REGULAR MLETING
CITY OF PALM BEACH GARDENS
MAY 15, 1980
The Regular Meeting of the City Council of Palm Beach Gardens was called
to order by Mayor Dick Feeney at B:GO P.M. in the Assembly Room, 10500
North Ihlitary Trail, Palm Beach Gardens, Florida; and opened with the
Pledge of Allegiance to the flag.
ROLL CALL:
the roll was called by the City Clerk and present were: Mayor Feeney,
Tice 1`layor Aldred, Councilman Kiedis, Councilman Laurie, and Councilwoman
Monroe. Attorney George Baldwin was also in attendance. The City Manager
was not in attendance due to an .illness in his family.
MINUTES:
The minutes of the Regular Meeting of 1,12v 1, 1980, were unanimously
approved by the Council, as written.
The minutes of the Workshop Meeting of flay 2, 1980, were unanimously
approved by the Council, as written.

Pursuant to some of the concerns brought out by Mr. Samuel Carsillo, 10063

Dahlia Ave., PBG, the Principal of the PDG High School will be requested
to discourage students from parking on their lawn; the State Department
of Transportation will he requested to post "No Littering" signs on PGA
BOLlleVard and comple+•- the project of widening this artery west of the
turnpike by placing proper,'adequate signage; the Building Official will
be instructed to halt all building inspections /approvals at the his,on I
prel,::ct until such time they at least "clean up" the bicycle path along
the front ^f "re project; the Mayor will discuss at a luncheon with County

Commissioner Peggy Evatt on May 21, 1980, the need for the intersection of
Burns Road and Alternate A -1 -A to be upgraded; the SFWMD will be requested
to clean the canal east of the YMCA on Monet Road: the City will reiterate
its request of the County to upgrade the radii of the roadway at the inter-
section of Arbor [day and Military Trail; and the Council will consider

applying for funds that may be available under the Farmers Home Act
during their future discussions re: the acqui- sition of Seacoast Utilities,
Inc..
In response to flr. Carrillo, the flayor reported that per the request of
the Council at their meeting of flay 1, 1980, he sent mailgrams to members
of the State Legislature advising that the City adnmently opposes Senate
Bill 904, which proposes that the taxpayers pay 50 percent of the main-
tenance costs of signals at railroad crossings.
11R. JOHN Mr. John Caporini, President of the PBGYAA, addressed the Council pursuant
CAPS to his request outlined in a communication dated flay 13, 1980 that the
PBGYAA HOSTING Assoc -at-ion be permitted to host an area tournament of the National Pon.;
PONY LEAGUE pasebnll organization at Plant Drive Park July 14 - July 19, 1980.

A motion was unanimously adopted by the Council that the foregoing request
of the City's Recreation Director be granted. The Public Works Department
will erect temporary fences in the outfield and down the first and third
base lines and provide a grounds k�Ner between the games that take place
during normal working hours of that department. A "reserve" or "off- duty"
police officer will be on duty at the field during the tournament.
® RESOLUTIONS: By a unanimous vote of the Council, the City Clerk read in full Resolution
RESOLUTION' 30, 30, 1980. approving and adopting the City of Palm Beach Gardens Employees
Manual. Resolution 30, 1950 vas unanimously adopted by the Council with
the word "he" inserted between the words "shall" and "effective" rn
Section 3.
The City Manager will extend the grot_tude of the Council to the members
of the City's Merit System Board, who compiled this manual that contains
"highlights" of the City's Merit System Rules and Regulations.
RESOLUTION 3], By a unanimous vote of the Council, the City Clerk read in full Resolution
191- 31, 1980, appointing members to the Board of Trustees of the Folicemcn's
Retirement Trust Fund. Resolution 31, 1980 uns unanimously adopted by
the Council.
RESOLUTION 32, mayor Feeney declared the Public Hearing open, uhich was duly advertised
$� April 22, 1980, and held on the intent of Resolution 32, 1980, permitting
as an exception to Chapter 3 of the City's Code the sale of dlcoholic
beverages for on- premise consumption at "Pasquale Italian Restaurant ",
which is proposed to be located within the PGA Plaza of 2534 PGA Boulevard,
PBG, and closer than the required 750' to other .ilcoholic beverage vendors..

Ps. Fay Proctor addressed the Council on behalf of Mr. Pasquale Donza,
the applicant for this variance. Ms. Proctor advised the Council PEr.
Donza now operates /owns "Pasquale Italian Restaurant" in Jupiter, Fla..
and he wishes to locate this restaurant in Palm Beach Gardens. This
application is only for the sale of beer and wine. The lease Mr. Donza
has with t1r. Wm. G. Lassiter, owner of the PGA Plaza, prohibits him from
serving /selling alcoholic beverages other than beer and wine.
W3Lh no further comments from members of the audience, Mayor Feeney
declar ^d the Public Hearing closed.
By a unanimous vote of the Council, the City Clerk read in full Resolution
32, 1980. Resolution 32, 1980 was unanimously adopted by the Council.
RESOLUTION 33, mayor Feeney declared the Public Hearing open, which was duly advertised
T797- April 22, 1980, and held on the intent of ReSOIL.tion 33, 1980, permitting
as a "conditional use" in a CG -1 Zoning District the retail sale of
alcoholic beverages for on- premise ---- ,-nption at "Pasquale Italian
Restaurant ", which is proposed to be located within the PGA Plaza at
2534 PGA Boulevard, PBG.
The City Clerk reported that at their duly advertised Public Hearing held
May 13, 1980. a motion was adopted by the Planning and Zoning Commission
that they recommend to the City Council the granting of the request of
Mr. Pasquale Donza to sell /serve beer and wine as a "conditional use ".
Members of the audience did not address the Council re: the =ntent of
Resolution 33, 1980. Nayor Feeney declared the Public Hearing closed.
By a unanimous vote of the Council, the City Clerk read in full Resolution
33. 1980. Resolution 33, 1980 was unanimously adopted by the Council
with the verbiage "limited to malt and wine beverages" inserted between
the uords "beverages" and "at" in the fourth line of the heading paragraph
and the third line of Section 1.
ORDINANCES: Mayor Feeney declared the Public Hearing open, which was duly advertised
April 30. 1980, and held on the intent of Ordinance 7, 1980, providing
for the creation of a Couc Enforcement Board of the City.
Members of the audience did not address the Council re: the intent of
Ordinance 7, 1980. Mayor Feeney declared the Public Hearing closed.

By a unanimous vote of the Council, the City Clerk read by title only
on second reading Ordinance 7, 1980. The May 0, 1980 draft of Ordinance
7, 1980 was unanimously adopted by the Council.
ORDINANICF 8, By a unanimous vote of the Council, the City Clerk read by title only
1980 on first reading Ordinance 6, 3980, providing for the rezoning of a 2.386 -
acre parcel of land located on the west side of Military Trail, south of
the Thompson River from RH -High Density Residential District to CPO -
Commercial Professional Office District.
The Mayor requested the City Clerk to invite the members of the Planning
and Zoning Commission and those individuals that own property within 300`
of this parcel to attend the Council's meeting of June 5, 19BO when this
request of Attorney Ciklin, authorized agent for Messrs. Harry S. Hamilton,
B. H. Vaughn, and Jack A. White, is workshopped.
ITEMS FOR DISCUSSION:

SPRIGGING OF S. The City's Public Works Director reviewed with the Council his memo of

This commurication was pursuant to the discussions at the Regular Meetings
Of Apr!] 17, 198D and May 1, 1980.
By a unanimous vote of the Council, the City Manager was authorized to
expend $2370 fLum the Council Cc tangency Account for the purchase,
including freight, of 419 Bermuda sprigs to be planted on the south 9,
acres at Gardens Park. These sprigs will be planted with the assistance
Of volunteers on Ilay 23 & 24, 1980.
PETITIONS AND CONNUNICATIONS:
INVITATION TO Elayor Feeney acknowledged receipt of a memo from Steve Hr- nning, Director
ITAL of RecreatLon and Parks, requesting the Council to attend the department's
nnnual dance recital nn May 17, 1980 at the Palm Beach Gardens High School.
REPORTS: Councilwoman Monroe reported on the Site Plan and Appearance Review Com-
COUNCILWOMAN mittee's and Planning and Zoning Commission's meetings of May 13, 1980.
MONROE_ During the Council's discussion re: these meetings, they requested that
the advisory boards be as definitive Ps possible in making their motions
approving /disapproving projects. The Building Official will be requested

to not issue a temporary Certificate of Occupancy to CvPrglades federal
Savings and Loan until direction is received from the City Manager.
VICE MAYOR
Vice Mayor Aldred reported on the Recreation Advisory Board meeting he

and Councilman Kiedis attended on May 13, 1980. The minutes of this
meeting will he placed on file in the City Clerk's office.
MAYOR FEENEY
Mayor Feeney reported that Steve Henning, Director, rind Ken Schott,
Supervisor II of the City's Recreation and Parks Department, have
tendered their resignations to the City effective June 4, 1480, and
May 28, 1980, respectively.
Mayor Feeney reported on a meeting he had with Commissioners of Rock
County, 5. Caroiina. on Flay 13. 1 °80 re: the acquisition of an AMI
hospital.
COUNCILMAN
Councilman Kiedis suggested and the other membr,rs of the Council concurred

that because of the deterioration in cooperation of the Community School
Program with the city in the use I '_'eii facilities, they consider not
financially supporting this program /renewing this Joint agreement with
the School Board during the 1980/1981 budget discussions.
Moyor Feeney will send a communication to Mr. Luther Thornton, Principal
of the Palm Beach Gardens 112gh School, advi-s2rig him that the City will
not Le contrihuting its fields for the high school's use to the extent
the Caty has in the past; and suggesting that they request funds from
the P. B. Co. 5rhool board to further upgrade the field at the high school,
which thr City ns,,isLed them with last year.

Councilman Kiedis suggested that the City take immediate step: to make

application for the funds available from the County on a 50/50 cost -
matching hoses for bicycle paths. The Inca Lions to be explored include
along Military Trail between Holly Drive and Lilac Street and between
Plat 44 and PGA Boulevard. Mayor Feeney offereo to pur;ua the request

of a bicycle path along PGA Boulevard between the Avenue of the PGA and
Military Trail.
An Ordinance amending the City's Code to include the requirement for
landscaping approved by the Site Plan and Appearance Review Committee
to be maintainod will be considered by the Council in the near future.
