The Regular Meeting of the City Council of Palm Beach Gardens was called
Lo order ty Never Samuel Laurie at 8 :00 P.fl. in the Assembly Room, 10500
North Military Trail, Palm Beach Gardens, Florida; and opened with the
Pledge of Allegiance to the Flag.
ROLL CALL: The roll was called by the City Clerk and present were: flayor Laurie,
nice Mnvor kiedis. Councilman flartrno, Councilman Feeney, and Councilman
Aldred. rjty fIanager ,John Orr and attorney William Brant were also in

MINUTES: The minutes of the December 13, 1979 Uorkshop[,Ieetino were unanimously
approved by the Council. ns written.

rate increase request at a facility that has a large capacity, rather than
at the North Palm Seach library as planned.
RESOLUTIONS: By a unanimous vote of the Council, the City Clerk read in full Resolution
RESOLUTION li 1, 1980, confirming the appointments of officers of the Fire Department.

ORDINANCES: RV a unanimous vote of the Council, the City Clerk read on first reading
URDINANCE 19, by title only Ordinance 19, 1979, providing for a referendum election to be
g 9 held in conjunction with the City's General Election on March 11, 1980.
This referendum is for the purpose of the City's electors approval /disapproval
of a change in the dates for filing as a candidate for Council in the City's
Charter. Ordinance 18, 1979 will be considered for adoption at the Regular
Meeting of January 17, 1900.

COMMUNICATIONS:
PGA NATIONAL
T',e City Manager acknowledged receipt of a cr- ._,.ic ition dated January 1,
RE: DECiCATION
1980 from PGA National Venture, Ltd., illustrating their position in regards
to the streets within the "PGA National ". When the PGA National PCD was
adopted by the City, the developer advised that all of the interior roads

the single family plats of the PGA National would be private; however,
they now desire the City to accept the dedication and perpetual maintenance
responsibility of these roads. Upon substantial completion of all construc-
tion within the project, they also wish to convey the Lwo access points to
the single family areas (one on PGA Boulevard and the other on Northlake
Boulevard) to the City. They will continue to own the loop roads, with a
roadway easement granted to the Northern Palm Beach County 'dater Control
District. The District will continue Lo build these public roads and will
also have the maintenance responsibility for them. The City's acceptance of
the dedication of these interior roads will be further discussed at a future
workshop meeting.

Attorney rendering a legal opinion as to when the City's Site Plan and
RE: S /P /R -
Appearance Review Committee's approval of plans is required prior to the
issuance of a building permit for buildings other than single family.
The City Attorney will meet with the City Manager and Building Official to
draft a revision to the City's Code that will clearly define as to what
magnitude the exterior of an existing building can be changed without having
to be approved by the Site Plan and Appearance Review Committee. The Com-
mittee will be requested to review and provide their input re: this draft,
prior to the Council's consideration of its adoption.

SEACOAST UTIL - On February 7, 1979, the City received a communication from Mr. Gerald L.
IT 61NG Gunter, member of the Public Service Commission, replying favorably `o the
RATE INCfFEASE
City's Resolution 61, 1979, which included the request that their rlublic
hearings on Seacoast Utilities, Inc. petition for a rate hike be held at
night.
On November 7, 1979, the Florida Public Service Commission issued a "Notice
of Hearing" to users of Seacoast Utilities, Inc., notifying them of the
times and dates of the hearings they will be holding on this request. This
notification -included that time had been set aside to permit customers to
give testimony and present evidence regarding the proposed rate increase,
as well as the auequacy and quality of service rendered by the utility
on Tuesday, January 15, 1980, from 7:00 P.H. to 9:30 P.M..
In addition to the foregoing, Mr. Howard Osterman of Diversified Utility
Services, who was employed by the tri- cities to f-ight the increase and
granted permission by the Public Service Com^'i ^sion to intervene on the
—ties' behalf, had ad'vi"_a

The City Hanager reported that he ^poke 'w,th a member of t;c Public Service
Commission's staff this date and was advised that Lhey have now decided
not to hold a hearing on this increase during ev,,,ing h -urs. However, if
Fir. Osterman requests an evening hearing, in wr-iting, they will take it -into
consideration.
Thy members of the Council expressed dissatisfaction with the Public Service
Commission's "last minute" change in the times of the hearings. Fhey also
indicated dissatisfaction that none of the members of the Commission will be
in attendance at the he< ^.rings; and suggested that the hearings be held in a
larger facility than the North Palm Oeach library, perhaps the PBGHS
audil-crium.
Following the admirii5traLive rules of procedures as recommended by the City
Attorney, the City Manager was requested to contact Fir. Osterman asking him
to make this formal request to the Puhlic (ervjce Commission for an Pvrn,nri
hearing.
In the meantime, Mayor Laurie will draft a letter to he coordinated with the
Mayors of the Town of Lake Park and Village of North Palm Beach and sent to
Governor Graham and members of the Public Service Commission in the event
Mr. Osterman's request is not received /granted.

Palm Beach Gardens High School for several years. be presented a plaque of
appreciation, recognizing his contributions in workinq with the youth of
the City and also, a Proclamation be read proclaiming a week in his honor.
Councilman Feeney will draft this Proclamation.
MAYOR LAURIE: The City Manager reported that the County Commissioners are considering the
BIKE PATHS IN approval of funds for the construction of bicycle paths in various parts of
7TTT=-- the County. The locations of the paths in the City are: on Hums Road from
Military Trail to Riverside Drive, Riverside Drive from Burns Road to Holly
Drive, and Gardens East Drive from Meridian Wn y to Lighthouse Drive.
Steve Henning, the City's Director of Recreation and Parks, will be con -
tectxng Richard Morley, County Recreation Planner, to see how much these
bike paths will cost, as the City would have to approve 50 percent matching
funds for the bike paths within its corporate limits.
UOUNCILNAN Councilman Martinn reported a street light out on uaisam Street.

Dear Mr. Orr:
Reference is made to the inquiry of the City Council at its last meeting as to
when site plan approval is required prior to the issuance of a building permit.
Upon review of Article III of Chapter 6 of the Palm Beach Gardens Code,
it is my opinion that such approval is required prior to issuance -:- 2 building
permit except for the following:
a. Internal renovation or repair of a building or structure
6. Repairs to or replacement of any part of the exterior
of a structure or building
c. Single family buildings or structures
d. A Planned Unit Development
The City is required to meet the some requirements of this portion of the Code
"i %c, any other citir_en.
In conclusion, situations can arise as to whether the construction work involved
is a repair, replacement or an addition or a combination. If the building official
should be in doubt as to the classification, their site plan approval should be
required prior to issuance of a permit.

letter will illustrate our position in regard to the streets within
PGA National.

be Owned by PG!! National Venture, Ltd., with a roadway easement granted
to the Northern Palm Beach County Water Control District, The District
will continue to build these roads and will also have the maintenance

Access Points
PGA ,rational Venture, Ltd. will ',cep the tuo access points indicated
on Exhibit D, and this retention will be noted on future plats. These
! - access points are being retained, so as to allow the PGA National in-
ter -wal security force (operated by the Property Owners Association) a
: better opportunity to prevent vandalism and pilferage of valuable con-
struction materials and equipment during the construction of the PGA

out of the project through quiet residential areas (which is where
these access points are Located) would invite the vandalism and
pi]ferage described above. PGA National Venture, Ltd, or its
cssigns will, upon the substantial completion of all construction
within the project convey these access points to the City.
It is understood that cha-iges in the raster De,,elopment Plan may
alter the configuration of the roads as they appear on the exhibits
attached to this letter; however the basic plan described herein
shall continue to apply. We will be happy to discuss this matter
with you or Bill &cant at any convenient time. Thank you for your
