CITY OF PALM BEACH GARDENS
JANUARY 27, 1977
The Workshop Meeting of the City Council of Palm Beach Gardens
was called to order by Mayor r,artino at 8:15 P.M. after the
Special Meeting was recessed.
ROLL CALL: Roll was called by the City Clerk and present were: Mayor Martino,
Vice Mayor Feeney, Councilman Kiedis and Councilman Rossow.
Councilman Laurie and Attorney Brant were attending the Zoning
Board of Appeals Meeting.
MINUTES: The Minutes of the Regular Meeting of January 20, 1977, as amended,
were unanimously approved by the Council.
ANNOUNCEMENTS: Mayor Martino made the following announcements:
Senior Citizens Dance - Friday, January 28, 1977 at 8:00 P.M. at
Howell Watkins Junior High School.
Tennis Committee Meeting - Tuesday, February 1, 1977 at 8 :00 P.M.
Candidates seeking election must file with the City Clerk between
February 14 -28.
PRESENTATION BY STEVE HENNING, RECREATION DIRECTOR:
Steve Henning, Recreation Director, presented to the Council a
trophy received from the Town of Lake Park for winning first place
for the best float in the Christmas in Dixie Parade and a trophy
from the Boynton Beach Chamber of Commerce for first place for the
best float in the Boynton Beach Parade. Steve also advised that the
City had received a check for $100.00 from Jupiter for placing
first in their Christmas parade.

stressing the need for a Community Center. He stated that the
Club had grown to 219 members and that the City facilities are too
small to accommodate their activities. He presented the Council
with a picture of a pagoda type building that aaild be constructed,
and used in the interim, at a cost of approximately $8,000.
Mayor Martino commented that the Council fully realizes the need for
a Center but lack the funds, and suggested that the Senior Citizens
pursue their goal and provide the Council with any information,
plans, costs, etc. concerning a Center. He also suggested that
the Club explore the use of the varies church facilities and
asked the Recreation Director to prepare a letter, representing
the Senior Citizens, advising the churches of their problem, and
if a fee is required to return to the Council for their consideration.
Mr. Weimer offered the assistance of their telephone service to the
Council in promoting the election referendum.
COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA:
HARRY LEWIS: Harry Lewis, Chairman of the Committee of Adjustment to the Landscape
Code reported that the Committee has heard all of the petitions
for variances, and those given a time limit will be reviewed at
a later date. He extended thanks to Vice Mayor Feeney and Councilman
Kiedis for their attention to the Committee. The City t,.anager
will direct the Building Department to follow up as to compliance
on those businesses granted a variance.
The Council expressed thanks to the Committee for their work.
SAM CARSILLO: Sam Carsillo spoke from the audience and asked that the ('ouncil
continue to urge the DOT to beautify the median strip on PGA Blvd.;
continue with the plans to irrigate the median strip on Holly Drive;

send a letter to the State requesting that free transportation be
provided to the citizens on the Turnpike from Palm Beach Gardens
to Fort Pierce until the continuation of I -95 is accomplished; and
asked that the City Manager locate the plans he had submitted for
the recreational use of the 10 acre tract.
ITEMS BY THE MAYOR AND COUNCIL:
COUNCILMAN KIEDIS: Councilman Kiedis suggested that the Public Works area be
shaded in the map provided by the City Manager in reference to the
proposed referendum issue.
VICE MAYOR Vice Mayor Feeney advised that he was in agreement with Councilman
FEENEY:
Kiedis' suggestion that a letter be sent to Lake Park and North
Palm Beach asking for a contribution to the Community School Program.
Vice Mayor Feeney suggested and the Council agreed to ask the City
Manager for information and cost figures regarding a CB base station
for the Police Department, so that they may further pursue the
subject.
COUNCILMAN Councilman Rossow questioned the advisability of scheduling Zoning

ORDINANCES: A discussion was held on the consideration of a proposed ordinance

It was the opinion of the Council that they did not want to
legislate an ordinance on recreational vehicles, but were concerned
about large commerical vehicles and trucks.

The City Attorney was directed to prepare a draft of an ordinance,
using the sample ordinances from surrounding municipalities,
leaving the tonnage blank, for consideration by the Council at
the Workshop Meeting February 10, 1977.
PETITIONS AND COMMUNICATIONS:
Mayor Martino acknowledged receipt of communications from:
MARVIN HILL: 1. Marvin Hill, Planning Consultant, stating he will begin
immediately under the original contract to draft revisions to the
existing zoning ordinance.
BD. OF COUNTY 2. Board of County Commissioners advising of a seminar on water

COMMENTS FROM THE PUBLIC:
WALTER WILEY:
Walter Wiley, a resident of the City, spoke from the audience,
stating he had observed that several homes in the City, some with
"for sale" signs, have swale areas with gravel instead of grass,
which is a violation of the Code. He also commented on a new home
located on Holly Drive, west of I -95 on the south side of the street,
that contains a 10 or 121, concrete pipe in the swale area for
drainage, that is unsafe and aesthetically incorrect.
The City Manager was requested to include a report on these two
items in the Tuesday mail drop for the Council.
Mr. Wiley commented that he was in favor of the purchase of the
12 acres of land adjacent to the City Hall on the south side of
Burns Road, but requested that a maximum millag a rate stipulation
be included in the referendum vote.
MR. DI VOSTA: Mr. Otto DiVosta spoke from the audience explaining that he had

not received from the Village of North Palm Leach the easement
deed for the drainage culvert system under Prosperity Farms Road
to the outfall near Prosperity Harbor, and asked permission to
proceed with the first 96 units with the existing drainage as
outlined in Ordinance #16, 1976.
Mr. DiVosta advised he has basically met all the requirements,
however he has not received the Certification of Title.

A motion was made, seconded and unanimously adopted authorizing
the City Attorney to prepare an Ordinance amending Ord. #16, 1976,
that would resolve the problem as presented by Mr. DiVosta, for
consideration by the Council at the Regular Meeting February 3, 1977;
and further, that the City Council is in receipt of the
Certification of Title at the same time.
The Council requested that Howard Searcy, Engineers be made aware
of the problem and that his comments be presented at the Regular
Meeting on February 3, 1977.
The City Attorney advised that he will confer with the City Attorney
of North Palm Beach relative to the subject.
REPORTS: Councilman Kiedis reported on the meeting of the Planning and
