HomeMy WebLinkAboutMinutes Council 032780CITY COUNCIL WORKSHOP MEETING CITY OF PALM BEACH GARDENS MARCH 27, 1980 The Workshop Meeting of the City Council of Palm Beach Gardens was called to order by Mayor Dick Feeney at 8:00 P.M. in the Assembly Room, 10500 North Military Trail, Palm Beach Gardens, Florida; and opened with the Pledge of Allegiance to the Flag. ROLL CALL: The roll was called by the City Clerk and present were: Mayor Feeney, Vice Mayor Aldred, Councilman Kiedis, Councilman Laurie, and Councilwoman Monroe. City Manager John Orr and Attorney William Brant were also in attendance. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA: MR. SAMUEL Mr. Samuel Carsillo, 10063 Dahlia Ave., PBG, addressed the Council re: CARSILLO: the south side of PGA Boulevard, between Military Trail and the Sunshine State Parkway, needing a general clean -up; the fuel adjustment charge Florida Power & Light Company is charging its users; people that attend garage sales parking on other residents' lawns; expediting the County's location of a pedestrian crossing light at the intersection of Military t Trail and PGA Boulevard; contractors developing in Plat 4 being requested to keep their job sites tidy; the developers of the Edgemere multi - family PUD being requested to accelerate the installation of the landscaping they offered to locate within the Elm Street median: RCA's lack of compliance with the City's Landscape Code; and the FEC Railroad being contacted re: the long length of time the loud whistle is blown on their trains passing through the City. MR_ JOHN fir. John Costello, 302 Riverside Drive, PBG, addressed the Council request - COSTELLO ing that the Police Department provide the out -of -the- ordinary service of placing his fingerprints on his application to the State for a real estat; license without filling out the application form for an identification card of the City. Attorney Brant advised that per a strict interpretation of the City's Cod the data on the City's form is not required to be furnished, unless a City ID Card is to be issued; however, it would be a policy decision of the Council as to whether or not the Police Department is to provide this type ( of service requested by Mr. Costello. ` With no objections from the members of the Council, the Police Department will be requested to provide this service requested by Mr. Costello without him being required to complete the application form for a City ID Card. City Council Workshop Meeting, 3/27/80 Page Z MRS. LORRAINE Mrs. Lorraine Averbach, 4335 Elm Ave., PBG, addressed the Council AVERBACH reporting deviations she felt were occurring from the plans the Council approved for the Winchester Courts PUD, which is currently being developed within Plat 4 of the City. The City's Building Official will be requested to ensure that the development is in compliance with the plans approved, which were attachments to the City's Ordinance 15, 1978. Until such time Winchester Drive is dedicated to the City so that Florida Power & Light Company can /will install a street light at its intersection with Military Trail, the City will place reflectors on the median and request that if a power source is available, the developer install a temporary light at this intersection. MR. EDWARD Mr. Edward Weimer, President of the PBG Senior Citizens' organization, WEIMER extended invitations to the members of the Council, the City Manager, and the City Attorney to attend their luncheon on March 31, 1980. MR. JOHN Mr. John Caporini, President of the Palm Beach Gardens Youth Athletic CAPORINI Association and member of the City's Recreation Advisory Board, addressed the Council re: an article that appeared in the Palm Beach Times yesterday evening. This article, which was entitled "Gardens hitting here, fielding there, but still winning ", quoted Mr. Dave Schumacher, a baseball coach at the Palm Beach Gardens High School, as saying derogatory remarks about the City. Mr. Caporini and the members of the Council took great exception to the statements made by Mr. Schumacher, as instead of being appreciative of the facilities the City provides the high school, which is the responsibility of the Palm Beach County School Board, he ridiculed the City for what it does provide. Mayor Feeney will meet with Mr. Luther Thornton, Principal of the high school, re: the Council's request for a public retraction of the comments made by Coach Schumacher. Mayor Feeney will also request the high school to "leave the City's baseball fields in the same condition they find them" (i.e., at least rake around the batters box and the pitchers mound), so they will be in readiness for the subsequent games of the PBGYAA. RESOLUTIONS: During the workshop session on the March 25, 1980 draft of Resolution 21, RESOLUTION 21, 1980, executing an Addendum Agreement "B" to the agreement entered into on T797 April 7, 1977, between the City and the City's contracted Tennis Profes- sional, the figures of "$20.00" and "$10.00" were inserted respectively in the blanks of the paragraph to substitute Sub - paragraph D of Section 3 of the agreement. The City Attorney was requested to also include in this City Council Workshop Meeting, 3/27/80 Page 3 Addendum Agreement "B" an amendment to Sub - paragraph I of Section 2 of the agreement, whereby the tennis pro will be permitted rather than required to carry an inventory of tennis supplies in the pro shop. Resolution 21, 1980 will be considered for adoption by the Council at their Regular Meeting of April 3, 1980. ORDINANCE 2, Mr. Kieran Kilday, Land Planner, addressed the Council re: the intent I7987-- of Ordinance 2, 1980, which is based on his request as authorized agent for Mr. Charles Lamn, Trustee, for the annexation of the 7.71 -acre parcel of land located on the southwest corner of RCA Boulevard and Prosperity Farms Road within Section 8 -42 -43 with the zoning classification of CN - Neighborhood Commercial. Pursuant to Mayor Feeney's suggestion at the Workshop Meeting of February 28, 1980, the City Manager explained that under the City's current Code, the subject property could be zoned for a Planned Unit Development, with site plans being the attachments to the Ordinance. And then, prior to the PUD being developed, the detailed drawings would be required to be approved by the City. However, members of the Council concurred that they did not wish to make a modification to the process that has been followed for the creation of PUDs in the past. A Public Hearing and the Council's consideration of adoption of Ordinance 2, 1980, will take place at the Regular Meeting of April 3, 1980. ORDINANCE 4, Mayor Feeney acknowledged receipt of a communication from the City's Site 1980 Plan and Appearance Review Committee recommending to the Council the adoption of the February 26, 1980 draft of Ordinance 4, 1980, with a modi- fication that would provide for the requirement that the Building Official notify them, in writing, if /when he permits an alteration /improvement to an existing non - single family residential structure without the plans being approved by the Committee. During the workshop session on Ordinance 4, 1900, the Council inserted the the words "non - single family residential" in the stead of the word "non- residential" in the fourth line and added the verbiage "; and shall submit to the Site Plan and Appearance Review Committee a report of his action for their review" to the last paragraph of the text to be added to Section 6 -12(2) of the City's Site Plan and Appearance Review Code. A Public Hearing and the Council's consideration of adoption of Ordinance 4, 1980, will take place at the Regular Meeting of April 3, 1980. City Council Workshop Meeting, 3/27/80 ITEMS FOR DISCUSSION: Page 4 CO'S ACQUISITION At the Workshop Meeting of March 13, 1980, Councilman Kiedis acknowledged OF - ipt of a communication, with attachments, from County Commissioner PARC - =CA RWAY Peggy Evatt in response to the City's request that the County consider acquiring with the Beach Bond Referendum funds the 21.03 -acre parcel commonly known as the "Rybovich property" and /or the adjoining 13.50 -acre parcel owned by Royal American Industries, which are located on the intra- coastal waterway, south of the Monet Road extension, within the Village of North Palm Beach. The members of the Council concurred with the reasons why Mr. Peter J. Kelly, Director of the County's Land Acquisition Division, recommended the 21.03 -acre parcel not be acquired. The County will be requested/ reminded to pursue the acquisition of the 13.50 -acre parcel as soon as the cost figure is ascertained from Royal American Industries. PROCEDURE FOR The members of the Council were in favor of the procedure recommended by SELECTION OF the City Manager for the City to follow in the selection of a Police POLICE CHIEF Chief. The position will be advertised within the state in various magazines and newspapers. The applications will be reviewed by the City's Merit System Board, who will,in turn,recommend five candidates to the City Manager. The City Manager will recommend three candidates to the City Council for interviews. However, the Council will have the prerogative to request additional recommendations from the City Manager and Merit System Board. The City Manager was requested to prepare the advertisement for this position with the salary range of $20- 22,000 for the Council's approval. APP'T OF COUN- Council Liaisons /Representatives were appointed for a three -month period CIL LIAISONS to the various Advisory Boards of the City. RECOMMENDED Councilman Kiedis suggested that the Council consider in the near future AMENDMENT TO an amendment to the City's Sign Code, whereby political signs would not be SIGN CODE permitted to be posted within the City. LEGAL OPINION Councilman Kiedis requested that the City Attorney render a legal opinion RE: CAMPAIGNING re: candidates soliciting votes and posting political signs at an entrance FOR COUNCIL road to City precincts while the General Election is in process. PETITIONS AND COMMUNICAIIONS: Mayor Feeney acknowledged receipt of communications from the following: STEVE HENNING 1. Steve Henning, Director of Recreation and Parks, requesting the Mayor to present trophies to the City's soccer league participants on March 28, 1980. ITEMS BY THE CITY MANAGER: REQUEST TO EX- The City Manager advised the Council that at their Regular Meeting of PEND FUNDS FOR April 3, 1980, he will be requesting permission to expend funds from the INSTALLATION OF LIGHTS Council Contingency Account for the replacement of light bulbs on the �s poles at Plant Drive Park. The cost will be approx $100 per pole. ITEMS BY THE MAYOR AND COUNCIL: COUNCILMAN Councilman Kiedis suggested that some recreational improvements be made 7Krmr� to the 2.9 -acre parcel of land Mr. Otto DiVosta, developer of the Garden RECREATIONAL Lakes /Square POD, donated to the City pursuant to the City's Ordinance 18, IMPROVEMENTS TO CIT 'S 2.9 1977 - monies for these improvements to be taken from the $3745.82 Mr. AC 5 DiVosta donated to the City as a settlement amount, which was approved by the Council at their Regular Meeting of February 21, 1980. These improve- ments would include the installation of baskets on the existing concrete slab for basketball play and the planting of sod. The Council's authorization for expending these funds will take place at a future Regular Meeting. RELOCATION OF Councilman Kiedis requested that the shell rock located at the above- - SHELLROCK TO referenced 2.9 -acre parcel be relocated to the parking area at Lake LAKE CATHERINE Catherine. VICE MAYOR ALDREDIn response to Vice Mayor Aldred, the City Attorney advised that per the P & Z'S RECOM- City's Code, the Planning and Zoning Commission has the authority to con- sider for recommendation to the Council a PUD with a higher density than s the zoning classification that exists on the parcel permits. COUNCILMAN Councilwoman Monroe offered to follow -up on the landscaping of the medians LAURIE BEAUTIFICATION OF at the intersection of PGA Boulevard and Military Trail and on Elm Street. MEDIANS The City Manager offered to follow -up on a request of a resident residing REQUEST FOR on Cottonwood Avenue for the Northern Palm Beach County Water Control C117MM OF District to clean the canal behind his /her home. CANAL ENFORCING SIGNS Mayor Laurie requested that the "No Stopping Or Standing" signs located AT G S in front of the PBGHS be enforced by the Police Department. RECOGNITION OF The City's Recreation Department will be requested to explore the cost of E PLAYERS the Cit presenting some token of recognition, IN ORLD RECORD y p g g , perhaps patches or pins/ ME buttons, to those involved in the soccer game that took place at the PBGHS February 22, 23, and 24, 1980 and set a new World Record for continual soccer playing.
