HomeMy WebLinkAboutMinutes Council 032483CITY COUNCIL WORKSHOP MEETING CITY OF PALM BEACH GARDENS MARCH 24, 1983 The Workshop Meeting of the City Council of the City of Palm Beach Gardens Florida, was called to order by Mayor Aldred, at 8:00 P.M., in the Assembly Room, 10500 North Military Trail, Palm Beach Gardens, Florida; and opened with the Pledge of Allegiance to the Flag. ROLL CALL: The roll was called by the City Clerk and present were: Mavor Aldred, Vice Mayor Kiedis, Councilman Martino, Councilwoman Monroe, and Council- man Kiselewski. City Manager John Orr and Attorney William Brant were also in attendance. ANNOUNCEMENTS: The Mayor announced that there will be a meeting of the City's Comprehen- sive Land Use Plan Committee on Wednesday. March 30, 1983, at 8:00 P.M.. Subsequently, the City Manager was authorized to further engage Mx. Arsenicos' services for preparation of working drawings on remodeling the Assembly Room per the plan tentatively chosen; and also, providing cost estimates for implementing this plan and the two alternatives he recommended for the Police Department. in the mean - time, the Police Chief will submit his comments, in writing, comparing the two alternatives from the standpoint of productivity. REPORTS: Councilman Martino reported on the City's Planning and Zoning Commission COUNCILMAN Meeting he attended March 22, 1983. The minutes of this meeting are on MARTINO file in the City Clerk's office. VICE MAYOR Vice Mayor Kiedzs reported he visited "A-bley's Arcade" in the shopping KIEDIS center on the northeast corner of Gardens East and Lighthouse Drives; and per his observations, the only cause for concern was the parking of bicycles on the sidewalk along the front, which was rectified. At a meeting in the near future, the Council will discuss scheduling a Public Hearing on their consideration of adopting Ordinance 17, 1982, regulating the location of "Coin And /Or Token Operated Or For Hire Amusement, And/ Or Skill Game -Type Machines" within the City. ITEMS BY THE MAYOR AND COUNCIL: COIUNCILI:OMA`1 Councilwoman Monroe acknowledged receipt of Councilman Kiselewski's MO \ROE ;March 14, 1983 communication, with attachment, on resolving the closing of the north side of Holly Drive to vehicular traffic during the hours the schools are in session; and requested a copy of the conceptual plan prepared by Mr. Steve Godfrey, Traffic Engineer with Kimley Horn & Associates, also a possibility. These are alternatives to the suggestion contained within our Comprehensive Land Use Plan; and are a part of the "act hoc committee's" considerations (ref: minutes of Regular Meeting of August 5, 1982). The City Manager will contact the County re: the location of a street light at the corner of Keating Drive & Northlake Boulevard, county- and state -owned roads, respectively. City Council Workshop Meeting, 3/24/83 Page 3 VICE MAYOR The City Manager advised that the irrigation pumps for Plant Drive Park KIEDIS and Gardens Park are operating. 49 The Chief advised that the members of the -olice force do report non- functioning street lights. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA: MR. SAMUEL Mr. Samuel Carsillo, 10063 Dahlia Avenue, PBG, addressed the Council CARSILLO reminding them to observe the State Fire Protection and Prevention Codes when considering improvements to the Assembly Room. ORDINANCES: Councilman Kiselewski provided the other members of the Council copies ORDINANCE 11, of the March 24, 1983 communication of Mr. Vince Pappalardo of Pappalardo 1981 Construction expressing firm opposition to the City imposing a "Fire Service and Facilities Fee" on developers of structures exceeding two stories via the proposed Ordinance 11, 1981. During the lengthy deliberations on the proposed Ordinance, the Council discussed considering its defeat, su,— quent t., exercising the duly advertised Public Hearing at the Regular Meeting of April 7, 1983. And then, directing the City Attorney to draft an Ordinance for their con- sideration of first reading at a future meeting, amending the City's Code to enable developers of PUDs approved with structures that place unusual and added burdens upon the present fire protection capabilities to contribute funds to be deposited into a "Specialized Fire - Fighting Equipment Fund" - to include those PUDs already approved and such a fee would apply to, per the Ordinances that created them. ORDINANCE 2, Subsequent to exercising a duly advertised Public Hearing at their meet - 1983 ing of March 22, 1983, the Planning and Zoning Commission adopted a motion recommending to the Council, with a proviso, passage of the amendments to the City's Zoning Codes contained within the March 22, 1983 draft of Ordinance 2, 1983. They are: 1. Defining a "story" of a building; 2. Limiting "conditional uses" granted for the sale /service of alcoholic beverages to owners /initial license holders; and 3. Adding a "PDA - Planned Development Area" zoning classification to the City's Codes. The Commission recommended the Council further review the minimum acreage required for PDAs. Also, implementation of our Comprehensive ]and Use Map by adoption of the Ordinance's attachment - a new zoning map of the City. This recom- mendation was with the proviso the Council consider the recommendations / requests of Bankers Land Company. City Council Workshop Meeting, 3/24/83 Page 4 During the workshop session on the March 22, 1983 draft of Ordinance 2, 1983, Attorney Raymond Royce addressed the Council on behalf of r,nktrs Land Company, reviewing the major v ^cant land owner's "analysis and summary" re: the zoning of fourteen of their parcels. In nine of these instances, the City's Comprehensive Land Use Map adopted in com- pliance with the Local Government Comprehensive Planning Act of 1975 on June 18, 1981, would have to be amended; in two of the instances, the proposed new zoning map would have to be modified pursuant to the zoning designations on the Comprehensive Land Use Map. They have reserved comments on three of the parcels for further review. (Note: during the duly advertised Public Hearings on adoption of the City's Comprehen- sive Land Use Plan and Map, the only objection voiced by Bankers Land Company was the zoning designation of "Parks District" placed upon the lands surrounding Lake Catherine on MacArthur Boulevard (ref: minutes of Regular Meeting of June 4, 1981). The only other objection of record was that of the School Board re: the ':_rks Dis�rict" designation placed upon a portion of their 10 -acre tract along the FEC railroad, south of Plat 114.) is Attorney Royce's further suggestions included that: the City's proposed PDA - Planned Development Area zoning district not have a minimum requirement of 100 acres and that it include permissible land usages without application for PUD or PCD development approval; that zoning classifications on the Comprehensive Land Use Map and /or new zoning map not already a part of our Zoning Codes be created (i.e., P - Parks District; and GL - Gove_rnment Use); and the area now - reflected as "L,):,ahaLchee Slouth Area" along the westerly portion of the PGA National project be more appropriately designated. At their Regular Meeting of April 7, 1983, the Council will exercise the first of two State - required Public Hearings on adoption of the new zoning map. in the meantime, they were in favor of receiving the input of members of the City's Planning and Zoning Commission re: the suggestions/ requests of Bankers Land Company. A duly posted special meeting of the commission will be hold next week for the purpose of their review of the company's "Analysis & Summary for P.B.G. Proposed Rezonings" dated March 24, 1983. Also, the comments of Mr. Marvin C. Hill, the City's ® contracted Land Use Consultant in the preparation of our Comprehensive Land Use Plan, re: Bankers T,anl Compt.ny's proposals will be requested by the City Manager. City Council Workshop Meeting, 3/24/83 Page 5 The members of the Council were not objectionable to the request of Mr. 49 Rudy Arsenicos, representative, to introduce to the Planning and Zoning Commission at their special meeting next w,: -ik the requests of two groups of doctors for the rezoning of parcels located on the north side of Burns Road, east of the existing "Plaza North Medical Complex ", to CPO - Commercial Professional Office District. Ordinance 2, 1983, will be further workshopped by the Council at a future meeting, as amended with the minimum acreage for Planned Development Areas deleted. Per the recommendation of Councilwoman Monroe, the City Attorney will draft an Ordinance for the Council's consideration of first reading at a future meeting, providing for a recreation /open space zoning category (ref: minutes of Regular Meeting of February 17, 1983), ITEMS FOR DISCUSSION: ADDING "FRATERNAL Subsequent to exercising a duly advertised Public Hearing at their meeting ORGANIZATIONS" TO of March 22, 1983, the Planning and Zoning Commission adopted a motion PERMISSIBLE CON- DITIONAL USES recommending "fraternal organizations" be included as a permissible OF CG -1 ZONING conditional use within the City's CC -1, General Commercial, zoning dis- CLASSIFICATION trict - to include direction re: assembly occupanies (i.e., fire conditions, parking, ingress /egress, traffic, etcetera). The City Attorney was requested to draft an Ordinance for the Council's considera- tion of first reading at a future meeting, providing for this modifica- tion to the City's zoning codes. REGULATING DIRT During their discussion on regulating dirt bikes, Mr. Jack Ballard of BIKES 4690 Holly Dr., PBG, addressed the Council voicing his obJections to these excessively -noisy off-street vehicles traversing, on a frequent basis, the vacant land along the rear of his home. Using the one of "Temple Terrace" as a model, the City Attornev was requested to draft an Ordinance regulating off - street vehicles, for the Council's consideration of first reading at a meeting in the near future. The City's Police Chief will be requested to provide his comments re: the draft. Also, department heads of the City will be requested to make recommendations to the Council re: improvrngChapter 17. Offenses and Miscellaneous Pro- visions of our Code. City Council Workshop Meeting, 3/24/83 Page 5 POLICIES RE: Due to the lateness of the hour, the Council postponed to a later date ADV150RY BOARDS workshopping Councilman Kiselewski's March 15, 1983 draft of recommended >olicies re: the application, appointment, membership, and attendance for our advisory boards. RELOCATION OF Pursuant to the discussion at the Workshop Meeting of March 17, 1983, FREEDOM SHRINE" the members of the Council were in favor of the relocation of the "Freedom Shrine" now on display in the Assembly Room to the City's Community Activities Building for better exposure. PETITIONS AND COMMUNICATIONS: Mayor Aldred acknowledged receipt of the following: 1. Invitation from Community Partnerships of South Florida to attend a "Media Kick -Off" Breakfast to be held March 31st at 8:00 A.M. at the Boca Raton Sheraton on Glades Road. 2. Communication from Mr. Gerald A. 71^rvPr of 124 Lakeshore Drive, NPB, expressing dissatisfaction with our City for not joining the Village of North Palm Beach in entering into an agreement with Diversified • Utility Services. The Mayor will advise the public, by open letter to the newspaper, Mr. Jack Shreve, Public Counsel for the State of Florida, has officially intervened in opposition to Seacoast Utilities' request of the Public Service Commission for permission to substan- tially increase their water and sewer rates - a considerable savings of tax dollars. (At the Regular Meeting of January 6, 1983, the Council discussed Mr. Howard Osterman's proposal for Diversified Utility Services to provide utility consulting services for a flat agreed charge of $30,000, plus direct out -of- pocket expenses. The Council chose to first pursue attracting the services of Mr. Shreve.)
