HomeMy WebLinkAboutMinutes Council 0203832 CITY COUNCIL REGULAR MEETING CITY OF PALM BEACH GARDENS FEBRUARY 3, 1983 Tho Regular Meeting of the City Council of the City of Palm Beach Gardens, Florida, was called to order by Mayor Kiselewski at 8:00 P.M., in the Assembly Room, 10500 North Military Trail, Palm Beach Gardens, Florida; and opened with the Pledge of Allegiance to the Flag. ROLL (.ALL: The roll was called by Deputy City Clerk and present were: Mayor Kiselewski, Vtce Mayor Monroe, Councilman Kiedis, and Councilman Martino. Councilman Aldred was not in attendance. MINUTES: The minutes of the Workshop Meeting of January 13, 1983 were unanimously adopted by the Council. PROCLAJ%V\TI0NS: Mayor Kiselewski read a Proclamation proclaiming February 6 - 12, 1983 as "Vocational Education Week ". ,ITF,iS BY TFE CITY NIANAGRR: CAULKING CITY Per the request of the City Manager, the Council unanimously adopted HALL a motion authorizing him to expend $2976.00 for caulking of the City [fall windows. General Caulking and Coating Company will do the work and the monies will come from Council Contingency Fund. EMERGENCY Per the request of the City Manager, the Council unanimously adopted GENERATOR a ;notion authorizing him to expend $2400.00 for the Emergency Generator Line that will ne installed between the Fire Department and the City Hall. Public Works will install the lane, the monies to come from the Council Contingency Fund. PUMP AT PLANT Per the request of the City [Manager, the Council unanimously adopted DRIVE PARK a motion authorizing im ex $2379.75 for the g to end p pump at plant Drive, and 1,140.00 for 80' of cable for the hook -up. Monies to come from Council Contingency Fund. :,r the request of the City Manager, the Council unanimously adopted a motion authorizing him to expend $281.60 for Laws of Planning & Zoning books to be used for reference by the Planning and Zoning Commission. City Itanager advised that Attorney Brant, Mayor Kiselewski, and himself w--ll be out of town to a meeting in Tallahassee on February 9, 10, and 11, 1983. SEL'CiGSKT_ There eie still --Orie rt,ings to be done; request n be separated Lrom AIR QUALITY PLAT: Dade County so the City is considered independently, to plan litigation to sec that the Citv is not cut out from the funds, tell Dade County to clean up their act, form an alliance with Broward County, clarify what the air shed as, and they agree to uphold the clean air standards. Mayor Kiselewski talked with Jack Shreed, the Public Council, in Tallahassee who assured the Mayor that once the proposed agency order is given out there will be a 14 day period to react. If the rate is not agreed upon,the City has 14 days to react. 17EMS DY :dAsQR AND COUNCIL: COUR7CILMAN Councilman Kiedis voiced his concern of the condition of the KIEDIS: intersection of A -1 -A and Burns Road. Ke would like to make an appeal to the County or State of Transportation to get some type of emergency action taken to improve that intersection. VICE Vicc• Mayor Monroe advised that she spoke with a resident of PGA National MONPOE: and they have concern about children attempting to travel from PG% National over the turnpike to the City. The Mayor will follow -up this situation by writing a letter to the Department of Transportation for suggestions on thLS problem. COt2-1ENTS FRO:`, THE P7BLIC FOR ITEMS NOT ON THE AGENDA: BILL , -LnRKH M i�:r. williar Markham, 10330 N. military :rail, Palm Beach Gardens, spoke to the Council about moving the collection box for mail, outside the City Hall Complex, closer to the road. Another item of concern to Mr. [iarkham was raising of the Council's salaries. He feels that this City's Council is the lowest paid in the area. This Item will be brought up at a future meeting under Items for Discussion. PESCLUTIONS: RLSOI,UTION 14, ~^ The Public Hearin,] was declared open by the Mayor. Attorney Thomas Yeager 1933 was present to represent Fran% Callander and Judith Anspach, owners of The R]VerhOU =7e Restaurant. The restaurant will have hours of 11:30 A.M. until 1:00 A.M. Resolution 14, 1983 was unanimously adopted by the Council. SCLUTION 15, The P:olic Healing ,vas declared open by the Mayor which was duly advertised 1983 and held on the intent of Resolution 15, 1983, requesting a variance to the requirement of 750' between alcoholic beverage vendors, per petition of "Taco Viva ", proposed to be located within "Lochmann's Plaza" at 4128 PGA Boulevard, By the concurrence of the Council, the Deputy City Clerk read, in full, Resolution 15, 1983, which was unanimously adopted. RES0;r1T1O1,J 16, By the concurrence of the Council, the Deputy City Clerk read, in full, 1981, Pesolution 16, 1983, permitting as a CG -1 "conditional use" the sale of beer and wine, for on- premise consumption, at "Taco Viva ". Resolution 16, 1983 wa-- unanimously adopted by the Council. RESOLUTION 17, The City Manager explained how the working situation will be set up with 1983 the Urban Forester. Councilman Kiedis advised that he was not in favor of the idea of employing an Urban Forester. Councilman Martino was in favor of Mr, h.redis' idea. Mayor Kiselewsri and Vice Kayor Monroe were both in favor of employing an Urban Forester. The Council decided to postpone decision on Resolution 17, 1983 until the next regular meeting. SOLUTION 18, By the concurrence of the Council, the Deouty City Clerk read, in full, 3� Resolution 18, 1983, cancelling the General Election scheduled to be held on March 8, 1983, and declaring the candidates who qualified for City Council Groups 1, 2, and 4, as duly elected to said offices. Resolution 18, 1983 was unanimously adopted by the Council, as amended. ORDINANCES: ORDINANCE If 1983 Mayor Kiselewski declared uhe Public Hearing open, which was duly advertised January 17, 1983 and 'held on the intent of Ordinance 1, 1983, expanding the City's Code Enforcement Board. By the concurrence of the Council, the Deputy City Clerk was asked to read Ordinance 1, 1983, on second reading, by title only. Ordinance 1, 1983 was unanimously adopted by the Council. ORD1tiatCn 17, Vayor Eiselewski voiced his concern about the wording in Section l(A), 198: an6 advised that the wording e changed to "use of registered 9 9 g� guests in a hotel ". Attorney Crant was asked to check into the use of leases to determine the number of years to insert into the Ordinance. Another suggestion made was to add the wording, "any action regarding non - corpliance be brought before the Code Enforcement Board ". This Resolution will be workshopped at the next workshop meeting. Resolution 13, 1983 was unanimously adopted by the Council. PETITIONS &YID CDMhIUr;TCATIONS: YiAyO:: Mayor Kiselewski acknowledged receipt of communications from: KISELEWSKI DRIVER-- LICENSE 1. Mr. Watt, Driver's License facility, money for this facility is rACILTTY in the proposed budget for the Department of Highway Safety and Motor Vehicles. RAY LIBERTI 2. Mr. Ray Liberti responding to the Resolution regarding Revenue Sharing. EXCHANGE CLUB 3. Exchange Club of the Northern Palm Beaches advising of a show at the High School. COUNTY COMMISSION 4. Board of County Commissioners regarding the PGA :national planning and landscaping. WATERFORD 5. Waterford questioning remarks made by :9r, Patrick Harkins. T is FOR CISCUSSION: VICE b1AYOR Vice tiayor Monroe suggested sending a form letter to board members whose MONROE term is expiring, stating that if continued interest in that board, they have so many days to return letter to us, otherwise the name will be taken off the list. CITY MANAGER The City Manager acknowledged a letter from TSorth Palm Beach stating that they have solicited the services of Diversified Utility Company. They are awaiting a response from Lake Park and Palm Beach Gardens. MAYOR KISELEIdSKI Mayor Kiselewski acknowledged correspondence from Oliver & Glidden requesting additional money for the job done on the Community Center.
