HomeMy WebLinkAboutMinutes Council 090982CITY COUNCIL WORKSHOP MEETING ® CITY OF PALM BEACH GARDENS SEPTEMBER 9, 1932 The Workshop Meeting of the City Council of Palm Beach Gardens was called to order by Mayor Kiselewski at 8:00 P.M., in the Assembly Room, 10500 North Military Trail, Palm Beach Gardens, Florida, and opened with the Pledge of Allegiance to the Flag. ROLL CALL: The roll was called by the Deputy City Clerk and present were: Mayor Kiselewski, Vice Mayor Monroe, Councilman Aldred, Councilman Martino, and Councilman Kiedis. City Manager John Orr and Attorney William Brant were also in attendance. ANNOUNCEMENTS: Mayor Kiselewski announced that on Tuesday, September 14, 1982, at 7 :30 F.M., there will be a meeting of the City's Planning & Zoning Commission, Recreation Advisory Board, The Merit System Board, and Palm Beach Gardens Fire Department Inc., and on Wednesday, September 15, 1982, at 7:30 P.M., there will be a meeting of the City's Site Plan & Appearance Review Committee. ITEMS BY THE CITY The City Manager stated that he had a meeting with some of the MANAGER• Di,:ectors of the Inter City First Aid Squad and they have reorganized with businessmen and are going to continue their operation. They are requesting a donation of 15,000.00 to help operate their organization. It was the consensus of the Council, that prior to approving any monies, they would like to see an audit /balance of their unpaid bills. REPORTS- VICE MAYOR MONROE Vice Mayor Monroe reported on the B & E Committee Meeting held last night - 9/8/82, and informed the Council they have purchased 25 live oak trees to be planted around the Pity Iiall. City Council Workshop Meeting - 9/9/82 Page 2 ITEMS BY MAYOR AND COUNCIL: AUNCILMAN KIEOIS Councilman giedis requested of the City Manager to check into the unsightly condition of the building that exists on the northwest corner of Holly Drive and Military Trail. VICE MAYOR MONROE Vice Mayor Monroe requested of the City Manager to contact Banker's Land Company asking them to have Dr. Nikolas respond in written form the information he verbally gave at last week's meeting regarding similar centers in Dade and Broward Counties comparing those to what Banker's Land Company is proposing with their Regicnal Center. Vice Mayor Monroe suggested that perhaps the rest of the Council would like to go to these centers along with a representative from Banker's Land Company. Regarding the controversial "psychic science" class being offered through the Recreation Department, the City Attorney will render his opinion as to whether a class of this sort is legal. MAYOR KISELEWSKI Mayor Kiselewski requested a letter be sent to Governor Bob Graham regarding a representative from the City oecoming a member of the Metropolitan Planning Organization. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA: MR. DICK WORKNER/ Requesting the City to place a sign at the entrance to Miramar to MIRAMAR; identify the street; and the City Manager will check as to why the "No Parking" signs are placed in their swale. In response to a resident of the City in the audience, the City Manager advised that the reason for the survey stakes on Gardenia Drive is that that street will be overlayed. In response to a gentleman from Plat 51 the Mayor stated that if they opcan respond with a better soLution to why stop signs in the subdivision should be removed, they would consider it then. MR. STEVE STEPHENS: Mr. Steve Stephens, representing Loehmann's Plaza - addressed the City Council Workshop Meeting, 9/9/82 Page 3 Council assuring them that they fully intend to live -up to their agreement regarding what was approved for Loehmann's Plaza. ITEMS FOR DISCUSSION: PROBLEMS /COMPLAINTS OF CITY RESIDENTS PERTAINING TO RECENTLY ADOPTED ORDINANCE REGARDING N PARXIN ON CITY STREET The Members of the Council concurred to discuss this item next, prior to workshopping the ordinances, due to the amount of residents in the audience. The residents that were in attendance gave their reasons as to why they felt the "NO Parking" in the streets should be taken out of the Ordinance, in that they don't want cars to park in their swales, ruining the grass and sprinkler heads. Fire Chief Arrants and Inspector Nolan, were in attendance, at the Council's request, and, individually addressed the Council, stating that they have had very few problems, in an emergency situation, with cars parked on the streets. Councilman Martino stated he has received several complaints regarding recently adopted Ordinance 11,1982, prohibiting the narking of cars on streets and suggested the Council consider one prohibiting parking as it was prior to their Ordinance between the hours of 2 A.M., and 6 A.M. Mayor Xiselewski and Councilman Aldred suggested the Ordinance be lef-, as written but maybe allow leaving one side of the car on the street. Councilman Aldred was in favor of allowing two wheels on pavement. Councilman Martino Suggested reinstituting parking being allowed in streets, Vice Mayor Monroe suggested compromising and asking Police Department and Fire Department for their opinion. In response to Vice Mayor Monroe, Attorney Brant stated that, #1 - the swale area is public property and what this code provision does is delegate authority to a private landowner how and when City property City Council Workshop Meeting, 9/9/82 Page 4 should be used. From a policy aspect I understand the issue the 49 City is not equipped to maintain each and every Swale - however, he fuels it is an improper delegation of authority to the private property owner to delegate how the Swale area is to be used, to that portion of the Ordinance only. Vice Mayor Monroe suggested that the Police Chief and Fire Chief be asked to come up with an alternative or compromise that they feel is an acceptable one to them, if not, keep the Ordinance as is and striking the part of improper delegation. ORDINANCES: ORDINANCE 16,1982, The Council held a workshop session on Ordinance 18,1982, "rewrite" of the Fire Preventior. ^_; -de, and its attachment, a Resolution. Comments are needed in writing from the Fire Chief and Building Dept. Fire Marshall Tom Vreeland made corrections on the Ordinance section pertaining to Section 11.5 - Code of Palm Beach Gardens Fire P•_uention Standard latest edition. Mr. Vreeland and Attorney Brant are to get together on Section 11 -5. Mt. Lew Lawder suggested using uniformity throughout the County by using Standard Fire Prevention Code from the Standard Building Code Congress which parallels the Code. It was suggested to retain the professional services of Mr. Carl Simmons from Orlando who was Fire Marshall for 28 years in Orange County and now has a Fire Consultant Business. Any written comments prior to Public Bearing on October 7, 1992 will be heard at the Meeting. ORDINANCE 1982 During the workshop session on Ordinance 1982, Providing for 55' wide green belt along PGA Blvd., the members of the Council requested the City Attorney to redraft the ordinance incorporating the thoughts of the Council in reference to providing for a hardship City Council workshop Meeting, 9/9/82 Page 5 section in the Ordinance that would make it easier for those people who have irregular shaped properties. Councilman Martino also suggested perhaps referencing A.1.A, Northlake Boulevard, and U.S. #1. In response to Mayor Kiselewski, Attorney Brant stated legally, Planning & Zoning would have to hold another Public Hearing if the Ordinance were to include streets other than PGA Boulevard. Vice Mayor Monroe stated that the rest of the Council has been provided with copies of two Ordinances - one from California and one from Sanibel, Florida. The one from California has gone to the Supreme Couit of the United States and was not struck down, referring to open space and reasonable use of the property. ITEMS FOR DISCUSSION: ANNEXATION OF 3.69 -ACRE PARCEL ON WEST SIDE OF MILITARY TRAIL, NORTH OF NORTHLAKE BOULEVARD, WITH CG -1 ZONING Mr. Frank DeFilippo, along with Mr. Nick Corcoklos and David Kelly, of Landmark III Development Group, owners of a parcel of land, contain- ing 3.69 -acres located on the west side of Military Trail, north of Northlake Boulevard. were in attendance to address the Council regarding the annexation of their property (presently in the County and zoned RM), into the City with a zoning classificati— of CG -l. This property is 280' wide and 575` long. Mr. DeFilippo stated that it is their intention to construct a 2 -story office complex on this property. They feel by developing this property as an office complex it would Enhance the south entrance to the City. Mr. DeFilippo stated that King Arthur Estates (duplexes) immediately abuts their north property line and to the south is property recently annexed into the City and zoned CG -1. The reason for requesting the zoning of CG -1, is to provide some flexibility in the operation of the office plaza, such as supportive businesses (i.e. medical supplies, or office supplies y. City Council Workshop Meeting, 9/9/82 Page 6 Mr. DeFilippo introduced Rudy Arsenicos, Architect, who presented renderings of the:r proposed office complex. Mr. Arsenicos stated they are intending to buffer their project from the residential area to the north with a fence and hedge. The petitioners were in agreement to construct a bike path - pedestrian walk in front of their property. vice Mayor Monroe suggested this property be zoned CPO to buffer them from residential and to keep the commercial out. The petitioners had no objection to CPO, however preferred the CG -1 zoning. Councilman Martino pointed out that on Page 1306.1, Section 7, in the Code Book, buffered areas ragaired when commercial or industrial use abuts residential use. Another point brought out AM wr wac that if petitioner went for annexation with CPO usage and was in the City, he could come back to the City Council and request PUD. The City Attorney was requested to draft an Ordinance for consideration of first reading at the Regular Meeting of September 16, 1982, annexing the subject lands with CPO zoning. PERMITTING AS A CONDITIONAL USE THE RETAIL SALE /SERVICE OF BEER AND VINE FOR ON- PREMISE CONSUMPTION AT THE PGA NATIONAL SPORTS COMPLEX. 600 AVENUE OF CHAMPIONS Attorney Andrew Jacobson was present on behalf of PGA National. He stated that the snack bar which will be selling the beer and wine will service the tennis courts, the Nautilus Club and the swimming pool area. The City Attoiney was requested to draft a resolution for the next Regular Meeting of September 16, 1982, permitting the above mentioned conditional use. There was no further discussion. City Council xorkshop Meeting - 9/9/82 Page 7 PROVIDING FOR AN EXTENSION OF PERMISSIBLE TIME FOR THE COMPLETION ® OF THE "WINCHESTER COURTS II ", PUD, CREATED BY ORDINANCE 12, 1989,. Attorney Robert Cook was present in behalf of the owners. He explained to the Council that the extension of time is mainly because of the bad economic conditions. They are going to be down sizing the units probably creating more open space in the project. There will be the same number of units, just smaller in size. A modification of the plans is required for such a change, and therefore a two year extension is required for this project. There being no foreseen problems with the extension of time asked, it was requested of the City Attorney to draft an Ordinance providing for an extension of permissible time for the completion of the "Winchester Courts II ", NUD. This Ordinance will go for first reading at the Regular Meeting of October 7, 1982. POSSIBILITY OF BREAKING CITY UP INTO DISTRICTS FOR COUNCIL SEATS This discussion was on the idea of having districts, residents would call on someone living in their area, that person would be more familiar with the problems in that particular area. Every three years the districts would have to be changed because of the population growth. The person would have to live in the district they are representing but still be elected at large. It was highly discussed the pos ^ibility of someone not running from a certain district. It was decided to have Councilman Aldred check with other municipalities of close to the same population to see how this idea worked for them. A discussion was brought forward by Vice Mayor Monroe in reference to the Land Use Plan by Sanibel and California. The difference Is between these two places and this City was highly discussed.
