HomeMy WebLinkAboutMinutes Council 050880CITY COUNCIL WORKSHOP MEETING CITY OF PALM BEACH GARDENS MAY 8, 1980 The Workshop Meeting of the City Council of Palm Beach Gardens was called to order by Mayor Dick Feeney at 8:00 P.M. in the Assembly Room, 10500 North Military Trail, Palm Beach Gardens, Florida; and opened with the Pledge of Allegiance to the Flag. ROLL CALL: The roll was called by the City Clerk and present were: Mayor Feeney, Vice Mayor Aldred, Councilman Kiedis, Councilman Laurie, and Councilwoman Monroe. Attorney George Baldwin and City Manager John Orr were also in attendance. ANNOUNCEMENTS: Mayor Feeney announced that meetings of the City's Recreation Advisory Board, Planning and Zoning Commission and Fire Department would take place on Tuesday, May 13, 1980 at 7:30 P.M., and a meeting of the City's Beautification and Environmental Committee would take place on Wednesday, May 14, 1980, at 7 :30 P.M., PROCLAMATIONS: Mayor Feeney read Proclamations proclaiming May 10 through May 16, 1980 "Municipal Clerk's Week" and May 11 through May 17, 1980 "National Hospital Week ". PRESENTATION OF PLAQUE OF APPRECIATION TO MR. E. B. SHEARIN,, JR., MEMBER Of THE CITY'S FIRF DEPARTMENT FOR 10 YEARS On behalf of the City, Mayor Feeney presented a plaque of appreciation to Mr. E. B. Shearin, Jr., who has been a volunteer member of the City's Fire Department for ten years. This plaque read "Presented To E. B. Shearin, Jr. In Appreciation For Dedicated And Conscientious Service To The City Of Palm Beach Gardens As Member Palm Beach Gardens Fire Department 10 Years Service May, 1970 - May, 1980 From The Palm Beach Gardens City Council ". COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA: MR, BOB YEAGER Mr. Bob Yeager, recently elected President of the Plat A Homeowners Association, addressed the Council forwarding requests of members of the Association,including the installation of a bicycle path along North Military Trail from the subdivision to PGA Boulevard, support of their requests of owners of vacant lots to maintain them; a construction trailer at 4339 Linden Avenue be removed; and a passive recreation area be located in the general area of the subdivision. SAMUEL Mr. Samuel Carsillo, -10063 Dahlia Ave., PBG, addressed the Council re: CARSILLO the need for the County to: have roadway improvements made at the intersections of Military Trail and Arbor Way and Burns Road and A -1 -A Alternate and on PGA Boulevard, west of the Sunshine State Parkway overpass; and the willingness of residents to install a sprinkler system in the median of the cul -de -sac on Seagrape Way. RESOLUTIONS: The modifications made by the Council to the "F-ity of Palm Beach Gardens RESOLUTION 30, Employees Manual", Exhibit "A" of Resolution 30, 1980, will be incorporated 1987— prior to their consideration of its adoption at their Regular Meeting of May 15, 1980. ORDINANCES: During the workshop session on Ordinance 7, 1980, Sub- paragraph D of ORDINANCE 7, Section 4 was amended to read "The City Attorney, City Manager, or his �— representative, shall represent the City by presenting cases before the Board. ". A Public- Hearing and the Council's consideration of adoption of Ordinance 7, 1980 will take place at the Regular Meeting of flay 15, 1980. ITEMS FOR DISCUSSION: REZONING OF At their meeting of April 8, 1990, the Planning and Zoning Commission 2.386 —ACRE adopted a motion to recommend to the Council the denial of the request PARCEL ON MILITARY TRAIL of Attorney William Ciklin for the rezoning of a 2.386 -acre parcel of land located on the west side of Military Trail, south of the Thompson River,from RH -High Density Residential to CPO - Commercial Professional Office. This recommendation was made for the reasons of the traffic impact CPO usage would have on Military Trail, the "spot zoning" it would create, and this property is not being used as a transitional zone between abutting properties. In the absence of Attorney Ciklin, who is the authorized agent for the owners /developers of this property, Mr. Hank Skokowski, Land Planner, and Mr. Ed Oliver, Architect, addressed the Council re: this rezoning request. Mr. Skokowski presented an aerial depicting the existing land usage along both sides of Military Trail between PGA Boulevard and Holly Drive; Mr. Oliver demonstrated what could be built on this property under the current zoning classification and what could /would be developed if the rezoning request is granted. City Couccil Workshop Meeting, 5/8/80 Page 3 The owners, Messrs. Harry S. Hamilton, B. H. Vaughn, and Jack A. White, propose to develop a two -story professional /medical office building with 22,000 sq. ft, of leasable space and 122 off - street parking spaces. The total lot coverage would be 14.1 %. Approximately 25% of the building would be medical clinics /offices; the balance would be professional offices. The Council- shared the City Manager's concern for the safety of those residents traveling the bicycle /pedestrian path that exists along the Front of the subject parcel if it were developed commercial. With no objections from Mr. Hamilton or Mr. White, who were members of the audience, Mr. Oliver indicated that has clients would be receptive-to installing a path along the east side of Military Trail between Holly Drive and Lilac Street, thus linking the existing paths and making it safer for bicyclists /pedestrians to travel along this major roadway. An Ordinance providing for this rezoning will be considered for first reading at the Regular Meeting of May 15, 1980. Prior to the Council's consideration of adoption of this Ordinance, the applicant will provide a comparative traffic analysis (i.e., the traffic impact of the usages permitted by RH zoning vs CPO zoning). The City Engineer will be requested to provide his comments re: the traffic analysis and the pro- posed quantity and locations of the curb cuts. PETITTONS AND COMMUNICATIONS: Mayor Feeney acknowledged receipt of the following: MS. EMILY OBST, 1. A letter dated April 30, 1980, from Ms. Emily V. Obst, President of 77T 77— Obst Associates, re: the status of the preliminary plans she is pre- paring for the Community Center the Council will consider for a Special Referendum Election in the future. JDM PLAT #1 2. A copy of a petition residents of PGA (JDM) Plat III have sent to the Palm Beach County Board of Health re: the construction project known as "Vision One ". The City Manager will contact the Board requesting they expedite their judgment in the hopes that something can be done, perhaps by the City, to alleviate the dust and dirt blowing from this property onto adjacent lands. (A copy of this petition has been attached and made a part of these minutes.) OFFICE OF COUNTY 3. A communication from J. H. Burns of the Office of the County Engineer FFG 7__ soliciting the City's suggestions as to road projects that should be included in the County's 1980/81 Fiscal Year's Budget. The Mayor City Council Workshop Meeting, 5/9/80 Page 4 will send a letter of response to Mr. Burns incorporating the thoughts of the Council. MR. JOHN DANCE 4. A letter from Mr. John Dance, Director of the County's Parks and DIR. OF 0. PARKS & RECRE- Recreation Department, seeking applications for the County /City AT 0 funding program for recreational developments in municipalities. The City Manager will explore whether or not these monies can be spent for recreational improvements on private property, particularly the installation of a sprinkler system at Lake Catherine. Vice Mayor Aldred will solicit recommendations of the Recreation Advisory Board at their meeting of May 13, 1980. REPORTS: The City Manager reported that he has applied to the Community Affairs CITY MANAGER: Division of the State for a second one -year extension for the completion of the City's Comprehensive Land Use Plan. ITEMS BY THE CITY MANAGER: WAIVER OF RE- The Council acknowledged receipt of a communication from Mr. Michael D. QUIREMENT FOR Rosen, Project Director of the PGA National Resort Community, requesting MEWALKS I N PGA SINGLE that the homeowners in the single family residential areas of the project FAMILY AREAS not be compelled to install sidewalks in front of their homes. A memo from the City Manager providing further information re: these sidewalks accompanied this communication. When this project was first .introduced to the City, the developer indicated that all of the streets would be public. The major roadways would be dedicated to the Northern Palm Beach County Water Control District for perpetual maintenance; and the streets within the single family plats would be dedicated to the City. In keeping with the guidelines of Sub - section (6) of Section 310 of the City's Subdivision Regulations, which states that sidewalks "shall be provided on each side of all major arterial and collector streets when those streets are accepted by the City for maintenance ", sidewalks were indicated on the construction drawings for Plats 1, 2, and 3 of the project. Mr. Rosen made reference to Plats 1, 2, and 3, as recorded, and requested on behalf of the owners of homes /property in the single family subdivisions that in view of the fact that the streets were ultimately dedicated to the individual homeowners associations, they not be required to install the sidewalks. Mr. Rosen reiterated the various reasons for this request, which were outlined in his communication. City Council Workshop Meeting, 5/8/80 Page 5 This matter was referred to the City Manager and City Attorney for recom- mendation to the Council at a future meeting. ITEMS BY THE MAYOR AND COUNCIL: COUNCILWOMAN In response to Councilwoman Monroe, the City Manager advised that monies T were not allocated in this year's budget for the construction of a parking lot at Gardens Park. The Council was requested to offer their input to the Beautification and Environmental Committee re: the proposed location of a new identifying sign for the municipal complex on Military Trail.
