'lire Regular Meeting of the City Council of Palm Beach Gardens was called
to order by Mayor Fec,n(,v r R :00 P.M. in the Assembly Room, 10500 North
Military frail, Palm Beach Gardens, Florida; and opened with the Pledge
of Allegiance to the Flag.
ROLL CALL: The roll was called by the City Clerk and present were: Mayor Feeney,
Vic^ Mayor Aldred, Councilman Kiedis, Councilman Laurie, and Council
Monroe. City Manager John Orr and Attorney William Brant were also in
attendance.
MIN[117S:_ The minutes of the. Regular leeting of September 4, 1980 were unanimous
approved by the Council, as Written.
The ninutes of the Workshop Meeting of September 11, 1980 were unanimously
approved by the Council, as amended.
Mayor Feenev announced that the City's Annual Bicycle Auction will take
place at the Public Works Department on Satu,dav, September 20, 1980 at
10:00 A.LL; and meet-.„g of the City's Planning and Zoning Commission
will take Dlace on T'ue,�day, Septe -ber 23, 1980 at 7:30 P.M..

tion in an effort to deter speeders.
ORDINANCES: hL-avor Feeney declared the Public Hearing open, which was duly advertised
ORDINANCE 14, September 2, 1980, and held on the intent of Ordinance 14, 1980,
i - placing the questiuu vE revising Subparagraph (b) initiation by
Petition of Section 22 -1 of Article XIT of the City's Charter before
the City's electors at the November 4, 1980 General Election.
Members of the audience did not address the Council re: the passage
of this Ordinance. Mayor Feeney declared the Public Hearing closed.
By a unaniT:ious vote of the Council, the City Clerk read by title only
on second reading Ordinance 14, 1980. Ordinance 14, 1980 was unanimously
adopted by the Cc.,ncil with the word "shall" deleted from the third 1inE
of the third page.

the City approve revising Subparagraph (b) Initiation By Petition of
Section 22 -1 of Artixle XII of the City's Charter. Resolution 51, 1980
was unaninx-)usly adopted by the Council with the explanation "(Pertaining
to petitions to City Council for Charter Amendment)' inserted between
the words "XII" and "of" in the first line of the PROPOSITI0N.
RE,SOLTTT -LM 527 By a unaninnus vote of the Council, the City Clerk read in full Resolu-
tion 52, 1980, establishing a special referendum election to be held on
November 4, 1980 for the purpose of deternninirg whether the electors of
the City approve borrowing monies for the payment of cost of construction
and furnishing of a Cam amity Activities Building.

We Resolution 52, 1980 was unanimusly adopted by the Council with the
following amendnents incorporated:
1. The words "AND REAL PROPERTY IIRTY'AGE" deleted from the fifteenth

2. The eighth and all lines thereafter in Section 1 repealed and the
following placed in their stead:

priated in the City's 1979/1980 Budget for the period of October 1 - 15,
1980. Resolution 53, 1980 was unanimously adopted by the Council.
ORDMVEES: Mayor Feeney declared the Public Hearing open, which was duly advertised
ORI)INADU, 1 , July 18, 1980, recessed at the Regular Meetings of August 7, August 21,
170 and September 4, 1980, and held on the intent of Ordinance 12, 1980,
providing for the creatinn of the 'tdinchester Courts II" nulti- family
PiT on a 20 -acre parcel of land on the west side of Military Trail at
Elm Avenue.
The City Manager acknowledged receipt of a comunication of this date
from Mr. Lennart Linda! -il, the City's consulting engineer, advising that
the preliminary layout of the interior site i.mprovempnts for thiG pro-
ject appears to be satisfactory; however, with regard to ofEsite improve-
ments and access, he concurs with the recarmendations of Palm Beach
County that the proposed northern ingress /egress not be constructed, or
as an option, this road align with the entrance to the Miramo r project
on the east ;i_de of Military Trail.
Bob Yeager, President of the Plat 4 Homeowners Association, related
the concern of sa,-re of their members re: the present trend of re:,idential
development in the City, inasmuch as the land usage of multi- family has
a greater impact than single family on the roadway system, etcetera.
With no further coaments from ua^rbera of the audience, Mayor Feeney
declarers the Public hearing closed.
By a vote of four ayeq and one nay, the City Clerk read by title only
on second reading Ordinance 12, 1980. Vote: on motion: Mayor Feeney,
Vice �Liyor Aldred. Counui'nan Kiedis, and Councilman Laurie voted aye;
Councilixxnn Monroe voted nay.
By a vote of Four a_aes and one nav, Ordinance 12, 1980 was adopted with
the following inserted in the stead of the second and third sentences
® of sub - paragraph (d) of Section 6:
"In addition, the Developer, at h:'s expense, shall cause to be constructed
an off -site bicycle path in the width of six feet (6') along the West

right- of-way line of Military Trail from Elm Street south to the resi-
aential entrance to Gardens Lakes Planned Unit Development. The bicycle
path sh311 be constricted in two phases: the first phase, from south
line of Winchester Courts II to the residential entrance to Gardens Lakes
Planned Unit Developwnt, within six (6) months from effective date
h-reef. The sc,cnd phasc, from the south iiue of Wincilesrer Courts 11
to Ehn Street, shall be completed by July 1, 1981."
Vote on motion: Mayor Feeney, Vice Mayor Aldred, Councilman Kiedis, and
Councilman Laurie voted aye; Councilwoman Monroe voted nay.
Councilwcgwn Pfcnroe related that she was not in favor of the creation of
this PUD, as granting the land usage of medium density residential on
the subject site is not in keeping with the City's proposed Comprehensive
Land Use Plan. (This plan reflects single family residential usage.)
Pursuant to the recommendation of the City Engineer, the northern ingress/
egress will not be shown on the plat `ter this project, which will be con-
sidered for approval. /adoption by a subsequent Resolution. Also, because
of the deletion of this road, the layout of the buildings will be modified
dft on the site plans to accompany the developer's tuture request for a
revision to this PUD.
0RDI1,TAXE 13, Mavor Feeney declared the Public Bearing open, .rihich was duly advertised
1390 - August 29, 1980, and held on the intent of Ordinance 13, 1980, amending
the minimunc acreage and fee stnicture for PUDs.
The Public Hearing and the Council's consideration of Ordinance 13, 1980,
was recessed until the Repllar Meeting of October 2, 1980, by a unanimous
vote of the Council.
ORDINANCE 15, By a tnanimous vote of the Council, the City Clerk read by title only
on tirst reading {7 dirance 16, 1980, amending Ordinance #15, 1978 by
extending the time for the completion of the Winchester Courts 1 PUD. A
Public Bearing and the Council's consideration of adoption of Ordinance
16, 1980 will take place at the Regular Meeting of October 16, 1980.

on first reading Ordinance 19, 1980, amending the permissible hours for
the sale /service of alcoholic beverages. Ordinance 19, 1980 will be

AMER LUC ASSOC. 8. The American Lung Association of Southeast Florida, Inc, re: the
Palm Beach County Clean Indoor Air C-ui.,ance, adopted by the County
Ccarrnission on August 26, 1980. The Council will discuss the City's
participation in this matter at a meeting in the near future.

GARDENS PARK Fence ConTany for fencing for three softball fields at Gardens Park in
the amount of $8,858.82 - with thiq fencing meeting the approval of
the Building Official and Public Works Director, the monies are to be
taken from account 15- 63.60.
APPROVAL OF The Council unanimously approved the request of the North Palm Beach/
JAYCEES FLEA palm Beach Gardens Jaycees to use the land immediately west of the City's
MARKET
fire station on the northeast corner of Burns Road and Military Trail
for a flea market. The Jaycees will be notified of the Council's
approval, so they can determine a date certain for this event.

Re: Jaycee Flea Market
Dear Mr. Orr:
The North Palm Beach /Palm Beach Gardens Jaycees are '.inning to operate
a Flea Market in the very near future, with the date to be determined
pending approval of the Town Council.
The primary purpose of the Jaycee Flea Market is to create income for
the NPB /PBG Jaycees to provide other civic services in the area, specif-
ically, Take -A- Child - Fishing, M.D. lelethon, Christmas Party for under-
privileged Kids, 4th of July and many other service oriented activities.
We are seeking Council approval to use the land immediately west of the
fire station on the northeast corner of Burns Pd. and Military Trail.
This will be used for only one day starting curly in the morning and
lasting until the afternoon. All cleanup to be performed by the Jaycees.
If approval is received, this project will probably be conducted on a
Saturday. Display areas will be set up and a small fee charged to all
sellers.
