HomeMy WebLinkAboutMinutes Council 042679CITY COUNCIL WORKSHOP MEETING CITY OF PALM BEACH GARDENS r APRIL 26, 1979 The Workshop Meeting of the City Council of Palm Beach Gardens was called to order by Mayor Samuel Laurie at 8:00 P.M. in the Assembly Room, 10500 North Military Trail, Palm Beach Gardens, Florida, and opened with the Pledge of Allegiance to the Flag. ROLL CALL: The roll was called by the City Clerk and present were: Mayor Laurie, Vice Mayor Kiedis, Councilman Martina, Councilman Feeney, and Councilman Aldred. Attorney William Brant and City Manager John Orr were also in attendance. ANNOUNCEMENTS: Mayor Laurie announced that meetings of the City's Merit System Board and Recreation Advisory Board will convene at 7:30 P.M. on Tuesday, May 1, 1979. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA: MR. SAMUEL Mr. Samuel Carsillo, 10063 Dahiia Avenue, PBG, addressed the Council re: CARSILLO the following: 1. The permission granted by Pratt & Whitney Aircraft for individuals riding in car pools to park their automobiles in the parking lot of their rented warehouse at 4176 Burns Road, PBG. 2. The lack of response to his letter County Commissioner Peggy Evatt referred to Mr. Herb Kahlert of the P. B. County Traffic Division re: the four - laning of A -1 -A Alternate and N. Military Trail. Mayor Laurie offered to contact Mr. Kahlert regarding this matter. 3. Vehicles crossing the landscaped area of the median on MacArthur Blvd. at Howell Watkins Junior High School. The City Manager was requested to provide the Council cost estimates for the curbing of the medians on MacArthur Boulevard. 4. The unpleasant appearance of medians within the City under the juris- diction of the County. Mayor Laurie offered to contact County Com- missioner Peggy Evatt requesting better maintenance of these medians. �- 5. Identification signs for the City Hall Complex. The City Manager was requested to locate identification signs on Military Trail and Burns Road, subsequent to the Council's approval of the plans. City Council Workshop Meeting, 4/26/79 Page 2 MS. KATHY POTTS: The Council apprised Ms. Kathy Potts, 444 Riverside Dr., PBG, that the locations she recommended for pedestrian /bicycle paths are a part of the approved program. Ms. Potts reiterated her concern re: vehicles speeding and leaving the pavement at the curve on Riverside Drive. The City Manager was requested to refer this matter to the Acting Chief of Police. ITEMS FOR DISCUSSION: REC. RE: CITY'S The three engineering firms the Screening Committee recommended for the CONSULTING Council's consideration of appointment of one to act in the capacity of �� Consulting Engineers for the City will be interviewed by the Council at their Regular Meeting of May 3, 1979. These firms were selected from 15 applicants and are: Hutcheon Engineers, Inc., 1201 Belvedere Road, WPB; Barker, Osha & Anderson, Inc., 860 U. S. Highway X61, NPB; and Lindahl, Browning, and Ferrari, Inc., 426 Indiantown Road, Jupiter. LIAISON MEMBERS Council representatives were selected to be liaison members to the City's V. OARDS Advisory Boards and Special Projects. The City Manager was requested to provide the Council a report on the current members of the City's Landscape Committee of Adjustments and those businesses and multi - family developments that remain in non - compliance with the City's Landscape Code. CITY "GREEN -UP Per the request of Mr. Samuel Carsillo, Vice Chairman of the City's Beauti- C E N -UP DAY" fication and Environmental Committee, the City's "Green -Up (Clean -Up) Day" initiated by Mrs. Adrienne Broch and Mrs. Charlotte Doran, was referred to the Committee for coordination. FIN. CONSULTANT Pursuant to the proposals of William R. RESOLUTION 19, The City Manager reported that the Village of North Palm Beach's and Town of w T777'— Lake Park's Resolutions indicating their concurrence in sharing equally with the City all of the necessary costs expended to property effect the purchase of Seacoast Utilities, Inc. by the City have been referred to their municipal Attorneys for possible rewording. Mayor Laurie acknowledged receipt of a communication from the Northern CHAMBER OF COM- Palm Beach County Chamber of Commerce re: the "International Festival" MERCE they propose to sponsor in all the communities they serve from July 4th thru July 8th, 1979. REPORTS: Mayor Laurie reported on the affirmative recommendation made by the P & Z COM. MEET- Planning and Zoning Commission at their meeting of April 24, 1979, on INT 4/24/79 the petition of Mr. Charles E. Brooks for the annexation of a 10 -acre parcel of land located south of Holly Dr., west of Military Trail with the zoning classification of RS -2, Single Family Residential District. Attorney Brant reported on the legal opinion he rendered at this meeting re: to the application of a State Statute (Statutory Way of Necessity Exclusive of Common Law Right - Chapter 701.01 (2), Florida Statutes) to the roadway the applicant proposes to locate on the single family lot (Lot 9 -A of the Unrecorded PGA National Golf Club Estates, First Addition, PBG) for ingress /egress to the single family subdivision. ITEMS BY THE CITY MANAGER: u LEGISLATIVE The City Manager made a report on the current status of various State PT D Legislation including: HB 730 re: Prevailing Wage; HB 1568 re: Double Taxation; HB 402 re: Annexation; PCB No. 6 re: Financial Disclosure; HB 531 re: Compliance with Municipal Codes; SB 198 re: Property Taxes; HB 1088 re: Unemployment Compensation; HJR 641 re: Effective Date Laws; and HB 892 re: CATV Authority to Set Rates. The City Attorney was requested to draft a Resolution opposing House Bill 892 and its Senate companion Senate Bill 641, which would negate municipal authority to set rates for Cable TV. ITEMS BY MAYOR AND COUNCIL: IMPLEMENTATION Vice Mayor Kiedis noted the unsatisfactory implementation of the Police SCE Department's Program on Bicycle Safety. PRPRRAM CONSIDERATION A budgetary revision providing for City employees to receive a salary LIVING INCREASE increase to compensate for the escalation in the cost of living will be considered by the Council at their Regular Meeting of May 17, 1979. ELM STREET The Council requested that a manual irrigation system for the Elm Street ME977 median be placed on the Public Works priority list to be completed by TR177ATION/ LA7=ING May 30, 1979. Also, some landscaping is to be installed. CONSIDERATION Irrigation systems for the medians on MacArthur Boulevard and Keating Drive OF IRRIGATION will be considered in the 1979/80 Fiscal Year's Budget. Also, a Professional CST MANS Consultant for the functioning of the waterfalls at MacArthur Boulevard. NON - RESIDENTS Limiting the availability of recreational facilities /activities to Palm UTTUT= CITY- Beach Gardens residents will be considered by the Council in the future. OWNED RECREA- TIONAL FACILI- In the meantime, Mayor Laurie will write letters to the Municipal League TIES and the County Commission re: the lack of the County allocating funds to the City to compensate for residents of unincorporated areas utilizing its recreational facilities. REPORT ON PEND- The City Attorney reported on the status of certain pending litigation. ING LIITTATTIIIT- INTENT OF S /P /R The Council will determine at a meeting in the near future whether or not it should be the intent of the City's Site Plan and Appearance Review Code for "aesthetics" to be addressed by the Committee when considering the approval of plans for a proposed development. SANDTREE PUD The City Manager reported that the developer intends to apply for building permits for the "Sandtree "residential units prior to the expiration of the PUD, June 1, 1979.
