CITY OF PALM BEACH GARDENS
NOVEMBER 3, 1977
The Regular Meeting of the City Council of Palm Beach Gardens
was called to order by Mayor Feeney at 8:00 P.M. in the
Assembly Room, 10500 North Military Trail, Palm Beach G- Ardens,
Florida, and opened with the Pledge of Allegiance to the Flag.
ROLL CALL: Roil was called by the City Clerk and present were: Mayor
Feeney, Vice Mayor Laurie, Councilman Kiedis, Councilman
Martino, Councilman Wiley. Attorney Brant was in attendance.
MINUTES: The Minutes of the Workshop Meeting of October 27, 1977,
as amended, were unanimously approved by the Council.
ANNOUNCEMENTS: Mayor Feeney made the following announcements:
Planning and Zoning Commission Meeting - Tuesday, Nov. 8, 1977

Recreation Advisory Board Meeting - Tuesday, Nov. 8, 1977 at
8:00 P.M.
Volunteer Firemen's Meeting - Tuesday, Nov. 8, 1977 at 8:00 PM
Beautification and Environmental Committee Meeting - Wed.
Nov. 9, 1977 at 7:30 P.M.
PROCLAMATIONS: Mayor Feeney read a Proclamation declaring October 31st
through November 4th as "Palm Beach Gardens High School
Homecoming Week."
Mayor Feeney read a Proclamation From the Exchange Club of
the Northern Palm Beaches declaring the month of November
as "One Nation Under God" month.
BID OPENINGS: The City Clerk advised that no bids were received for three
(3) new 1978 Police Cars, Chevrolet Nova with special police
package with trade -in. as duly advertised on October 6, 1977.
The City Manager had received word from the Chevrolet

dealers that they do not have the 1978 prices. The City
Manager was directed to go out for bids again to be
returnable on December 1, 1977, and hopefully by that time
the 1978 prices will be available.
PRESENTATION OF AWARDS TO WINNERS OF THE CITY'S GOLF TOURNAMENT.
Mayor Feeney with the assistance of Steve Henning, Director,
Recreation and Parks presented trophies to the winners of
the City's Golf Tournament held at Frenchman's Creek on
October 15, 1977. Mayor Feeney, on behalf of the Council,
thanked Steve for obtaining Frenchman's Creek for the
tournament.
A five minute recess was held to congratulAte the winners.
COMMENTS FROM THE PUBLIC FOR ITEMS NOT ON THE AGENDA:
Sam Carsillo brought the following items to the attention of
-- of the Council: check on the delivery date of the Malayan
trees, request Peggy Evatt, County Commissioner to contact
the Turnpike authority re beautification of the median
strip on PGA Blvd. west of Military Trail, water and fertilize
the shrubs and trees around the City, contact the Florida
Power and Light Company relative to the high power lines at
the location of the puoposed helicopter pad at the Palm
Beach Gardens Hospital, after the Board of Directors Meeting
of the Hospital on December 9th, and requested a letter be
sent to RCA to resume with their landscaping plans to
comply with the Code.
PETITIONS AND COMMUNICATIONS:
COMMUNITY Councilman Wiley reported he had taped to Mr. DeLonga,
SCHOOL. PROGRAM:
School Board member, relative to the lack of contributions
to the Community School Program by other Cities.

Mr. DeLonga suggested a letter be sent by the Mayor to
Mike Robbins, Director, with a copy to the Superintendent
and the School Board expressing concern about the inequities,
with mention of the large usage by the non - contributors,
and the possibility of charging a fee for outsiders.
Mayor Feeney acknowledged receipt of communications from:
PUBLIC SEPVICE 1. Florida Public Service Commission concerning the
OMMZSSION:
resolution from the City about the rate increase granted to
Southern Bell and Florida Power and Light Company.
JOHN L. HXtKINS: 2. John L. Hawkins, Executive Secretary, Professional
Wrecker Operators with comments relative to the Ordinance
about commercial vehicles parking in residential areas.
ORDINANCES: Mayor Feeney declared the public hearing open on consideration
ORDINANCE #15, of Ordinance #15, 1977 providing for the reimbursement of
basic expenses of the Mayor and members of the City Council,
as duly advertised on October 15, 1977.
Councilman Wiley clarified that the Budget that was adopted
in September indicated a fixed total amount for the
reimbursement, and this ordinance allocates that amount.
Sam Carsillo spoke from the audience asking for further
clarification of the expenses of the Council.
Mayor Feeney declared the Public Hearing closed.
A motion was made, seconded and unanimously carried to read
Ordinance #15, 1977 on second reading by title only.
A motion was made, seconded and unanimously carried to amend
Section 5 by adding "and shall be retroactive to October 1,
1977.

ITEMS BY THE CITY MANAGER:
PUD The City Manager, John L. Orr stated that the Code does
PROCEDURES:
not provide a procedure for contractors to follow when
a PUD is submitted. The Council was provided with a PUD
development procedure as prepared by the City Manager with
input from Marvin Hill, Planning Consultant, for the
Council's input and review.
Discussion followed including comments from Mr. Otto DiVosta,
who has submitted a PUD for the City's consideration.
In the second paragraph on page 1, the Council concurred
to add Public Works Director and Building Official.
Councilman Wiley commented that the words "certification of
approvals" in the last paragraph on page 4 might be
interpreted too strictly. Two alternatives were offered
as follows: appropriate approvals have been given or
in the usual form submitted by such agencies.
Councilman Kiedis suggested that an aerial view of the
proposed property be included as a requirement to be
provided by the contractor.
Mayor Feeney was of the opinion that a school impact study
be included with a formal acknowledgement from the School
Board as to what they foresee if such a project comes into
the area.
Geoffrey Birt spoke from the audience and suggested
contacting the State Planning Department relative to the
school impact stating they make studies at 5 year intervals.

Motion was made by Councilman Wiley to adopt the
procedures for PUD's as presented by the City Manager as
a policy decision of the Council to use in the interim until
ultimately an Ordinance will be adopted. Motion was
seconded by Vice Mayor Laurie.
Motion was made by Councilman Martino to amend the main
motion to strike the reference to the second public hearing
before the Planning and Zoning Commission in the last
paragraph on page 4. seconded by Councilman Kiedis.
Motion was made by Councilman Wiley, seconded by Vice
Mayor Laurie to table both motions. and to continue
discussion until the Workshop Meeting on November 10, 1977.
Motion was unanimously carried.
ITEMS FOR DISCUSSION:
SCHEDULE FOR City Manager John L. Orr stated at this time he did not

.1 have a schedule for the placing of the three ballfields on
the 10 acres. The Council concurred with Mr. Orr's
suggestion that the trees on the North East corner of the
10 acres be removed.
COMMUNITY Discussion on a resolution to support t Community
PEPWOH,MING
ARTS CENTER: Performing Arts Center at Palm Beach Junior College was
postponed until after Dr. Eissey makes his presentation to
the Council at the meeting on November 17th or Dec. lst.
Consideration of the request from the PBGYAA for
advertising signs on fences at the ball fields will be held
at the Workshop Meet -ng on November 10, 1977.
REPORTS: Councilman Martino reported he had attended the Zoning

Gulf Service Station was allowed to move the sign but was
not granted any additional height.
ITEMS BY MAYOR AND COUNCIL:
COUNCILMAN Councilman Wiley suggested that the Councilman sit in the

reviewing stand at the Christmas In Dixie Parade, and make
arrangements to ride at the head of the parade with the
other Municipalities.
COUNCILMAN Councilman Martino remarked he was glad to see a basketball

game being played at Plant Drive Park that was sponsored
by the Recreation Department.
Councilman Martino requested that discussion on the stop
sign at the intersection of Gardens East and Meridian Way
be scheduled for a workshop Meet ing.
Councilman Martino asked that the City Manager pursue with
the County the offer the City had made fir the use of
City property for a Library.
Attorney Brant advised he was ready to file suit against
the company for repairs to the tennis courts
City Manager John L. Orr adv-sed the City was waiting for
work to be done by the Utility Company before starting on
the median strip on Holly Drive project.
The City Manager will pursue with the County the status of
the traffic light proposed for Burns Road and Alt. A1A.
VICE MAYOR The City Manager stated that Bob Diamond is reviewing the
• Public Liability Insurance coverage for the City.
The City Manager advised that CO's are being given for
construction in Plat 4.

The City Manager will pursue the leak in the roof" of the Fire
Station.
ITEMS BY THE CITY MANAGER:
JOGGING TRACK: City Manager John L. Orr reported that he had met with Virginia
McVey from the Heart Association who, in conjunction with the
Medical- Dental 9Wivep, will furnish possible funding for a one -mile
jogging track and exercise trail, if the Council is interested.
These facilities to be located on the 12 acres, south of Burns Road.
The Council concurred to proceed and a slide presentation will be
made by the Heart Association.
REQUEST TO City Manager John L. Orr presented a request from the Palm Beach
HOLD CARNIVAL:
Shrine Club to hold a carnival January 13 -22, 1978 on Northlake
Blvd. west of MacArthur Blvd. They will be placed on the agenda
of the meeting on November 17, 1977.
SANDALWOOD A letter from Howard L. Searcy, Engineer, was acknowledged by the
DRIVE:
City Manager relative to the right -of -way for Sandalwood Drive.
The City Attorney was directed to prepare a dedication deed and
resolution for consideration by the Council.
PUD REQUEST- Mr. Orr advised that a request for a PUD on the south 18 acres of
KASSUBA PROPERTY:
the old Kassuba property on Northlake Blvd. was forthcoming.
Mr. Orr advised he would be attending a meeting on Tuesday,
November 8, 1977 relative to a traffic study by the County on the
access road which runs the length of the Kassuba property; that
he would be meeting with Peggy Evatt, County Commissioner on
honday, November 7, 1977 relative to the drainage concept for
PGA Blvd., and that he would be attending a seminar re the
South Florida Labor Relations Board on `Wednesday, November 9, 1977.

City Manager John L. Orr advised he had received a call from
Rev. Frerking regarding the Hetzel Brothers Pageant who related
that due to the lack o! cooperation from Bob Hetzel, the Board
of Directors had abandoned their efforts to assist.
The City Manager will attempt to have Bob Hetzel attend a Council
Meeting to determine his future plans ror the pageant.
Receipt of a letter was acknowledged by the City Manager from
James R. Owens, President of the AARP Chapter, Palm Beach County
Senior Citizens, requesting to be placed on the agenda to explain
the purpose of the senior citizen activities. Mr. Owens will
be invited to attend a meeting in the near future.
ADJOURNMENT: No further business, the meeting adjourned at 10:45 P.M.
