CITY OF PALM BEACH GARDENS
FEBRUARY 9, 1978
The Workshop Meeting of the City Council of Palm Beach Gardens
was called to order by Mayor Feeney at 8:00 P.M. in the
Assembly Room, 10500 North Military Trail, Palm Beach Gardens,
Florida, and opened with the Pledge of Allegiance to the Flag.
ROLL CALL: Roll was called by the city Clerk and present were: Mayor
Feeney, Vice Mayor Laurie, Councilman Martino, Councilman Kiedis
and Councilman Wiley. Attorney Brant was in attendance.
MINUTES: The Minutes of the Regular Meeting of February 2, 1978, as
amended, were unanimously approved by the Council.
ANNOUNCEMENTS: Mayor Feeney made the following announcements:
Merit System Board Meeting - Monday, February 13, 1978 at 7:00 PM
Planning and Zoning Commission Meeting - Tuesday, February 14,
1978 at 7:30 PM
Recreation Advisory Board Meeting - Tuesday, February 14, 1978
at 8.00 P.M.
Volunteer Firemen's Meeting - Tuesday, February 14, 1978.
PROCLAMATIONS: Mayor Feeney read a Proclamation declaring February 12 -18, 1978
as "National Vocational Education Week".
MR_ MACHTEL, MANAGER, JACOBSON'S DEPARTMENT STORE:
Mr. Machtel, Manager, Jacobson's Department Store, addressed
the Council apologizing for the misunderstanding that the
advertising for Jacobson's indicates they are located in North
Palm Beach. He advised the Council they are prepared to change
the local advertising to read Palm Beach Gardens, however
the national advertising will take longer to change. He further
commented that he is a resident of Palm Beach Gardens, and
that the people at Jacobson's are good citizens, gentlemen and

good businessmen and are interested in local government .
COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA:
Dick Aldred, 9773 Gardenia, announced that he would run for
the Council seat now held by Walter Wiley which is Group 3.
ORDINANCES: Ordinance #1, 1978 amending conditional uses in M —lA Light
ORDINANCE #1, Industrial District was workshopped by the Council.
Councilman Martino disagreed with the fourth paragraph on page
1. He felt that all vehicles should be parked behind the fence.
Vice Mayor Laurie agreed that restriction should be made.
Mayor Feeney, Couicilman Kiedis and Councilman Wiley agreed to
leave the paragraph as written.
It was agreed to change the last line in paragraph 2 on page 2
to read for a period of "four (4) hours" or more.
Councilman Martino suggested the words "must have a gross
vehicle rating of 11,000 lbs. or more be added to (b) "Motor
home" definition. Discussion on this item was tabled until
more information can be obtained as to a definition that would
exclude certain types of vans, prior to the second reading
of the ordinance on February 16 1978.
ORDINANCE #2, Ordinance #2, 1978 amending Section 15 -36 of Chapter 15 Licenses
1978
and License taxes was discussed by the Council.
Councilman Martino suggested the word only'be added after the
worditrade� in (A) (c). The final outcome was to leave the
paragraph as written.
ORDINANCE #4, Ordinance #4, 1978 repealing Sec. 3 -33 of Article II of Chapter
1978:
3 of Palm Beach Gardens Code permitting certain restaurants
to apply for a variance to distance requiteuents for a license
to sell malt and wine beverages, was workshopped by the Council.
A change was made to paragraph (c) to add the words "less than"

before four thousand (400a)square feet of space.
Ordinance #4, 1978 will be read on second reading with a Public
Hearing on March 2, 1978.
ITEMS FOR DISCUSSION:
DEDICATION OF 1. Dedication of ballfield in honor of Woody Dukes. Mayor
BALLFIELDS:
Feeney suggested that discussion on this item be postponed until
other recommendations were received as to the naming of the
ballfields.
Ken Staggs, Chairman of the Recreation Advisory Board, proposed
that the name be formally designated by April 1st, the opening
of the baseball season, and agreed to solicit recommendations
at the registration days and at the Recreation Advisory Board
Meeting.
gAFETY FENCE Mr. Staggs stated that the Recreation Advisory Board is

City manager John L. Orr stated he had provided the Board with
cost figures as requested by the Board.

Councilman Martino expressed that he was in favor of the marquees.
Vice Mayor Laurie did not consider the marquees containing
advertising as appropriate for the area.

Jack Davis, Governor of the Moose Lodge addressed the Council
requesting that they reconsider the recommendation from the P &Z
Commission which was to deny their request for rezoning.
He stated the plans are for a beautiful building, well
landscaped,using 1/5 of the 5 acre parcel for the building,
there would be no impact to the school system, and a less
burden on the Police and Fire Departments than if land was used
for single family residences, and that 400 members are residents
of Palm Beach Gardens.
The City Attorney was instructed to prepare an Ordinance for
rezoning the land to R -3C for first reading on February 16, 1978.
It was determinedby the Council that the members of the Moose,
prior to second reading, provide a drawing of the area showing
the relationship to the existing residential area and a
demarcation relative to the buffer zone.
Mr. Robert Hogaboam and Mr. Richard Reilly who live in the
County on Monet Ridge Road, adjacent to the property were present
in the audience as concerned citizens.
4. A discussion on the rewrite of Article III, Zoning Codes
was held. A PU - Parks Use was added and consideration of
adding a district to include lodges will be discussed at a
future date. Residential Single Family Districts will be
differentiated with a density figure.
PETITIONS AND COMMUNICATIONS:
SENATOR Councilman Martino acknowledged receipt of a communication

from Senator Jim Glisson relative to State- mandated programs

provided by Senator Glisson, for consideration by the Council
at the Regular Meeting on February 16, 1978.

DAVID LUDWICK• Councilman Martino acknowledged receipt of a communication from
David Ludwick expressing a desire to purchase Lot 12, Plat
6 on Ilex Circle South from the City. Councilman Martino stated
for the record he had no interest in selling the lot.
Mayor Feeney, Councilman Kiedis and Councilman Wiley stated
they would be interested in negotiating a sale of the lot.
BILLY R. Mayor Feeney acknowledged receipt of a communication from
Billy R. Manning, Director of Education informing that Jack
Hanson has been issued a certificate of registration as a
Building Inspector with the Southern Building Code Congress
International.
REP. BILL Mayor Feeney acknowledged receipt of a communication from Rep.

Bill James relative to the Resolution regarding mobile home
taxation.
PEGGY EVATT: Mayor Feeney acknowledged receipt of a communication from Peggy
Evatt, Chairman, Board of County Commissioners, attaching a
suggestion from the Third Grade Class of the Classroom Academy
concerning bike trails, sidewalks or ramps.
REPORTS: Councilman Wiley asked that some other member of the Council
MERIT SYSTEM be appointed as liaison member to the Merit System Board,
BOARD: since he is unable to attend their meetings on Monday nights
due to a conflict.
B& E COMMITTEE Vice Mayor Laurie reported he had attended the meeting of the
MEETING:
Beautification and Environmental Committee held February 8, 1978
and that the minutes would be available in the information
folder. He welcomed Mr. George Bayer, a member who was
present in the audience.
Mayor Feeney advised that Mrs.Pat Junod, PGA Realty, had
mentioned to him, that she will donate an oil painting of

Mr. John D. MacArthur to the City.
ITEMS BY THE CITY MANAGER:
The City Manager advised of a meeting to be held on February 13,
1978 at 7:30 P.M. at the North County Courthouse Auditorium
regarding proposed revisions to the Palm Beach County Land
Use Plan.
LETTER TO A letter, prepared by the City Manager, at the request of the
RESIDENTS OF
COUNTY —� Council, to all residents of Monet Acres /Oaks, Palm Beach
County, was reviewed by the Council.
Several questions were posed by Mr. Hogabcam and Mr. Reilly
relative to water, sewer, street maintenance and hydrants.
The letter will be revised by the City Manager and Councilman
Wiley and mailed to all areas in the County that are "pockets"
within the City.
TTEMS BY THE MAYOR AND COUNCIL:
Councilman Kiedis asked the city Manager to check with the
State relative to extending I -95 to Military Trail.
Vice Mayor Laurie asked that in the near future an item for
discussion on the agenda be the acquisition of Plant Drive
and the entrance to the City at MacArthur Blvd. and other lan

Vice Mayor Laurie suggested that the organization behind the
Hetzel Brothers Pageant be contacted as to their intent to
put on the Easter pageant.
