WORKSHOP MEETING
CITY nF PALM BEACH GARDENS
SEPTEMBER S, 1977
The Workshop Meeting of the City Council of Palm Beach Gardens was called
to order by Mayor Feeney at 5:00 P.M. in the Assembly Room, 10500 North
Military Trail, Talm Beach Gardens, Florida and opened with the Pledge
of Allegiance to the Flag.
ROLL CALL: Roll was called by the City Clerk and present were: Mayor Feeney, Vice
Mayor Laurie, Councilman Martino and Councilman Kiedis. Councilman
Rossow was absent. Attorney Brant was in attendance.
MINUTES: The Minutes of the Regular Meeting of September 1, 1977 were unanimously
approved, as amended, by the City Council.
PETITInNS AND COMMUNICATIONS:
Mayor Feeney acknowledged receipt of a communication from:
WALTER WILEY: Walter H. Wiley, a copy of a letter he had written to Jackie Winchester,
Supervisor of Elections encouraging another site be found for precinct
42,which has been recently created, other than the Palm Beach Gardens
High School.
RESOLUTInNS: Resolution #37, 1977 urging the Public Service Commission to reconsider
RESOLUTION #37, the rate structure approved by the PSC for Florida Power and Light Co.

was workshopped by the Council. Councilman Martino was of the opinion
that the first draft of Resolution #37, as prepared by the City Attorney,
was more in keeping with the policy of the Council, and that stronger
language, as presented by the Mayor, could be included in a separate
letter from the Mayor. Resolution #37, 1977, as redrafted by Mayor
Feeney, with the elimination of a whereas and other minor changes, will
be considered for passage at the Regular Meeting on September 15, 1977.

ORDINANCES: Ordinance #9, 1977 the Budget Ordinance for the Fiscal Year 1977. -78,
ORDINANCE #9, was workshopped by the Council. Mayor Feeney presented the recommendation

of the City Manager for consideration by the Council, to increase the
millage to 6.063 and establishing a Reserve Account for future Capital
Expenditures, matching funds and land purchases. Councilman Kiedis and
Councilman Martino were not in favor of following this procedure this
year. Vice Mayor Laurie concurred with the recommendation of the City
Manager as did Mayor Feeney, after they were assured by the City Attorney
that this was an accepted accounting procedure. However, it was agreed
that the Budget figures would not be changed.
Mayor Feeney, mentioned to the Council, the fact that Ed Weimer had been
present at the Public Hearing held to discuss the uses for the Federal
Revenue Sharing funds, and had suggested monies be used to construct a
gazebo for the use of the Senior Citizens in case of inclement weather.
The Council indicated they were against any temporary structure being
erected.
ITEMS FOR DISCUSSION:
ORDINANCE- An Ordinance relative to creating the licensing of Special Regulated Uses
PORNOGRAPHIC ARTS:
relative to Pornographic Arts and the zoning approach to such uses was
discussed by the Council and will be placed on first reading at the
Regular Meeting on September 15, 1977. The Council was of the opinion
that this use should be placed in the C -2 Zoning category and will be
given to the Planning and Toning Commission for consideration at a later
date.
Vice Mayor Laurie complimented the City Manager and the City Attorney
for the research and homework they did prior to preparing this Ordinance.
DISASTER PLAN: The City Manager presented for the Council's review a Disaster Plan for
Palm Beach Gardens, as prepared by Fire Chief Ed Arrants, as part of
the overall disaster plan for the County Civil Defense, which will be

accepted by Resolution for consideration at the Regular Meeting on

ITEMS BY CITY MANAGER:
BALL FIELDS - City Manager Jahn L. Orr reported on the progress of the ball fields to

be located on the north 10 acres adjacent to the City Hall Complex: the
weed killing process was still being used; the Recreation Director,
Steve Henning will furnish specifications for the backstops to go out for
bids, if necessary; Leonard Devine, Director Public Works has surveyed
the area for location of power lines and the orchard, etc. to determine
the location of the fields. Vice Mayor Laurie volunteered to make a
drawing of the layouts of the fields. Councilman Martino, as liaison
to the Recreation Advisory Board, will obtain their recommendation as to
the location of the fields and which one will have grass or clay infields.
Councilman Kiedis reported that there was no grass on the east end of
the 10 acres and other areas had bare spots. He suggested that Leonard
Devine, Public Works Director, contact Karl McKinney, JEM Country Club,
for grass springs, and obtain figures for the cost of the heads and pipe
for additional sprinklers.

The Council concurred that specifications should be prepared for bid for
the laying out of the ball diamonds, and then determination made
whether an outside contractor or the Public Works Department should do
the work depending on the cost figures received.
Councilman Martino suggested that the fields should be located so that
future consideration for the installation of lights are taken into
account.
ITEMS BY MAYOR AND CnUNCIL:
COUNCILMAN The City Manager advised Councilman Kiedis that the two billboards on
KIEDIS:
PGA Blvd. west of Military Trail are not located within the City limits,
and that a letter had been mailed to all owners of billboards that the
expiration date for such structures has terminated.
Councilman Kiedis recommended that compliance to the Landscape Code be
continued and further pursued.
Councilman Kiedis advised of some Australian pine trees around the
perimeter of the tennis courts that need replacing and suggested ordering
more Australian pines to do the job.
PLAT #4; Councilman Kiedis reported that Royal American gealty, Inc. intends to
refurbish the median strip on Military Trail at Plat #4, but suggested
that the City pick up the debris located there and level the shell in
preparation for the work to be done by Royal American Realty, Inc.;
and that the City mow the swale areas in Plat #4.
12 ACRES: Councilman Kiedis requested that the sign be erected on the 12 acres across
from the Fire Station, that was recently purchased by the City, designating
this as a park owned by the City to be used by the residents for picnics,etc.

Councilman Kiedis expressed concern regarding the death of a teenage girl
who was hit by a car, while riding a bicycle after dark without proper
lights. He felt that the Police Department personnel literally ignores
kids riding on bicycles at night, paying no attention to them. He
further stated he hated to see kids get killed because we don't have the
time, or we don't want to take the time to train somebody, or to cause
the parents some discomfort by calling their attention to the fact that
their kids are violating the laws.
COUNCILMAN Councilman Martino expressed congratulations to Chief Ed Arrants for
MARTTNO:
being elected as 2nd Vice President of the Florida Fire Chief's Assoc.,
which shows the esteem he holds in the Rtate Association.
At the recommendation of Councilman Martino, the Council concurred that
the City Manager and the City Attorney should proceed to pursue and go
to Court relative to the matter of the repair of the tennis courts.
The City Manager advised Councilman Martino that the problem with the
swale area at the Ton Mitchell residence on Hyacinth Circle had been
resolved.
Councilman Martino suggested that Steve Henning, Recreation Director,
pursue an idea he had heard about in Miami, for a jogging area on the 12
acres interspersed with exercise spots, which could be accomplished for
a minimal cost and installed possibly with help of the Jaycees.
At Councilman Martino's suggestion, Jim DeLonga, School Board member, will
be invited to attend a meeting to enlighten the Council on the
possibility of reducing the size of School Districts.
~ VICE MAYOR LAURIE: The City Manager advised Vice Mayor Laurie that the dog training program
held at Plant Drive is offered throughout the year.

The City Manager advised Vice Mayor Laurie what was contemplated for
construction at the various areas near PGA Blvd. and Military Trail.
The City Manager was directed to draft a letter to be sent to Mr. Climer,
Bankers Life and Casualty, that the City Council would appreciate
consideration being given to the use of the southeast corner of PGA Blvd.
and Military Trail for professional offices or banks similar to the
existing use on the other corners.
Vice Mayor Laurie suggested that discussion be held on placing
conditional use approval under the City Council. The City Manager was
directed to obtain input from Marvin Hill, Planning Consultant, and
from neighboring municipalities.
Vice Mayor Laurie referenced an article in the Town Crier that Van Scott
was interested in receiving help with the Hetzel Brother Pageant. The
City Manager was instructed to contact Mr. Scott to determine their
future plans for the Christmas season.
A letter of resignation from Selema Oxnevad from the Beautification and
Environmental Committee was acknowledged and the Council concurred that
a plaque should be presented to Mrs. Oxnevad who has served since 1971.
MAYOR FEENEY: Mayor Feeney requested that more trash containers be placed at Plant Drive.
ADJOURNMENT: No further business, the meeting adjourned at 10:0 (1�P.M.
