ROLL CALL: Roll ttias called by the City Clerk and present :-ere: Mayor Feeney, .ice Mayor Laurie, Councilman Kiedis, Councilman Martino, and Councilman f,iley. Attorney Brant was in attendance. I MINUTES: The Minutes of the Regular Meeting of November 3, 1977 %%ere unanimously approved by the Council as written. ANNOUNCENNENTS: Mayor Feeney announced that the Merit System Board meeting,, would hold a meeting on Tuesday, November 15, 1977 at 7 :00 P.M. PRESENTATION BY HEART ASSOCIATION RE JOGGING TRACK AND SXF-RCISL TPAIL: Virginia. N,cx ey, FxecutiA a Director o� the Heart Association and Peter Boyland from the Heart Association addressed the Council introducing a project called Heart Parcours, which is a litness trail consisting of a series o-L� exercise stations, that they would like to construct on the 12 acres belonging to the City across from the Fire Station. The proposed track is 8 feet pride and consists or 2 inches or sludge and 2 inches of pea rock, and ten of the stations will consist o.L items that :oust be purchased, and ten of the stations consist of materials such as railroad ties, wood, etc. that can be obtained by the City from various sources. Mrs. John Hildreth, a member oi. the medical and dental Kives association of the North Palm Beaches, stated that they selected Vorkshop Meeting, 114 ovember 10, 1977 Page 2 a charity each year as a project and would raise funds for it, and all indications were that Heart Parcours could be their project for this year, if the City's land were available. Slides were shown of a similar trail located in Ft. Lauderdale. The Council concurred wholeheartedly that the land would be available and agreed to proceed, and asked for more detailed information such as cost figures, plans, etc. COMMENTS FRO`'. THE PUBLIC FOR ITEMS NOT ON THE AGENDA: TALES ON Sam Carsillo spoke from the audience commenting on the injustice MOBILE HOMES: that people who live in mobile homes, or which there are 369000 in the County, do not pay taxes, and asked the Council to send a resolution to the Legislative Delegation expressing concern about this injustice. Councilman V.'iley agreed that these sentiments should be expressed to the Legislators and the City Attorney was directed to prepare a resolution for consideration by the Council pointing out these inequities, and taking into account those trailers that are being rented, and those that are privately owned including the land, and also taking into consideration some relief for the senior citizens. FIRE HYDRANT- Mr. Julius darks, 10310 Seagrape 'kay brought to the attention of HOLLY DRIVE., the Council a fire hydrant that is hidden and could not easily be seen by thi. firemen, that is located on Dolly Drive west of Military Trail. The City Manager will pursue this. PETITIONS AND COMMUNICATIONS: Mayor Feeney acknowledged receipt of communications from: 1. Invitation to attend a Community Appreciation Luncheon at the PGA Golf Club on Friday, November 1$1 1977. Councilman Kiedis 1,orkshop Meeting, November 10, 1977 will attend in place of the Mayor. Frank Brutt, Area Planning Board notice of meeting on November 1977 re formation of planning technical advisory committee. Royal American Realty, Inc. relative to requesting the remaining lots in Plat 4 be released for issuance of Building Permits and CO's. The City Manager advised a recommendation is forthcoming from Howard Searcy, City Engineer. RESOLUTIONS: Resolution #47, 1977 requesting the DOT, in lieu of pylon type RESOLUTION 47, signs along I -95, that service stations be indicated by interstate- 19-17: type green and white signs containing the logo of each station, was explained by Councilman 1,11ey that it was prompted by an article in the newspaper indicating the esthetic pleasure of not having a proliferation of signs on I -95 in this area. Vice Mayor Laurie will provide his comments relative to this resolution. ORDINANCES: Ordinance #130 1977 providing that the Site Plan and Appearance ORDINANCE 13, Review Committee shall have certain authority to waiver the requirements of buffer areas was workshopped by theCouncil with input from John Glidden and Anthony Oliver, Architects, who are proposing a medical complex project to be built in the City. Clarification was made that the setback requirement is not effected by this Ordinance. A recommended change was made in Section 1. to add "after a variance to the requirement o.f landscaping within the fifteen (15)'x, and in Section 2. add after conjunction with "preliminary plans with tentative approval by the Site Plan Review Committee." workshop Meeting, November 10, 1977 Page 4 The City Attorney was directed to redraft the Ordinance to include the comments from the Council. Ordinance #13, 1977 will be read on second reading at a Public Hearing on November 17, 1977. ORDINANCE #16, Ordinance : {16, 1977 restricting the parking of commercial vehicles 977 ; in residential areas was workshopped by the Council with participation from members of the audience. Jack Hodson, 4615 Holly Drive expressed concern that the north side of Holly Drive was controlled by deed restrictions, and that the south side was not regulated by any deed restrictions. Gerry t,'eisenseel, 4599 Holly Drive suggested that the Council consider what is best for the community and not allow commercial vehicles in residential areas. Vic Santa, 4722 Holly Drive stated he was one of the signers of the petition and that commercial vehicles should not be allowed to park in residential areas and further consideration be given to the one ton rating. He referenced Florida Statute 316 which does not include wreckers as an emergency vehicle. Dick Turner, 4624 Holly Drive, owner of the truck that is objectionable to the neighbors "stated he has built a slat in the side yard of his residence where he can park the vehicle, and that he will also screen the area with a hedge. The City Manager was instructed to obtain copies of the deed restrictions in that area. Another workshop meeting will be scheduled to continue the discussion relative to size and capacity of the vehicles. ORDINANCE 17, Ordinance #17, 1977 creating an amendment to conditional uses permitted in C-2, General Commercial District will be placed on Workshop Meeting, November 10, 1977 Page 5 first reading December 1st, workshopped on December 8th and a Public Hearing and second reading will be held December 15, 1977. ITEMS FOR DISCUSSION: PBGYAA REQUEST A request by the Palm Beach Gardens Youth Athletic Association TO PLACE SIGNS DN FENCES: to place advertising signs on the fences at the ball fields was tabled until the Workshop Meeting on December 8, 1977. Members of the Association will be asked to attend. PUD A brief discussion was held by the Council relative to PUD PROCEDURES: procedures. It was the consensus ofthe Council that only two advertised public hearings would be held, one by the Planning and Zoning Commission and one by the City Council. As many other meetings as necessary will be held by the Planning and Zoning Commission and the City Council. The PUD procedures will be typed in final form for approval by the Council. PURCHASE OF Discussion on the purchase of the water plant was tabled to a WATER PLANT: future meeting, because of the lateness of the hour. Receipt vras ack *wledged of a Resolution from the Town of Lake Park relative to the acquisition of the water and sewer .facilities. REPORTS: Councilman Kiedis reported he had attended the Planning and Zoning P&Z COMMISSION Commission Meeting held November 8, 1977 and that the minutes MEETING: were available in the information folder. RECREATION Councilman Martino reported he had attended the Recreation Advisory ADVISORY BD. t3EETING: Board Meeting held November 8, 1977 and that the minutes were available in the information folder. He reported the Board was in favor of installing 4 ball fields on the 10 acre site. The Council concurred they had agreed that 3 ball fields would be constructed. Workshop Meeting, November 10, 1977 Page 6 Councilman t +iley reported he would attend the 1Ierit System Board Meeting on November 15, 1977. ITEMS BY CITY MANAGER -. City Manager, John L. Orr advised that Dr. Ed Eissey would attend the meeting on November 17, 1977 to make a presentation relative to the Community Performing Arts Center. City Manager, John L. Orr, referenced the recommendation from the Planning and Zoning Commission dated November 10, 1977 re the public hearing regarding amending M -lA zoning classification, and the decision is now in the hands of the Council. ITEMS BY MAYOR AND COUNCIL: Councilman Martino reported that the lights on the bridge on Holly Drive are out, and the City Manager advised he had requested that the lights be replaced.
