CITY OF PALM BEACH GARDENS
APRIL 20, 1978
The Regular Meeting of the City Council of Palm Beach Gardens
was called to order by Mayor Kiedis at 8:00 P.M. in the
Assembly Room, 10500 N. Military Trail, Palm Beach Gardens,
Florida, and opened with the Pledge of Allegiance to the Flag.
ROLL CALL: Roll was called by the City Clerk and present were: Mayor
Kiedis, Vice Mayor Laurie, Councilman Feeney and Councilman
Aldred. Councilman Martino was absent. Attorney Brant was in
attendance.
MINUTES: The Minutes of the Workshop Meeting of April 13, 1978, as amende(
were unanimously adopted by the Council.
ANNOUNCEMENTS: Mayor Kiedis announced there would be a Planning and Zoning
Commission Meeting on Tuesday, April 25, 1978 at 7:30 P.M.
PROCLAMATIONS: A Proclamation declaring April 30 - May 7, 1978 as Soil
Stewardship Week was read by Mayor Kiedis.

RESOLUTIONS: Resolution 25, 1978 adopting the Range and the Minimum and
RESOLUTION Maximum Salaries of the Job Classifications in the Merit System

was read in full by the City Clerk and unanimously adopted by
the Council.
RESOLUTION Resolution 26, 1978 approving designation of State Road 9,
7 N 7 O 7 A.
Section 93220 -2407 as a limited access facility was read in
full by the City Clerk and unanimously adopted by the Council.
RESOLUTION Resolution 27, 1978 endorsing the proposed St. Mary's Hospital

Certificate of Need was read by the City in full and unanimously

adopted by the Council. The City Clerk was directed to mail a
copy to the Health Planning Council.
RESOLUTION Resolution 28, 1978 approval of the Palm Beach County Central
28, 1978:
Planning Area 201 Water Pollution Control Facilities Plan, as
amended, by the recommendation of Vice Mayor Laurie to include
that the City Council accepts with reservation the conclusion
that deepwell injection is the best cost effective disposal,
was read in full by the City Clerk and unanimously adopted by
the Council.
ORDINANCES: Prior to the opening of the Public Hearing, as duly advertised
ORDINANCE on April 3, 1978, on consideration of Ordinance 9, 1978, adopting
9, 1978:
a new PUD planned unit development section of the Palm Beach
Gardens Code, Mayor Kiedis explained that the ordinance goes
into detail regarding a planned unit development, that includes
many things but is not limited to agreements, contracts,surities,
restrictions; it encompasses townhouses, condominiums, zero lot
line usages, as well as single family residential, commercial
uses, etc. It outlines professional services required by the
developer, step by step procedure to be followed by those who
wish to use a PUD to develop property. It controls ingress and
egress, traffic patternswithin and without the PUD, recreational
areas, open space requirements, community associations as they
relate to common properties, placement of utilities. drainage
and other services reauired. It is a complete document and
a very important part of the Zoning Code.
Minor changes were made to the Ordinance by the Council. Input
U was received from Mr. Gordon Hunter, a member of the audience
and Sam Carsillo? Chairman of the B &E Coitmittee and a member
of the audience.

Mayor Kiedis declared the Public Hearing closed.
A motion was made, seconded and unanimously carried that the
City Clerk read Ordinance 9, 1978 by title only, with the
amendments, on second reading.

Ordinance 9, 1978 as read with the amendments.
ORDINANCE Ordinance 7, 1978 establishing a Planned Unit Development on
lands lying within Section 19 -42 -43 (Sandtree Multiple Family/
Commercial PUD) by a unanimous vote of the Council was read by

title only on first reading, by the City Clerk.
Ordinance 7, 1978 will be workshopped by the Council on April

REVISIONS
TO ZONING
CODE:
Article VIII, Supplementary Regulations was reviewed by the
Council as revised in March by the Planning and Zoning
Commission. A change was made on page 6, Section 5 (2) to
add "properly landscaped on the residential side."
The City Manager John L. Orr will ask for input on the complete
package of revisions from the Building Official, Marvin Hill,
Land Planner, a local contractor etc. prior to Public Hearings
being scheduled.
VISION ONE: The following conclusions were made by the Council on the items
of concern regarding the creation of "Vision One" Multiple

Feeney and Councilman Aldred - 2.25; Mayor Kiedis, Vice Mayor
Laurie - as is. Density - Mayor Kiedis and Vice Mayor Laurie

as is; Councilman Feeney and Councilman Aldred - 9 units per
acre; Jogging Path - Vice Mayor Laurie and Councilman Aldred,
asphalt, Mayor Kiedis and Council Feeney chips and preferred
no jogging path; shuffleboard courts - all against; basketball
courts - Mayor Kiedis advised that the developer will propose
to move the northerly building adjacent to Military Trail, with
a screened basketball court in that location deeded to the City.
The developer has indicated he intends to provide horseshoe
courts and a fenced in tot lot.
Councilman Feeney stated he would like to see in lieu of
the shuffleboard and horseshoe courts, a park with picnic
area and picnic tables.
City Manager John Orr remarked that he had talked to the
developer who will ask the City to consider the private road
concept.
Discussion on Vision One will be held at the Workshop Meeting
on April 27, 1978.
PETITIONS AND COMMUNICATIONS:
FREEDOM 1. Vice Mayor Laurie acknowledged receipt of a communication

regarding the presentation by the Exchange Club of Northern
Palm Beaches to the citizens of Palm Beach Gardens a Freedom
Shrine on April 29, 1978 at 2:00 P.M. at the City hall.
PROCLAMATION 2. Mayor Kiedis acknowledged receipt of a Proclamation declaring
STATE OF
ISRAEL MONTH the month of May as State of Israel Month, which will be read
at the Regular Meeting of May 4, 1978.
CONGRESSMAN 3. Mayor Kiedis acknowledged receipt of a communication from
BAFALIS:
Congressman Bafalis relative to the problem the Police Dept.
is experiencing with its communication system.

parcel of land within Section 5- 42 -43.
CABLE TV: 5. Palm Beach Cable TV request to appear at the Council
meeting on April 27, 1978 to discuss the installation of a tower.
REPORTS: Councilman Feeney reported that basic emergency service was
being provided at the Palm Beach Gardens Community Hospital.
Councilman Aldred reported he had attended the Landscape
Committee of Adjustment Meeting on april 17, 1978.
Councilman Aldred made reference to the meeting held at the
north County Courthouse for a presentation by Mr. Ecclestone
on the PGA project, and questioned what effect the marsh area
would have on the mosquito control.
Vice Mayor Laurie reported he had attended the meeting relative
to the PGA project held April 17, 1978 and a sub - committee
meeting of the B &E Committee held April 18, 1978.
ITEMS BY THE CITY MANAGER:
BICYCLE PATHS: City Manager John L. Orr made reference to the memo from Steve
Henning, Recreation Director regarding matching funds from the
County for bicycle paths, which will be workshopped at the
meeting on April 27, 1978.
Councilman Feeney remarked he would like to see a bicycle
path on Military Trail from Plat 4 and Garden Lakes area.
SLURRY SEAL: City manager John L. Orr advised the Council that Crestdale
and Arbor Way will be slurry sealed as soon as possible, and
that the money is budgeted.
ITEMS BY MAYOR AND COUNCIL:
11� MAYOR KIEDIS: Mayor Kiedis pointed out there were burned out lights at the
Plant Drive field.
Mayor Kiedis requested an estimate on shell rock for a path

from the west baseball field to the east baseball field on the
ten acres adjacent to the City Hall, and quoted a price he
had received in the amount of $328.00.
This item will be placed on the agenda for consideration at the
Workshop Meeting on April 27, 1978.
Mayor Kiedis advised of a street sign located at Holly Drive and
Military Trail that needs repainting.
Councilman Feeney registered a complaint expressed by a citizen
about mosquitoes.
Councilman Feeney stated that the work on the median on Holly
Drive only extends to Dahlia.
Vice Mayor Laurie complimented the City Manager for obtaining
funds for the street marking project.
Vice Mayer Laurie questioned the status of the 50 Malayan
trees requested by the B &E Committee.
Councilman Aldred expressed concern about the hazard of children
and adults riding bicycles, and suggested a comprehensive
training program be initiated.
Pat Smith, spoke from the audience suggesting police enforcement
of the bicycle rules, and recommended a sign be placel on Holly
Drive indicating the path is a bicycle path.
Councilman Feeney advocated that a Resolution be sent to the
Legislative Delegation requiring moped riders to wear helmets.
ADJOURNMENT: No further business, the meeting adjourned at 11.15 P M
