CITY OF PALM BEACH GARDENS
MARCH 3, 1977
PUBLIC HEARING A Public Hearing was called to order by Mayor Martino at 8:00 P.M.
REFERENDUM
ELECTIONF prior to the Regular Meeting for the purpose of explaining the
Referendum question to purchase the 12 acres of land across from
the Fire Station, which will be placed on the March 8th City
Election.
Mayor Martino, Vice Mayor Feeney, Councilman Kiedis, Councilman
Laurie and Attorney George Baldwin were present.
Mr. A. J. Varney, 3310 C, Meridian South, spoke from the audience
posing questions relative to the purchase of the 12 acres and
the questions were clarified by the City Council members.
The Public Hearing was closed at 8:15 P.M.
REGULAR MEETING: The Regular Meeting of the City Council of palm Beach Gardens
was called to order by Mayor Martino at 8:16 P.M. in the Assembly
Room, 10500 N. Military Trail, Palm Beach Gardens, Florida and
opened with the Pledge of Allegiance to the Flag.
ROLL CALL: Roll was called by the City Clerk and present were: Mayor Martino,

Vase Mayor Feeney, Councilman Kiedis and Councilman Laurie.
Councilman Rossow was detained and arrived subsequently. Attorney
Baldwin was in attendance.
MINUTES: The Minutes of the Workshop Meeting of February 24, 1977, as
amended, were unanimously adopted by the Council.
ANNOUNCEMENTS: Mayor N.artino made the following announcements:

Special Meeting of the City Council will be held to Canvass the
Votes on ;,ednesday, Narch 9, 1977 at 6:30 P.M.
Number of Registered Voters in the City - 5419.
SILENT PRAYER A minute of silent prayer was held in memory of Woody Dukes, former
FOR WOODY
DUKES Recreation DirOctor of the City for 10 years, who passed away on
March 1, 1977. Mayor Martino stated that the �-ity had lost one of
its outstanding citizens, and that Woody had built up the Recreation
Department with very little in the way of money or help.
PROCLAMATION: Mayor Martino read a Proclamation declaring the month of March, 1977
RED CROSS as Red Cross Month.
MDNTH :
Mayor Martino stated that he and Councilman Kiedis and members of
the City starl attended a Flag Raising Ceremony on Tuesday, March
1, 1977 in front of the City Hall. Members of the Fire Department,
acting as a color guard, raised the Red Cross flag, which will be
flown during the month of March at the City Hall.
COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA:
SAM CARSILLO: Mayor Martino read the letter received from Peggy Evatt, County
LETTER FROM Commissioner, that she would meet with representatives from the

C LINTY municipalities at the Northeast Palm Beach County Court House at
COMMISSIONER:
9 :00 A.M. on March 9, 1977. Mayor Martino related that the City
Manager would advise her of the concerns of the Council,
including those concerns of Mr. Carsillo relative to the litter
on PGA Blvd. and Northlake Blvd., the beautification of the
median strips on these two boulevards, and the illegal crossing
of the median strip on Northlake Blvd.

Sam Carsillo mentioned the following items for consideration:
cleaning up of the Publix Shopping Center; need for light at Burns
�. Road and Alt. AIA; trim the shrubs at northwest corner Burns and
the railroad; trash can at Crestdale and Sirdwood, check the gas
main on south side Burns Road at railroad; skate board ramps;
clean up the weeds at the Public Works yard - Mayor Martino asked
the City Manager to direct the Public Works Director to complete
this as soon as possible.
Mr. Carsillo advised that plans for a helicopter pad at the
hospital were progressing and a possible location would be on the
roof of the emergency room.
Mr. Carsillo asked that the inoculation gun used for lethel
yellowing be given to Tom Armer for use on his palm trees.
Mr. Carsillo pointed out a newpaper item, that he felt was
erroneous, that stated that the Council was not represented at
School Board meetings. Vice Mayor Feeney pointed out that the
Council members did attend School Board meetings, and that Mr.
DeLonga, past Councilman and Mayor, was a member of the School
Board and relayed the feelings of the Council at these Meetings.
PETITIONS AND COMMUNICATIONS:
Mayor Martino acknowledged receipt of communications from:
DEPT. OF 1. Department of Transportation notice of meeting on.Thursday,

March 10, 1977 at 2 :00 P.M. at Ft. Lauderdale.
COMMUNITY 2. Community Development Division informing the City that Edward
DEVELOPMENT
as resigned as the City's representative on the Citizen
Advisory Committee and asking that a new member be appointed.
The City Manager advised that Mr. Erickson had resigned due to
lack of interest on the part of the Committee and that nothing
had been accomplished. A new member will not be appointed to

the Committee at the present time.

EARL MARSH: 3. Earl V. Marsh, Manager Hawthorne Roofing regarding the roof
leaks at the Fire Station.
MARTHA BOWLES: 4. Letter of resignation from Martha Bowles from the Beautification
and Environmental Committee.
DON WALKER: 5. Don �.Ialker, President, Northern Palm Beach County Water Control
District advising that the land owners of Plat #4 have petitioned
them to allow their property to drain through the District EPB -3
canal.
DON SHEPHERD: 6. Donald Shepherd, Engineer, to Donald Walker, in.answer to
above letter, advancing funds to permit the preliminary engineering
studies and legal work to incorporate Plat #4 into Taxing District
No. 2.
ORDINANCES: Mayor Martino declared the Public Hearing open on consideration
ORDINANCE #3, of Ordinance #3, 1977 rezoning of portions of the recorded Plat #4
• from R -1, Single Family Residential District to R -3C, Medium
PLAT #4:
Density Residential. District, and the balance of the Plat #4, from
R -1, Single Family Residential District to R -1A, Single Family
Residential District, per the petition of Royal American Realty, Inc.
This Public Hearing was held in conformance to a new State Statute
requiring a 30 day notice before the adoption of an ordinance
pertaining to rezoning.
RECOMMENDATION Mayor Martino noted the recommendation from the Planning and

C MM -IS S ION : Zoning Commission, as a result of their public hearing held
February 22, 1977, that the lands in question, as described above,
be rezoned as requested.
REPLATTING OF Recommendation was also made by the Planning and Zoning Commission

to the Council, as a result of their public hearing held February
22, 1977, that final approval be given for the final replat of
the existing Plat #4 as submitted by Donald Shepherd, Engineer,
Robert E. Owens and Assoc., Inc.
Mayor Martino referenced Section 205 of the Palm Beach Gardens
Code pertaining to platting, which states that upon receipt of a
recommendation from the Planning and Zoning Commission, the City
Council shall grant final approval or shall disapprove the
application on or before its second scheduled regular meeting
following action by the P&Z Commission.
The Council unanimously concurred to waive the above requirement
due to certain incomplete conditions that existed during and after
the Planning and Zoning Commission's approval. Mr. Don Shepherd,
Mr. Mark Garnett and Mr. Robert Rousseau, representatives of the
`� owner of Plat #4, were present at the meeting and agreed to the
action by the Council.
The second reading and public hearing on the Ordinance will be held
as advertised, and according to State Statute on Thursday,
April 7, 1977.
PRESENTATION BY Mr. Shepherd presented the Council with copies of Plat #4 in
MR. SHEPHERD:
final form, including all the required signatures.
He stated that a title certification has not been obtained, since
Pine Tree Lane has not officially been abandoned.
Mr. Shepherd explained the procedure for obtaining positive
drainage; that the Northern Palm Beach County Water Control
District has been petitioned and money advanced for preliminary
engineering studies and legal work to incorporate Plat #4 into

Mr. Shepherd referenced the letter from Howard Searcy, City
Engineer, dated February 21, 1977 and stated that items 11 2, and
3 were being accomplished as recommended by Mr. Searcy to minimize
the threat of flood damage in the event of a major storm, and asked
relief in that the owner could place certain lots on the market as
indicated by the table in Mr. Searcy's letter.
It was suggested that the Attorney for the owner meet with
Attorney Brant to determine the legality of selling the lots prior
to the rezoning and replatting of the area. This will be an item
for discussion at the March 10th meeting.
Mr. Shepherd stated that the road core samples had been given to
Mr. Searcy, and no answer had been received as yet.
Mr. Garnett verified that the drainage improvements will be
maintained by the owner, until such time that the Drainage district
accepts the drainage. The City Attorney will determine if a bond,
in addition to an agreement,is necessary.
Mayor Martino declared the Public Hearing closed.
Ordinance #3, 1977 was read in full, by the City Clerk, on first
r eading .
REPORTS: Councilman Laurie reported he and Mayor Martino had attended the
P &Z COMMISSION Planning and Zoning Commission Meeting held March 1, 1977. Mr.
MEETING:
Marvin Hill, Planning Consultant was in attendance and presented
the first draft of the revisions to the zoning code for their
review and input. Councilman Laurie requested that in the future
Mr. Hill send his drafts ahead for review by the Council and P&Z
Commission.

ITEMS FOR DISCUSSION:
ANTI- RECESSION At the recommendation of the City Manager, a motion was made,

seconded and unanimously carried authorizing the City Manager
to expend $24,706.00 from the Anti - Recession Funds, as per the
attached itemized list.
ITEMS BY MAYOR AND COUNCIL:
COUNCILMAN Councilman Laurie asked the City Manager to check on the skate

board ramps in various locations in the City; the pipe on a
residents property in the swale on Holly Drive that is exposed;
and the costs for concrete curbing of the median on Holly Drive.
VICE MAYOR Vice Mayor Feeney requested that a resolution be prepared by the

City Attorney referencing the article in the newspaper that the
Dept. of Revenue is forcing the Property Appraiser to increase
residential valuations, and expressing opposition to it, The
Council concurred to consider a resolution at the March 10th
meeting.
Vice Mayor Feeney asked that the Council pursue at a later date,
the selling of beer to minors and the purchase of pornographic
magazines by minors, which have been reported as occurring in the
City.
ADJOURNMENT: No further business, the meeting adjourned at 10:00 P.M.
