HomeMy WebLinkAboutMinutes Council 1013771,,ORKSHOP MEETING CITY OF PALM BEACH GARDENS OCTOBER 13, 1977 The Workshop Meeting of the City .Council of Palm Beach Gardens was called to order by Mayor Feeney at 8:10 P.M. in the Assembly Roomo 10500 North Military Trail, Palm Beach Gardens, Florida and opened with the Pledge of Allegiance to the Flag. ROLL CALL: Roll was called by the City Clerk and present were: Mayor Feeney, Vice Mayor Laurie, Councilman Kiedis and Councilman Wiley. Attorney Baldwin was in attendance. Councilman Martino arrived later in the meeting. MINUTES: The Minutes of the Regular Meeting of October 6, 1977 were unanimously approved by the Council as written. TOM SCHi�ARTZ: Tom Schwartz, Director of baseball, Palm Beach Gardens Youth Athletic Association, addressed the Council as Chairman of a Special Projects Committee relative to a fund raising project they are proposing. He stated they will sell advertising on 4 x 8 fence board signs, and when fastened together will make a 150' to 200' outfield fence on the proposed baseball fields to be placed on the 10 acres adjacent to the City Hall c emplex. The signs will be mobile and can be put up or down by four men in about twenty minutes; the fence will be at ground level attached to pipes placed in the ground 2 foot; services of professional sign painters will be used; maintenance to be done by YAA; the storing and problem of vandalism will be responsibility of YAA; advertising � will be sold at X150.00 each, and the Association would realize approximately 110;G00:00. The signs will remain up for the brorkshop Meeting, October 13, 1977 Page 2 duration of the season, and the contracts will be let for a period of 1 year. Discussion followed by the Council regarding the City's liability, the fact that billboards are not allowed in the City, and the safety factor. The Council concurred with the suggestion made by Councilman Nartino that the P13GYAA obtain permission from Mr. MacArthur, and consider placing these signs at the Lake Catherine fields. The City Manager was directed to contract Boca Raton, Lantana and lake Worth as to their experience with this type of advertising. Lou .zones, Vern Stephenson and Paul o'elch., also on the Special Projects Committee were at the meeting in support of the fund raising project. Councilman Martino asked the group to relay to the football coaches the concern the Council has for the children riding their bicycles after dark, and not to schedule games or practices that would continue later in the evening. COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA: iNURRAY KELLER; Murray Keller, 3940 Flag Drive asked what action had been taken regarding the problem of bicycles and mopeds being driven across his property destroying the lawn and trees. City Manager ,john L. Orr replied that the Church had been contacted in reference to extending their fence, and consideration is being given to keeping the easement open for maintenance purposes. PETITIONS AND COMMUNICATIONS: Mayor Feeney acknowledged receipt of communications from: P &Z COMMISSION: 1. Planning and Zoning Commission recommendation as a result of a Public Hearing re commercial recreational facilities. Further Workshop Meeting, October 13, 1977 Page 3 discussion will be held at the 'Workshop Meeting on October 27, 1977. BILL JAMES: 2. Bill James, House Minority Leader acknowledging receipt of Resolution #37, re utility rate increases. NORMAN JACKSON: 3. Norman A. Jackson, Executive Director, Department of Community Affairs declaring Dec. 4-11, 1977 as Human Rights t'eek. A similar Proclamation will be prepared by the City. RESOLUTION #44 The City Manager John L. Orr presented the Council with a copy of 1. ION _ an application form for the Local Government Comprehensive Planning PLANNING ASSISTANCE PROGRAM: Assistance Program and Resolution #44, 1977 requesting the Department of Community Affairs to include the City's application among those requesting financial assistance. At his suggestion, and by a unanimous vote of the Council, the Workshop Meeting was recessed at 9:00 P.M. to hold a Special Meeting to consider the above Mentioned application and Resolution. The Workshop Meeting reconvened at 9:06 P.M. with a full Council in attendance. ORDINANCES: Ordinance #13, 1977 providing that the Site Plan and Appearance ORDINANCE #13, Review Committee shall have certain authority to waiver the 7'T7—.- _ requirements of buffer areas was explained by Councilman Kiedis, that this pertains to buffer areas when a conditional use is involved for medical or dental clinics, or professional offices within the R -3, R -3A, R -3B, R -3D, and R -4 zoning districts. Discussion followed by the Council. Councilman wiley was concerned that the restrictions pertained only to the R -3 through R,4 districtr and also felt each case should be assessed on its own merit. �-' Councilman Martino did not like the concept of the Ordinance, and felt that the granting of a variance should be at the discretion RIM EM ► Workshop Meeting, October 13, 1977 Page 4 of the Council and not with the Site Plan and Appearance Review Committee. Mayor Feeney also felt it should be subject to final approval by the City Council. Vice Mayor Laurie expressed concern about the noise factor generated by the traffic as opposed to traffic noise from a multiple family use. The Ordinance will be modified to include "subject to final approval by the City Council" and "does not reduce the privacy of residential property adjacent to ", for first reading on October 20, 1977. ORDINANCE #142 Councilman Kiedis explained Ordinance #14, 1977 relative to 197 reserved parking improvements, which gives the Site Plan and Appearance Committee authority to waive up to 250 of parking spaces required by the Code. Discussion followed and concern was expressed that it was too arbitrary and if the parking requirements were inadequate, the Code should be changed. A poll of the Council was taken and the Ordinance will not be considered as an Ordinance by the City Council. It will be referred back to the Planning and Zoning Commission for specifics regarding the parking requirement section of the Code to determine if the Code needs to be changed. ORDINANCE RE: Vice Mayor Laurie reiterated the reasons for consideration of an PARKING OF ordinance restricting the parking of commercial vehicles in VEHICLES IN RESIDENTIAL residential areas, which was promoted by a petition from residents AREAS: of the City and presented by Louis Zehnle at the Workshop Meeting on Oct. 14, 1976. Discussion followed and the Council agreed to change the wording 3/4 ton to 1 ton wherever it appears in the Ordinance, and strike the word "volunteer" in Section D (3) and insert the words "fire and medical ". ITEMS FOR DISCUSSION: INTER -LOCAL City Manager John L. Orr presented the Council with copies of an AGREEMENT - COMMUNITY DEVEL- Inter -Local Agreement extending the agreement from last year OPMENT CT: through September 30, 1979, joining *ith the County so they may qualify as an urban county to receive entitlements under the Community Development Act. Consideration of the agreement will be held at the Regular Meeting, October 20, 1977. LAND USE PLAN: City Manager John L. Orr recommended, and the Council concurred, to defer discussion about State requirements for overall Land Use Plan with public input and participation, until the P &Z Commission has completed the re -write of the Zoning Code. Mr. Orr will set up a time table so that the deadline for compliance to the State requirements will be met. IMPROVEMENTS TO The improvements to the 10 acres and location of ball fields was IU ACRES: briefly discussed by the Council and further discussion will be LOCATION OF BALL FISEDS: held on October 20, 1977. Councilman Wiley suggested that a total, recreational valuation should be given to the placement of the ball fields relative to other existing and future utilization for that property. A further look will be given to the layout plan for the fields as recommended by the Recreation Advisory Board, and a request made for a recommendation from Steve Henning, Recreation Director. REPORTS: Councilman Martino reported he had attended the Recreation Advisory Board Meeting held October 11, 1977. The Tennis Committee has requested benches to be placed inside the fenced area; a litter bag affixed to the fence; mention was made of fabric being used as a wind screen; and a complaint made of water from the sprinklers r Workshop Meeting, October 13, 1977 Page 6 hitting the tennis courts. The City Manager was asked to investigate the hours worked by the part time person at the tennis courts. Councilman Martino reported he had attended the meeting held October 10, 1977 in Juno on growth rate control through local legislation which dealt with the economics of growth. Councilman Wiley reported he would be unable to attend the Zoning Board of Appeals meeting on October 19th and Mayor Feeney volunteered to attend in his place as liaison member to the Board. Councilman Kiedis reported he had attended the Planning and Zoning Commission meeting held October 11, 1977, and public hearings had been held on buffer strips and reserved parking and the public hearing relative to amending the conditional uses in M -lA Light Industrial District was recessed until October 25, 1977 at the request of the Attorney for Camdaras, Inc. ITEMS BY THE CITY MANAGER: ANNE`{ATION City Manager John L. Orr stated he had given the Council a copy PROCEDURES: of Annexation procedures as supplied by the Florida Department of Community Affairs and made reference to the possibility of Kendall Construction Company wanting to annex a parcel of land into the City. Mr. Kendall will provide a large scale drawing of his proposed project. BUDGET: City Manager John L. Orr advised that the City has placed an ad in the newspaper, to comply with the Statute, that the Budget is available for inspection by the public at the office of the City Clerk. ITEMS BY MAYOR AND COUNCIL: COUNCILMAN Councilman Kiedis asked that the canal at Honeysuckle be cleaned; 1 Workshop Meeting, October 13, 1977 Page 7 reported tall grass at the Woodland Lakes area and suggested that Mr. Pappalardo be advised. In answer to inquiries by Councilman Kiedis, City Manager John Orr advised that the recreation area at Sandalwood Phase II is completed; no answer has been received from the School Board re a proposed recreation area near Pine Tree Blvd.; no answer has been received from the Inter City First Aid request to use the picnic area; no answer has been received from Mr. Hayes, Manager FP &L regarding street lights; and the City is awaiting permission from FP &L to put in the electrical requirements for the Holly Drive median strip project. Councilman Kiedis requested that the soil be retained to fill in between the curbing. VICE MAYOR LAURIE. The City Manager advised that the teen center will be back in operation next week.
