HomeMy WebLinkAboutMinutes Council 111882CITY COUNCIL REGULAR MEETING CITY OF PALM BEACH GARDENS NOVEMBER 18, 1982 The Regular Meeting of the City Council of the City of Palm Beach Gardens, Florida, was called to order by Mayor Kiselewski at 8:00 P.M. in the Assen Room., 10500 North Military Trail, Palm Beach Gardens, Florida; and opened the i'1 edge of Allegiance to the Flag. ROLL CALL: The roll was called by the City Clerk and present were: Mayor Kiselewski, Vice Mayor Monroe, Councilman Kiedis, Councilman Aldred, and Councilman Martino. City ?tanager John Orr and Attorney William Brant were also in attendance. MINUTES: The minutes of the Workshop Meeting of October 29, 1982 and Regular Meeting of November 4, 1982, were unanimously approved by the Council, as written. ANNOUNCE:IENTS: ?Mayor Kiselewski announced that the City's administrative offices will be closed on November 25th and 26th, in observance of Thanksgiving. ITEMS BY THE CITY MANAGER: The City Manager reported that the Loxahatchee Council of Governments invited the City to join their membership at a fee of $1,400 annually. REPORTS: Vice Mayor Monroe reported on the meeting she attended last night of the City's Beau"ification and Envirc,nmental Committee. The minutes of this meeting will be placed on file in the Citv Clerk's office. ITEMS BY THE MAYOR ��ND COTIN('. TT. SEACOAST Councilman Martino expressed concern re: the lack of the City's receipt of a UTILITIES' notification on the Public Hearing held by the Public Service Commission or REQUEST FOR INCRhASES IN November 17th at the Northeast County Courthouse Complex for the purpose of CAS, WATER, & S. EFi EF 2ATE5 receiving any public concerns from Seacoast Utilities' isers of gas. The City Manager explained that per the utility company, notices of the hearing were sent to their gas users along with a past invoice. (The City, itself, is not a user of gas.) Also, it was advertised in a newspaper of general circulation. Although the PSC did not notify the City, as required by'the State's Administrative Code, cur input is welcome. They will send the City a copy of the staff's findings prior to the time a final decision is uvide on the is utility company's request for an increase in their gas rates. The City will also receive a copy of the final decision. The Citv will be not;fi —i of th o upcoming public hearings to be held by the Commission prior to their consider- ation of Seacoast Utilities' request for increases in their water & sewer rates. City Council Regular Meeting, 11/18/82 Page 2 The City Manager recommended, and the members of the Council concurred, the City Attorney work with the Consumer Advocate and Consumer Federation in researching whether the PSC is considering unjust increases in Seacoast Utilities' rates and whether the public is well - represented. The City Manager will forward a communication to the PSG formally requesting they hold, at night, the local Public Hearing(s) to precede their consideration of the utility company's request for an increase in water and sewer rates. VICE MAYOR Vice Mayor Monroe expressed concern re: the proposed location for a full- MONROE RE: service post office in our City; and suggested the City Manager contact Bankers LOCATION OF POST OFFICE Land Company, the owner of the land, re: the Postal Authorities negotiating I\ 7177-- the purchase of an alternate site further west. The Mayor recommended the City Manager contact Mr. Walter Smith, Director of Customer Services for the West Palm Beach Post Office, requesting that he attend a future Council meeting to answer inquiries the members of the Council puhlc may have. (He did address the Council •,t their Workshop Meeting of April_ 9, 1981 re: the carrier annex and contract branch proposed at that time to be located within the City.) PURCHASE OF in response to Vice Mayor Monroe, the City Manager advised that Coral Ridge _MASSES OF LAND M Properties, Inc., a subsidiary of Westinghouse Electric Corporation, and BANKERS LAND Bankers Land Company, a major vacant land owner, are both aware of the City's COMPANY BY WESTINGHOUSE interest in the development of Lands within our corporate boundaries. MAYOR The Mayor reported that per the County Engineers Office, roadway improvements KISELEWSKI to Northlake Boulevard between 1-95 and Milrtary Trail will be completed within LANDSCAPING IMPROVEMENTS 30 days. The City's landscaping program should be ready to begin in approx. TO NORTHLAKF BLVD 90 days following. DISTRIBUTION At their Regular Meeting of December 2, 198 ", the Council will consider adoption OF ADDITIONAL SALES TAX of a Resolution urging the State Legislators to leave, as is, the distribution of the additional (fifth) one -cent sales tax provided for by House Bill HD -54, Chapter 82 -154, Laws of Florida. ORDINANCES: By a unanimous vote of the Council, the City Clerk read, by title only, on first ORDINANCE 23, reading, Ordinance 23, 1982, amending the City's off- street parking restrictions. A Public Hearing and the Council's consideration of adoption of Ordinance 23, 1982, will take place at the Regular ;Meeting of December 16, 1982. City Council Regular Meeting, 11/18/82 Page 3 ORDINANCE 11, At their Regular Meeting of December 2, 1982, the Council will exercise a duly 1981 advertised Public Hearing and consider adoption of Ordinance 11, 1981, imposing ® a Fire Service and Facilities Fee on developers of structures exceeding two stories. In the meantime, Councilman Martino, the City Manager, the City Attorney, and the Fire Chief will formulate recommended amendments to the Ordinance Lo include the thoughts of the Council at the current meeting. ORDINANCE 17, At their Regular Meeting of Decemberl6, 1982, the Council will exercise a duly 1982 advertised Public Hearing and consider adoption of Ordinance 17, 1982, regulat- ing the location of "video games" in the City. In the meantime, the City Attornev will amend the Ordinance, incorporating the thoughts of the Council. ITEMS FOR DISCUSSION: PERMISSION FOR At their Regular Meeting of December 2. 1982, the Council will, subsequent to TOOJ� r-S—CAFE & MARKET PLACE "exercising duly advertised Public Hearings, consider adoption of Resolutions TO SELL BEER & granting "Toojay's Cafe and Market Place ", 4084 PGA Boulevard, PBG,: (1) WINE permission to sell beer and wine, for on- a- -: off- premise consumption, as a CG -1 (General Commercial) "conditional use "; and (2) a variance to the distance requirement of 750' between alcoholic beverage vendors. These are based on the request of Attorney Vincent James Zenga, authorized agent for Mr. Marc J. Katzenberg III, Pres. of Toojay's II, Inc. EXTENSION OF At their Regular Meeting of December 2, 1982, the Council will consider 1st PERMISSIBLE TIME FOR COM- reading of an Ordinance, extending the permissible time for completion of the PLETION OF "Beaumont Place" single - family PbT, created by Ordinance 4, 1951, on the south - BEAUMONT PLACE eas. corner of Elm Street and Military Trail, per the petition of Mr. Nicholas Raich, owner /developer. PETITIONS AND COM:IIJNICATIONS: Mayor Kiselewski acknowledged receipt of communications from: MR. RICHARD 1. Mr. Richard C. P'ihrmann, 10328 Magnolia St., PBG, requesting enforcement of FUHRMANN the City's "leash law ". The City Manager will ref -r this to the County Animal Regulation Department. I do not own a pet of any kind because I feel the property here is too small and furthermore, I don't want to clean up the mess they leave, particularly dogs and cats. Some of my neighbors and I are tired of cleaning up after other people's pets. Therefore, we want you to do something to stop it. My yard is a mess almost every morning because dogs and cats are allowed to run loose, especially at ni'nt. No leash, no pooper scooper, nothing. I want some of you to come over and smell my yard, it is discusting. I have to be extremely careful where I step when I go out to get my mail. One neighbor keeps his dog fenced in his back yard, but he still has to clean both his back and front yard because other dogs run free at night. I have called the City Manager, the police and some council members and nothing is being done. The mess is still there every morning. The James' dog, Ho (4432 Hickory Drive) and Egizio's dog, Mandy (10885 Magnolia St.) are always loose, one even chases cars' My neighbors and I are asking for nothing more than to be left alone. Dear Mr. Papas: I am writing to you because an injustice is being done to the people living on Military Trail, North Palm Beach, Florida; between North Lake Blvd, and PGA Blvd. ® The stretch of road on Military Trail from North Lake Blvd, to PGA Blvd, is two (2) miles long. The homes along this section of road are only 4 feet away from the edge. We have many many 18- wheelers traveling on Military Trail. We have heavy cement loaded trucks, trailers carrying liquid flamable mater- ials (L.N.G.),Trailers_ carrying toxic chemicals, gasoline tracter trailer and radio - active materials all using this ;.iece of road, All because they want to take a short -cut to the Florida Turnpike or do not want to use AIA, which runs parallel to Military Trail. All towns and cities in this Country have two (2) routes,.one for trucks and one for business centers. When the trucks traveling North on Military Trail reach North Lake Blvd., they should find a sign which reads "All Trucks turn right to I -95 or AIA. ". Also, on the Trail between North Lake Blvd. and PGA-Blvd., the bridge is sinking (tbe one that goes over the Earman River). I suspect, due to the heavy 18- wheelers and other trucks carrying heavy machinery, cement, etc, might be the cause. Now an attempt is being made by certain affluent communities with high sales tax collections to alter this formula to their advantage, and to your own city's disadvantage. Homestead has adopted Resolution No. 82 -11 -33 to protest any such change. A copy of it is enclosed. Please read it carefully.
