HomeMy WebLinkAboutMinutes Council 020377i REGULAR MEETING CITY OF PALM BEACH GARDENS FEBRUARY 3, 1977 The Regular Meeting of the City Council of Palm Beach Gardens was called to order by Vice Mayor Feeney at 8:00 P.M. and opened with the Pledge of Allegiance to the Flag. ROLL CALL: Roll was called by the City Clerk and present were: Vice Mayor Feeney, Councilman Kiedis, Councilman Laurie and Councilman Rossow. Mayor Martino arrived subsequently. Attorney Brant was in attendance. MINUTES: The Minutes of the Workshop h• eet ing of January 270 1977 and the Minutes of the Special Meeting of January 27, 1977 were unanimously approved by the Council, as written. ANNOUNCEMENTS: Vice Mayor Feeney made the following announcements: Recreation Advisory Board Meeting - Tuesday, Feb. 8, 1977 at 8 :00 P.M. Planning and Zoning Commission Meeting - Tuesday, Feb. 89 1977 at 7 :30 Volunteer Firemen's ]Meeting - Tuesday, Feb. 8, 1977 Beautification and Environmental Committee Meeting - [red. Feb. 9, 1977 at 7:30 P.M. PROCLAMATION: Vice Mayor Feeney read a Proclamation declaring February 6 -12, 1977 as National Vocational Education Week. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA: SAM CARSILLO: Sam Carsillo spoke from the audience requesting the following: Pursue the beautification of the PGA median strip and the Northlake Blvd. median strip; clean up the Public works yard after the freeze to make room for new shrubs; lower the sprinkler system at Public IA'orks yard; lights at the entrance to the City Hall not working; requested information at the next meeting re completion of hospital and helicopter pad at hospital. Mr. Carsillo advised he is working on obtaining plans for the Regular Meeting, February 3, 1977 utilization of the 20 acres for recreational purposes. PETITIONS AND COMMUNICATIONS; Page 2 Councilman Laurie acknowledged receipt of communications from: YMCA 1. Les Mc Whorter, YMCA thanking the Council for their interest and concern as a result of his presentation to the Council re YMCA activities. SCHOOL 2. Notice of meeting on February 7, 1977 proposals for school MZMRMY - ALL AMANDA oundary changes to be presented to the School Board involving CRY: Allamanda School in the City. A member of the Council will be present at this meeting and a copy sent to Mr. DeLonga, School Board member asking for his assistance. k RESOLUTIONS: Resolution #6, 1977 appointing clerks and inspectors for the March RESOLUTION #60 8, 1977 General Election was read in full by the City Clerk and 1977: unanimously adopted by the Council. ORDINANCES: Mayor [Martino declared the Public Hearing open on consideration ORDINANCE #120 of Ordinance #12, 1976 revisions to the Landscape Ordinance, as duly advertised on January 17, 1977. There were no comments from the Council or members of the audience. Mayor Martino declared the Public Hearing closed. Ordinance #12, 1976 was read on second reading, by title only, by the City Clerk and unanimously adopted by the Council. Councilman Rossow, during discussion on the motion, stated he felt the concept of the ordinance was fine but that it was unduly detailed, hard to understand and would be hard to enforce. He suggested in the future that a better job should be done to make ordinances more practical and easy to understand. ORDINANCE #1? Mayor Martino declared the Public Hearing open on consideration of Ord!ffnance #1, 1977 rezoning a parcel of land within Section Regular Meeting, February 3, 1977 Page 3 7. -42_43 from A -1 to R -3C on a petition from Amara Temple to locate a temple on RCA Blvd. near the Southern Bell building. This public hearing was held in conformance to a new State Statute requiring a 30 day notice before the adoption of an ordinance pertaining to rezoning. Mayor Martino read the recommendation received from the Planning and Zoning Commission, as a result of their Public Hearing held January 25, 1977, that the land in question be rezoned as requested. No comments were received from the Council or members of the audience. Mayor Martino declared the Public Hearing closed. Ordinance #11, 1977 was read in full, on first reading, by the City Clerk. A Public Hearing and second reading will be held at the Regular Meeting on March 3, 1977. ORDINANCE #29 Mayor Martino established the basis for placing Ordinancd #2, 19770 1z37'� — Amending Ordinance #16, 1976, Sandalwood PUD, on first and second reading on an emergency passage, due to the request of Mr. Otto DiVosta at the Tworkshop Meeting, January 27, 1977 that he be granted permission to proceed with the first 96 units under the existing drainage as outlined in Ordinance #16, 1976 inasmuch as he had been unable to obtain the easement deed from North Palm Beach for the drainage culvert system under Prosperity Farms Road. The Council agreed at the time, that relief be granted to Mr. DiVosta, in that the ¢oject would provide jobs for 100 people and prevent a delay in persons obtaining housing. Ordinance #2, 1977, was read on first reading, by title only, by the City Clerk. Mayor Martino declared the Public Hearing open on consideration of 1� Ordinance #2, 1977 on an emergency basis, on second reading, by a unanimous vote of the Council. Regular Meeting, February 3, 1977 Page 4 Mr. DiVosta commented that nothing had changed since his request at the Workshop Meeting on January 27th, and stated that he had not received the Certification of Title. Positive drainage across Prosperity Farms Road and East of Prosperity Farms Road is being considered by the Village of North Palm Beach. Howard Searcy, Engineer for the City,was present at the meeting and presented a letter from the South Florida water Management District dated January 25, 1977 certifying as to the 100 year storm requirement. City Manager John Orr clarified that the Plat request was a concern of the Council solely to eliminate metes and bounds description of the units for future use by the public. The City Engineer and City Attorney, after review of the Plat as presented by Mr. DiVosta, will sign the Plat, which in turn will 11� be signed by the Mayor. It was determined that the filing and recording of the plat is not required before a permit is issued for the project. Mayor Martino declared the Public Hearing closed. Ordinance #2, 1977 was read on second reading on an emergency basis in full by the City Clerk and unanimously adopted by the City Council. REPORTS: Councilman Kiedis reported that Dick Ferrara, Director of the COMMUNITY Community School advised that the Palm Beach Junior College has SCHOOL PROGRAM: paid the $2700 as their share of the maintenance service, and that V they plan on holding 10 Cr 12 more classes at the High School, which would entail using the drivers training area for parking, and they in turn will pay an attendant to park the cars. Regular Meeting, February 3, 1977 Page 5 ITEMS FOR DISCUSSION: PRELIMINARY Discussion was held on the conditional approval of the Preliminary REPLAT OF PLAN Replat of Plat #4. Mr. Don Shepherd, Engineer with Robert E. Owen, representing Royal American Realty, Inc. explained their plans to replat and rezone lands within the existing Plat #4 of the City, in that with the extension of Military Trail to the north, it would not be feasible for an R -1 single family residential area as in the existing plat along Military Trail, and they were requesting a rezoning to R -3C as outlined in the repl.at. Mr. Shepherd stated that Royal American Realty, Inc. were agreeable, as recommended by the Planning and Zoning Commission, to request the rezoning of the single family residential lots that remain in Plat #4 from R..1 to R -IA, however there were 6 or 7 lots that do no meet the criteria of R -lA and the lot lines must be adjusted. The completion of Pine Tree Blvd. to the east has not been completed and a Performance Bond will be posted for future improvement. Vice Mayor Feeney suggested, in view of the proposed school boundary changes, that the School Board should be encouraged to build a facility on their property adjacent to Plat #4 and south of Pine Tree Blvd. Mr. Shepherd advised that the potable water supply has been cleared by the Health Department and the sanitary sewers have been refurbished, but not certified by the Health Department. The City Manager was directed to obtain same from the Health Department. Copies of the Utilities easements will be supplied for the City files. Howard Searcy, Engineer spoke on the drainage of the Plat stating that before any replatting is done, committments should be received. He is of the opinion that the flow of water to the south is marginal and �., encouraged the development of the drainage outlet to the north from FGA Blvd. He advised that Royal American Realty, Inc. has petitioned the Northern Palm Beach County Water Control District to include Plat #4 in a unit of development of that District, which will be considered at their meeting on February 7, 1977. Mr. Searcy and Mr. Shepherd agreed to work out ways to achieve positive drainage, possibly by interim improvements to the north to allow for limited building. Mr. Searcy and Mr. Shepherd will inspect the road network by coring the streets for a laboratory test to determine if they conform to the City standards. Consideration will be given to the extension of Banyan Street for an alternate access to the plat for fire and police and input will be requested from the Fire Chief and the Chief of Police. The Council stressed that no title of record on any lot can be conveyed until the zoning is resolved. ITEMS BY THE CITY MANAGER: PUBLIC HEARINGS The City Manager and the Mayor will set up a schedule of dates F DCJM_: for Public Hearings regarding the Referendum proposition to b�-- on the ballot of the March 8th election. SENIOR CITIZEN The City Manager advised of the Senior Citizen Dinner Dance to be D. held at the Jupiter Holiday Inn on February 18, 1977. RECORD PLAYER A motion was made, seconded and unanimously carried authorizing the FOR SENIORS: City Manager to expend $140.00 for a record player for the Senior Citizens Club, monies to be taken from the Contingency Account. i Regular Meeting, February 3, 1977 Page 7 HOWELL WATKINS The City Council, with the exception of Vice Mayor Feeney who voted TO RAISE CHICKENS: nay, agreed to allow Howell. L. Watkins Junior High School to raise 12 chickens for a "hands-on" learning experience for the students. WIDENING OF After a review and recommendation is made by the City Attorney and MILITARY TRAIL: the City Engineer, consideration will be made relative to the conveying of lands to the DOT for the widening of Military Trail. ITEMS BY THE MAYOR AND COUNCIL: COUNCILMAN Councilman Kiedis called to the attention of the City Manager that KIEDIS: boats were parking at Holly Drive and Dogwood and a large truck was parked on the turn of Holly Drive and Ironwood Road. VICE MAYOR The Council, with the exception of Vice mayor Feeney, who voted nay, F EENEY : agreed to allow the soccer program to be played on the Plant Drive field. COUNCILMAN Councilman Laurie recommended that if a request is received from LAURIE : the "Moonies" to solicit in the City, that they be denied. Councilman Laurie recommended that the Council consider whether they want legalized casino gambling in the City inasmuch as this is being considered by the State, and recommended consideration of a referendum similar to Boca Raton. Councilman Laurie expressed thanks to the Firemen for inviting him to their installation dinner, and for allowing him to present an award. Attorney Brant explained the legal procedures in process regarding the pending suit against the Personal Touch Health Spa. Councilman Laurie suggested that the Council move in a positive direction toward a community center and the development of the 40 acres Regular Meeting, February 3, 1977 Page 8 VICE MAYOR Vice Mayor Feeney asked that the City Manager explore the cost FEENEY for a CB base station for the Police Department. Chief Arrant's report indicated a possible need for personnel to attend an air craft crash rescue course for small airports. The City Manager will determine from Chief Arrants the cost and need for this training, then contact Pratt and Whitney Aircraft for possible monetary support should the training be required. Councilman Rossow recommended that the Council consider two meetings per month, and that individuals appearing before the Council be better prepared so that prolong discussions, that are not relevant to the issue, can be eliminated.
