CITY OF PALM BEACH GARDENS
JANUARY 12, 1978
The Workshop Meeting of the City Council of Palm Beach Gardens
was called to order by Vice Mayor Laurie at 8:00 P.M. in the
Assembly Room, 10500 North Military Trail, Palm Beach Gardens,
Florida, and opened with the Pledge of Allegiance to the Flag.
ROLL CALL_ Roll was called by the City Clerk and present were: Vice Mayor
Laurie, Councilman Martino, Councilman Kiedis and Councilman
Wiley. Mayor Feeney was absent. Attorney Brant was in
attendance.
MINUTES: The Minutes of the Workshop Meeting of January 5, 1978 will
be approved at the Regular Meeting on January 19, 1978.
G)IIANNOUNCEMENTS:Vice Mayor Laurie announced that the Recreation Advisory
Board Meeting would be held on Tuesday, January 17, 1978 at
8:00 P.M.
PROCLAMATIONS:Vice Mayor Laurie read a Proclamation declaring the week of
January 15 -21 as JAYCEE WEEK.
Mr. Jim Detzel, President, was present to receive the
proclamation.
Councilman Martino commended the work of the North Palm Beach/
Palm Beach Gardens Jaycees and thanked them for the many civic
activities they have sponsored in Palm Beach Gardens and the
surrounding c- ommunities.
PETITIONS AND COMMUNICATIONS:
PATTY DOBBINS:Vice Mayor Laurie acknowledged receipt of a communication from
Patty Dobbins, Coach, P.B.G.H.S. girls softball team, requesting
the use of the Plant Drive softball field for their home games
and practice.

The Council unanimously approved the request of Patty Dobbins
as per the schedule reflected in her letter dated January 11,
• 1978.
SHERIFFS Councilman Martino acknowledged receipt of a letter from the
DEPARTMENT:
Sheriffs Dept. in answer to his letter relative to the Road
Patrol, which will be placed in the City Council information
folder.
ORDINANCES: No discussion was held on Ordinance #19, 1977 providing for a
ORDINANCE #19,Referendum Election changing the election filing dates. The
1978:
Ordinance will be read on second reading on January 19, 1978.
ORDINANCE #18,Vice Mayor Laurie read the notice of Public Hearing as required

by State Statute for consideration of Ordinance #18, 1977
Zoning Classification to a Planned Unit Development consisting
of a Townhbuse complex and shopping center, per the petition
of Mr. Otto DiVosta, which was duly posted on the bulletin
board at City Hall and in six locations within the City.
Vice Mayor Laurie read the waiver of notice of public hearing
as required by Florida Statutes and signed by Mr. Otto
DiVosta and Mr. Ted Climer, for Royal American Industries, Inc.
who is the fee simple title owner.
The Public Hearing on Ordinance #18, 1977 was declared open
by Vice Mayor Laurie.
The Council reviewed the amendmentsto the Ordinance, as prepared
by Attorney Brant, and the other areas of the Ordinance that
were of concern to the Council.
Mr. DiVosta agreed to start developing the park area immediately

the work to proceed - concurrently with construction, such as
• the lakes dragged, the bad materials taken out, the ground
elevations fixed, etc.
The Recreation area and open space will be titled _to the
Property Owners Assoc. less the road right -of -way.
Section 3. on page 4 will be modified by Attorney Brant,
at the agreement of the Council and Mr. DiVosta, to read
the lands designated as lakes and drainage canals on -site,
and on -site water control mechanisms, shall be maintained
by the Northern Palm Beach County Water Control District
or its successors, and if they default, the Property Owners
Assoc. may maintain it themselves or seek other contractors
to maintain the lakes.
• The Council and Mr. DiVosta agreed to insert the amendment
to Section 4 in the Ordinance as written by Attorney Brant
and to change the period of 18 months in the second sentence
to read 2 years, and Mr. DiVosta will call in the dollar value
of the insurance to insert in the blanks in the 8th and
9th sentence.
The Council and Mr. DiVosta agreed to the amendment to
Section 6 as written by Attorney Brant.
Mr. Di Vosta explained the numbering system for the buildings
which will be the same as in Sandalwood=± Phase 2 except that,
the streets will be called Lanes.
The City Attorney advised he will cross check with Howard
Searcy, Engineer, to finalize the exhibits.

ORDINANCE #17, Ordinance #17, 1977 relative to conditional uses permitted
1977:
in a C -2 General Zoning District was workshopped by the
• Council.
Vice Mayor Laurie emphasized the fact that the Council was
considering this ordinance because the Code did not provide
for certain types of recreational uses, and discussion should
be limited to generalities, to amend the zoning Code to
permit various recreational uses on a conditional use basis
in a C -2 District.
Mr. Ted Bartlett did petition the Planning and Zoning
Commission to develop a Skateboard park and waterslide park
on the south side of Northlake Blvd., across from MacArthur
Boulevard, and as a result of a Public Hearing a recommendatioi
was made to the Council to amend the Code.
• Mr. Bartlett and Mr. Hanson, Architect made a presentation
to the Council explaining there is no commercial recreation
in this area and that his project would provide a supervised,
safe place for the children to go, which would be aesthically
attractive.
Councilman Kiedis expressed concern about the safety factor
and the damage to adjoining property.
Councilman Wiley felt that high quality recreation was
needed in this area for all ages, and that the Town Hall
Home area did not have the advantage of a recreation area.
Councilman Martino recognized the needto place this category
in the Code in a commercial area, but also expressed
• concern about the safety factor,. and conditional use aspect
of the Ordinance.
Vice Mayor Laurie agreed this type of use should be in a
commercial area.

Mr. Joe Anderson spoke from the audience stating that Mr.
Bartlett had picked an ideal location for his proposed
• recreational use, since there was no type of recreation
provided in that area for the children.
Mrs. Lili Rausch spoke from the audience stating that Mr.
Bartlett's proposed use was ideal for daytime activity for
the children.
Ordinance #17, 1977 will be read on s;e "condreading on January
19, 1978.
ORDINANCE #1, Ordinance #1, 1978 relative to Conditional uses in M -lA
1978:
light Industrial District was workshopped by the Council.
Councilman Martino objected to the reference in Section I.
sub - paragraph 1. to minor repairs and asked that it be
further defined; stated he would like to see the area
• completely surrounded by a fence, and only one vehicle parked
outside during the day light hours.
A question was raised about the accessibility for emergency
purposes to the adjacent property, and Chief Ed Arrants
will be asked to provide, in writing, a report in reference
to this.
Vice Mayor Laurie made reference to the definitions in the
Florida Statutes on recreational vehicles, etc. which
Attorney Brant will add to the ordinance.
Councilman Wiley stated the original intent when the use
was granted to Mr. Clark was to sell recreation vehicles, with
the emphasis on recreation.
Attorney Brant will re -draft Ordinance #1, 1978 for first
reading on January 19, 1978.

ORDINANCE #2, Ordinance #2, 1978 amending Section 15 -36 of Chapter 15
1978_ Licenses and License taxes was workshopped by the council.
It was agreed that a figure of $100.00 be placed in (A) (1).
Councilman Martino suggested and the Council concurred to
restrict the wording "trade in to those items leased and
subsequently sold.
The City Attorney was directed to place all the verbage in
Ordinance #1, 1978, except for the license tax fee, and
refer back to Ordinance #1, 1978 for definitions etc.
Ordinance #2, 1978 will be read on first reading at the
January 19, 1978 meeting.
REPORTS:
Councilman Kiedis reported he had attended

Plan Review was held on Vision One, a Conditional

granted to Tropical Sands Christian Church
and a preliminary
review made of the Sand Tree project.
Councilman Martino thanked the City Manager
for redirecting
the people responsible for Vision One, and
they will now
apply for a PUD.

Review Committee
Meeting and the Planning and Zoning Commission

BOARD MEETING:
Kiedis will determine from the P &Z Commission if this is
satisfactory with them.
Councilman Wiley reported that a Palm Frond had gone through
t'h.e awning at Mr. DeLonga's residence, and he was relaying
the message from Mr. DeLonga that the Palm Trees in the
City need trimming.
The City Manager stated that the annual trimming of the trees
had been held off last fall due to the complaints from
residents that the City scalped the trees.
The Council directed the City /�bnig gEdule the trimming for
the last of February.
City Manager John L. Orr reported on the Merit System Board
Meeting held January 9, 1978 and a Resolution will be presente
to the Council for their review after two more meetings are
held relative to the people in the City who are not covered
by the Merit System.
B& E COMMITTEE Vice Mayor Laurie reported he had attended the Beautification
MEETING__
and Environmental Committee Meeting held January 11, 1978.
Mrs—Linda Monroe, a member of that Committee, was present
in the audience and discussed with the Council, some items
of concern to the B &E Committee, as follows: the location
of the trees delivered to the City; the status of the
• Malayan trees the City is to receive from the State; a key
to the Public Works Yard available for members of the B &E
Committee; clean the City Hall and trim the Palm Trees
in the City.

The City Manager was directed to obtain an estimate from

a fence company
to enclose the area
at the Public Works yard
containing the
plants, to obtain an
estimate for cleaning
the City Hall.
Mrs. Monroe stated
the B &E Committee would
suggest some kind of ground cover for the slopes on the
east side of City Hall.
ITEMS BY THE CITY MANAGER:
TRAFFIC LIGHT The City Manager John L. Orr advised the Council that the
BURNS & ALT AlA:
traffic light had been installed at the intersection of Alt.
AlA and Burns Road.
The City Manager John L. Orr advised the Council that the
cost for the Insurance program, not including hospitalization,
had risen to-$80,000.
• ITEMS BY MAYOR AND COUNCIL:
COUNCILMAN Councilman Martino on behalf of the Council, thanked Steve
MARTINO:
Jerauld, a Volunteer Fireman for completing the Emergency
Medical Technology 2 Training at Palm Beach Jr. College.
Councilman Martino asked that a final report and decision
be made re the stop sign at Gardens East Drive and Meridian
Way.
The Council agreed with the suggestion made by Councilman
Martino to schedule the discussion on the Holly Drive curb:Hg
at the Regular Meeting, January 19, 1978.
Mrs. Monroe, member of B &E Committee agreed to take on as
a project, the plantings for the Holly Drive median strip.
Councilman Martino asked that consideration be given in the
near future re an ordinance relative to the distance between
restaurants selling beer and wine.

Councilman Martino asked the City Manager to check into the
rumor he had heard that the PBG Community Hospital had turned
down people from entering the hospital if they carried
insurance from a certain'.-company.
VICE MAYOR The City Manager, in answer to a question posed by Vice Mayor
Laurie, explained the out -of -bound mail boxes that will be
used in Plat 4, and the problem the Police Dept. is
experiencing with their radio frequency.
Vice Mayor Laurie suggested that the fire vehicices that are
left outside, be parked at the Public Works Yard.
Vice Mayor Laurie recomriendeda resolution urging the
County Commission to preserve Peanut Island as a park.
City Manager John L. Orr advised that the City will loan
the fire pumper for eight weeks, as a good neighbor policy,
to North Palm Beach.
MR. MAC ARTHUR: Councilman Wiley commented on the passing of Mr. John D.
MacArthur on January 6, 1978, and that he had many moments
to reflect on his influence on the City. "Mr. MacArthur
was the Founder of the City in 1959, and through his
influence created the type of Community we have today
through the architectural control, financing of homes,
securing and encouraging major industries to move to this
area, making agreements with the School Board to provide
land for the construction of schools, and the building of
a hospital. These things gave us a well planned and well
balanced Community. The City has the use of lands owned
• by his organization for sports programs, which was a major
asset to our Community. We have had through the World Cup

and PGA tournaments held at the PGA or JDM County Club,
world wide recognition. There are lasting mementos around
the City: the Banyan trees and the double headed palm trees
at the Country Club. This City developed such a respect and
mutual admiration for Mr. MacArthur that he celebrated his
75th birthday, at least one of the celebrations here, at
City Hall, with teenagers and adults coming out to show their
respect and have a party. There area lot of things that
some of us knew about that were behind the scenes, that
didn't make the headlines - charitable contributions - a
helping hand. Every now and then, perhaps more often, the
man had a heart, and yet he liked to play the advocate role.
Continuing along with the area of our respect, we named a
street after him, and I was privileged to be the Mayor at
•
that time, and officiated at that Dedication Ceremony,.which
is something I will never forget. Prior to that, the City
Council placed a plaque at that entrance commemorating the
10th anniversary of the City. Later on the City made him an
Honorary Mayor and he sat at this very same Council table.
This past week in commemoration, I think that the City was
unusual, amongst our local municipalities, that the National
Flag was flown half mast-for the entire week in respect.
So to sum it up, I think all of us who have had the privilege
of knowing Mr. MacArthur, feel it is quite an honor and we
are grateful; I feel, for the influence he has had on the
City. I feel it has lost a friend, and I, for one, pray
that he rests in peace."
• Vice Mayor Laurie declared a moment of silent prayer in
memory of Mr. John D. MacArthur.
