seats, they, regardleos of the area they live in, are unbiased in making decisions. Also, the time frame for the City to realize Bankers Land Company's donation of a fire sub - station east of the railroad tracks was, effectively, the recommendation of the City's Fire Chief all parties mutually agreed upon at the time of adoption of the Development Order for the Bankers Land Company Regional Center. ® RESOLUTIONS: During the discussion on Resolution 29, 1984, providing for the adoption of RESOLUTION 29, the "Position Classifications" recommended by the City's Merit System Board 1984 -- for inclusion in the City's Rules and Regulations, the "Statement of Duties" for the Planning Director was amended to include "Ability to Analyze Development Plans" and "Ability to make oral and graphic presentations ". Per the request of the Mavor, the CLty Clerk read, in full, Resolution 29, 1984. A motion was made by Councilman Kiselewski seconded by Councilman Kiedis, the Council adopt Resolution 29, 1984, as amended. Discussion on the motion; In response to Councilman Kiselewski, the City Manager advised that he does have enough documentation to advertise, interview, and recommend the most qualified person for the planning position that has been a topic of discussion for some time, with the amount of money previously discussed for his /her wages Pursuant to the thoughts of Vice Mayor Monroe, the City Manager recommended the verbiage ", such as finance, personnel,etcetera" be added to the sentence "Performs related work as required" outlined as the last item under "State- ment of Duties" under the position of "Assistant to City Manager". City Council Regular Meeting, 4/19/84 Page 5 In response to Councilman Kiselewski, the City Manager advised that he does ® feel that with the descriptions being considered for adoption and past d,.acussions of the Council he would not have any problems in hiring someone_ to fill any one of the positions. A motion was made by Councilman Kiselewski, seconded by Councilman Kiedis, and unanimously adopted modifying the motion on the floor to include the amendment to the job description of "Assistant to City Manager" recommended by the City Manager. The initial motion on adoption of Resolution 29, 1984, was unanimously passed by the Council. Resolution 29, 1984, was unanimously adopted by the Council with the job descriptions for "Planning Director" and "Assistant to City Manager ", a part of Exhibit "A ", amended. ITEMS FOR DISCUSSION: CITY PLANT Mr. George Wuerthner, Chairman of the City's Beautification and Environmental NURSERY AS RECOMMENDED Committee, addressed the Council reviewing the January, 1984, "City Nursery BY B & E Plan" prepared by Jonathan H. Iles, our forester, and made possible through CO�!MI TTEE the efforts of many. The members of the Council complimented the members of the City's Beautifica- tion and Environmental Committee, our Superintendent of Parks, and Mr. Jonathan H. Iles, a member of our staff per the City's two -year agreement with the State Division of Forestry, for the very informative package and good presentation; and thanked them for their interest in keeping our City in its beauteous state. A motion was unanimously adopted by the Council they authori2e the expenditure of $2400 from the Council Contingency Fund {Account 02- 59.10) to match those funds the Beautification and Environmental Committee controls under their portion of the budget (i.e., a proposed use of a part of the City's Federal Revenue Sharing funds) to establish the City -owned plant nursery a, proposed. DEADLINES IN The City Attorney was requested to draft a Resolution for the Council's PROCESSING PUD APPLICA- consideration, adopting as a policy, on a trial basis, the recommendations TIONS outlined in the City Clerk's memorandum of this date re: deadlines for developers satisfying the PUD application requirements. An Ordinance amending the City's PUD Code to be more definitive in this respect may be considered for adoption by the Council .ifter a trial period. City Council Regular Meeting, 4/19/84 Page 6 At a future meeting, the Council will discuss the request of members of the City's Planning & Zoning Commission for delivery, to their homes, the site plans, archltectural elevation plans, and landscaping plans a part of PUD applications, so they may be familiarized with them prior to their meetings. In the meantime, members of the City's advisory boards and staff are invited, in writing, to attend the Preapplication Review in compliance with Section 16.7 of our PUD Code. Councilwoman Monroe noted that per Resolution 22, 1982, in the event the Site Plan & Appearance Review Committee shall not hold a meeting ^ithin 10 days of the final hearing by the Planning and Zoning Commission, input/ comments of the Committee is automatically waived; and expressed concern that with the committee now only meeting once a month, the Council may not have the benefit of their comments on some PUD applications. Councilman Kiselewski offered that when the Council agreed with the Site Plan & Appearance Review Committee's sugoestion/request to be a part of the PUD process, the Council adopted the Resolution providing for their comments within the 10 days. He felt that the intent of the Council was that in the event the Committee's regularly - scheduled meeting does not fall within the 0 10 -day time period, the administration should be scheduling a special meeting of the advisory board if they wish to ive input on the subject. The City Manager assured the Council that there would be a secon� meeting scheduled for a given month when its necessarXttS u�gl� wA� i�he jq Cu�ncigucrTfecSiszder amending Cub- paragraph 16.6 of the City's PUD Code, providing for the application filing fees to be payable to the City at the time of formal application to the Planning and Zoning Commission. Vice Mayor Monroe noted that Mr. Vincent Pappalardo, owner of Lhe idi,icent "Tanglewood Plaza ", was not receptive to the City's request he modify the Ingresses /egresses at the commercial/residential PUD; and suggested the members of the public might have some input with him. ® In response to Councilman Kiedis, the City Manager advised that the City has had a couple of traffic studies performed at the intersection; and one thing both studies recommended was one-way-in/one-way-out traffic to /from the plaza. City Council REgular Meeting, 4/19/84 Page 7 Councilman Kiselewski noted that Mr. Pappalardo providing for the parking ® garage at his "Admiralty" office building to be utilized by the evening patrons of the "Abbey Road" restaurant/lounge has allevia*ed some of the problems. "GREEN SPACE" Councilman Kiedis requested that the Building Department measure the depth of ALONG NORTHLAKE BOULEVARD the green space along the front of the projects within the City on Northlake Boulevard, from the Garden Lakes Bowling Alley to Military Trail, to see what the City might achieve in requiring a certain setback for future developments. In response to Councilman Kiselewski, Councilman Kiedis advised that the purpose of this exercise is to see whether we could/should adopt an Ordinance providing for a "green belt" a certain depth that is appropriate to what is already being developed within the community. Councilman Kiselewski suggested that a copy of the City's 55' -wide Green Belt Ordinance be forwarded to the County and the Mayor of Jupiter, soliciting their receptiveness to continuing it along Military Trail within the unincorporated areas and the Town of Jupiter. gft CITY MANAGER The City Manager suggested that the Council consider an Ordinance regulating JOHN ORR RE: REGULATING garage sales, as some homeowners are using them to sell new merchandise on GARAGE SALES a regular basis as a means of earning income; and they cause a traffic problem. The City Attorney, with the input of the City Manager, will draft recommendations for the Council's consideration. COUNCILMAN Councilman Kiedis noted that the house immediately south of the Earman River KIEDIS RE: POSSIBLE VACANT on Military Trail appears to be vacant; and the grass /weeds are rapidly HOUSE approaching the 18" maximum in height the City permits. The City Manager will have this checked into. VICE MAYOR Vice Mayor Monroe relayed concerns expressed to her re: Scotty's Lumber MONROE RE: MAINTENANCE OF on Northlake Boulevard not maintaining the drainage ditch within the road R/O /W AT right -cf-way; and was advised that the City does not have jurisdiction over SCOTTY'S LUMBER County /State property. COUNCILMAN Councilman Kiselewski noted that the Council has had many discussions on what KISELEWSKI RE: the Land Planner and Assistant to City Manager are to be responsible for; ADVERTISING FOR EMPLOYMENT OF and made a motion the City Manager be authorized to advertise for their ®LAND PLANNER & employment. Vice Mayor Monroe seconded the motion. Orr, Jr., City Manager SUBJECT: Salary Increases In an effort to provide an incentive for some of our current employees as- well -as trying to boost morale, I am recommending that the Council consider an interim increase for all employees with the exception of certified police officers. All certified officers with the exception of the Chief received the increase as of January 1, 1984. The proposed increase would be as follows: All full -time employees, except certified police officers, with more than six (6) months service with the City of Palm Beach Gardens as of October 1, 1983, shall receive wage adjustment of two percent (2 %), effective May 1, 1984. The proposed salary adjustment would not be inconsistent with the current salary pay plan and the budgetary increase would be approximately $9,000. FLORIDA 33410 , 322.1200 April 19, 1984 The Honorable Peggy Evatt Palm Beach County Commissioner Northeast County Courthouse 3188 PGA Boulevard Palm Beach Gardens, F1 33410 Dear Commissioner Evatt: The City of Palm Beach Gardens has received bids for the lighting of the jogging trail. This will allow for greater utilization of • the jogging trail during the nighttime hours, and we project that at least 40 to 50 percent of the people using this facility will reside outside the City of Palm Beach Gardens. Therefore, we are requesting that the county provide matching funds for the installation of the lights. The low bid for the project was $12,990.00, of which we are asking that the county participate with 50 per cent of these funds. We recognize that it will be the City's responsibility to continue to maintain the jogging trail in an acceptable condition, and that the county's obligation, if approved, would be for the initial instal- lation of the lights only.
