HomeMy WebLinkAboutMinutes Council 090177REGULAR MEETING CITY OF PALM BEACH GARDENS SEPTEMBER 1, 1977 The Regular Meeting of the City Council of Palm Beach Gardens was called to order by Vice Mayor Laurie at 8:00 P.M. in the Assembly Room, 10500 North Military Trail, Palm Beach Gardens, Florida and opened with the Pledge of Allegiance to the Flag. ROLL CALL: Roll was called by the City Clerk and present were: Vice Mayor Laurie, Councilman Martino and Councilman Kiedis. Mayor Feeney and Councilman Rossow were absent. Attorney Brant was in attendance. MINUTES: The Minutes of the Regular Meeting of August lei, 1977 were unanimously approved by the Council as written. The Minutes of the Budget Workshop Meeting of August 22, 1977 and the Budget Workshop Meeting of August 25, 1977 were unanimously approved by the Council as written. The Minutes of the Proposed Revenue Sharing Meeting of August 29, 1977 were unanimously approved by the Council as written. City Manager John L. Orr advised that there were only two residents in attendance. PROCLAMATIONS- Vice Mayor Laurie read a Proclamation declaring September 4th to September 5th as "Jerry Lewis Muscular Dystrophy Telethon Weekend ". PETITIONS AND COMMUNICATIONS: Vice Mayor Laurie acknowledged receipt of communications from: GERALD ROSSOW: 1. Councilman Gerald Rossow letter of resignation,since he is moving out of the City, which will be the first item for consideration at the Regular Meeting on September 15, 1977. PEGGY EVATT: 2. Peggy a Evatt, County Commissioner, notice of meeting with representatives of the other North County municipalities at 7 :30 F.M. on September 12, 1977 at the Northeast County Courthouse. All the Council Regular Meeting, September 1, 1977 indicated they would attend. Page 2 HOWARD WRIGHT: 3. Chief Howard Wright, Florida Fire Chief's Assoc., informing that Chief Edward F. Arrants was elected 2nd Vice President of the Florida Fire Chief's Assoc. at their annual conference last July, 1977. RESOLUTIONS: Resolution #36, 1977 appointing an alternate member to the Zoning Board of RESOLUTION #36, Appeals and inserting the name Virginia Amato in Section 1 was read in 1977: full by the City Clerk and unanimously adopted by the Council. Mr. Joseph F. Alcock, also an applicant for an Advisory Board, was present and stated his qualifications. In order to create a balance on the Zoning Board of Appeals as far as background was concerned, the Council appointed Mrs. Amato to serve, and Councilman Martino was in favor of appointing Mr. Alcock to fill the next vacancy on any board since he had not specified a preference to any Board. RESOLUTION #37, Resolution #37, 1977 urging the Public Service Commission to reconsider `f 1977: the rate structure recently approved by the PSC for Florida Power and Light Company will be considered at the Regular Meeting on September 15, 1977 when a full Council is present. ORDINANCES: Ordinance #9, 1977 the Budget Ordinance for the Fiscal Year 1977 -78 was ORDINANCE #9, read in full by the City Clerk on first reading. A Public Hearing and 1977: second reading will be held at the Regular Meeting on September 15, 1977. ITEMS FOR DISCUSSION: Discussion was held by the Council on consideration of conditional uses permitted at Camdaras, Inc., a business located at 3844 Burns Road. Mr. Chan Clark, owner of Camdaras, Inc. was present at the meeting and questioned why he did not receive a renewal notice for his occupational licenses for his business. r Regular Meeting, September 1, 1977 Page 3 Councilman Martino reiterated the events surrounding the issuance of an Occupational License to Camdaras, Inc. dating back to 1973; and the conditional use that was granted by the Planning and Zoning Commission at their Public Hearing held September 24, 1974 allowing Camdaras, Inc. to remain at their locale under a Conditional Use in the M -1 -A Zoning District. Included under the Conditional Use were 8 categories including a sales agency for motor homes, travel trailers, and other associated recreation vehicles; and it was determined by the Council and the City Attorney that the Planning and Zoning Commission does not have the power to grant a conditional use for a category that is not allowed in the Code; that is for a sales agency, therefore, this is an illegal use, and an occupational license cannot be issued for that category. In addition, Councilman Martino questioned the parking of the recreational vehicles outside the perimeter of the fence during the day and over night, and the lack of conformance to the requirements of the Landscape Code. Mr. Clark advised he had planted a hedge within the last month and full compliance to the Code would be met within a month with the completion of the new construction. Further discussion revolved around a means to provide relief to Mr. Clark and at the same time resolve the legality of issuing a license for the sale of motor homes, travel trailers and other associated recreation vehicles. A motion was made by Councilman Martino, seconded by Councilman Kiedis and unanimously carried that the Council instruct the Planning and Zoning Commission, at their next meeting, to consider an addition to the M -1 -A Toning Classification for a conditional use to allow the sale of recreational vehicles. Regular Meeting, September 1, 1977 Page 4 The City Attorney was directed to collaborate with Floyd Herald, Attorney for Mr. Clark, who was present at the meeting, and prepare a document, which will enable Mr. Clark to continue in his present mode of operation until the Planning and Zoning Commission provides the Council with a recommendation either positively or negatively with respect to the sale of Recreational vehicles. If the recommendation is positive it should continue beyond that until the City Council acts and either approves or denies the recommendation, at which time if approval is granted then Mr. Clark will be in the position to then apply to the Planning and Toning Commission for that conditional use. At that point, if the petition from Mr. Clark for a conditional use is approved, a license could be issued. Attorney Brant advised that this action taken will be a judgement without prejudice in the event litigation follows. The City Council authorized the City Manager to issue 4 of the 5 licenses to Camdaras, Inc. namely, LP Gas and Gasoline, Retail Store, Garage Storage, Rental of Motor Homes and Travel Trailers, and to hold the license for a Sales Agency for Motor Homes, Travel Trailers, and other associated recreation vehicles until a decision is reached. Regular Meeting, September 1, 1977 Page 5 REPORTS: Councilman Kiedis reported he had attended the Sub - committee meeting of the P &Z COMMISSION Planning and Zoning Commission held August 30, 1977 to consider a MEETING: recommendation relative to including various types of recreational facilities in the permitted or conditional uses of the 'zoning classifications Vice Mayor Laurie reported he had also attended the Sub - committee meeting of the Planning and Zoning Commission held August 30, 1977. ITEMS BY CITY MANAGER: CALL FOR BIDS The City Manager John L. Orr recommended and the Council concurred to hold DIESEL TRACTOR: a Special Meeting on September 22, 1977 prior to the Workshop Meeting to open and read bids for a 45 h.p. Diesel Tractor, which has been duly advertised. FOOTBALL The City Manager John L. Orr extended an invitation from the Youth JAMBOREE; Athletic Association to attend the Football Kick -off Jamboree to be held at Plant Drive on Saturday, September 3, 1977 at 10 :00 A.M. PROPOSED ORD. At the suggestion of the City Manager, the following time table was FOR DISCUSSION AT WORKSHOP established by the Council for discussion on proposed ordinances: MEETING . Zoning for Pornographic Arts - Workshop Meeting, Sept. R, 1977; Regulating the parking of commercial vehicles within residential districts - Workshop Meeting Sept. 22nd and if necessary on October 13, 1977. An item will be placed in the Newsletter advising the residents of this schedule. ITEMS BY MAYOR AND COUNCIL: COUNCILMAN Councilman Martino complimented the City Manager and the Department Heads MARTINO: on the preparation and input into the Budget, stating that it was a job well done and the residents could be assured we do have a good City Manager and Administrative staff that are concerned about how they use the tax dollars. He also complimented the City Council for taking out Regular Meeting, September 1, 1977 Pag e 6 1/2 mill below the City Manager's recommendation and below the certified millage. He also brought out an interesting point that the expenditures `-/ for the City last year was approximately 1.7 million and the City Manager had proposed an increase of only $85,000 this year, which is commendable in light of the double digit inflation of this time. BALL FIELDS: Councilman Martino requested, and the Council concurred, to keep as an agenda item for information purposes, the progress of the ball fields, looking at the proposed lay -out of the fields and consideration of who will lay out the fields, etc. Councilman Martino stated it was suggested by the YAA that removable fences on the fields might be feasible. Councilman Kiedis indicated he was not in favor of this method. VICE MAYOR Vice Mayor Laurie requested that the high grass be cut around the bleachers; LAURIE: 11--. requested a copy of the letter sent to the new residents; and in answer to his question about the disposition of the fire truck parked in the Public Works yard, he was advised by the City Manager that it will be removed in the near future. Vice Mayor Laurie asked that consideration be given to providing a meeting room for the Girl Scouts as requested by Susan Poncy. COUNCILMAN Councilman Kiedis referred to a memo from Steve Henning, Recreation KIEDIS: Director, relative to a policy decision on initiating a $1.00 fee per child, per lesson for 10 lessons, to pay the instructors costs for to gymnastic lessons. A poll of the Council was taken as Follows / Vice charge a $1.00 fee for advanced gymastic lessons. Mayor Laurie and Councilman Kiedis voted aye; Councilman Martino voted nay.
