REGULAR MEETING
CITY OF PALM BEACH GARDENS
NOVFMBER 6, 1980
The Regular Meeting of the City Council of Palm Beach Gardens was called
to order by Mayor Feeney at 8:00 P.M. in the Assembly Room, 10500 North
Military Trail, Palm Beach Gardens, Florida; and opened with the Pledge
of Allegiance to the Flag.
ROLL CALL: The roll e:us called by the City Clerk and present were: Mayor Feeney,
Vice Mayor Aldred, Councilman Laurie, Councilwoman Monroe, and Council-
man Kiedis. City Manager John Orr and Attorney William Brant were also
in attendance.
MINUTES: [he minutes of the Regular fleeting of October 16, 1980, were unanimously
approved by the Council, as written.

ANNOUNCEMENTS: Mayor Feeney announced the following:
A,5,pecial Meetinq of the City's Planning and Zoning Commission /Local
Planning ,Agency will take place on r1onday, November 10, 19BO, at 7:30 P.M.
Meetings of the Citv's Planning and Zoning Commission, Fire Department,
rnd Recreation Advisory Board will convene at 7:30 P.M. on Tuesday,
November 11, 1980.
A meeting of the City's BeauLification and Environmental Committee will
take place on Wednesday, November 12, 1980, at 7:30 P.H..
PROCLAMATIONS: Mayor 'reenry read proclamations proclaiming November lI through
November 15, 1980, "Marine, Corps Wee'.;" and November 6 through November 16,
1980, "Shriners 'lospitals Week ".
AWARDING OF BID Per the recommendations of the City Manager, the Chief of Vehicular

MR. RON CARDOZA Tn response to Mr. Ron Cardoza, 9787 Gardcnio Dr., PDG, the City Manager
clarified that the animal warden of the County Animal Regulation Depart-
ment is on duty around- the - clock; and the City Attorney explained the
procedures for one to file a complaint igainnt a violator of the City's
"leash law" {i.e., assisting the Police Department in the enforcement
of the "lease law "). The City Attorney will research whether or not
this particular law falls within the jurisdiction of the newly- created
Code Enforcement Board.
RESOLU3IONS:
By a unanimous vote of the Council, the City Clerk read in full Resolu-

tior 61, 1980, requesting the members of the Fla. Legislature to adopt a
1980
bill providing for the conduction of fire safety .inspections in public
schools by the Division of State Fire Marshal or a qualified local fire
department official. Resolution 61, 1980 was unanimously adopted by
the Council with the �Yords "safety vlrhin" inserted in the stead of the
words "the general welfare of" in the third lane of Section I.
RESOLUTION 62i By a unanimous vote of the Council, the City Clerk read in full Resolu-

tion 62, 1980, amending Sections VI and XII of the Citv's Merit System
Rules and Regulations. Resolution 62, 1980 was unanimously adopted by
the Council, with edific3tion of the attachment. Exhibit "A ".
RCSCLU H ON 63, By a unanimous vote of the Council, the City Clerk read in full Resolu-
19uO Lion 63, 1980, executing an employment agreem -nt hetween the City and
the Service Employees international Union as the bargaining unit /agent
for certain Public Works and Park^ i"ainterance empinyees of the City.
Resolution 63, 1980 was unanimously adopted by the Council.
RESOLUTION 65` By ra unanimous vote of the Council, the City Clerk read in full Resolu-
i980 v ;ion 65, 19BO, expressing the intent of the Citv Council to pursue the
acqui- ,ition of Seacoast Utilities, Inc.. Resolution 65, 1983 way
unanimously adopted by the Council with the following modifications:
1. The verbiage "pursue the acquisition" placed it the stead of the
word "acquire" in the Lhird line of the heading paragraph and the
second line of Section 1.
2. The word "of" inserted between the words "purchase" and "the" in
the third line of the heading paragraph and the second line of
Section 1.
3. The word "unincorporated" placed between the words "the" and "areas"
of the tenth line of the heading paragraph.

4. The words "may be" placed in the stead of the word "is" in the
second line of the first WHEREAS paragraph.
5. The Phrase "upon the some or equal basis as applied to the residents
and citizens of Palm Beach Gardens" inserted between the words
"municipalities" and "and" in the seventh line of the second
WHCREAS paragraph.
6. The word "(unincorporated)" inserted between the uords "County" and
"area" in the eighth line of the second WHEREAS paragraph.

from metal to fiberglas shingles was defeated. Vote on this proposal
that the Council overrule the decision of the Site Plan and Appearance
Review Committee at their meeting of S -1 -ember 23, 1980 that fiberglas
shingles cannot be substituted for the metal roofing originally on the
plans and approved by the Committee: Mayor Feeney, Councilman Kiedis,
and Councilwoman Monroe voted nay: Vice Mayor Aldred and Councilman
Laurie voted aye.
APPROVAL OF PBG The Council approved for this year season the schedules for the baseball

1, The high school's varsity boys baseball team is permitted to play
their scheduled horde games on the baseball field at Gardens Park.
They may use this facility for practice the day before each home
game only. ny 5:00 P.M., all practices must be ended, the clay
infield and the batters box must be manually drug with a portable
dray that will be supplied by the City. and the field left in the
same condition they found it.
2. the high school's varsity girls softhall team may play all their
scheduled home games on the southeast field at Gardens Park. ]hey
may use their field for practice on the dates that the field is
. not in use by the Benjamin School for their scheduled home games,
provided that the clay infield and the batters box are manually
drug with the portable drag and the field is left Jr) the same
condition they found it.

4. The home games of the private school's boys baseball and girls
® softball teams may be played on the foreyoing fields. They,
too, must manually drag the clay infield and batters box with the
portable drag and leave the field in the same condition they found
it.
5. Any practice conflicts or change in the schedules, which have been
attached and made a part of the record, must be funneled /approved
by the Recreation Director.
Mr. Dick Cameron of the Citv's Public Works Department was requested to
demonstrate to the teams the proper way to drag the fields.
The Council made it clear that their approval of the schools' usage of
the City's fields is for this year /season only and it does set a prece-
dent for future years; and that any violation of the guidelines they
have established would prompt the withdrawal of the particular team's
privilege, to use the City's fields.

the entrance /exit roads to Howell Watkins Junior High School. The
City flanager advised that this path suggested by the principal of the
school, Mr. Dirk Ferrara, will be completed no later than December 15,

will be advised of thz, action of the Council.

A motion was unanimously adopted by the Council that the City
Attorney draft a letter for the Mayor's signature, advising Attorney
Cook that in order to keep within the procedural requirements of
Ordinance 12, 1978, an amending ordinance would have to be passed
to extend this time allotted, requiring more time than their
November 15, 1980 deadline; however, the Council is in favor of
the one -vear exten.aen to June I; _'81 and would consider another
extension on that date if some reasonable visible progress is made
on the project.

Ordinance 19, 1980, amending the permissible hours for the sale /service
of alcoholic beverages, will be workshopped by the Council at their
meeting of November 13, 1980.
COUNCILMAN An Ordinance divorcing the Site Plan and Appearance Review Committee

from the Planning and Zoning Commission will be considered by the
Council, subsequent to the appointments being made to the Code Enforce-
ment Board. Resolution 48, 1980, which provides for these appointments,
will be workshopped by the Council at their meeting of November 13, 1980.
Councilman Vaed.is requested that the Czty Manager have the pole light
on the south slope of the City Hall repaired, provide the Council a
cost estimate for the installation of a well for the City Fall, and
have the building addition at the Public Works Department completed
Up -to- standards.
The Mayor will send a communication to the Palm Beach Gardens High
School requesting that they maintain the landscaping the City planted
for them.
MAYOR FEENEY The City Manager was requested to have the I -95 columns on Holly Drive
painted.
