HomeMy WebLinkAboutMinutes Council 051178s WORKSHOP MEETING CITY OF PALM BEACH GARDENS MAY 11, 1978 The Workshop Meeting of the City Council of Palm Beach Gardens was called to order by Mayor Kiedis at 8:40 P.M. in the Assembly Room, 10500 North Military Trail, Palm Beach Gardens, Florida, and opened with the Pledge of Allegiance to the Flag. ROLL CALL: Roll was called by the City Clerk and present were: Mayor Kiedis, Vice Mayor Laurie, Councilman Martino, Councilman Feeney, and Councilman Aldred. Attorney Brant was in attendance. MINUTES: The Minutes of the Regular Meeting of May 4, 1978, as amended, were unanimously approved by the Council. ANNOUNCEMENTS: Mayor Kiedis announced there would be a Merit System Board Meeting on Monday, May 15, 1978 at 7:00 P.M. PROCLAMATIONS: Mayor Kiedis read a Proclamation declaring the week of May 14 - May 20, 1978 as Municipal Clerk's Week. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA: Mr. & Mrs. Rogers who live at 4413 Crestdale Street, were in the audience and addressed the Council regarding a complaint about the unkept yard of their -neighbor, Jim Williams, 4429 Crestdale Street, and the violation of the ordinance in allowing the grass and weeds to grow over 18 inches high. Discussion was held about making a distinction between the height of grass allowed on improved property as opposed to unimproved property; and if this was an isolated situation. Councilman Aldred pointed out he had received four similar complaints in the last five weeks. The Council agreed to consider amending the ordinance to Workshop Meeting, May 11, 1978 Page 2 differentiate between improved and unimproved property relative to the height of grass allowed to grow before it constitutes a menace. ORDINANCES: Ordinance 13, 1978, as prepared by Attorney Brant at the ORDINANCE recommendation of Jack Hanson, Building Official, adopting by I ,1TT8 : reference the Standard Building Code, the Standard Plumbing Code, the Standard Mechanical Code, the Standard Gas Code and the National Electrical Code was reviewed by the Council. The City Manager explained the City is currently using the above mentioned codes, as the State mandates that some type of code be adopted, and the adoption of this ordinance will make it official. The City Manager and the Building Official will further review the proposed ordinance for first reading on June 1, 1978. ITEMS FOR DISCUSSION: LOCAL GOV'T A Resolution will be prepared for consideration at the Regular COMPREHENSIVEMeeting on May 18, 1978 supporting the local government PLANNING ACT: comprehensive planning act of 1975 and recognizing the need for additional funds to assist municipalities to prepare and implement this plan. The City Manager, John L. Orr, advised that the City has applied for 701 funds, and that Marvin Hill, Land Planner has assisted in filling out the application. FAIR TAX Councilman Martino reported he had attended a meeting of the Charter Advisory Committee who were advocating a Fair Tax Council to be made a part of and attached to the proposed County Charter. This Fair Tax Council will determine what the County provides the municipalities and tax the municipalities only for those services. Workshop Meeting, May 11, 1978 Page 3 Vase Mayor Laurie expressed concern about any additional expenditures caused by the creation of this Council. The Council agreed to the idea of a Fair Tax Council and directed the Mayor to advise the Charter Advisory Committee that they endorse same. PARKING IN Discussion was held on the recommendation of the Planning and SWALE AREAS: Zoning Commission relative to cars parking in the swales. BUTTONS/ U Councilman Martino and Councilman Aldred were in favor of an ordinance prohibiting the parking of cars in the swale area for the reasons that the swales are there for a specific purpose to maintain the drainage system, and for the safety of the children. Vice Mayor Laurie did not favor an ordinance that would pertain to a minority and would be difficult to police. Councilman Feeney was not in favor of an ordinance and felt it would encourage the parking of cars in the yards. Mayor Kiedis felt an ordinance would be too difficult to police but agreed with the concern about the safety of the children. Further discussion and consideration of Ordinance 16, 1977 pertaining to the parking of commercial vehicles in residential areas will be held at the May 18th meeting, to determine if that ordinance should be amended or a new ordinance drafted addressing just the swale problem. Discussion was held on the second recommendation from the Planning and Zoning Commission relative to the plating of buttons/ pyramids along the edge of the City's roadways. The Council agreed that buttons used to protect the swale area, particularly on corners, was allowable, but pyramids should not Workshop Meeting, May 11, 1975 Page 4 be allowed. The City Manager was directed to notify citizens that had pyramids of the Council's policy and have pyramids along road- ways removed. PLANNED UNIT The revised Planned Unit Community District section of the Code DISI'KiCT: was reviewed by the Council and amended on page S �'f) in the last sentence to read 250 acres. The City Manager will give this section, together with the rewrite of the other zoning code sections, to Marvin Hill, the Building Official and the Association of Contractors for their review and input. PETITIONS AND COMMUNICATIONS: Mayor Kiedis acknowledged receipt of communications from: REF. TAYLOR:l. Representative Taylor regarding the use of headgear by operators of mopeds. GOV. ASKEW: 2. Governor Askew regarding the Council's support of a proposed bill authorizing municipal annexation of enclaves by ordinance. F.C.C. 3. Letter from F.C.C. relative to the problem the City is experiencing with its communication system. The Council concurred to hold off on a suit against the F.C.C. and the State but to draft a letter putting them on notice of a pending suit, and if necessary the City Manager meet with representatives of the F.C.C. the State and Sarasota's Police Department to resolve the problem. The City Manager was directed to contact the PBA to ask assistance so that action could be expedited. REPORTS: Mayor Kiedis reported he had attended the meeting of the Beautification and Environmental Committee and the minutes are Available in the information folder. Vice Mayor Laurie reported he had attended the Planning and Zoning Commission Meeting held May 9th. A petition was before r Workshop Meeting, May 11, 1978 Page 5 the Board from the Perry Cable Television asking permission to erect a tower. Vice Mayor Laurie suggested they first get permission from the F.A.A. and the City Manager advised they were aware of this. ITEMS BY THE CITY MANAGER: 2 MEETINGS The Council concurred with the recommerdetion of the City Manager to hold two regular meetings per month during June, July and August and as many workshop meetings as necessary. GROUP The City Manager, John L. Orr, referenced a letter from Larry INSURANCE: Wilks, Cornelius, Johnson and Clark, Insurance, indicating that he has researched the possibility of finding better group insurance rates with other major companies, and they have declined to bid as they cannot compete with the rates that Connecticut General, the local carrier for the City, offers. The City Manager will make a recommendation to retain Connecticut General at the Regular Meeting on May 18, 1978. GLENBROOK The City Manager, John L. Orr, advised of a letter he had sent to the Developer of a proposed apartment project, "Glenbrook Apts." notifying them that he would appeal the decision of the final approval by the Site.Plan and Appearanace Committeee and stating the reasons for same. The Cit,y Manager was directed to investigate the chance of buying the property together with the Plant Drive property. SENIOR The Council expressed no interest in the proposal relative to CITIZENS CE ER: the County offer to build a Senior Citizen's Center if the City would donate 2 acres or less for this use. ITEMS BY MAYOR AND COUNCIL: Mayor Kiedis requested that the street signs in the City be FA Workshop Meeting, May 11, 1978 Page 6 inspected for refurbishing, in particular, the sign at Honeysuckle and Gardenia and the sign in front of his home. Mayor Kiedis pointed out that no action had been taken on constructing a shell rock path at the baseball fields. In answer to a question posed by Vice Mayor Laurie, the City Manager explained that Jim Graham Auctioneers /Realtors, Inc. have been advised relative to the status of their signs at 204 U.S. Highway 1 when they present plans for expansion. Councilman Feeney pointed out his concern over the article in the newspaper that I -95 would never be extended beyond Palm Beach Gardens.
