HomeMy WebLinkAboutMinutes Council 110978CITY COUNCIL WORKSHOP MEETING CITY OF PALM BEACH GARDENS NOVEMBER 9, 1978 The Workshop Meeting of the City Council, of Palm Beach Gardens was called to order by Mayor John Kiedis at 8:00 P.M. in the Assembly Room, 10500 North Military Trail, Palm Beach Gardens, Florida, and opened with the Pledge of Allegiance to the Flag. ROLL CALL: The roll was called by the City Clerk and present were: Mayor Kiedis, Bice Mayor Laurie, Councilman Martino, Councilman Aldred, and Councilman Feeney. Attorney William Brant and City Manager John Orr were also in attendance. MINUTES: The minutes of the Regular Meeting of November 2, 1978, were unanimously approved, as amended. ANNOUNCEMENTS: Mayor Kiedis made the following announcements: A meeting of the Planning and Zoning Commission will take place on November 14, 1978, at 7:30 P.M.. A Volunteer Firemen's Meeting will convene at 7:30 P.M. on November 14, 1978. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON 1HE AGENDA: SAM CARSILLO Mr. Sam Carsillo, Vice Chairman of the City's Beautification and Environ- A RMAN mental Committee, addressed the Council requesting: (1) a "no crossing M median" sign be placed within the median adjacent to the convenience store on Northlake Boulevard, east of Military Trail; (2) the City obtain permission to place cyclone fencing around three sides of the Salvation Army depot located within the parking lot of the shopping center of Publix on Alt. A -1 -A; (3) a letter be sent to the owner of the convenience center on the northwest corner of Nortl its appearance be upgraded; (4) be portable so that they can be and (5) the City administration reconsider negotiations. slake Boulevard and Keating Drive requesting the structures for the Hetzel Bros. Pageant removed when the pageant isn't in session; request the Police Dept. personnel to City Council Workshop Meeting, 11/9/78 ITEMS FOR DISCUSSION: Page 4 BICYCLE Chief William Edwards and Lieutenant Hank Nolan of the PBG Police Depart - T=Y ment made a presentation re: a Bicycle Safety Program proposed to be SRAM: offered to 3rd - 8th grade students at schools within Palm Beach Gardens. Chief Edwards and Lt. Nolan were unanimously thanked and commended by the Council for their efforts in the preparation of the program, which was initiated by Councilman Aldred. GARDEN VILLAS Pursuant to the discussions at the City Council Regular Meeting of Novem- VRUJECT ber 2, 1978, re: the "grandfathering" of the Garden Villas project to the City's Ordinance 28, 1978, the "rewrite", Attorney Brant reported that per the request of the Council, he exercised a meeting with Attorney Rosenbach and determined that excluding the cost of the lands, approx. $10,000 had been expended thus far by the developer, Mr. Bob Edgar, involving the project. The Council unanimously objected to the 15 u /p /a density of the project, particularly its location in the close proximity of the high school and Plant Drive Park where it will aggravate the existing conjestion. Based on the five factors Attorney Brant advised would be considered in a Court of Law in determining equitable estoppel, Councilman Feeney, Councilman Aldred, and Councilman Martino were in favor of Mr. Edgar being permitted to proceed with his application for the PUD concept. Mayor Kiedis and Vice Mayor Laurie remained unfavorable to the "grandfathering ". Mr. Edgar confirmed the commitments he made at the Regular Meeting of November 2, 1978 re: drainage improvements and the donation of lands/ monies to the City for recreational facilities. EMPLuYEt BENE- Councilman Aldred introduced for the other Council members' consideration �NG an advisory committee of the City entitled ' "Employee Benefit Steering Committee" to be equally composed of City employees and citizens, and one Councilman. The purpose of the Committee would be to accumulate employee benefit information and transmit it to the City Council for consideration in determining the City's annual budget. Councilman Aldred also reviewed an outline he prepared re: Proposed City Employees Meetings, which would pro- vide for direct communications between City Employees and City Council members. City Council workshop Meeting, 11/9/!8 Page 3 Members of the audience, which included a majority of the City's police- men and their familiies, applauded Councilman Aldred's proposals. The members of the Council complimented Mr. Aldred's presentation; and a further study of the proposals will take place at a Council meeting in December. ORDINANCE 30, There weren't any changes made by uhe Council to Ordinance 100, 1978, T77F- Enacting a Flood Damage Prevention Plan of the City. A Public Hearing and consideration of second reading of Ordinance 930, 1978, as drafted, will take place at the Regular Meeting of December 7, 1978. ORDINANCE 31, Ordinance #31, 1978, prohibiting commercial vehicles from residential streets of the City except for deliveries, was workshopped by the Council. Police Chief Edwards was requested to provide the Council the gross vehicle weights of the two commercial vehicles parked on HoneysucKle Dr. and Fushia Circle and one on Holly Drive and Ironwood Road in the City. The City Attorney was requested to re- -draft Ordinance #31, 1978 incorpora- ting the thoughts of the Council, to include its reference to "commercial motor vehicles in excess of 11,000 lbs. gross vehicle weight'in lieu of 'any vehicle in excess of three - quarters ton capacity ". Ordinance #31, 1978 will be read on first reading at the Regular Meeting of November lb, 1978 and further workshopped at a meeting in December. ORDINANCE 32, A workshop session was held on Ordinance #32, 1978, prohibiting the parking of vehicles in road rights-of-way (svele /drainage areas). Ordinance 32, 1978, as drafted, will be read on first reading at the Regular Meeting of November 16, 1978 and further workshopped at a meeting in December. ORDINANCE 33, Ordinance #33, 1978, providing for a bonus in density within a PUD, was T97T_ workshopped by the Louncil. Starting with the third to the last paragraph of Section 1, the word "one" was inserted in the 1st paragraph, the word "two" in the 2nd paragraph, and the word "three" in the 3rd paragraph. the City Attorney was requested to amend the draft of Ordinance #33, 1978 to include a provision whereby the City Council may permit up to 17 u /p /a within a PUD on lands that were zoned R -3, High Density Residential Dis- trict, prior to the adoption of the City's Ordinance #28, 1978, the "rewrite". City Council Workshop Meeting, 11/9/78 Page 4 Ordinance #33, 1978 will be read on first reading at the Regular Meeting of November lb, 1978; and a Public Hearing and consideration of second reading will be held at the Regular Meeting of December 7, 1978. PETITIONS AND COMMUNICATIONS: WALT LEONHART Councilman Feeney acknowledged receipt of a letter of appreciation from VHGHS BASE- E:OACH Mr. Walt Leonhart, PBGHS Baseball Coach, for the use of the City's baseball fields for the 1978 games. The members of the Council didn't have any objections to Mr. Leonhart's request to again use the field for the coming season. REPORTS: CITY MNGR City Manager John Orr reported that the PBGHS "homecoming" would take R place Friday, November 10, 1978. COUNCILMAN Councilman Martino and Dice Mayor Laurie reported on the Recreation MAP= & VICE Advisory Board Meeting of November 7, 1978. The minutes are on file an the City Clerk's Office. VICE MAYOR Vice Mayor Laurie reported that he attended the Miss Palm Beach Gardens LAURIE Pageant on November 8, 1978. ITEMS BY LITY MANAGLR: LABOR RELA- Mr. Orr reported that per his request, Attorney Brant will be in attendance 7TUN7FORUM at the Fourth Annual Public Employment Labor Ralations Forum. PGA RESORI Mr. Orr reported than on Friday, November iO, 1978, he will exercise a oURRMIIY meeting with Attorney William Boose and Mr. Tom Sansbury to discuss the voluntary annexation of the lands of the proposed PGA Resort Community into the City and its subsequent rezoning from Planned Unit Development to Planned Community District. SPLC. MEETING A Special Meeting of the Council was scheduled to take place on November W /SHLRIFF 30 1978 for the RILC� , purpose of discussing with Sheriff Wille the proposed Law Enforcement Services Agreement with his department. ADJOURNMENT: with no turther business, the meeting adjourned at 11:20 P.M..
