HomeMy WebLinkAboutMinutes Council 042177REGULAR MEETING CITY 0 PALM' BEACH GARDENS APRIL 21, 1977 The Regular Meeting of the City Council of Palm Beach Gardens was called to order by Mayor Feeney at 8 :00 P.M. in the Assembly Room, 10500 N. Military Trail, Palm Beach Gardens, Florida, and opened with the Pledge of Allegiance to the Flag. ROLL CALL: Roll was called by the City Clerk and present were: Mayor Feeney, Councilman Martino, Councilman Kiedis and Councilman Rossow. due to the proximity of a fire on PGA 4/28/77 Vice Mayor Laurie was absent/ City Manager John L. Orr was absent Blvd. near to his residence. due to the death of his Father. Attorney Brant was in attendance. MINUTES: The Minutes of the GAorkshop Meeting of April 14, 1977 were unanimously approved by the Council. ANNOUNCEMENTS: Mayor Feeney made the following announcements: Planning and Zoning Commission meeting - Tuesday, April 26, 1977 at 7:30 P.M. PBGYAA General Membership Meeting - 'Wednesday, April 27, 1977 at 8:00 P.M. Senior Citizens Dance - Friday, April 29, 1977 at 8:00 P.M. at Howell Watkins Junior High School. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA: HARRY LB(IS: Harry Lewis, Chairman of the Landscape Committee of Adjustment requested that the Council provide his Committee with a letter containing their intentions regarding the enforcement of the Landscape Ordinance on the existing businesses, before any further meetings are held by the Committee. SAM CARSILLO: Sam Carsillo reported on his trip to Tallahassee where he had talked to the Legislators relative to the high premiums on automobile insurance. He thanked the Council for their support Regular Meeting, April 21, 1977 Page 2 and was of the opinion that HB 50 would be passed by the Legislature, which Bill would insure the people instead of the automobiles. SANDRA MDRGAN: Sandra Morgan, Softball Director, PBGYAA together with a group of parents and managers who are members of the PBGYAA,were present at the meeting. Ms. Morgan presented the Council with a letter and reviewed the contents with the Council advising that the softball fields on the north side of Burns Road are unplayable in their present condition and that she has directed that the remainder of the games will be played at the Elementary School. She further stated that a Senior League player had been injured on the field. Members of the group offered to work on the fields, if necessary, to get them in shape. Richard Landers, father of the injured girl, requested that the City close the fields for play. Mayor :Feeney assured the people in the audience that the first concern of the City is for the safety of the children that play on all the fields in the City, and that the City does its best to provide adequate playing facilities. A motion was made, seconded and unanimously adopted authorizing the City Manager to post signs on the ball fields, located on the north side of Burns Road adjacent to the City Complex, that play will be suspended until the City Council determines that the fields are usable and playable. Councilman Martino advised the parents and members of the PBGYAA of the things that they might not be aware that the City does in preparing and maintaining the 14 fields, and asked for joint cooperation in improving and maintaining the fields. He expressed concern that the coaches and managers are losing sight of their responsibility to provide a safe atmosphere, i.e. to make sure the bases are tied down, and to teach the fundamental things like sliding. Regular Meeting, April 21, 1977 Page 3 Sam Carsillo offered that he had previous experience relative to ball fields and would give his input to the Council after inspecting the fields. PETITIONS AND COMMUNICATIONS: Mayor Feeney acknowledged receipt of communications from: TOM VREELAND: 1. Tom Vreeland, President of Volunteer Fire Department stating that at a General Membership Meeting held April 12th, the members voted unanimously not to support or assist any function held at the Central Fire Station referencing the Las Vegas night function to be held there. Councilman Rossow stated he disagrees with the implication that if the Council allows the Las Vegas night function to be held at the Fire Station, they are not concerned with the safety of the citizens. EMERY N. MILLS: 2. Emery N. Mills, 4137 Jonquil Circle, South expressing concern 1'-1 over the problems caused by the footbridge that crosses over from the Town Hall home area to Gardenia Drive. TRUDY DULMAGE: 3. Trudy Dulmage, Junior Woman's Club of the North Palm Beaches asking the City to declare the week of May B -14 as Healthy Baby Week. CHUCK OTTERSON: 4. Chuck Otterson, Acting Director, Palm Beach County Sports Hall of Fame asking the City to proclaim May 6th as Palm Beach County Sports Hall of Fame Day. PSG HIGH SCHOOL 5. Donald L. Kiselewski, President, P.B.G.H.S. Band Parent BAND PARENT ASSOC.: Association asking for financial support for the band to go to the Six Flags Over Georgia Music Festival. � The Council concurred that it was their policy not to financially support any group for whatever reasor�- and a letter will be sent to Mr. Kiselewski explaining same. Regular meeting, April 21, 1977 Rage 4 RESOLUTIONS: Resolution #22, 1977 Supporting the Lewis Bill and Senate Bill RESOLUTION #22r #41 which provide that Identification Stickers shall be issued to �-� disabled persons whether or not they own or operate the motor vehicle was read by the City Clerk and unanimously adopted by the Council. RESOLUTION #23t Resolution #23, 1977 authorizing the Mayor to execute an agreement on behalf of the City concerning the pavement marking demonstration program was read by the City Clerk and unanimously adopted by the Council. ITEMS FOR DISCUSSION: TRAFFIC CONTROL A motion was made, seconded and unanimously adopted authorizing AGREEMENTS: the Mayor to sign a traffic control agreement with the County for the Intersections of Lighthouse Drive and Alt. AIA and Holly Drive and Military Trail,. M}NIES A motion was made, seconded and unanimously adopted authorizing AUTHOR XZED TO SPRIG 10 ACRES: the expenditure of $3200 for the sprigs and planting of the 10 acres east of the City Complex, monies to be taken from the Anti- Recession Funds. The Council directed the Public Works Director to procedd without delay in preparing the fields for the planting. REWRITE/UPDATE Councilman Martino reported on the status of the rewrite /update ZONING CODE_: of the Palm Reach Gardens Zoning Code by the Planning and Zoning Commission and Marvin Hill, Land Planner: at the April 19th meeting all of Article 5 and the definition section had been reviewed and at the May 17th meeting the general regulations section will be discussed. The Council concurred that Attorney Brant should receive all the material drafted by Mr. Hill and should attend all the meetings. i Regular Meeting, April 21, 1977 Page 5 LANDSCAPE The comments made by Harry Lewis, Chairman of the Landscape COMMITTEE OF ADJUSTMENT-.- Committee of Adjustment made earlier in the evening, were discussed by the council. An updated report on the cases pending and those businesses that did not reply will be given to the Council for consideration at the workshop meeting on April 28th. Mr. Lewis will be asked to attend the meeting. Consideration will be given on full compliance to the Ordinance by the City. The Council was of the opinion that the ordinance should be enforced and tested in court if necessary. REPORTS: Councilman Martino reported he had attended the meeting of the Palm Beach County Library Board on April 20th relative to the equity of the Library Tax appropriated among the municipal libraries that participate in the County Library System and at this time the City is not in danger of losing its library. ITEMS BY MAYOR AND COUNCIL: MAYOR FEENEY: Mayor Feeney referenced the letter from Tom Vreeland in regard to Las Vegas Night being held at the Fire Station. Councilman Martino stated that the Council had already approved the use of the Fire Station for Las Vegas Night. COUNCILMAN Councilman Rossow questioned the construction of the ballfieids ROS SOW : BALLF IELDS and the legal obligations on insurance coverage, and a discussion on this item was held by the Council. The City Attorney was directed to make a recommendation as to the Cities legal obligations and the establish mentof a written policy as to responsibility in the future. The letter presented to the Council by Richard Landers, parent o f the injured girl, will be forwarded to the Insurance Car-tier of the City, and a letter written to Mr. Landers and to Sandy Regular Meeting, April 21, 1977 Page 6 Morgan that use of the fields has been suspended for maintenance until further notice. Relative to the construction and location of the ballfields, the Council concurred that in the future clear, concise instructions would be given on any project to be undertaken, plans to be submitted for final approval as to policy by the Council, and that the City Manager should involve all Departments concerned with that particular project. It was also determined that it be mandatory that the Building Department inspect any changes, alterations, or installations made by any Department of the City. The City Manager was directed to meet with the Staff when planning any future projects to obtain all pertinent input to ensure more efficiency. PLANT DRIVE The City Council concurred that C. R. Dunn should be contracted LIGHTS: each year to refurbish the lights at Plant Drive and if funds are needed, to request the authorization from the City Council.
